4242 creating the offense of sexual extortion;
4343 establishing elements of offense; creating felony

5050 BE IT ENACTED BY THE PEOPLE OF THE ST ATE OF OKLAHOMA:
5151 SECTION 1. AMENDATORY 21 O.S. 2021, Section 1488, is
5252 amended to read as follows:
5353 Section 1488. A. Blackmail is verbally or by written or
5454 printed communication and with intent to extort or gain any thing of
5555 value from another or to compel another to do an act a gainst his or
5656 her will:
5757 1. Accusing or threatening to accuse any perso n of a crime or
5858 conduct which would tend to degrade and disgrace the person accused;
5959 2. Exposing or threatening to expose any fact, rep ort or
6060 information concerning any person which wo uld in any way subject
6161 such person to the ridicule or contempt of socie ty; or

8888 3. Threatening to report a person as being illegally present in
8989 the United States, a nd is coupled with the threat that such
9090 accusation or exposure will be communicated to a thir d person or
9191 persons unless the person threatened or some other person p ays or
9292 delivers to the accuser or some other person some thing of value or
9393 does some act against his or her will.
9494 B. Blackmail is a felony punishable by imprisonment in the
9595 State Penitentiary for custody of the Department of Corrections not
9696 to exceed five (5) yea rs or fine not to exceed Ten Thousan d Dollars
9797 ($10,000.00) or by both such imprisonm ent and fine.
9898 C. Sexual extortion is verbally or by written or printed
9999 communication and wit h intent to cause a person to engage in any
100100 sort of sexual activity or to injure the body or reputation of the
101101 person:
102102 1. Threatening to disseminate, sell, or p ublish a video or
103103 still image created by any means; or
104104 2. Refusing to delete, remove, or resci nd a previously
105105 disseminated, sold, or published video or still image created by any
106106 means,
107107 that depicts the person threatened or household member of the person
108108 threatened as defined in Section 60.1 of Title 22 of the Oklahoma
109109 Statutes as nude or in a state of undress so as to expose the
110110 genitals, pubic area, buttocks, or breast .

137137 D. 1. Sexual extortion committed against a person under the
138138 age of eighteen (18) shall upon conviction be a felony punishable by
139139 imprisonment in the custody of the Department of Corrections for not
140140 less than one (1) year nor more than twenty (20) years , by a fine
141141 not to exceed One Hundred T housand Dollars ($100,000.00), or by both
142142 such imprisonment and fine.
143143 2. Sexual extortion committed against a person eighteen (18)
144144 years of age or older shall upon convict ion be a felony punishable
145145 by imprisonment in the custody of the Department of Corrections not
146146 to exceed five (5) years, by a fine not to exceed Ten Thousand
147147 Dollars ($10,000.00), or by both such imprisonment and fine.
148148 SECTION 2. This act shall become effective November 1, 2024.
