9999 Section 34.11.1. A. There is hereby created the position of
100100 Chief Information Officer who shall be appointed by the Governor.
101101 The Chief Information Officer, in addition to having authority over
102102 the Information Service s Division of the Office of Management and
103103 Enterprise Services, shall also serve as Secretary of Information
104104 Technology and Telecommunications or succ essor cabinet position and
105105 shall have jurisdictional areas of responsibility related to
106106 information technology and telecommunications systems security of
107107 all state agencies as provided for in state law. The salary of th e
108108 Chief Information Officer shall not be less than One Hundred Thirty
109109 Thousand Dollars ($130,000.00) or more than One Hundred Sixty
110110 Thousand Dollars ($160,000.00).
111111 B. Any person appointed to the position of Chief Informati on
112112 Officer shall meet the following eligibility requirements:
113113 1. A baccalaureate degree in Computer Inform ation Systems,
114114 Information Systems or Technology Management, Business
115115 Administration, Finance, or other similar degree;
116116 2. A minimum of ten (10) years of professional experience wit h
117117 responsibilities for management and support of information systems
118118 and information technology, including seven (7) years of direct
119119 management of a major information technology operation;
120120 3. Familiarity with local and wid e-area network design,
121121 implementation, and operation;

198198 Information Officer and shall be budgeted a s a separate line item
199199 through the Office of Management and Enterprise Service s. The
200200 Office of Management and Enterprise Services shall provide adequ ate
201201 office space, equipment and support necessary to enable the Chief
202202 Information Officer to carry out the inf ormation technology and
203203 telecommunications security duties and responsibilities of the Chief
204204 Information Officer and th e Information Servic es Division.
205205 D. 1. Within twelve (12) months of appointment, the first
206206 Chief Information Officer shall complete an asses sment, which shall
207207 be modified annually pursuant to Section 35.5 of this title , of the
208208 implementation of the transfer, coordination, and mode rnization of
209209 all information technology and telecommunication syste ms of all
210210 state agencies in the state as provided for in the Oklahoma
211211 Information Services Ac t. The assessment shall include the
212212 information technology and telec ommunications system s of all
213213 institutions within The Oklahoma State System of Higher Education,
214214 the Oklahoma State Regents for Higher Educatio n and the
215215 telecommunications network known as OneNet as assembled and
216216 submitted by the Oklahoma Higher Education Chief Information
217217 Officer, as designated by the Oklahoma State Regents for Higher
218218 Education.
219219 2. Within twelve (12) months of appointment, the first Chief
220220 Information Officer shall issue a report setting out a plan of

261261 d. define the roadmap to implement the proposed shared
262262 services model. The roadmap shall include
263263 recommendations on the transfer, coordin ation, and
264264 modernization of all information technology and
265265 telecommunication systems of all the state agencies in
266266 the state,
267267 e. recommendations on the reallocation of information
268268 technology and telecommunication resources a nd

299299 g. a calculation of the net savings realized t hrough the
300300 reallocation and consolidation of information
301301 technology and teleco mmunication resources and
302302 personnel after compensating for the cost of
303303 contracting with a private consultant as authorized in
304304 paragraph 4 of this subsection, implementing the plan
305305 of action, and ongoing costs of the Informa tion
306306 Services Division of the Office of Management and
307307 Enterprise Services, and
308308 h. the information required in subsection B of Section
309309 35.5 of this title.
310310 3. The plan of acti on report shall be presented to the
311311 Governor, Speaker of the House of Representatives, and the President
312312 Pro Tempore of the State Senate.
313313 4. The Chief Information Officer may c ontract with a private
314314 consultant or consultants to assist in the a ssessment and
315315 development of the plan of action report as required in this
316316 subsection.
317317 E. The Chief Information Officer shall be authorized to employ
318318 personnel, fix the duties and c ompensation of the personnel, not
319319 otherwise prescribed by law, and otherwise direct th e work of the

348348 Enterprise Services.
349349 F. E. The Information Services Division of the Office of
350350 Management and Enterprise Services shall be responsible for the
351351 following duties:
352352 1. Formulate and imple ment the information technology and
353353 telecommunications security strategy for all state agen cies;
354354 2. Define, design, and implement a shared services statewide
355355 infrastructure and application environment for information
356356 technology and telecommunications security for all state agencies;
357357 3. Direct the development and operation of a scalable
358358 telecommunications infrastructure that supports data and voice
359359 communications reliability, integrity, and security;
360360 4. Supervise the applications development process for those
361361 necessary information security applications that are utilized across
362362 multiple agencies;
363363 5. Provide direction for the professional development of
364364 information technology sta ff of state agencies and oversee the
365365 professional development of the staff of the I nformation Services
366366 Division of the Office of Management and Enterprise Services;
367367 6. Evaluate all technology and telecommunication investment
368368 choices telecommunications security for all state agencies;

396396 and processes with the strategic information tec hnology plan for all
397397 state agencies;
398398 8. Set direction and provide oversight for the support and
399399 continuous upgrading of the current information technology and
400400 telecommunication security infrastructure in the state in support of
401401 enhanced reliability, user service levels, and security ;
402402 9. 8. Direct the development, implementation, and manageme nt of
403403 appropriate standards, policies , and procedures to ensure the
404404 success of state information technology and telecommunication
405405 security initiatives;
406406 10. 9. Recruit, hire, and transfer the required technical staff
407407 in the Information Services Division of the Office of Managemen t and
408408 Enterprise Services to support the services provided by the Division
409409 and the execution of the strategic information technology p lan;
410410 11. 10. Establish, maintain, and enfo rce information technology
411411 and telecommunication telecommunications security standards;
412412 12. 11. Delegate, coordinate, and review all work to ensure
413413 quality and efficient operation of the Information Services Division
414414 of the Office of Managemen t and Enterprise Services;
415415 13. 12. Create and implement a communication plan that
416416 disseminates pertinent information to state agencies on information
417417 security standards, policies, procedures, service levels, project
418418 status, and other important information to customers of the

448448 14. 13. Develop and implement training programs for state
449449 agencies using the shared services of t he Information Services
450450 Division of the Office of M anagement and Enterprise Services and
451451 recommend training programs to state agencies on information
452452 technology and telecommunication systems telecommunications
453453 security, products and procedures;
454454 15. 14. Provide counseling, performance evaluation, training,
455455 motivation, discipline, and assign duties for employees of the
456456 Information Services Division of the Office of Management and
457457 Enterprise Services;
458458 16. 15. For all state agencie s, approve the purchasing of Chief
459459 Information Officer must be notified of pl ans to purchase all
460460 information technology and telecommunication telecommunications
461461 security services and approve the purchase of a ny information
462462 technology and telecommunication product except the following:
463463 a. a purchase less than or equal to Five Thousand Dollars
464464 ($5,000.00) if such product is purchased using a state
465465 purchase card and the product is listed on either the
466466 Approved Hardware or Approved Software list located on
467467 the Office of Management and Enterprise Services

504504 17. 16. Develop and enforce an overall infrastructure
505505 architecture strategy and associated roadmaps for desktop, network,
506506 server, storage, and statewide management systems for state agencies
507507 as necessary to maintain information and telecommunications
508508 security;
509509 18. Effectively manage the design, implementation and support
510510 of complex, highly available infrastructure to ensure optimal
511511 performance, on-time delivery of features, a nd new products, and
512512 scalable growth;
513513 19. 17. Define and implement a governance model for requesting
514514 services and monitoring service level metrics for all shared
515515 information and telecommunications security services; and
516516 20. 18. Create the budget for the Information Services Division
517517 of the Office of Management and Enterprise Services to be subm itted
518518 to the Legislature each year; and

545545 19. Monitor all portal systems and applications for portal
546546 systems created by state agencies , boards, commissions, or
547547 authorities, review portal systems applications approved or denied
548548 by the Information Services Division of the Office of Management and
549549 Enterprise Services, and make recommendation to th e Legislature and
550550 Governor to encourage greater use of the open -systems concept as
551551 defined in Section 34.26 of this title.
552552 G. The State Governmental Technology Applications Rev iew Board
553553 shall provide ongoing oversight of the implementation of the plan of
554554 action required in subsection D of this section. Any proposed
555555 amendments to the plan of action shall be approved by the Board
556556 prior to adoption.
557557 H. F. 1. The Chief Informatio n Officer shall act as the
558558 Information Technology and Tele communications Purcha sing Director
559559 for all state agencies and shall be responsible for the procurement
560560 of all information technology and telecommunication
561561 telecommunications software, hardware, equi pment, peripheral
562562 devices, maintenance, consulting services, high technology systems,
563563 and other related information technology, data processing,
564564 telecommunication telecommunications and related peripherals and
565565 services for all sta te agencies. The Chief In formation Officer
566566 shall establish, implement, and enforce policies and procedur es for
567567 the procurement of information technology and telecommunication
568568 telecommunications software, hardware, equipment, peripheral

596596 and other related information technol ogy, data processing,
597597 telecommunication telecommunications and related peripherals and
598598 services by purchase, lease -purchase, lease with option to purchase,
599599 lease and rental for all state agencies. The procurement policies
600600 and procedures establis hed by the Chief Information Officer shall be
601601 consistent with The the Oklahoma Central Purchasing A ct.
602602 2. The Chief Information Officer, or any employee or agent of
603603 the Chief Information Officer acting wit hin the scope of delegated
604604 authority, shall have the same power and authority regarding the
605605 procurement of all information technology and telecommunication
606606 telecommunications products and services as outlined in paragraph 1
607607 of this subsection for all state agencies as the State Purchasing
608608 Director has for all acq uisitions used or con sumed by state agencies
609609 as established in The the Oklahoma Central Purchas ing Act. Such
610610 authority shall, consistent with the authority granted to the State
611611 Purchasing Director pursuant to Section 85.10 of Title 74 of the
612612 Oklahoma Statutes, include the power to designate financial or
613613 proprietary information submitted by a bidder confidential and
614614 reject all requests to disclose the information so designated, if
615615 the Chief Information Officer requires the bidder to submit the
616616 financial or proprietary informati on with a bid, proposal, or
617617 quotation.

644644 I. G. The Information Services Div ision of the Office of
645645 Management and Enterprise Services and the Chief Information Officer
646646 shall be subject to The the Oklahoma Central Purchasing Act for the
647647 approval and purchase of equipment and products not related to
648648 information and telecommunications technology, equipment, softw are,
649649 products and related peripherals and services and shall also be
650650 subject to the requirements of the Public Competitive Bidding Act of
651651 1974, the Oklahoma Lighting Energy Conservation Act and the Public
652652 Building Construction and Planning Facilities Act when procuring
653653 data processing, information technology, telecommunication
654654 telecommunications, and related peripherals and services and when
655655 constructing informat ion technology and telecommunication
656656 telecommunications facilities, telecommunication telecommunications
657657 networks and supporting infrastructure. The Chief Information
658658 Officer shall be authorized to delegate all or some of the
659659 procurement of information technology and telecommunication
660660 telecommunications products and services and construction of
661661 facilities and telecommunication telecommunications networks to
662662 another state entity if the Chief Information Officer determines it
663663 to be cost-effective and in the best interest of the state. The
664664 Chief Information Officer shall have author ity to designate
665665 information technology and telecommunication contrac ts as statewide
666666 contracts and mandatory statewide contracts pursuant to Section 85.5
667667 of Title 74 of the Oklahoma Statutes and t o negotiate consolidation

695695 contracts in accordance with the procedu res outlined in Section
696696 85.9D of Title 74 of the Oklahoma Statutes. Any contract entered
697697 into by a state agency for which the Chief Informati on Officer has
698698 not acted as the Information Tec hnology and Telecommunications
699699 Purchasing Director as required in thi s subsection or subsecti on H
700700 of this section, shall be deemed to be unenforceable and the Office
701701 of Management and Enterprise S ervices shall not process any claim
702702 associated with the provisions thereof.
703703 J. H. The Chief Information Officer shall establis h, implement,
704704 and enforce policies and procedure for the development and
705705 procurement of an interoperable radio communications system for
706706 state agencies. The Chief Information Officer shall work with local
707707 governmental entities in developing the interoperable radio
708708 communications system.
709709 K. The Chief Information Officer shall develop and implement a
710710 plan to utilize open source techn ology and products for the
711711 information technology and telecommunication sy stems of all state
712712 agencies.
713713 L. I. All state agencies and authorities of this state and all
714714 officers and employees of those entities shall work and cooperate
715715 with and lend assistance to the Chief Information Officer and the
716716 Information Services Division of the Office of Management and

744744 requested by the Chief Information Officer.
745745 M. The Chief Information Officer shall pr epare an annual report
746746 detailing the ongoing net saving attributable to t he reallocation
747747 and consolidation of information technology and telecommunicat ion
748748 resources and personnel and shall submit the report to the Governor,
749749 the Speaker of the House of Representatives, and the President Pro
750750 Tempore of the Senate.
751751 N. J. For purposes of the Oklahoma Information Services Act,
752752 unless otherwise provided for, “state agencies” shall include any
753753 office, officer, bureau, board, commission, counsel, unit, division,
754754 body, authority, or institution of the executive branch of state
755755 government, whether elected or appoi nted; provided, except with
756756 respect to the provisio ns of subsection D of this section, the term
757757 “state agencies” shall not include institutions within The Oklahoma
758758 State System of Higher Education, the Oklahoma State Re gents for
759759 Higher Education and the telecommunications network known as OneNet.
760760 O. K. As used in this section:
761761 1. “High technology system ” means advanced technologica l
762762 equipment, software, commu nication lines, and services for the
763763 processing, storing, and retrieval of infor mation by a state agency;
764764 2. “Consolidation contract ” means a contract for several state
765765 or public agencies for the purpose of purchasing information

794794 3. “Enterprise agreement ” means an agreement for information
795795 technology or telecommunication telecommunications goods and
796796 services with a suppli er who manufactures, develops an d designs
797797 products and provides services that are used by one or more state
798798 agencies.
799799 SECTION 2. AMENDATORY 62 O.S. 2021, Section 34.11.1.1,
800800 is amended to read as follows:
801801 Section 34.11.1.1. A. The Chief Information Officer shall
802802 source and submit to the State Governmental Technology Applications
803803 Review Board proposed state employee performance information
804804 metrics, convenience information sets and other data streams for
805805 possible publication o n the “data.ok.gov” website in accordance with
806806 guidelines established by Section 34.11.2 of Title 62 of the
807807 Oklahoma Statutes this title.
808808 B. The Chief Information Officer shall assist the State
809809 Governmental Technolog y Applications Review Board with developing
810810 performance metrics pursuant to the requirements of Section 34.27 of
811811 Title 62 of the Oklahoma Statut es.
812812 C. The following data sets shall be placed online at the

902902 to all available convenience information sets shall be prominently
903903 featured on the portal system referenced in Section 34.24 of this
904904 title and if possible li nked to the data.ok.gov web portal.
905905 E. The board Chief Information Officer may conduct events and
906906 contests to provide recognition of software application development
907907 provided that the application being recognized utilizes standards
908908 established in this sec tion to the benefit of the citizens of
909909 Oklahoma this state.
910910 F. The board Chief Information Officer shall establish an
911911 application process through which applicants can request the
912912 scheduled implementation of application programming interfaces,
913913 creation of open technology standards, and publication of
914914 convenience information sets pursuant to the provisions of this

948948 performance information metrics and guidelines which shall be used
949949 to establish criteria which govern participation in the “State
950950 Government Employee Performance Transparency Pilot Program ”. The
951951 board Chief Information Officer shall set a schedule for the
952952 publication of performance information metrics through the
953953 data.ok.gov website.
954954 I. For the purposes of this section, “open technology
955955 standards” are widely accepted standards and mechanisms for the web -
956956 based connectivity and asynchronous communication betwe en software
957957 programs. “Application programming interface ” is a standardized
958958 interface enabling a standard form of connectivity between
959959 convenience information sets and software program s, “performance
960960 information metrics” are sets of information which refl ect the
961961 performance of state employees and state agencies, and “convenience
962962 information sets” are sets of information which are subject to
963963 public access under the Oklahoma Open Records Act and which do not
964964 contain personally identifiable information.

12911291 B. No agency Agencies of the executive branch of the this state
12921292 shall be authorized to use state funds for or enter into any
12931293 agreement for the acq uisition of any category of computer hardware,

12951295 telecommunication telecommunications services and equipment, service
12961296 costs, maintenance costs, or any other costs or fees associated with
12971297 the acquisition of the services or equipment, without except for
12981298 purchases related to information and telecommunications security and
12991299 data protection, which shall require written authorization of the
13001300 Chief Information Off icer or a designee except the following:
13011301 1. A purchase less than or equal to Five Thousand Dollars
13021302 ($5,000.00) if such product is purchased using a state purchase card
13031303 and the product is listed on either the Approved Hardware o r
13041304 Approved Software list located on the Office of Management and
13051305 Enterprise Services website;
13061306 2. A purchase over Five Thousand Dollars ($5,000.00) and less
13071307 than or equal to Twenty -five Thousand Dollars ($25,000.00) if such
13081308 product is purchased using a sta te purchase card, the produc t is
13091309 listed on an information technology or telecom munications statewide
13101310 contract, and the product is listed on either the Approved Hardware
13111311 or Approved Software list located on the Office of Management and
13121312 Enterprise Services w ebsite; or

13581358 to disclose, directly or indirectly, any information of a state
13591359 agency which is declared t o be confidential or privile ged by state

13961396 a state agency, board, commission, or authority may obtain
13971397 reimbursement of a merchant fee incurred in connection wit h any
13981398 electronic or online transaction.
13991399 B. Subject to review and approval as provided for in Section
14001400 34.27 of this title by the Chief Information Officer , unless
14011401 otherwise permitted by law, a state agency, board, commission , or
14021402 authority may charge a c onvenience fee for a man ual transaction.
14031403 Each state entity shall keep a record of how the convenience fee has
14041404 been determined and shall file t he record with the Information
14051405 Services Division of the Office o f Management and Enterprise
14061406 Services. A state agency , board, commission, or authority may
14071407 periodically adjust a convenience fee as needed upon review and
14081408 approval as provided for in Section 34.27 of this t itle.
14091409 Any state agency, board, commission or authority may apply t o
14101410 the State Governmental Technology Applications Review B oard for
14111411 authorization to charge a convenience fee for electronic or online

14401440 The Board shall annually review the authorization for a convenien ce

14421442 renew or revoke the authorization as provided for in this subsection

14441444 C. For purposes of this section:
14451445 1. “Merchant fee” shall mean and be limited to t he cost of a
14461446 charge imposed by a third-party credit card or debit card issuer
14471447 that is necessary to process an electronic or online transaction
14481448 with a state agency, board, commission or authority;
14491449 2. “Convenience fee” shall mean a fee charged to partially
14501450 compensate for costs incurred as a result of providing for a manual
14511451 transaction or an electronic or online transact ion if authorization
14521452 is approved as provided for in subse ction B of this section; and
14531453 3. “Manual transaction” shall mean a transaction that is not
14541454 conducted online or e lectronically if the transaction is made
14551455 available online or electronically.
14561456 The Office of Management and Enterprise S ervices shall be
14571457 authorized to promulgate rules necessary to effectuate the
14581458 provisions of this section.

16411641 SECTION 8. AMENDATORY 62 O.S. 2021, Section 35.5 , is

16431643 Section 35.5. A. 1. All state agencies shall provide to the
16441644 Chief Information Officer a list of information technology assets of
16451645 the agency which are integral to the information and
16461646 telecommunications security aspects of agency-specific applications
16471647 or functions and a list o f information technology positions which
16481648 are directly associated with the assets. The agency shall further
16491649 provide the reference to federal or state statutory or
16501650 constitutional provisions whi ch require it to perform th e
16511651 applications or functions .
16521652 2. If the Chief Information Officer dispute s the identification
16531653 of assets or positions provided by a state agency as bein g integral
16541654 to agency-specific applications or functions , the Director of the
16551655 Office of Management and Enterprise Services shall make the final
16561656 determination. Each dispute by the Chief Information Officer shall
16571657 include a written statement that includes a concise summary of the
16581658 dispute’s reasoning, as well as any material information necessary
16591659 for the Director of the Office of Management and Enterprise Services
16601660 to make a final determination.

16961696 of this state or improved efficiency of state government operations,
16971697 including all furniture, equipment, vehicles, supplies, re cords,

17081708 resulting from the provisions of the Information Technology
17091709 Consolidation and Coordination Act; and
17101710 4. Any changes in law required or any changes to the amount of
17111711 state appropriations or other state funds associated with the
17121712 transfer of the information technology assets or positions.

17391739 C. The information technology assets a nd positions of each
17401740 appropriated state agency identified pursuant to this section shall
17411741 be transferred as part of the consolidation of inf ormation
17421742 technology operations of the state agency to the Information
17431743 Services Division of the Office of Ma nagement and Enterprise
17441744 Services when determined by the Information Services Division. The
17451745 costs of operation, maintenance, licensing and service of the
17461746 information technology assets shall rema in the responsibility of the
17471747 state agency from which the assets are tran sferred until the state
17481748 agency information technology operations are consolidated in the
17491749 Information Services Division, unless otherwise ag reed to by the
17501750 state agency and the Information Services Division. Appropriat e
17511751 conveyances and other docum ents shall be executed to effectuate the
17521752 transfer of the information technology assets and positions to the
17531753 Information Services Division of the Office of Management and
17541754 Enterprise Services.
17551755 D. The Chief Information Officer shall may recommend changes to
17561756 the Director of the Office of Manage ment and Enterprise Services and
17571757 the Governor for inclusion in the next executive budget to be
17581758 submitted to the Legislature.
17591759 E. The Information Services Division shall provide shared
17601760 services to each state agency and sh all bill agencies for those
17611761 shared services at an estimated cost to provide the services. The
17621762 estimated cost shall include the full cost of the services,

17941794 installing, and operat ing information technology and
17951795 telecommunications infrastructure, hardware and software for use by
17961796 state agencies. The Info rmation Services Division shall publish a
17971797 schedule of costs for eac h available shared service and shall enter
17981798 into an agreement with each stat e agency for the shared se rvices
17991799 that will be provided to the agency. The aggregated cost of shared
18001800 services to be provided to each state agency shall be budgeted
18011801 annually as a separate line item through each state a gency. State
18021802 agencies shall process request for payments as provided for under
18031803 the agreement entered into with the Information Services Division in
18041804 a timely manner. If payments are deemed to be delinquent for shared
18051805 services provided to a state agency, t he Information Services
18061806 Division may request the Division of Cent ral Accounting and
18071807 Reporting of the Office of Management and Enterprise Services to
18081808 create vouchers and process p ayments to the Information Services
18091809 Division against the funds of the delinque nt state agency. If the
18101810 state agency for which shared services were provided disputes the
18111811 provision of shared services in accordance with its agreement with
18121812 the Information Services Division, no voucher shall be process ed

18421842 F. The Information Services Division of the Office of
18431843 Management and Enterprise Services shall s ucceed to any contractual
18441844 rights, easement rights, lease rights, and other similar rights and
18451845 responsibilities related to the information technology asse ts that
18461846 are transferred as provided for in this section and incurre d by an
18471847 appropriated state agency.
18481848 SECTION 9. AMENDATORY 62 O.S. 2021, Section 35.6, is
18491849 amended to read as follows:
18501850 Section 35.6. A. All appropriated and nonappropriated state
18511851 agencies shall be required to use the following information
18521852 technology services and systems operated and maintained b y the
18531853 Office of Management and Enterprise Services for the purpose of
18541854 information and telecommunications security and data management for
18551855 all agency functions:
18561856 1. Data Service Center of the Informa tion Services Division;
18571857 2. Networking services;
18581858 3. Communication or intercommunicati on systems;
18591859 4. Electronic mail systems; and
18601860 5. Data and network security systems .
18611861 B. All appropriated and nonappropriated state agencies shall be

19081908 SECTION 10. AMENDATORY 62 O.S. 2021, Section 35.8, is

19411941 Technology Applications Review Board Chief Information Officer shall
19421942 consider and approve security protocols which sha ll be followed by
19431943 employees of the Information Services Division of the Office of
19441944 Management and Enterprise Services who are assigned to service law
19451945 enforcement agencies. The Board Chief Information Officer shall
19461946 make recommendations to state officers and employees related to
19471947 continuity of criminal justice information system security
19481948 protocols.
19491949 B. Notwithstanding the provisions of Section 35.5 of this
19501950 title, the transfer of information technology assets and positions
19511951 of the Department of Public Safety sha ll occur prior to the transfer
19521952 of assets and positions of other public safety agenci es.
19531953 C. Unless otherwise provided for in law, the transfer of
19541954 information technology assets and positions of any state agenc y
19551955 pursuant to the Information Technology Consolidation and
19561956 Coordination Act shall not act to transfer to the Information
19571957 Services Division of the Office of Management and Enterprise
19581958 Services or to the Chief Information Officer the duties of a state
19591959 agency to keep, maintain and open to any person all rec ords of the
19601960 agency in compliance with the Oklahoma Open Records Act. Each state
19611961 agency shall continue to be responsible for records created by,
19621962 received by, under the authority of, or coming into the custody ,

19901990 and categorize the records in a retrievable form and the duty to
19911991 respond to requests for records, even if the records have been
19921992 transmitted to or stored by the Information Services Division of the
19931993 Office of Management and Enterprise Se rvices or the Chief
19941994 Information Officer.
19951995 D. State employees who are members of the Teachers’ Retirement
19961996 System of Oklahoma and are transferred pursuant to the Information
19971997 Technology Consolidation and Coordin ation Act may elect to continue
19981998 their participation in the Teachers ’ Retirement System of Oklahoma
19991999 in lieu of participating in the Oklahoma Public Employees Retirement
20002000 System. Any transferred employee who wishes to make such election
20012001 shall do so in writing within thirty (30) days of the effective date
20022002 of this act August 24, 2012. If any transferred employee has
20032003 already started participating in the Oklahoma Public Employees
20042004 Retirement System, the employee may make an election to return to
20052005 the Teachers’ Retirement System of Oklahoma if the election is made
20062006 in writing within thirty ( 30) days of the effective date of this act
20072007 August 24, 2012. In the event a transferred employe e who has
20082008 already begun participating in the Oklahoma Public Employees
20092009 Retirement System elects to return to the Teachers ’ Retirement
20102010 System of Oklahoma, the Okl ahoma Public Employees Retirement System
20112011 shall transfer the service credit and contributions to the Teachers ’
20122012 Retirement System of Oklahoma for any credit that accrued after the

20442044 SECTION 11. REPEALER 62 O.S. 2021, Sections 34.27, 35.2,
20452045 35.7, and 35.9, are hereby repealed.
20462046 SECTION 12. Provisions of this act shall be enacted no later
20472047 than July 1, 2026. By that date, state agencies must notify the
20482048 Director of the Office of Enterprise and Management Services their
20492049 intention to continue to contract with the Information Services
20502050 Division for information technology or telecommunication s services
20512051 or to create their own agency-specific information services
20522052 division.
20532053 SECTION 13. This act shall become effective July 1, 202 4.
20542054 SECTION 14. It being immediately necessary for the preservation
20552055 of the public peace, health or safety, an emergency is hereby
20562056 declared to exist, by reason whereof this act shall take effect and
20572057 be in full force from and after its passage and approval.
