2755 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

2956 SECTION 1. AMENDATORY 59 O.S. 2021, Section 2053, is
3057 amended to read as follows:

3258 Section 2053. A. The re is hereby re-created until July 1, 2024
3359 July 1, 2027, in accordance with the provisions of the Oklahoma
3460 Sunset Law, the State Board of Examiners of Perfusionists. The
3561 Board shall administer the provisions of the Oklahoma Licensed
3662 Perfusionists Act. Th e Board shall consist of nine (9) members,
3763 appointed by the State B oard of Medical Licensure and Supervision.

3964 B. The initial appointments for each mem ber shall be for
4065 progressive terms of one (1) through three (3) years so that only

4193 one term expires each calendar year; subsequent appointments shall
4294 be for five-year terms. Members of the Board shall serve at the
4395 pleasure of and may be removed from offic e by the appointing
4496 authority. No member shall serve more than three consecutive terms.
4597 Members shall continue to serve until their successors are

4898 appointed. Any vacancy shall be filled in the same manner as the
4999 original appointments. Five members shal l constitute a quorum.

51100 C. The Board shall be composed as follows:

53101 1. Three members shall be members of the general public;

55102 2. Four members shall be licensed perfusionists appointed from
56103 a list of not less than ten licensed perfusionists submitted by a
57104 statewide organization representing licensed perfusionists; and

59105 3. Two members shall be physicians licens ed pursuant to the
60106 Oklahoma Allopathic Medical and Surgical Licensu re and Supervision
61107 Act and who are also board certified in cardiovascular surgery.

63108 D. The licensed perfusionist members shall have been engaged in
64109 rendering perfusion services to the publi c, teaching perfusion care,
65110 or research in perfusion care, for at least five (5) years
66111 immediately preceding their appointments. These members shall a t
67112 all times be holders of valid licenses for the practice of perfusion
68113 in this state, except for the memb ers first appointed to the Board.
69114 These initial members shall, at the time of appointment, be
70115 credentialed as a Certified Clinical Perfusionist (CCP) conferred by
71116 the American Board of Cardiovascular Perfusion (ABCP) or its

72144 successor organization, and all shall fulfill the requirements for
73145 licensure pursuant to the Oklahoma Licensed Perfusionists Act. All
74146 members of the Board shall be residents of this state.

76147 E. Upon expiration or vacancy of the term of a member, the
77148 respective nominating authority may, as appropriate, submit to the
78149 appointing authority a list of not le ss than three persons qualified
79150 to serve on the Board to fill the expired term of th eir respective
80151 member. Appointments may be made from these lists by the appointing
81152 authority and additio nal lists may be provided by the respective
82153 organizations if requested by the appointing authority.

84154 F. It shall be a ground for removal from the Board if a member:

86155 1. Does not have at the time of appointment the qualifications
87156 required for appointment to the Board;

91157 2. Does not maintain during service on the Board the
92158 qualifications required for appointment to the Board;

94159 3. Violates a prohibition esta blished pursuant to the Oklahoma
95160 Licensed Perfusionists Act;

97161 4. Cannot discharge the member ’s term for a substantial part of
98162 the term for which the member is appointed because of illness or
99163 disability; or

101164 5. Is absent from more than half of the regularly scheduled
102165 board meetings that the member is eligible to attend during a
103166 calendar year unless the absence is excused by a majority vote of
104167 the Board.

106195 SECTION 2. This act shall become effective July 1, 2024.

108196 SECTION 3. It being immediately necessary for the preservation
109197 of the public peace, health or safety, an emergency is he reby
110198 declared to exist, by reason whereof this act shall take effect and
111199 be in full force from and after its passage and approval.
