39	60		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

41	61		SECTION 1. From the funds appropriate d to the Oklahoma Health
42	62		Care Authority in Enrolled Senate Bill No. 1125 of the 2nd Session
43	63		of the 59th Oklahoma Legislature, the sum of Thirty Million Dollars
44	64		($30,000,000.00) shall be used to increase reimbursement s to long-
45	65		term care facilities and inter mediate care facilities for
46	66		individuals with intellectual disabilities.

50	93		SECTION 2. A. The duties and compensation of employees , not
51	94		otherwise prescribed by law, necessary to perform the duties imposed
52	95		upon the Oklahoma Health Care Authori ty by law shall be set by the
53	96		Administrator of the Oklahoma Health Care Authority.

55	97		B. The Oklahoma Health Care Authority is authorized to:

57	98		1. Pay professional expenses of the Administrator of the
58	99		Authority including dues, licenses, professional membershi ps, and
59	100		continuing education classes conducted in this state; and

61	101		2. Pay professional expenses of any employee including dues,
62	102		licenses, professional memberships, continuing medical education
63	103		classes conducted in this state, and medical malpractice insura nce
64	104		provided he or she is a full -time employee of the Authority in
65	105		accordance with subsection B of Section 5006 of Title 63 of the
66	106		Oklahoma Statutes and is utilizing those professional skills in the
67	107		performance of his or her job duties.

69	108		SECTION 3. In order to facilitate cash management of federal
70	109		grant receipts and disbursements, the Office of Management and
71	110		Enterprise Services sh all transfer monies between the Oklahoma
72	111		Health Care Authority federal and revolving funds in amounts
73	112		requested by the Oklahoma Health Care Authority.

75	113		SECTION 4. The Oklahoma Health Care Authority is authorized to
76	114		transfer funds from Fund 205 and Fund 270 to Fund 200 and Fund 340
77	115		to satisfy claims made to the Authority under the Supplemental
78	116		Hospital Offset Payment Program Act.

80	143		SECTION 5. The Administrator of the Oklahoma Health Care
81	144		Authority may request that receipt and expenditure of unanticipated
82	145		federal funds awarded after July 1, 202 4, be exempt from expenditure
83	146		limitations and from budgetary limitations.

85	147		SECTION 6. A. The Director of the Office of Management and
86	148		Enterprise Services shall transfer monies appropriated from the
87	149		General Revenue Fund and the Health Care Enhancement Fund to the
88	150		Oklahoma Health Care Authority disbursing funds in the amounts and
89	151		ratios requested by the Authority, except that the cumulative
90	152		amounts transferred shall not exceed the cumulative amounts of equal

93	153		monthly allotments of the appropriations from the General Revenue
94	154		Fund and Health Care Enhancement Fund.

96	155		B. Monies appropriated or collected for the fiscal year ending
97	156		June 30, 2025, may be transferred to these disbursing funds for the
98	157		fiscal year ending June 30, 202 4, to satisfy encumbrances and
99	158		obligations of such fiscal year; pro vided, that monies equal in
100	159		amount are transferred from appropriations or collections for the
101	160		fiscal year ending June 30, 202 4, to the disbursing fund for the
102	161		fiscal year ending June 30, 202 5, to satisfy encumbrances and
103	162		obligations of such fiscal year. A ll transfer requests shall be in
104	163		writing to the Director of the Office of Management and Enterprise
105	164		Services.

107	165		C. The Oklahoma Health Care Authority shall maintain records of
108	166		the inter-year transfers.

110	193		SECTION 7. The Administrator of the Ok lahoma Health Care
111	194		Authority may request, through the Director of the Office of
112	195		Management and Enterprise Services, the early transfer by the
113	196		Oklahoma Tax Commission of tax collections to the General Revenue
114	197		Fund for the purpose of early allocation to the agency’s disbursing
115	198		funds to alleviate cash -flow problems.

117	199		SECTION 8. This act shall become effective July 1, 2024.

119	200		SECTION 9. It being immediately necessary for the preservation
120	201		of the public peace, health or safety, an e mergency is hereby
121	202		declared to exist, by reason whereof this act shall take effect and
122	203		be in full force from and after its passage and approval.
