3960 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

4161 SECTION 1. From the funds appropriate d to the Oklahoma Health
4262 Care Authority in Enrolled Senate Bill No. 1125 of the 2nd Session
4363 of the 59th Oklahoma Legislature, the sum of Thirty Million Dollars
4464 ($30,000,000.00) shall be used to increase reimbursement s to long-
4565 term care facilities and inter mediate care facilities for
4666 individuals with intellectual disabilities.

5093 SECTION 2. A. The duties and compensation of employees , not
5194 otherwise prescribed by law, necessary to perform the duties imposed
5295 upon the Oklahoma Health Care Authori ty by law shall be set by the
5396 Administrator of the Oklahoma Health Care Authority.

5597 B. The Oklahoma Health Care Authority is authorized to:

5798 1. Pay professional expenses of the Administrator of the
5899 Authority including dues, licenses, professional membershi ps, and
59100 continuing education classes conducted in this state; and
60-
61101 2. Pay professional expenses of any employee including dues,
62102 licenses, professional memberships, continuing medical education
63103 classes conducted in this state, and medical malpractice insura nce
64104 provided he or she is a full -time employee of the Authority in
65105 accordance with subsection B of Section 5006 of Title 63 of the
66106 Oklahoma Statutes and is utilizing those professional skills in the
67107 performance of his or her job duties.

69108 SECTION 3. In order to facilitate cash management of federal
70109 grant receipts and disbursements, the Office of Management and
71110 Enterprise Services sh all transfer monies between the Oklahoma
72111 Health Care Authority federal and revolving funds in amounts
73112 requested by the Oklahoma Health Care Authority.

75113 SECTION 4. The Oklahoma Health Care Authority is authorized to
76114 transfer funds from Fund 205 and Fund 270 to Fund 200 and Fund 340
77115 to satisfy claims made to the Authority under the Supplemental
78116 Hospital Offset Payment Program Act.

80143 SECTION 5. The Administrator of the Oklahoma Health Care
81144 Authority may request that receipt and expenditure of unanticipated
82145 federal funds awarded after July 1, 202 4, be exempt from expenditure
83146 limitations and from budgetary limitations.

85147 SECTION 6. A. The Director of the Office of Management and
86148 Enterprise Services shall transfer monies appropriated from the
87149 General Revenue Fund and the Health Care Enhancement Fund to the
88150 Oklahoma Health Care Authority disbursing funds in the amounts and
89151 ratios requested by the Authority, except that the cumulative
90152 amounts transferred shall not exceed the cumulative amounts of equal

93153 monthly allotments of the appropriations from the General Revenue
94154 Fund and Health Care Enhancement Fund.

96155 B. Monies appropriated or collected for the fiscal year ending
97156 June 30, 2025, may be transferred to these disbursing funds for the
98157 fiscal year ending June 30, 202 4, to satisfy encumbrances and
99158 obligations of such fiscal year; pro vided, that monies equal in
100159 amount are transferred from appropriations or collections for the
101160 fiscal year ending June 30, 202 4, to the disbursing fund for the
102161 fiscal year ending June 30, 202 5, to satisfy encumbrances and
103162 obligations of such fiscal year. A ll transfer requests shall be in
104163 writing to the Director of the Office of Management and Enterprise
105164 Services.

107165 C. The Oklahoma Health Care Authority shall maintain records of
108166 the inter-year transfers.

110193 SECTION 7. The Administrator of the Ok lahoma Health Care
111194 Authority may request, through the Director of the Office of
112195 Management and Enterprise Services, the early transfer by the
113196 Oklahoma Tax Commission of tax collections to the General Revenue
114197 Fund for the purpose of early allocation to the agency’s disbursing
115198 funds to alleviate cash -flow problems.

117199 SECTION 8. This act shall become effective July 1, 2024.

119200 SECTION 9. It being immediately necessary for the preservation
120201 of the public peace, health or safety, an e mergency is hereby
121202 declared to exist, by reason whereof this act shall take effect and
122203 be in full force from and after its passage and approval.
