43	43	of new hospital; creating the Rural Hospital
44	44	Replacement Revolving Fund; specifying type of fund
45	45	and source of monies; providing for expenditure of
46	46	funds; authorizing promulgation of rules; prov iding
47	47	for codification; provid ing an effective date; and

52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. NEW LAW A new section of l aw to be codified
54	54	in the Oklahoma Statutes as Section 3241.21 of Title 63, unless
55	55	there is created a duplication in numbering, reads as follows:
56	56	A. As used in this section, “qualifying rural hospital ” means a
57	57	hospital that is:
58	58	1. Licensed by the State Department of Health;
59	59	2. Located in a county of this state that has:
60	60	a. a population of not greater than fifty thousand
61	61	(50,000) as reported in the most recent Federal
62	62	Decennial Census published by the United State Census
63	63	Bureau, and

90	90	b. a poverty rate of not less than nineteen percent (19%)
91	91	as reported in the most recent Federal Decennial
92	92	Census published by the United State Census Bureau;
93	93	and
94	94	3. Is in a hazardous, unsafe, or derelict condition such that
95	95	renovation would be significantly more costly than demolition and
96	96	construction of a new hospital.
97	97	B. There is hereby created the Rural Hospital Replacement Grant
98	98	Program. The grant program shall be administered by the State
99	99	Department of Health for the purpose of providing fu nding to support
100	100	the construction of new hospitals to replace qualifying ru ral
101	101	hospitals.
102	102	C. The Rural Hospital Replacement Grant Program shall be
103	103	available to qualifying rural hospitals. The Department shall
104	104	develop an application process and a scoring criter ia for evaluating
105	105	applicants. Awardees shall be selected based upon the severity of
106	106	the qualifying rural hospital’s condition, availability of matching
107	107	funds for the project, and such other criteria as may be established
108	108	by the Department.
109	109	D. The governing entity of a qualifying rural hospital that
110	110	receives a grant under this section may only use grant funds fo r
111	111	costs directly related to demolition and constru ction of a new
112	112	hospital. The governing entity shall locate the new hosp ital as
113	113	close as possible to the qualifying rural hospital. In no event

140	140	shall the new hospital be located more than twenty (20) miles away
141	141	from the qualifying rural h ospital.
142	142	E. There is hereby created in the State Treasury a revolving
143	143	fund for the State Department of Health to be designated the “Rural
144	144	Hospital Replacement Revolving Fund ”. The fund shall be a
145	145	continuing fund, not subject to fiscal year limitations, and shall
146	146	consist of all monies received by the Department from legislative
147	147	appropriations provided for the purpose of administering grants
148	148	under this section. All monies accruing to the credit of the fund
149	149	are hereby appropriated and may be budgeted and expended by the
150	150	Department for the purpose provided for in this subsection.
151	151	Expenditures from the fund shall be made upon warrants issued by the
152	152	State Treasurer against claims filed as prescribed by law with the
153	153	Director of the Office of Management and Enterprise Services for
154	154	approval and payment.
155	155	F. The State Commissioner of Health may promul gate rules as
156	156	necessary to implement this section.
157	157	SECTION 2. This act shall become effective July 1, 2024.
158	158	SECTION 3. It being immediately necessary for the preservation
159	159	of the public peace, health or safety, an emergency is hereby
160	160	declared to exist, by reason whereof th is act shall take effect and
161	161	be in full force from and after its passage and approval.
