131131 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
132132 SECTION 1. AMENDATORY 10 O.S. 2021, Section 7505 -5.1, is
133133 amended to read as follo ws:
134134 Section 7505-5.1. A. Except as otherwise prov ided in this
135135 section, only a person fo r whom a favorable written preplacement
136136 home study has been prepared may accept custody of a minor for
137137 purposes of adoption. A preplacement home study is favorable if it
138138 contains a finding that the person is suited to be an adoptive
139139 parent, either in general or for a particular minor, and it is

167167 preceding a placement of a minor with the person for adoption.
168168 B. A preplacement home study is not required if a par ent or
169169 guardian places a minor directl y with a relative of the minor for
170170 purposes of adoption, or if the minor has been residing with a birth
171171 parent’s spouse for not less than one (1) year as of the date t he
172172 petition for adoption is filed, but a home study of the relative or
173173 stepparent is required during the pendency of a proceeding for
174174 adoption.
175175 C. A prospective adoptive parent shall not be approved for
176176 placement of a child if the petitioners or any ot her person residing
177177 in the home of the petitioners has been convicted of any of the
178178 following felony offenses:
179179 1. Within the five-year period preceding the date of the
180180 petition, physical assault, domestic abuse, battery or a drug -
181181 related offense;
182182 2. Child abuse or neglect;
183183 3. A crime against a child, including, but not limited to,
184184 child pornography sexual abuse material; and
185185 4. A crime involving violence, including, but n ot limited to,
186186 rape, sexual assault or homicide, but excluding those crimes
187187 specified in paragraph 1 of this subsection.
188188 D. Under no circumstances shall a child be placed in the
189189 custody of an individual subject to the Oklahoma Sex Offenders

218218 Act.
219219 SECTION 2. AMENDATORY 10 O.S. 2021, Section 7505 -6.3, is
220220 amended to read as follows:
221221 Section 7505-6.3. A. After six (6) months from the dat e of the
222222 interlocutory decree unless the court waive d all or part of the
223223 waiting period, the petitioners may apply to the court for a final
224224 decree of adoption. The court shall thereupon set a time and place
225225 for final hearing.
226226 B. If the minor is relat ed by blood to one of the petitioners,
227227 or is a stepchild of the petitioner, or the court finds that the
228228 best interests of the child wil l be furthered thereby, the cour t,
229229 after examination of the home stud y reports required by Section
230230 7505-5.1 or 7505-5.2 of this title, may waive the entry of an
231231 interlocutory decree and the waiting period of six (6) months or the
232232 balance of the waiting period provided in this section.
233233 C. Notice of the time and date of the hearing shall be served
234234 at least ten (10) days prior to the hearing upon any parent whose
235235 parental rights have not been terminated, unless that parent has
236236 properly executed a consent to t he adoption or a permanent
237237 relinquishment pursuant to Sections 7503 -2.3, 7503-2.4 and 7503-2.6
238238 of this title or has waived th e right to notice pursuant to Section
239239 7503-3.1 of this title. Notice of the hearing shall also be served

266266 on the child-placing agency or the Department of Human Services in
267267 those cases where the child -placing agency or Departme nt has
268268 original custody, or performed a home study.
269269 D. The petitioners and child shall appear at the hearing on the
270270 application for final decree, unless the pr esence of the child is
271271 waived by the court.
272272 E. The final hearing is not required to be recorded by a court
273273 reporter. Upon the request of any party, the court shall direct
274274 that the hearing be recorded by the court reporter, or th e court may
275275 order on its own initiative that the hearing be recorded.
276276 F. The court may enter a final decree of adoption, if the court
277277 is satisfied that the adoption is in the best interests of the
278278 child.
279279 G. For purposes of this subsection, the State of Oklahoma
280280 elects to make subparagraph (A) of paragraph 20 of subsection 3 of
281281 Section 471(a) of th e Social Security Act (Public Law 105-89)
282282 inapplicable to Oklahoma. Instead, the State of Oklahoma requires
283283 that:
284284 1. Except as otherwise provided by this subse ction, a
285285 prospective adoptive parent shall not be approved for placement of a
286286 child if the petitioners or any other person residing in the home of
287287 the petitioners has been convicted of any of the followi ng felony

315315 a. within the five-year period preceding the date of the
316316 petition, physical assault, domest ic abuse, battery or
317317 a drug-related offense, except as otherwise authorized
318318 by this subsection,
319319 b. child abuse or neglect,
320320 c. a crime against a child, including, but not limited
321321 to, child pornography sexual abuse material , and
322322 d. a crime involving violence, including, but not limited
323323 to, rape, sexual assault or homicid e, but excluding
324324 physical assault or battery.
325325 2. A prospective adoptive parent m ay be an approved placement
326326 regardless of whether such parent has been convicte d of any of the
327327 felony offenses specified by subparagraph a of paragr aph 1 of this
328328 subsection, if an evaluation has been made and accepted by the court
329329 which considers the natur e and seriousness of the crime in relation
330330 to the adoption, the time elapsed since the commission of the crime,
331331 the circumstances under which the crime was committed, the degr ee of
332332 rehabilitation, the number of crimes committed by the person
333333 involved, and a showing by clear and convincing evidence that the
334334 child will not be at risk b y such placement.
335335 H. Under no circumstances shall a child be placed in the
336336 custody of an individual subject to the Oklahoma Sex Offenders
337337 Registration Act or an individual who is married to or living with

364364 an individual subject to the Oklahoma Sex Offenders Registration
365365 Act.
366366 SECTION 3. AMENDATORY 10A O.S. 2021, Section 1 -4-705, is
367367 amended to read as follows:
368368 Section 1-4-705. A. In placing a child in th e custody of an
369369 individual, a private agency, or institution, the court and the
370370 Department of Human Services sh all, if possible, select a person,
371371 agency, or institution governed by persons of the same religious
372372 faith as that of the parents of the child, or in case of a
373373 difference in the religious faith of the parents, th en of the
374374 religious faith of t he child.
375375 B. Except as otherwise provided by this section or by law, it
376376 shall be left to the discretion of the judge to place the custody of
377377 children where their total needs will best be served. If an
378378 individual meets the minimum require d age for placement purposes,
379379 the age of an otherwise eligible individual shall not be a reason
380380 for denying the individual placement or custody of a child.
381381 C. A prospective fos ter or adoptive parent shall not be an
382382 approved placement for a ch ild if the prospective foster or adoptive
383383 parent or any other person residing in the home of the prospective
384384 foster or adoptive parent has been convicted of any of the following
385385 felony offenses:
386386 1. Within the five-year period preceding th e application date,
387387 a physical assault, battery, or a drug-related offense;

414414 2. Child abuse or neglect;
415415 3. Domestic abuse;
416416 4. A crime against a child, including, but not limited to,
417417 child pornography sexual abuse material; or
418418 5. A crime involving violence, including, bu t not limited to,
419419 rape, sexual assault o r homicide, but excluding those crimes
420420 specified in paragraph 1 of this subsection.
421421 D. 1. Under no circumstances shall a child be placed with or
422422 in the custody of an individual subject to the Oklahoma Sex
423423 Offenders Registration Act or an individual who is mar ried to or
424424 living with an individual subject to the Oklahoma Sex Offenders
425425 Registration Act.
426426 2. In addition, prior to the court placing a child in the
427427 custody of an individual, the court shall inquire as to whether the
428428 individual has been previously convicted of any felony or relevant
429429 misdemeanor or has any felony or misdemeanor charges pendi ng.
430430 3. Prior to the custody order being entered, the in dividual
431431 seeking custody shall provide an Oklahom a criminal history record
432432 obtained pursuant to Section 150.9 o f Title 74 of the Oklahoma
433433 Statutes to the court.
434434 4. For purposes of this subsec tion the terms:
435435 a. “relevant misdemeanor ” may include assault an d
436436 battery, alcohol- or drug-related offenses, domestic
437437 violence or other offenses involving the use of

465465 property of another, and
466466 b. “individual” shall not include a parent or legal
467467 guardian of the child.
468468 E. The provisions of this section shall not apply in any
469469 paternity or domestic rel ations case, unless otherwise or dered by
470470 the court.
471471 SECTION 4. AMENDATORY 10A O.S. 2021, Section 2-8-221, is
472472 amended to read as follows:
473473 Section 2-8-221. A. Whenever the district attorney for any
474474 district has reasonable c ause to believe that an individual, with
475475 knowledge of its content, is engaged in sending a transmission or
476476 causing a transmission to originate within this state containing
477477 obscene material or child pornography sexual abuse material , as such
478478 terms are defined in Section 1024.1 of Title 21 of the Oklahoma
479479 Statutes, the district attorney for the district in to which the
480480 transmission is sent or caused t o be sent, may institute an action
481481 in the district court for an adjudication of the obscenity or child
482482 pornographic content sexual abuse material of the transmission.
483483 Provided that if the conditions of subsection B of this section are
484484 present, then it shall be at the di scretion of the district attorney
485485 whether the action instituted is a juvenile offen se as defined in
486486 subsection B of this section or whe ther the action instituted is a

514514 Oklahoma Statutes.
515515 The individual sending the transmission specified in this
516516 section may be charged and tried in any distri ct wherein the
517517 transmission is sent or in which it is received by the person to
518518 whom it was transmitted.
519519 For purposes of any cri minal prosecution pursuant to a violation
520520 of this section, the person violating the provisions of this section
521521 shall be deemed to be within the jurisdiction of this st ate by the
522522 fact of accessing any computer, cellular phone, or other computer-
523523 related or satellite -operated device in this state, regardless of
524524 the actual jurisdiction where the violator resides.
525525 B. Any individual und er eighteen (18) years of age who engages
526526 in the original or relayed transmission of obscene material or child
527527 pornography sexual abuse material via electronic media in the form
528528 of digital images, videos, or other depictions of real persons un der
529529 the age of eighteen (18) years, and:
530530 1. The original or relayed transmission is of another minor
531531 over thirteen (13) years of age and is made with the consent of the
532532 pictured individual and is transmitted to five or fewer individual
533533 destinations, known or unknown, shall be guilty of a misdemeanor
534534 violation of this section punishable by:
535535 a. a fine not to exceed Five Hundred Dollars ($500.00)

565565 c. up to forty (40) hours of community service,
566566 d. a referral to a juvenile bureau to propose a probation
567567 plan which shall be adopted through disposition, or
568568 e. attendance and successful completion of an educational
569569 program or a delinquency prevention and diversion
570570 program as provided in Section 24 -100.4 of Title 70 of
571571 the Oklahoma Statutes. The court shall have the
572572 discretion to order the parent or legal guardian of
573573 the juvenile to attend and s uccessfully complete the
574574 educational program;
575575 2. The original or relayed transmission is of another minor
576576 over thirteen (13) years of age and is made without the consent o f
577577 the pictured individual, or is sent to six or more individual
578578 destinations, known or unknown, shall be guilty of a misdemeanor
579579 violation of this section p unishable by:
580580 a. a fine not to exceed Seven Hundred Dollars ($700.00)
581581 for the first offense,
582582 b. a fine not to exceed One Thousan d Four Hundred Dollars
583583 ($1,400.00) for a second or subse quent offense,
584584 c. up to sixty (60) hours of community servi ce,
585585 d. a referral to a juvenile bureau to propose a probation
586586 plan which shall be adopted through disposition, an d

620620 3. The original or relayed transmission is of another minor
621621 thirteen (13) years of age or younger, with or without the pictured
622622 individual’s consent, and is transmitte d to any number of
623623 destinations, known or unknown, s hall be guilty of a misdemeanor
624624 violation of this section punishable by:
625625 a. a fine not to exceed Nine Hu ndred Dollars ($900.00)
626626 for the first offense,
627627 b. a fine not to exceed One Thousand Eight Hundred
628628 Dollars ($1,800.00) for a seco nd or subsequent
629629 offense,
630630 c. up to eighty (80) hours of community service,
631631 d. a referral to a juvenile bureau to pr opose a probation
632632 plan which may be adopted through disposition, and
633633 e. attendance and successful completion of a n educational
634634 program or a delinquency prevention an d diversion
635635 program as provided in Section 24-100.4 of Title 70 of
636636 the Oklahoma Statutes. The court sha ll have the

665665 educational program.
666666 C. The fact that the individual making the tr ansmission and the
667667 individual pictured are the same does no t alter the criminality
668668 provided in this section.
669669 D. It is an affirmative defense to the relayed transmission of
670670 obscene material or child pornography sexual abuse material, as
671671 these terms are defined in Section 1024.1 of T itle 21 of the
672672 Oklahoma Statutes, if a juveni le:
673673 1. Has not solicited the visu al depiction; and
674674 2. Does not subsequently distribute, present, transmit, post,
675675 print, disseminate or exchange the visual dep iction except for the
676676 purpose of reporting the original transmission or relayed
677677 transmission to appropriate school or law enforcement a uthorities.
678678 SECTION 5. AMENDATORY 2 1 O.S. 2021, Section 13.1, is
679679 amended to read as fol lows:
680680 Section 13.1. Persons convicted of:
681681 1. First degree murder as defined in Section 701.7 of this
682682 title;
683683 2. Second degree murder as defined by Section 701.8 of this
684684 title;
685685 3. Manslaughter in the first degree as defined by Section 711

10231023 L. Provided, however, that nothing contained in this section
10241024 shall prohibit any parent or guardian from using reasonable and
10251025 ordinary force pursuant to Section 844 of this title.
10261026 M. Consent shall not be a def ense for any violation pr ovided
10271027 for in this section.
10281028 N. Notwithstanding the age requirements of other statutes
10291029 referenced within this section, this section shall apply to any
10301030 child under eighteen (18) years of age.
10311031 O. As used in this section:
10321032 1. “Child abuse” means:

10761076 b. penetration of the vagina or anus, however slight, by

10821082 4. “Child sexual exploitation ” means the willful or malicious

13651365 Section 1021. A. Every person who willfully and knowingly

13671367 1. Lewdly exposes his or her person or genitals in any public
13681368 place, or in any plac e where there are present other persons to b e
13691369 offended or annoyed thereb y; provided, however, for purposes of this
13701370 section, a person alleged to have committed an act of public
13711371 urination shall be prosecuted pursuan t to Section 22 of this title
13721372 unless such act was accompanied with another act th at violates

14141414 shall be guilty, upon conviction, of a felony and shall be punished
14151415 by the imposition of a fine of not less than Five Hundred Dollars
14161416 ($500.00) nor more than Twenty Thous and Dollars ($20,000.00) or by
14171417 imprisonment for not less than thirty (30) days nor more than te n
14181418 (10) years, or by both such fine and imprisonment.
14191419 B. Every person who:
14201420 1. Willfully solici ts or aids a minor child to perform; o r
14211421 2. Shows, exhibits, loans , or distributes to a minor child any
14221422 obscene material or child pornography sexual abuse material for the
14231423 purpose of inducing said the minor to participate in,
14241424 any act specified in paragraphs 1, 2, 3 or 4 of subsection A o f this

16221622 analog or other means and whether directly viewable, compressed or
16231623 encoded depicting a child under the age of eighte en (18) years
16241624 engaged in an act of sexual conduct as defined in Section 1024.1 of
16251625 this title shall immediately or as soon as possible report by
16261626 telephone such instance of suspected child abuse or child
16271627 pornography sexual abuse material to the law enforcement agency
16281628 having jurisdiction over the case and shall prepare and send a

16631663 person but shall not include a person who develops film or makes
16641664 prints for a public agency; and
16651665 2. “Commercial computer technician ” means any person who
16661666 repairs, installs, or otherwise servic es any computer including, but
16671667 not limited to, any component part, device, memo ry storage or
16681668 recording mechanism, auxiliary storage, recording or memory
16691669 capacity, or any other materials relating to operation and
16701670 maintenance of a computer or computer networ k or system, for
16711671 compensation. The term shall also include any employee of such
16721672 person.
16731673 B. Any person who violates the provisions of th is section, upon
16741674 conviction, shall be guilty of a misdemean or and shall be punished
16751675 by the imposition of a fine not to exceed Five Hundred Dollars
16761676 ($500.00) or by impri sonment in the county jail not to exceed one
16771677 (1) year, or both such fine and imprisonment.
16781678 C. Nothing in this section shall be construed to require or

18201820 of the viewer, or wherein a person under the age of eighteen (18)
18211821 years observes such acts or exhibitions. Each visual depiction or
18221822 individual image shall constitute a separate item and multiple
18231823 copies of the same identical mat erial shall each be count ed as a
18241824 separate item.

18271827 1. “Obscene material” means and includes any representation,

18621862 patently offensive as found by the average pers on

18641864 b. taken as a whole, have as the dominant theme an appeal
18651865 to prurient interest in sex as found by the average
18661866 person applying contemporary community standards, and
18671867 c. a reasonable person would find the material or
18681868 performance taken as a who le lacks serious literary,
18691869 artistic, educational, political, or scientific
18701870 purposes or value.
18711871 The standard for obscenity applied in thi s section shall not apply
18721872 to child pornography sexual abuse material;
18731873 2. “Performance” means and includes any display, live or
18741874 recorded, in any form or medium;
18751875 3. “Sexual conduct” means and includes any of the following:
18761876 a. acts of sexual intercourse including any intercourse
18771877 which is normal or perverted, actual or si mulated,

19211921 The types of sexual conduct described in paragraph 3 of this
19221922 subsection are intended to include situations when, if appropriate
19231923 to the type of conduct, the con duct is performed alone or between
19241924 members of the same or opposite sex or between humans and animals in
19251925 an act of apparent sexu al stimulation or gratification.

20152015 Section 1040.8. A. No person shall knowingly photograph, act
20162016 in, pose for, model for, print, sell, off er for sale, give away,
20172017 exhibit, publish, offer to publish, or otherwise distribute,
20182018 display, or exhibit any book, magazine, story, pamphlet, paper,
20192019 writing, card, advertisement, circula r, print, picture, photograph,

20722072 violation shall, upon conviction, be puni shed by imprisonment in the
20732073 custody of the Department of Corrections for not less than ten (10)

25652565 last-known address; and

25672567 addresses are unknown, by o ne publication in a ne wspaper of general
25682568 circulation in the county where the se izure was made.
25692569 C. Within sixty (60) days after the mailing or publ ication of

26072607 by clear and convincing evidence that the equipment was used in the
26082608 preparing, photographing, printing, selling, exhibi ting, publishing,
26092609 distributing, displaying, advertising, filming, copying, recordin g,
26102610 or mailing of obscene material, as defined in p aragraph 1 of
26112611 subsection B of Section 1024.1 of this title or child pornography
26122612 sexual abuse material , as defined in paragraph 1 of subsection A of
26132613 Section 1024.1 of thi s title, with knowledge by the owner of the
26142614 equipment.
26152615 G. The owner or party in intere st may prove that the right or
26162616 interest in the equipment was created without any knowledge or
26172617 reason to believe that the equipment was being, or wa s to be, used
26182618 for the purpose charged.
26192619 H. In the event of such proof, the court may order the
26202620 equipment released to the bona fide or innocent owner or party in

26492649 I. If the amount due to such person is less than the value of

26522652 to the judgment of the court.
26532653 J. Equipment taken or detained pursuant to this section shall
26542654 not be repleviable, b ut shall be deemed to be in the custody of the
26552655 office of the district attorney of the county where the equi pment
26562656 was seized or in the custo dy of the party seeking the forfeiture.
26572657 The district attorney or the party seeking the equipment may release
26582658 said the equipment to the owner of the equipment if it is determin ed
26592659 that the owner had no knowledge of the illegal use of the eq uipment
26602660 or if there is insufficient evidence to sustain t he burden of
26612661 showing illegal use of the equipment. Equ ipment which has not been
26622662 released by the district attorney or the party sei zing the equipment
26632663 shall be subject to the orders and decrees of the court or the
26642664 official having jurisdiction thereof.
26652665 K. The district attorney or the party seizing such e quipment
26662666 shall not be held civi lly liable for having cust ody of the seized
26672667 equipment or proceeding with a forfeiture action as provided for in
26682668 this section.
26692669 L. The proceeds of the sale of any equipment not t aken or
26702670 detained by the Oklahoma State Bureau of Narcot ics and Dangerous

27102710 fund to be used and maintained as a revolving fund for any purpose
27112711 by the department that m ade the seizure with a yearly accoun ting to
27122712 the board of county commissioners in whose county the fund is
27132713 established. Monies from said such fund may be used to pay costs
27142714 for the storage of such equipment if such equipment is ordered
27152715 released to a bona fide or innocent owner, purchaser, or conditional
27162716 sales vendor and if such monies are available in said the fund.
27172717 M. The proceeds of the sale of any equipment seized, taken or
27182718 detained by the Oklahoma State Bureau of Narcotics and Dangerous
27192719 Drugs Control, the Department of Public Safety, the Oklahoma State
27202720 Bureau of Investigation, the Alcoholic Beve rage Laws Enforcement

27652765 enforcement agency whic h seized the equipment for its offi cial use.
27662766 O. If the court finds that the equipment was not used in the
27672767 preparing, photographing, printing, selling, exhibiting , publishing,
27682768 distributing, displaying, advertising, filming, copying, recording,
27692769 or mailing of obscene material, as defined in p aragraph 1 of
27702770 subsection B of Section 1024.1 of this title or child pornography

28042804 owner while such equipment was unlawfully in the possession of a
28052805 person other than the owner in violation of the criminal laws of the

28092809 Section 1040.56. A. Any person who, while under th e age of
28102810 eighteen (18), was a victim of an offense provided for in Secti on
28112811 681, 741, 843.5, 852.1, 867, 885, 886, 888, 891, 1021, 1021.2,

28482848 B. In any civil action brought under this sec tion, the
28492849 prevailing plaintiff shall recover the actu al, special and punitive
28502850 damages such person sustained and the cost of the suit, including
28512851 reasonable attorney fees.
28522852 C. Notwithstanding any other provision of law, any civil action
28532853 commenced pursuant to this section shall be filed within three (3)
28542854 years after the later of :
28552855 1. The conclusion of the related criminal case;
28562856 2. The notification to the victim by a law enforcement agency
28572857 of the creation, possession, distribution or promotion of child
28582858 pornography sexual abuse material ; or
28592859 3. In the case of a vi ctim younger than eighteen (18) years of
28602860 age, within three (3) years after the person reaches the age of
28612861 eighteen (18).
28622862 D. It is not a defense to a civi l cause of action under this
28632863 section that the resp ondent did not know the victim or commit the
28642864 abuse depicted in the child pornography sexual abuse material.
28652865 E. As used in this section, “child pornography sexual abuse
28662866 material” shall have the same meaning as such term is defined in
28672867 Section 1024.1 of Title 21 of the Oklahoma Statutes this title.
28682868 F. The provisions of this section shall not apply t o any acts

29002900 SECTION 32. AMENDATORY 21 O.S. 2021, Section 1040.80, is

29022902 Section 1040.80. A. As used in this section, the term:
29032903 1. “Interactive computer service provider” means any provider
29042904 to the public of computer access via the Internet to a computer
29052905 server or similar device used for the storage of graphic, video or
29062906 images;
29072907 2. “Internet” means the international computer network of b oth
29082908 federal and nonfederal i nteroperable packet-switched data networks;
29092909 3. “Controlled or owned by ” with respect to a server or other
29102910 storage device means a server or other such device that is entirely
29112911 owned by the interactive computer service provi der or is subject to
29122912 exclusive management by the interactive computer service provider by
29132913 agreement or otherwise; and
29142914 4. “Child pornography sexual abuse material” means explicit
29152915 child pornography sexual abuse material as defined in Section 1024.1
29162916 of Title 21 of the Oklahoma Statutes this title.
29172917 B. The Attorney General or a law enforcement officer who
29182918 receives information that an item of alleged child pornography
29192919 sexual abuse material resides on a server or other storage device

29482948 1. Contact the interactive computer service provider that
29492949 controls or owns the se rver or other storage dev ice where the item
29502950 of alleged child pornography sexual abuse material is located;
29512951 2. Inform the interactive com puter service provider of th e
29522952 provisions of this section; and
29532953 3. Request that the interactive compu ter service provider
29542954 voluntarily comply with this section and remove the item of alleged
29552955 child pornography sexual abuse material from its server or other
29562956 storage device expeditiously.
29572957 C. 1. If an interact ive computer service provider does not
29582958 voluntarily remove the item of alleged child pornography sexual
29592959 abuse material in a timely manner, the Attorney General or law
29602960 enforcement officer shall apply for a co urt order of authorization
29612961 to remove the item of alleged child pornography sexual abuse
29622962 material under this section. The obligat ion to remove the item of
29632963 alleged child pornography sexual abuse material shall not apply to
29642964 the transmitting or routing of, or the intermediate, temporary
29652965 storage or caching of an image, information or data that is
29662966 otherwise subject to this section.
29672967 2. The application for a court order shall include:
29682968 a. the authority of the applicant to make such an

30163016 interactive computer service provider, and
30173017 (4) the steps taken to obtain voluntary compli ance by

30563056 accordance with the provisions of this section. The A ttorney
30573057 General shall notify an interactive computer service provider upon
30583058 the issuance of an order authorizing the removal of the items
30593059 alleged item of alleged child pornography sexual abuse material .
30603060 1. The notice by the Attorney General shall include:
30613061 a. a copy of the application made pursuant to subsection
30623062 C of this section,
30633063 b. a copy of the court order issued pursuant to
30643064 subsection K of this section,
30653065 c. notification that the interactive computer service
30663066 provider shall remove the item of alleged chil d
30673067 pornography sexual abuse material contained in the
30683068 order which resides on a server or other storage
30693069 device controlled or owned by such inter active

31063106 2. An interactive computer service provider may designate an
31073107 agent within the state to receive notification pursuant to thi s
31083108 section.
31093109 E. The interactive computer service provider has the right to
31103110 request a hearing befo re the court imposes any penalty under this
31113111 section.
31123112 F. Nothing in this section may be construed as imposing a duty
31133113 on an interactive computer service provider to actively monit or its
31143114 service or affirmatively seek evidence of illega l activity on its
31153115 service.
31163116 G. Notwithstanding any other provision of law to the contrary,
31173117 any interactive computer service provider that intentionally
31183118 violates subsection L of this s ection commits:

31593159 may be kept by the interactive computer service provider in the
31603160 normal course of bus iness.
31613161 J. Upon consideration of an application for authorization to
31623162 remove the item of alleged child pornography sexual abuse material
31633163 that resides on a server or other storage dev ice controlled or owned
31643164 by an interactive computer servi ce provider as set fo rth in
31653165 subsection C of this section, the judge may e nter an ex parte order,
31663166 as requested or as mod ified, authorizing the removal of the item of
31673167 alleged child pornography sexual abuse material , if the court

31983198 2. The investigative or law enforcement of ficer or agency acted
31993199 within the official sc ope of that officer’s duties or agency’s
32003200 authority, in discovering the imag es, information, or data and has
32013201 complied with the requirem ents of subsection I and subsection K of
32023202 this section;
32033203 3. An item of alleged child pornography sexual abuse material
32043204 resides on the server or ot her storage device controlled or owned by
32053205 the interactive computer service provider and is ac cessible to
32063206 persons located in the state ; and
32073207 4. In the case of an applic ation, other than a re newal or
32083208 extension, for an order removing th e item of alleged child
32093209 pornography sexual abuse material which was the subject of a
32103210 previous order authorizing the removal or disabli ng of access, the
32113211 application is based upon new evidence or information different from
32123212 and in addition to the ev idence or information offered to support
32133213 the prior order.
32143214 K. Each order authorizing the removal or disabling of access to
32153215 an alleged item of child pornography sexual abuse material shall
32163216 contain:
32173217 1. The name of the judge authorized to issue the order;

32493249 or agency who discovered the images, in formation, or data and the
32503250 identity of whoever authorized the applica tion; and
32513251 4. Such additional info rmation or instruction as the court
32523252 deems necessary to execute the order.
32533253 L. The court shall r eview the application and testimony, if
32543254 offered, and, upon a finding of probable cause, issue an order th at:
32553255 1. An item of child pornography sexual abuse material resides
32563256 on a server or other storage device controlle d by the interactive
32573257 computer service provider and is accessible to persons located in
32583258 the state;
32593259 2. The interactive c omputer service provider shall remove the
32603260 item residing on a server or other stor age device controlled or
32613261 owned by the interactive computer service provider expeditiously
32623262 after receiving the order, if practical;
32633263 3. The order shall specify that removal of any item covered by
32643264 the order shall be accomplished in a fashion that prevents or
32653265 minimizes the removal of, or restriction of access to, images,
32663266 information, or data that are is not subject to the order;

33003300 6. Provides the interactive computer service p rovider notice
33013301 and opportunity for a hearing before the court imposes any penalty
33023302 under this subsection.
33033303 M. An interactive computer service provider who is served with
33043304 a court order under subsec tion L of this section sh all remove the
33053305 item of child pornography sexual abuse material that is the subject
33063306 of the order expeditiously after rec eiving the court order, if
33073307 practicable.
33083308 N. 1. An interactive service provider may petition the court
33093309 for relief for cause from an order issued under subsection L of this
33103310 section.
33113311 2. The petition may be based on considerations of:
33123312 a. the cost or technical feasibility of compliance with
33133313 the order, or
33143314 b. the inability of the interactive computer service
33153315 provider to comply with the order wit hout also

33473347 Section 1123. A. It is a felony for any person to knowingly
33483348 and intentionally:
33493349 1. Make any oral, written or electronically or computer-
33503350 generated lewd or indecent proposal to any child under sixteen (16)
33513351 years of age, or other indiv idual the person beli eves to be a child
33523352 under sixteen (16) years of age, for the child to have unlawful
33533353 sexual relations or sexual intercourse with any person;
33543354 2. Look upon, touch, maul, or feel the body or private parts of
33553355 any child under sixteen (16) years of age in any lewd or lascivious
33563356 manner by any acts against public decency and morality, as defined
33573357 by law;

34073407 obscene materials, child pornography sexual abuse

34093409 terms are defined by Sections 1024.1 and 1040.75 of
34103410 this title,
34113411 e. cause, expose, force or require a child to look up on
34123412 sexual acts performed in the presence of the child, or
34133413 f. force or require a child to touch or feel the body or
34143414 private parts of the child or another person.

34413441 Any person convicted of any violation of this subsection shall
34423442 be punished by imprisonment in the custody o f the Department of
34433443 Corrections for not less than three (3) years nor more tha n twenty
34443444 (20) years, except when the child is under twelve (12) years of age
34453445 at the time the offense is committed, and in such case the person
34463446 shall, upon conviction, be punished by imprisonment in the custody
34473447 of the Department of Corrections for not less than twenty-five (25)
34483448 years. The provisions of this subsection shall not apply unless the
34493449 accused is at least three (3) years older than the vi ctim, except
34503450 when accomplished by the use of force or fear. Except as provided
34513451 in Section 51.1a of this title, any person convicted of a second or
34523452 subsequent violation of thi s subsection shall be guilty of a felony
34533453 punishable as provided in this subsection and shall not be eli gible
34543454 for probation, or a suspended or deferred sentence. Except as
34553455 provided in Section 51.1a of this title, any person convicted of a
34563456 third or subsequent violation of this subsection shall be guilty of
34573457 a felony punishable by imprisonment in the custody of the Department
34583458 of Corrections for a term of life or life without parole, in the
34593459 discretion of the jury, or in case the jury fails or refuses to fix
34603460 punishment then the same shall be pronounced by the court. Any
34613461 person convicted of a violation of this subsection aft er having been
34623462 twice convicted of a violation of subsection A of Section 1114 of
34633463 this title, Section 888 of this title, sexual abuse of a child

34963496 “Sexual battery” shall mean the intentional touching, mauling or

34983498 years of age or older, in a lewd and lascivious manner:
34993499 1. Without the consent of that person;
35003500 2. When committed by a state , county, municipal or political
35013501 subdivision employee or a contractor or an employee of a contractor
35023502 of the state, a county, a municipali ty or political subdivision of
35033503 this state upon a person who is under the legal custody, supervision
35043504 or authority of a state agency, a cou nty, a municipality or a
35053505 political subdivision of this state, or the subcontractor or
35063506 employee of a subcontractor of th e contractor of the state or
35073507 federal government, a county, a municipality or a political
35083508 subdivision of this state;
35093509 3. When committed upon a person who is at least sixteen (16)
35103510 years of age and is less than twenty (20) years of age and is a
35113511 student, or in the legal custody or supervision of a ny public or
35123512 private elementary or secondary school, or technology center s chool,
35133513 by a person who is eighteen (18) years of age or older and is an
35143514 employee of a school system;

35463546 concurrently enrolled at an institution of higher education, and
35473547 engages in acts pursuant to this subsection with a perpetrator who
35483548 is an employee of the institution of higher education of which the
35493549 student is enrolled.
35503550 As used in this subsection, “employee of an institution of
35513551 higher education” means faculty, adjunct faculty, instructo rs,
35523552 volunteers, or an employee of a business contracting w ith an
35533553 institution of higher education who may exercise, at any time,
35543554 institutional authority over the victim. Employee of an institution
35553555 of higher education shall not include an enrol led student who is not
35563556 more than three (3) years of age or older than the concurrently
35573557 enrolled student and who is employed or volunteering, in any
35583558 capacity, for the institution of higher education.
35593559 As used in this subsection, “employee of a school system” means
35603560 a teacher, principal or other duly appointed person employed by a
35613561 school system or an employee of a firm contracting with a school
35623562 system.
35633563 C. No person shall in any manner lewdly or lasciviously:

35983598 E. The fact that an undercover operative or law enforcement
35993599 officer was involved in the detection and investigation of an
36003600 offense pursuant to this section shall not constitute a defense to a
36013601 prosecution under this s ection.
36023602 F. Except for persons sentenced to life or life without parole,
36033603 any person sentenced to imprisonme nt for two (2) years or more for a
36043604 violation of this section shall be required to serve a term of post-
36053605 imprisonment supervision pursuant to subparagraph f of paragraph 1
36063606 of subsection A of Secti on 991a of Title 22 of the Oklahoma Statutes
36073607 under conditions determined by the Department of Corrections . The
36083608 jury shall be advised that the mandatory post-imprisonment
36093609 supervision shall be in addition to the actual imprisonment.

43944394 recorded for any inmate serving any sentence for a criminal act
43954395 which resulted in the death of a police officer, a law enfo rcement
43964396 officer, an employee of the Department of Corrections, or an
43974397 employee of a private prison contractor and the death occurred while
43984398 the police officer, law enforcement officer, employee of the
43994399 Department of Corrections, or employee of a private prison
44004400 contractor was acting within the scope of their employment. No
44014401 earned credit deductions shall be credited or recorded for any
44024402 person who is referred to an intermediate revoca tion facility for
44034403 violating any of the terms and conditions of probation.
44044404 B. The Department of Corrections is directed to develop a
44054405 written policy and procedure whereby inmates shall be assigned to
44064406 one of four class levels determine d by an adjustment review
44074407 committee of the facility to which the inmate is assigned. The

44364436 credits for rehabilitation, obtaining job skills and educ ational
44374437 enhancement, participation in and completion of alcohol/chemical
44384438 abuse programs, incentives for inmates to accept work assignments
44394439 and jobs, work attendance and productivity, conduct record,
44404440 participation in programs, coopera tive general behavior, and
44414441 appearance. When assigning inmates to a class level the adjustment
44424442 review committee shall consider all aspects of the policy and
44434443 procedure developed by the Depa rtment including but not limited to
44444444 the criteria for awarding credits required by this subs ection.
44454445 C. If an inmate is subject to misconduct, nonperformance or
44464446 disciplinary action, earned credits may be removed according to the
44474447 policies and procedures developed by the Department. Earned credits
44484448 removed for misconduct, non performance or disciplinary action may be
44494449 restored as provided by Department policy, if any.
44504450 D. 1. Class levels shall be as follows:
44514451 a. Class level 1 shall include inmates not eligible t o
44524452 participate in class levels 2 through 4, and shall
44534453 include, but not be limited to, inmate s on escape
44544454 status.
44554455 b. Class level 2 shall include an inmate who has been

45994599 4. The evaluation scale for assessing performance shall be as

46014601 a. Outstanding - For inmates who display consistently
46024602 exceptional initiative, motivation, and work habits.
46034603 b. Excellent - For inmates who display abo ve-average work
46044604 habits with only minor errors and ra rely perform below

46434643 or adjudicated delinquent as a juvenile in this state for any felony
46444644 offense enumerated in th is subsection or a similar felony offense
46454645 pursuant to the provisions of another state, the United States, or a
46464646 military court shall be eligible for the credits provided b y the
46474647 provisions of subparagraph c of paragraph 2 of subsection D of this

49944994 G. Inmates granted me dical leaves for treatment that cannot be
49954995 furnished at the penal institution where incarcerated shall be
49964996 allowed the time spent on medica l leave as time served. Any inmate
49974997 placed into administrati ve segregation for nondisciplinary reasons
49984998 by the institution’s administration may be place d in Class level 2.
49994999 The length of any jail term served by an inmate before being
50005000 transported to a state correctio nal institution pursuant to a
50015001 judgment and sentence of incarceration shall be deducted from the

57355735 B. The provisions of the S ex Offenders Registration Act shall

57385738 been convicted or received a suspended sentence at a ny time in any

57845784 21 of the Oklahoma Statutes if the offense involved sexual abuse or
57855785 sexual exploitation as those terms are defined in Sectio n 1-1-105 of
57865786 Title 10A of the Oklahoma Statut es, Section 681, if the offense
57875787 involved sexual assault, 741, if the offense involved sexual abuse
57885788 or sexual exploitation, Section 748, if the offense involved human
57895789 trafficking for commer cial sex, Section 843.1, if t he offense
57905790 involved sexual abuse or sexual exploi tation, Section 852.1, if the
57915791 offense involved sexual abuse of a child, 856, if the offense
57925792 involved child prostitution or human trafficking f or commercial sex,
57935793 865 et seq., 885, 886, 888, 891, if the offense involved sexual
57945794 abuse or sexual explo itation, 1021, 1021.2, 1021.3, 1024.2, 1029, if

58245824 Oklahoma Statutes. The provisions of the Sex Offenders Registration
58255825 Act shall not apply to any such p erson while the person is
58265826 incarcerated in a maximum or medium c orrectional institution of the
58275827 Department of Corrections.
58285828 D. On November 1, 2002, any person regi stered as a sex offender
58295829 for an offense committed pursuant to Section 741 of Title 21 of the
58305830 Oklahoma Statutes shall be summarily removed from the Sex Offender
58315831 Registry sex offender registry by the Department of C orrections and
58325832 all law enforcement agencies of any pol itical subdivision of this
58335833 state, unless the offense involved sexual abuse or sexual
58345834 exploitation.
58355835 E. The provisions of the Sex Offenders Registration Act shall
58365836 not apply to any such person who has received a criminal history
58375837 records expungement for a conviction in another state for a crime or
58385838 attempted crime which, if committed or attempted in this state,
58395839 would be a crime or an attempt to comm it a crime provided for in any
58405840 laws listed in subsection A o f this section.
58415841 F. The provisions of the Sex Offender s Registration Act shall
58425842 apply to any person residing, working or attendin g school within
58435843 this state who, after the effective date of this act November 1,
58445844 2020, has been convicted, whether upon a verdict or plea of guilty

58875887 medium correctional ins titution in the custody of the Department of
58885888 Corrections.
58895889 SECTION 42. AMENDATORY 68 O.S. 2021, Section 2357.101,

59275927 B. In no event shall the amount of the credit pro vided for in
59285928 subsection A of this section for an eligible taxpayer exceed the tax
59295929 liability of the taxpayer in a cal endar year.
59305930 C. The Oklahoma Tax Commission shall have the authority to
59315931 prescribe forms for purposes of claiming the credit authorized in
59325932 subsection A of this section. The forms shall include, but not be
59335933 limited to, requests for informati on that prove who the investment
59345934 was with, the amount o f the original investment and the amount of
59355935 the profit realized from the investment.
59365936 D. As used in this section:
59375937 1. “Film” means a professional single media, multimedia program
59385938 or feature, which is not child pornography sexual abuse material as
59395939 defined in subsection A of Section 1024.1 of Title 21 of the
59405940 Oklahoma Statutes or obscen e material as defined in paragraph 1 of
59415941 subsection B of Section 1024.1 of Title 21 of the Oklahoma Sta tutes
59425942 including, but not limited to, national advertising messages that
59435943 are broadcast on a national affiliate or cable netwo rk, fixed on
59445944 film or digital video, which can be view ed or reproduced and w hich

59815981 music project for exhibition in theaters, on television or
59825982 elsewhere;
59835983 4. “Total production cost” includes, but is not limited to:
59845984 a. wages or salaries of persons who have earned income
59855985 from working on a film or music p roject in this state ,
59865986 including payments to personal services corporations
59875987 with respect to the services of qualified perform ing
59885988 artists, as determined under Section 62(a)(A) of the
59895989 Internal Revenue Code,
59905990 b. the cost of construction and operations, wardrobe,
59915991 accessories and related services,
59925992 c. the cost of photography, sound synchronization,
59935993 lighting and related services,
59945994 d. the cost of editing and related s ervices,

60266026 6. “Profit” means the amount made by the taxpayer to be
60276027 determined as follows:
60286028 a. the gross revenues less gross expense s, including
60296029 direct production, distribution and marketing costs
60306030 and an allocation of indirect overhead costs, of the
60316031 film or music project s hall be multiplied by,
60326032 b. a ratio, the numerator of which is Oklahoma production
60336033 costs, as defined in paragraph 7 of this subsection,
60346034 and the denominator of which is total production
60356035 costs, as defined in paragra ph 4 of this subsection,
60366036 which shall be multiplie d by,
60376037 c. the percent of the taxpayer ’s taxable income allocated
60386038 to Oklahoma in a taxable year, and
60396039 d. subtract from the result of the formula calculated
60406040 pursuant to subparagraphs a through c of this
60416041 paragraph the profit made by a taxpayer from
60426042 investment in an existing Oklahoma film or music
60436043 project in previous taxable years. Profit shall
60446044 include either a net profit or net loss;

60766076 (1) fifty percent (50%) or more of its employees are
60776077 Oklahoma residents, and
60786078 (2) fifty percent (50%) or more of gross wages, as
60796079 reported on Internal Revenue Service Form W -2 or
60806080 Form 1099, are paid to Oklahoma residents.
60816081 b. For purposes of this paragraph, an employee shall
60826082 include a self-employed individual reporting income
60836083 from a qualified vendor on Internal Revenue Service
60846084 Form 1040.
60856085 c. The Oklahoma Tax Commission shall prescribe forms by
60866086 which an entity may be certified to a production
60876087 company as a qualified vendor for purp oses of this
60886088 section; and
60896089 9. “Investment” means costs associated with the original
60906090 production company. Film or music projects acquired from an
60916091 original production company do not qualify as investment under
60926092 subsection A of this section.
60936093 E. No credit otherwise authorized b y the provisions of this
60946094 section may be claimed for any event, transaction, investment,

61286128 SECTION 43. AMENDATORY 68 O.S. 2021, S ection 3623, is

61306130 Section 3623. As used in the Compete with Canada Film Act :
61316131 1. “Crew” means any person who works on preproduction,
61326132 principal photography, and postproduction, with the except ion of
61336133 producers, principal cast, screenwriters, and the director. The
61346134 qualifying salary of producers, principal cas t, screenwriters, and
61356135 the director, also known as “above-the-line personnel”, may be
61366136 included as crew if the salaries are paid to loan-out corporations
61376137 and limited liability com panies registered to do business i n the
61386138 State of Oklahoma this state or the salaries are paid to Oklah oma-
61396139 based above-the-line personnel. The qualifying salary of above-the-

62886288 seventy-five percent (75%) of the series season is filmed within the
62896289 state or, for an episodic television pilot, if more than seventy-
62906290 five percent (75%) of the pilot is filmed within the state;

63876387 occurring within the state and who is subject to the payment of
63886388 Oklahoma employment taxes;
63896389 9. “Production company” means a person, producer or company who
63906390 produces film for exhib ition in theaters, on television or
63916391 elsewhere;

64746474 2. Filter or block access to child pornography sexual abuse
64756475 material or obscene materials, as defined in Section 1024.1 of Title
64766476 21 of the Oklahoma Statutes, or materials that depict child sexual
64776477 exploitation, as defined in Section 843.5 of Title 21 of the
64786478 Oklahoma Statutes.
64796479 C. Notwithstanding any contract provision to the contrary, if a
64806480 provider of digital or online library resources fails to comply with
64816481 the requirements of subsection B of this section, the school
64826482 district, public charter school, state agency, public library, or
64836483 institution of higher education shall withhold further payments, if
64846484 any, to the provider pending verification of compliance.
64856485 D. If a provider of digital or online library database
64866486 resources fails to timely verify that the provider is in compliance
64876487 with the safety policies and requirements of subsection B of this
64886488 section, the school district, public charter school, state age ncy,
64896489 public library, or institution of higher education shall consider
64906490 the provider’s act of noncompliance a breac h of contract.

65246524 shall not be exempt from prosecution for willful violations of state
65256525 law prohibiting indecent exposure to obscene material or child
65266526 pornography sexual abuse material as provided in Section 1021 of
65276527 Title 21 of the Oklaho ma Statutes.
65286528 G. Nothing in this act section shall be construed in a manner
65296529 that applies to digital or onli ne library database resources off ered
65306530 by institutions of higher education when the primary purpose of the
65316531 resources is for education or research.
65326532 SECTION 46. AMENDATORY 70 O.S. 2021, Section 1210.163,
65336533 is amended to read as fol lows:
65346534 Section 1210.163. A. Every school employee having reason to
65356535 believe that a student under the age of eighteen (18) years is a
65366536 victim of abuse or neglect shall report the matter immediate ly to
65376537 the Department of Human Services a nd local law enforcement. Reports
65386538 to the Department shall be made to the hotline provided for in
65396539 Section 1-2-101 of Title 10A of the Oklahoma Statutes. Any

65766576 otherwise ordered by the court. A school employee with knowledge of
65776577 a report required by subsection A or B of this section shall not
65786578 disclose information identifying the report ing school employee
65796579 unless otherwise order ed by the court or as part of an in vestigation
65806580 by local law enforcement or the Department.
65816581 D. For the purposes of this section, “child abuse and neglect ”
65826582 shall include, but not be limited to:
65836583 1. Child abuse as defined in Section 843 .5 of Title 21 of the
65846584 Oklahoma Statutes;
65856585 2. Sexual abuse or sexual exploitation as defined in Section 1-
65866586 1-105 of Title 10A of the Oklahoma Statutes;
65876587 3. Contributing to the delinquency of a minor as defined in
65886588 Section 856 of Title 21 o f the Oklahoma Statutes;
65896589 4. Trafficking in children, as defined in Section 8 66 of Title

66806680 the primary purpose of inve stigating Internet crimes committed
66816681 against children, including, but not limited t o, offenses related to
66826682 child pornography sexual abuse material and solicitation of minors
66836683 for pornography, prostitution or sex-related offenses. The unit
66846684 shall additionally promote safe Internet u se among children and
66856685 their parents by various media or pr inted-material campaigns or by
66866686 offering educational programs to schools or co mmunities throughout
66876687 this state. The Bureau shall employ suffi cient employees to
66886688 investigate and implement the ICAC unit.
66896689 B. The Director of the Oklahoma State Bureau of Investig ation
66906690 is hereby authorized to enter into local cooperative agr eements with

67226722 Investigation and shall not be em ployees of the Bureau. I CAC
67236723 Affiliate Task Force Agents shall have general peace officer powers

67256725 purpose of investigating Internet crimes committed against child ren
67266726 including, but not limited to, offenses related t o child pornography
67276727 sexual abuse material, solicitation of minors for pornography,
67286728 prostitution or sex-related offenses. ICAC Affiliat e Task Force
67296729 Agents shall promote safe Internet use among child ren and parents of
67306730 children by various media or printed -material campaigns or by
67316731 offering educational programs to sch ools or communities throughout
67326732 Oklahoma. The Director of the Bureau may renew, suspend or revo ke
67336733 any agreement appointing an ICAC Affiliate Tas k Force Agent at any
67346734 time. ICAC Affiliate Task Force Agents serve solely at th e
67356735 discretion and will of the Director of the Oklahoma State Bureau of
67366736 Investigation.
67376737 SECTION 48. This act shall become effective November 1, 2024.
