40	40	An Act relating to sexual extortion; amending 21 O.S.
41	41	2021, Section 1488, which relates to blackmail;
42	42	creating the offense of sexual extortion;
43	43	establishing elements of offense; creating felony
44	44	offense; establishing punishment ; updating statutory

50	50	BE IT ENACTED BY THE PEOPLE OF THE ST ATE OF OKLAHOMA:
51	51	SECTION 1. AMENDATORY 21 O.S. 2021, Section 1488, is
52	52	amended to read as follows:
53	53	Section 1488. A. Blackmail is verbally or by written or
54	54	printed communication and with intent to extort or gain any thing of
55	55	value from another or to compel another to do an act a gainst his or
56	56	her will:
57	57	1. Accusing or threatening to accuse any perso n of a crime or
58	58	conduct which would tend to degrade and disgrace the person accused;
59	59	2. Exposing or threatening to expose any fact, rep ort or
60	60	information concerning any person which wo uld in any way subject
61	61	such person to the ridicule or contempt of socie ty; or

88	88	3. Threatening to report a person as being illegally present in
89	89	the United States, a nd is coupled with the threat that such
90	90	accusation or exposure will be communicated to a thir d person or
91	91	persons unless the person threatened or some other person p ays or
92	92	delivers to the accuser or some other person some thing of value or
93	93	does some act against his or her will.
94	94	B. Blackmail is a felony punishable by imprisonment in the
95	95	State Penitentiary for custody of the Department of Corrections not
96	96	to exceed five (5) yea rs or fine not to exceed Ten Thousan d Dollars
97	97	($10,000.00) or by both such imprisonm ent and fine.
98	98	C. Sexual extortion is verbally or by written or printed
99	99	communication and wit h intent to cause a person to engage in any
100	100	sort of sexual activity or to injure the body or reputation of the
101	101	person:
102	102	1. Threatening to disseminate, sell, or p ublish a video or
103	103	still image created by any means; or
104	104	2. Refusing to delete, remove, or resci nd a previously
105	105	disseminated, sold, or published video or still image created by any
106	106	means,
107	107	that depicts the person threatened or household member of the person
108	108	threatened as defined in Section 60.1 of Title 22 of the Oklahoma
109	109	Statutes as nude or in a state of undress so as to expose the
110	110	genitals, pubic area, buttocks, or breast .

137	137	D. 1. Sexual extortion committed against a person under the
138	138	age of eighteen (18) shall upon conviction be a felony punishable by
139	139	imprisonment in the custody of the Department of Corrections for not
140	140	less than one (1) year nor more than twenty (20) years , by a fine
141	141	not to exceed One Hundred T housand Dollars ($100,000.00), or by both
142	142	such imprisonment and fine.
143	143	2. Sexual extortion committed against a person eighteen (18)
144	144	years of age or older shall upon convict ion be a felony punishable
145	145	by imprisonment in the custody of the Department of Corrections not
146	146	to exceed five (5) years, by a fine not to exceed Ten Thousand
147	147	Dollars ($10,000.00), or by both such imprisonment and fine.
148	148	SECTION 2. This act shall become effective November 1, 2024.
