4040 An Act relating to the Oklahoma Employees Insurance
4141 and Benefits Act; amending 74 O.S. 2021, Section
4242 1308.3, which relates to opt-out options; increasing
4343 opt-out amount for certain employees in li eu of

5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. AMENDATORY 74 O.S. 2021, Section 1308.3, is
5252 amended to read as follows:
5353 Section 1308.3. Any active employee eligible to participate or
5454 who is a participant may opt out of the state ’s basic plan as
5555 outlined in Sections 1370 and 1371 of this title, or may o pt out of
5656 the health and dental basic plan options only and retain the life
5757 and disability plan benefits, provided that the participant is
5858 currently covered by a separa te group health insurance plan or will
5959 be covered by a separate group health insurance p lan at or before
6060 the beginning of the next plan year. Any active employee elig ible
6161 to participate or who is a participant opting out of coverage
6262 pursuant to this section shall provi de proof of the separate health

8989 insurance plan participation and sign an a ffidavit attesting that
9090 the participant is currently covered and does not require state -
9191 provided health insurance each plan year. Any Beginning November 1,
9292 2011, and ending on June 30, 2024, any active employee opting out of
9393 the state’s basic plan or the health and dental basic plan options
9494 pursuant to this section shall receive One Hundred Fifty Dollars
9595 ($150.00) in lieu of the flexible benefit amount the employee would
9696 be otherwise eligible to receive. Beginning July 1, 2024 , any
9797 active employee opting out of the state’s basic plan or the health
9898 and dental basic plan optio ns pursuant to this section shall receive
9999 Five Hundred Dollars ($500.00) monthly in lieu of the flexible
100100 benefit amount the employee would otherwise be eligible to receive.
101101 Any savings realized by the state as a result of a participant
102102 opting out of health insura nce plan coverage shall be retained by
103103 the state.
104104 SECTION 2. This act shall become effective July 1, 2024.
105105 SECTION 3. It being immediately nece ssary for the preservation
106106 of the public peace, health or safety, an emergency is hereby
107107 declared to exist, by reason whereof thi s act shall take effec t and
108108 be in full force from and after its p assage and approval.
