79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
80	80	SECTION 1. AMENDATORY 70 O.S. 2021, Section 1-109, is
81	81	amended to read as follows:
82	82	Section 1-109. A. For all public schools in Oklahoma, school
83	83	shall actually be in session and classroom in struction offered:
84	84	1. For not less tha n one hundred eighty (180 ) days; or
85	85	2. For not less than one t housand eighty (1,080) hours each
86	86	school year, if a district board of education adopts a school -hours
87	87	policy and notifies the State Board of Education pri or to October 15
88	88	of the applicable scho ol year; or

140	140	3. Beginning with the 2021-2022 school year, for n ot less than
141	141	one thousand eighty (1,080) hours with a minimum of one hundred
142	142	sixty-five (165) days of instruction each school year, if a district
143	143	board of education adopts a school -hours policy and notifies the
144	144	State Board of Education prior to October 15 of the applicable
145	145	school year; or
146	146	4. Beginning with the 2021-2022 school year, for not less than
147	147	one thousand eighty (1,080) hours each school year, if a district
148	148	board of education adopts a s chool-hours policy, notifies the State
149	149	Board of Education prior to October 15 of the applicable school
150	150	year, and meets the requirements established by the State Board of
151	151	Education pursuant to set forth in subsection H of this section.
152	152	B. A school district may not count more than thirty (30) hours
153	153	each school year tha t are used for attendance of professional
154	154	meetings toward the one hundred eighty (180) days or one thousand
155	155	eighty (1,080) hours of classroom instruction time required in
156	156	subsection A of this section.
157	157	C. Teachers off contract with an employing district sh all not
158	158	be required by the employing school district to attend professional
159	159	meetings unless the teacher is paid additional compensation for the
160	160	additional time. Teachers may be paid additional compensation for
161	161	attending professional meetings in excess of their contract term.
162	162	Subject to district board of e ducation policy or collective
163	163	bargaining agreement, additional paid professional days may be

216	216	professional meetings, staff development training, or National Board
217	217	certification portfolio developmen t as provided for in Section 6 -
218	218	204.2 of this title.
219	219	D. A school district may authorize parent -teacher conferences
220	220	to be held during a regular school day. If authorized by the school
221	221	district, parent-teacher conferences shall be counted as classroom
222	222	instruction time for no more than six (6) hours per semester, for a
223	223	total of twelve (12) hours per school y ear.
224	224	E. A school district may maintain school for le ss than a full
225	225	school year only when conditions b eyond the control of school
226	226	authorities make the mai ntenance of the term impossible and the
227	227	State Board of Education has been apprised and has expressed
228	228	concurrence in writing.
229	229	F. The State Board of Educati on shall establish criteria for an
230	230	extended-day schedule for schools subject to paragraph 1 of
231	231	subsection A of this section. The criteria shall:
232	232	1. Prescribe a lengthened school day within limits deter mined
233	233	not to be detrimental to quality instruction;
234	234	2. Ensure that the schedule is equivalent in annu al hours of
235	235	instruction to the one -hundred-eighty-day school year specified in
236	236	paragraph 1 of subsection A of this section; and

289	289	Sections 1-111 and 1-112 of this title, but may result in fewer
290	290	annual days of instruction.
291	291	G. Notwithstanding the provis ions of subsection F of this
292	292	section, a school district board of education subject to paragraph 1
293	293	of subsection A of this section may adopt and implement a n extended-
294	294	day schedule subject to the following requirements:
295	295	1. The annual number of hours of inst ruction shall equal or
296	296	exceed one thousand eighty (1,080) hours, which is the equivalent of
297	297	one hundred eighty (180) days of instruction as specified in
298	298	subsection A of this section for six (6) hours each day as specified
299	299	in Section 1-111 of this title;
300	300	2. The annual number of days of instruction shall equal or
301	301	exceed one hundred eighty (180) days as spec ified in subsection A of
302	302	this section;
303	303	3. The schedule adopted shall be consistent with the provision s
304	304	of Sections 1-111 and 1-112 of this title, except that for not more
305	305	than one (1) day per week, a school day shall consist of not less
306	306	than five (5) hours devoted to academic instruction in a regular
307	307	classroom setting;
308	308	4. The district shall hold a public hearing prior to the
309	309	adoption of an extended -day schedule authorized pursuant to this
310	310	subsection; and

362	362	5. The district shall document the impact on stude nt
363	363	achievement as determined by the academic performa nce data score and
364	364	any other relevant factors tha t are a result of implementation of an
365	365	extended-day schedule authorized pursuant to this subsection and
366	366	provide an annual report to the State Board of Edu cation of the
367	367	results. If improvement in student ach ievement cannot be documented
368	368	in the report, the district board of education shall revoke
369	369	authorization as provided by this subsection. If the district does
370	370	not revoke authorization after student achiev ement is not documented
371	371	in the report, the State Boar d of Education may deny accreditation
372	372	of any school in violation of this subsection.
373	373	H. Beginning with the 2021-2022 school year, a school district
374	374	board of education may adopt a school -hours policy as provided for
375	375	by paragraph 4 of subsection A of this s ection only if it meets or
376	376	exceeds the minimum gu idelines for student performance and school
377	377	district cost savings established by the State Board of Education.
378	378	The State Board of Education shall promulg ate rules, subject to
379	379	approval by the Legislature, es tablishing the minimum guidelines for
380	380	student performance and school district cost savings each school
381	381	site within the district maintains an overview grade of “C” or
382	382	better on the annual report issued pursuant to Section 1210.545 of
383	383	this title. If the overview grade of one or more school site(s)
384	384	within a district with a school -hours policy drops below a “C”, the
385	385	district may maintain its school -hours policy for one year ;

437	437	provided, however, all school sites within the district must receive
438	438	an overview grade of “C” or better to maintain the school -hours
439	439	policy for subsequent year(s).
440	440	I. If subject to parag raph 2 of subsection A of this section, a
441	441	district board of education or designee may elect to close a school
442	442	during the school day for incle ment weather purposes. In such an
443	443	event, the number of hours i ncurred in classroom instruction time
444	444	prior to school closure shall be counted toward the one thousand
445	445	eighty (1,080) hours per year requirement.
446	446	J. Nothing in this section shall be construed as affecting the
447	447	right of an employing school district to requi re teachers as defined
448	448	in Section 6-101.3 of this title to work in excess of the one
449	449	thousand eighty (1,080) hours required for student instruction. In
450	450	addition, nothing in this section shall be construed to affect the
451	451	Fair Labor Standards Act status of a ny school district employee.
452	452	K. The provisions of t his section shall not prohibit the
453	453	Oklahoma School for the Blind or the Oklahoma School for the Deaf
454	454	from adopting an alternative school -hours policy if the Oklahoma
455	455	School for the Blind or the Oklahoma S chool for the Deaf notifies
456	456	and receives approval fr om the State Board of Education prior to
457	457	October 15 of the applicable school year.
458	458	SECTION 2. This act shall become effective July 1, 2023.
459	459	SECTION 3. It being immediatel y necessary for the preservation
460	460	of the public peace, health, or safety, an emergency is hereby
