7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 70 O.S. 2021, Section 1-109, is
8181 amended to read as follows:
8282 Section 1-109. A. For all public schools in Oklahoma, school
8383 shall actually be in session and classroom in struction offered:
8484 1. For not less tha n one hundred eighty (180 ) days; or
8585 2. For not less than one t housand eighty (1,080) hours each
8686 school year, if a district board of education adopts a school -hours
8787 policy and notifies the State Board of Education pri or to October 15

140140 3. Beginning with the 2021-2022 school year, for n ot less than
141141 one thousand eighty (1,080) hours with a minimum of one hundred
142142 sixty-five (165) days of instruction each school year, if a district
143143 board of education adopts a school -hours policy and notifies the
144144 State Board of Education prior to October 15 of the applicable
145145 school year; or
146146 4. Beginning with the 2021-2022 school year, for not less than
147147 one thousand eighty (1,080) hours each school year, if a district
148148 board of education adopts a s chool-hours policy, notifies the State
149149 Board of Education prior to October 15 of the applicable school
150150 year, and meets the requirements established by the State Board of
151151 Education pursuant to set forth in subsection H of this section.
152152 B. A school district may not count more than thirty (30) hours
153153 each school year tha t are used for attendance of professional
154154 meetings toward the one hundred eighty (180) days or one thousand
155155 eighty (1,080) hours of classroom instruction time required in
156156 subsection A of this section.
157157 C. Teachers off contract with an employing district sh all not
158158 be required by the employing school district to attend professional
159159 meetings unless the teacher is paid additional compensation for the
160160 additional time. Teachers may be paid additional compensation for
161161 attending professional meetings in excess of their contract term.
162162 Subject to district board of e ducation policy or collective
163163 bargaining agreement, additional paid professional days may be

215215 granted for individual teachers to attend or participate in
216216 professional meetings, staff development training, or National Board
217217 certification portfolio developmen t as provided for in Section 6 -
218218 204.2 of this title.
219219 D. A school district may authorize parent -teacher conferences
220220 to be held during a regular school day. If authorized by the school
221221 district, parent-teacher conferences shall be counted as classroom
222222 instruction time for no more than six (6) hours per semester, for a
223223 total of twelve (12) hours per school y ear.
224224 E. A school district may maintain school for le ss than a full
225225 school year only when conditions b eyond the control of school
226226 authorities make the mai ntenance of the term impossible and the
227227 State Board of Education has been apprised and has expressed
228228 concurrence in writing.
229229 F. The State Board of Educati on shall establish criteria for an
230230 extended-day schedule for schools subject to paragraph 1 of
231231 subsection A of this section. The criteria shall:
232232 1. Prescribe a lengthened school day within limits deter mined
233233 not to be detrimental to quality instruction;
234234 2. Ensure that the schedule is equivalent in annu al hours of
235235 instruction to the one -hundred-eighty-day school year specified in
236236 paragraph 1 of subsection A of this section; and

288288 3. Be consistent with the provisions of this section and
289289 Sections 1-111 and 1-112 of this title, but may result in fewer
290290 annual days of instruction.
291291 G. Notwithstanding the provis ions of subsection F of this
292292 section, a school district board of education subject to paragraph 1
293293 of subsection A of this section may adopt and implement a n extended-
294294 day schedule subject to the following requirements:
295295 1. The annual number of hours of inst ruction shall equal or
296296 exceed one thousand eighty (1,080) hours, which is the equivalent of
297297 one hundred eighty (180) days of instruction as specified in
298298 subsection A of this section for six (6) hours each day as specified
299299 in Section 1-111 of this title;
300300 2. The annual number of days of instruction shall equal or
301301 exceed one hundred eighty (180) days as spec ified in subsection A of
302302 this section;
303303 3. The schedule adopted shall be consistent with the provision s
304304 of Sections 1-111 and 1-112 of this title, except that for not more
305305 than one (1) day per week, a school day shall consist of not less
306306 than five (5) hours devoted to academic instruction in a regular
307307 classroom setting;
308308 4. The district shall hold a public hearing prior to the
309309 adoption of an extended -day schedule authorized pursuant to this
310310 subsection; and

362362 5. The district shall document the impact on stude nt
363363 achievement as determined by the academic performa nce data score and
364364 any other relevant factors tha t are a result of implementation of an
365365 extended-day schedule authorized pursuant to this subsection and
366366 provide an annual report to the State Board of Edu cation of the
367367 results. If improvement in student ach ievement cannot be documented
368368 in the report, the district board of education shall revoke
369369 authorization as provided by this subsection. If the district does
370370 not revoke authorization after student achiev ement is not documented
371371 in the report, the State Boar d of Education may deny accreditation
372372 of any school in violation of this subsection.
373373 H. Beginning with the 2021-2022 school year, a school district
374374 board of education may adopt a school -hours policy as provided for
375375 by paragraph 4 of subsection A of this s ection only if it meets or
376376 exceeds the minimum gu idelines for student performance and school
377377 district cost savings established by the State Board of Education.
378378 The State Board of Education shall promulg ate rules, subject to
379379 approval by the Legislature, es tablishing the minimum guidelines for
380380 student performance and school district cost savings each school
381381 site within the district maintains an overview grade of “C” or
382382 better on the annual report issued pursuant to Section 1210.545 of
383383 this title. If the overview grade of one or more school site(s)
384384 within a district with a school -hours policy drops below a “C”, the
385385 district may maintain its school -hours policy for one year ;

437437 provided, however, all school sites within the district must receive
438438 an overview grade of “C” or better to maintain the school -hours
439439 policy for subsequent year(s).
440440 I. If subject to parag raph 2 of subsection A of this section, a
441441 district board of education or designee may elect to close a school
442442 during the school day for incle ment weather purposes. In such an
443443 event, the number of hours i ncurred in classroom instruction time
444444 prior to school closure shall be counted toward the one thousand
445445 eighty (1,080) hours per year requirement.
446446 J. Nothing in this section shall be construed as affecting the
447447 right of an employing school district to requi re teachers as defined
448448 in Section 6-101.3 of this title to work in excess of the one
449449 thousand eighty (1,080) hours required for student instruction. In
450450 addition, nothing in this section shall be construed to affect the
451451 Fair Labor Standards Act status of a ny school district employee.
452452 K. The provisions of t his section shall not prohibit the
453453 Oklahoma School for the Blind or the Oklahoma School for the Deaf
454454 from adopting an alternative school -hours policy if the Oklahoma
455455 School for the Blind or the Oklahoma S chool for the Deaf notifies
456456 and receives approval fr om the State Board of Education prior to
457457 October 15 of the applicable school year.
458458 SECTION 2. This act shall become effective July 1, 2023.
459459 SECTION 3. It being immediatel y necessary for the preservation
460460 of the public peace, health, or safety, an emergency is hereby
