50	50	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	51	SECTION 1. AMENDATORY 74 O.S. 2021, Section 1308.3, is
52	52	amended to read as follows:
53	53	Section 1308.3. Any active employee eligible to participate or
54	54	who is a participant may opt out of the state ’s basic plan as
55	55	outlined in Sections 1370 and 1371 of this title, or may o pt out of
56	56	the health and dental basic plan options only and retain the life
57	57	and disability plan benefits, provided that the participant is
58	58	currently covered by a separa te group health insurance plan or will
59	59	be covered by a separate group health insurance p lan at or before
60	60	the beginning of the next plan year. Any active employee elig ible
61	61	to participate or who is a participant opting out of coverage
62	62	pursuant to this section shall provi de proof of the separate health

89	89	insurance plan participation and sign an a ffidavit attesting that
90	90	the participant is currently covered and does not require state -
91	91	provided health insurance each plan year. Any Beginning November 1,
92	92	2011, and ending on June 30, 2024, any active employee opting out of
93	93	the state’s basic plan or the health and dental basic plan options
94	94	pursuant to this section shall receive One Hundred Fifty Dollars
95	95	($150.00) in lieu of the flexible benefit amount the employee would
96	96	be otherwise eligible to receive. Beginning July 1, 2024 , any
97	97	active employee opting out of the state’s basic plan or the health
98	98	and dental basic plan optio ns pursuant to this section shall receive
99	99	Five Hundred Dollars ($500.00) monthly in lieu of the flexible
100	100	benefit amount the employee would otherwise be eligible to receive.
101	101	Any savings realized by the state as a result of a participant
102	102	opting out of health insura nce plan coverage shall be retained by
103	103	the state.
104	104	SECTION 2. This act shall become effective July 1, 2024.
105	105	SECTION 3. It being immediately nece ssary for the preservation
106	106	of the public peace, health or safety, an emergency is hereby
107	107	declared to exist, by reason whereof thi s act shall take effec t and
108	108	be in full force from and after its p assage and approval.
