40	67		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

42	68		SECTION 1. There is hereby appropriated to the Oklahoma
43	69		Aeronautics Commission from any monies not otherwise appropriated
44	70		from the Statewide Recovery Fund of the State Treasury created in
45	71		Enrolled House Bill No. 3349 of the 2nd Session of the 58th Oklahoma

49	100		or so much thereof as may be necessary to address the negative
50	101		economic and public health impacts of the pandemic experienced by
51	102		the dedicated air and space museum s and their ability to provide
52	103		education services. Such funds shall be utilized in a manner
53	104		consistent with the recommendations adopted by the Joint Committee
54	105		on Pandemic Relief Funding on May 11, 2023.

56	106		SECTION 2. A. There is hereby created in the State Treasury a
57	107		Statewide Recovery Special Account for the Oklahoma Aeronautics
58	108		Commission for the appropriated monies as provided in Section 1 of
59	109		this act. The duration of such account shall continue for the
60	110		period of time that monies related to the American Rescue Plan Act
61	111		of 2021 are being budgeted, expended, or managed in the state. The
62	112		ending of such period shall be determined by the State Treasurer,
63	113		and shall result in the closing of such account as a matter of law.
64	114		Such account shall be a continuing account as otherwise provided in
65	115		this section, not subject to fiscal year limitations, and shall
66	116		exclusively consist of monies related to the relevant appropriation
67	117		made in this act and as otherwise directed by law. All monies
68	118		deposited to the credit of such account are hereby appropriated and
69	119		may be budgeted and expended by the Oklahoma Aeronautics Commission
70	120		in accordance with the provisions of this act. Expenditures from
71	121		such account shall be made upon warrants issued by the State
72	122		Treasurer against claims filed as prescribed by law with the

73	150		Director of the Office of Management and Enterprise Services for
74	151		approval and payment.

76	152		B. The Oklahoma Aeronautics Commission is authorized to request
77	153		in writing that the monies appropriated by the provisions of this
78	154		act be deposited or transferred to the account created pursuant to
79	155		subsection A of this section. No later than seven (7) calendar days
80	156		from the date of such request, the Director of the Office of
81	157		Management and Enterprise Services shall comply with such request
82	158		and verify to the requesting agency that such deposit or transfer
83	159		has been completed.

85	160		SECTION 3. The Oklahoma Aeronautics Commission may enter into
86	161		memorandums of understanding with other agencies of the State of
87	162		Oklahoma for the auditing, documentation, evaluation,
88	163		implementation, oversight, reporting, and management of funds and
89	164		associated efforts related to the appropriation made in this act;
90	165		provided, no such memorandum of understanding shall require or
91		-

93	166		include, as an option or condition, the direct or practical transfer
94	167		or relinquishment of control by the agency appropriated such funds
95	168		to budget, expend, allocate, and request the distribution of the
96	169		funds appropriated by this act.

98	170		SECTION 4. The Oklahoma Aeronautics Commission may promulgate
99	171		rules, utilize existing rules, establish procedures, and utilize
100	172		existing procedures to implement the provisions of this act,

104	202		SECTION 5. The Oklahoma Aeronautics Commission shall retain no
105	203		more than two percent (2%) of the funds appropriated by this act to
106	204		reimburse:

108	205		1. Costs incurred by the Oklahoma Aeronautics Commission; or
109		-
110	206		2. Costs incurred on the agency’s behalf,
111		-
112	207		associated with the administration of the appropriated funds and
113	208		programming required by the Oklahoma Aeronautics Commission under
114	209		the provisions of this act; provided, no funds shall be retained
115	210		that would be disallowable under the provisions of the American
116	211		Rescue Plan Act of 2021.

118	212		SECTION 6. A. The Oklahoma Aeronautics Commission shall:

120	213		1. Submit to the chairs of the Joint Committee on Pandemic
121	214		Relief Funding, or any successor of the Oklahoma State Senate or
122	215		Oklahoma House of Representatives legislative committee or joint
123	216		committee, as designated by the President Pro Tempor e of the
124	217		Oklahoma State Senate and the Speaker of the Oklahoma House of
125	218		Representatives:

127	219		a. a written or electronic quarterly report detailing the
128	220		budgeting, expenditure, and management of all monies
129	221		appropriated in this act, and
130		-
131	222		b. a copy of all memorandu ms of understanding and
132	223		contracts with third parties entered into by the

137	253		Commission under the provisions of this act; and

139	254		2. At the Joint Committee on Pandemic Relief Funding ’s request,
140	255		appear before the Joint Committee no later than six (6) months after
141	256		the effective date of this act, and as otherwise requested by the
142	257		Joint Committee, to provide a status update regarding the
143	258		implementation of the provisions of this act.

145	259		B. The provisions of subsection A of this section shall remain
146	260		applicable for the period of time that monies appropriated under
147	261		this act are being budgeted, expended, or managed in the sta te. The
148	262		ending of such period shall be dete rmined by the State Treasurer,
149	263		and shall be reported to the Governor, the President Pro Tempore of
150	264		the Oklahoma State Senate, and the Speaker of the Oklahoma House of
151	265		Representatives.

153	266		SECTION 7. It being immediately necessary fo r the preservation
154	267		of the public peace, health or safety, an emergency is hereby
155	268		declared to exist, by reason whereof this act shall take effect and
156	269		be in full force from and after its passage and approval.
