4040 An Act relating to state parks; prohibiting
4141 occupation of a reserved campsite; prohibiting
4242 certain entries into a state park without payment of
4343 entry fee; setting administrative fine; providing for
4444 collection and deposit of certain fines; amending 74
4545 O.S. 2021, Section 2220 , which relates to collection
4646 of rates and fees of state parks; authorizing the
4747 Oklahoma Tourism and Recreation Commission to
4848 establish entrance fees, day-use fees, or passes for
4949 nonresidents entering state park; establishing
5050 maximum daily fee; providing for proof of residen cy;
5151 removing provision fo r certain age group rates;
5252 providing for codification; an d providing an

5858 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5959 SECTION 1. NEW LAW A n ew section of law to be codified
6060 in the Oklahoma Statutes as Section 2217.2 of Title 74, unless there
6161 is created a duplication in numbering, reads as follows:
6262 A. No person shall:
6363 1. Physically occupy a campsi te identified as “Reserved” by
6464 Oklahoma Tourism and R ecreation Department staff or by the park
6565 reservation system, or fail to vacate a campsite within a reasonable

9292 time after being notified of the campsite’s reserved status by
9393 Department staff; or
9494 2. Enter an area of a state park that requires payment of an
9595 entry fee for the person’s recreational vehicle or travel trailer
9696 without having first paid the entry fee.
9797 B. Any violation of the provisions of t his section may be
9898 punishable by an administrative fine not exceeding:
9999 1. Fifty Dollars ($50.00) for a firs t offense;
100100 2. One Hundred Dollars ($100.00) for a second offense ; and
101101 3. Two Hundred Fifty Dollars ($250.00) for any third or
102102 subsequent offense.
103103 C. All monies collected pursuant to this section shall be
104104 deposited in the Oklahoma Tourism and Recreation Department
105105 Revolving Fund.
106106 SECTION 2. AMENDATORY 74 O.S. 2021, Section 2220, is
107107 amended to read as follows:
108108 Section 2220. A. The Oklahoma Tourism and Recreation
109109 Commission may prescribe and collect reasonable rates and f ees
110110 pursuant to the provisions of this sec tion for the services,
111111 facilities, and commodities rendered by a ll property of the
112112 Commission.
113113 1. The Commission may establish maximum rates for rooms at the
114114 state lodges and cabins, for recreational activities, f or
115115 recreational vehicles and camping sites, and for community

142142 facilities under control of the Commission. The method whereby the
143143 rates are determined shall be pr omulgated pursuant to Article I of
144144 the Administrative Procedures Act. At least twenty (20) da ys prior
145145 to the adoption or approval of an y rate changes by the Commission,
146146 the Oklahoma Tourism and Recreation Department shall submit a copy
147147 of the proposed rates, for informational purposes, to the Governor,
148148 Speaker of the House of Representatives , and President Pro Tempore
149149 of the Senate. Any change in the rates during the year when the
150150 Legislature is not in session shall be report ed in writing to the
151151 Governor, Speaker of the House of Representa tives, and President Pro
152152 Tempore of the Senate within five (5) busi ness days of such
153153 Commission action.
154154 2. The Commission may establish maximum charges for all
155155 activities at state-owned golf courses. The charges may vary among
156156 the different golf courses according to the practices of the golf
157157 industry. The method whereb y the maximum charge s are determined
158158 shall be in accordance with rules promulgated pursuant to Article I
159159 of the Administrative Procedures Act. At least twenty (20) days
160160 prior to the adoption or approval of any rate changes by the
161161 Commission, the Departmen t shall submit a copy of s uch proposed
162162 charges, for informational purposes, to the Governor, Speaker of the
163163 House of Representatives, and President Pro Tempore of the Senate.
164164 3. The Commission may establish entrance or day -use charges for
165165 the state park system for nonresidents not to exceed Sixteen Dollars

192192 ($16.00) per day. All monies collected from entrance or day-use
193193 charges shall be used at the state parks where the charges were
194194 collected. The Commission may establish an annual pass, or other
195195 varied passes as appropriate to that park, for visitors ; provided,
196196 the entrance fee, day-use charge, or annual pass or other passes
197197 established in this paragraph shall not be charged to visitors of
198198 the state park system that are residents of this state. Residency
199199 may be established by presentation of a state driver license, a
200200 state license for identification only, birth certificate , or any
201201 other form of identifica tion authorized by the Commission . The
202202 method whereby the maximum charges are determined, sold, and
203203 collected shall be in accordance with rules promulgated pursuant to
204204 Article I of the Administrati ve Procedures Act. At leas t twenty
205205 (20) days prior to the adoption or approval of any rate changes by
206206 the Commission, the Department shall submit a copy of suc h proposed
207207 charges, for informational purposes, to the Governor, Speaker of the
208208 House of Representatives, and President Pro Tempore of the Senate .
209209 4. Fees shall be promulgated pursuant t o Article I of the
210210 Administrative Procedures Act.
211211 5. Fees may reflect the seasonal usage of the parks and
212212 facilities and for promotional purposes and goals.
213213 B. All fees, licenses, and other charges shall be posted in a
214214 convenient place in each park. Ever y person using any of the

241241 facilities in a park shall be charged the same fees, licenses , and
242242 every other charge except:
243243 1. Residents of this state six ty-two (62) years of age and over
244244 and their spouses shall not be charge d any admission fees for
245245 entrance into any state-owned and -operated park. The Commission
246246 may promulgate rules establishing different fees for residents and
247247 nonresidents sixty-two (62) years of age and over. Identification
248248 may be established by presentation of proof of age, residency, a
249249 state driver license, a state license for identification only, birth
250250 certificate, or any other form of identification author ized by the
251251 Commission;
252252 2. Individuals Nonresidents who have been certified as totally
253253 disabled under state or federal law and their s pouses shall be
254254 entitled to a fifty percent (50%) reduction of fees which apply to
255255 recreational-use facilities;
256256 3. Children’s Nonresident children’s groups, volunteer groups
257257 as specified by the Commission, or governmental entities that
258258 provide beneficial services at the facility for which the fee may be
259259 reduced or waived; and
260260 4. Special discount rates as authorized in this section may be
261261 waived for individuals nonresidents who are members of a group being
262262 provided a special group rate as allowed by law.

289289 C. The failure to collect such fees, licenses , and other
290290 charges shall subject an employee of the Commission to a fine of
291291 Twenty-five Dollars ($25.00) for each and every violation.
292292 SECTION 3. This act shall become effective November 1, 202 4.
