27	55		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

29	56		SECTION 1. AMENDATORY 59 O.S. 2021, Section 2053, is
30	57		amended to read as follows:

32	58		Section 2053. A. The re is hereby re-created until July 1, 2024
33	59		July 1, 2027, in accordance with the provisions of the Oklahoma
34	60		Sunset Law, the State Board of Examiners of Perfusionists. The
35	61		Board shall administer the provisions of the Oklahoma Licensed
36	62		Perfusionists Act. Th e Board shall consist of nine (9) members,
37	63		appointed by the State B oard of Medical Licensure and Supervision.

39	64		B. The initial appointments for each mem ber shall be for
40	65		progressive terms of one (1) through three (3) years so that only

41	93		one term expires each calendar year; subsequent appointments shall
42	94		be for five-year terms. Members of the Board shall serve at the
43	95		pleasure of and may be removed from offic e by the appointing
44	96		authority. No member shall serve more than three consecutive terms.
45	97		Members shall continue to serve until their successors are

48	98		appointed. Any vacancy shall be filled in the same manner as the
49	99		original appointments. Five members shal l constitute a quorum.

51	100		C. The Board shall be composed as follows:

53	101		1. Three members shall be members of the general public;
54		-
55	102		2. Four members shall be licensed perfusionists appointed from
56	103		a list of not less than ten licensed perfusionists submitted by a
57	104		statewide organization representing licensed perfusionists; and
58		-
59	105		3. Two members shall be physicians licens ed pursuant to the
60	106		Oklahoma Allopathic Medical and Surgical Licensu re and Supervision
61	107		Act and who are also board certified in cardiovascular surgery.

63	108		D. The licensed perfusionist members shall have been engaged in
64	109		rendering perfusion services to the publi c, teaching perfusion care,
65	110		or research in perfusion care, for at least five (5) years
66	111		immediately preceding their appointments. These members shall a t
67	112		all times be holders of valid licenses for the practice of perfusion
68	113		in this state, except for the memb ers first appointed to the Board.
69	114		These initial members shall, at the time of appointment, be
70	115		credentialed as a Certified Clinical Perfusionist (CCP) conferred by
71	116		the American Board of Cardiovascular Perfusion (ABCP) or its

72	144		successor organization, and all shall fulfill the requirements for
73	145		licensure pursuant to the Oklahoma Licensed Perfusionists Act. All
74	146		members of the Board shall be residents of this state.

76	147		E. Upon expiration or vacancy of the term of a member, the
77	148		respective nominating authority may, as appropriate, submit to the
78	149		appointing authority a list of not le ss than three persons qualified
79	150		to serve on the Board to fill the expired term of th eir respective
80	151		member. Appointments may be made from these lists by the appointing
81	152		authority and additio nal lists may be provided by the respective
82	153		organizations if requested by the appointing authority.

84	154		F. It shall be a ground for removal from the Board if a member:
85		-
86	155		1. Does not have at the time of appointment the qualifications
87	156		required for appointment to the Board;

91	157		2. Does not maintain during service on the Board the
92	158		qualifications required for appointment to the Board;

94	159		3. Violates a prohibition esta blished pursuant to the Oklahoma
95	160		Licensed Perfusionists Act;

97	161		4. Cannot discharge the member ’s term for a substantial part of
98	162		the term for which the member is appointed because of illness or
99	163		disability; or

101	164		5. Is absent from more than half of the regularly scheduled
102	165		board meetings that the member is eligible to attend during a
103	166		calendar year unless the absence is excused by a majority vote of
104	167		the Board.
