43	40		An Act relating to state parks; amending 74 O.S.
44	41		2021, Section 2212, which relates to powers, rights,
45	42		and privileges of Oklahoma Tourism and Recreation
46	43		Commission; providing for legislative approval for
47	44		certain property decision; updating statutory

53	50		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
54	51		SECTION 1. AMENDATORY 74 O.S. 2021, Section 2212, is
55	52		amended to read as follows:
56	53		Section 2212. A. The Oklahoma Tourism and Recreation
57	54		Commission shall have the authority to exercis e the following
58	55		powers, rights, and privileges related to state parks:
59	56		1. Have the exclusive possession and control of, and t o operate
60	57		and maintain for the benefit of the people of the State of Oklahoma
61	58		this state, all state parks and all lands and other properties no w
62	59		or hereafter owned or leased by the state or Commission for park o r
63	60		recreational purposes;
	61	+	2. Acquire Except as provided in subsection B of this section,
	62	+	acquire by purchase, exchange, lease, gif t, condemnation, or in any

91		-	2. Acquire Except as provided in subsection B of this section,
92		-	acquire by purchase, exchange, lease, gif t, condemnation, or in any
93	89		other manner and to maintain, u se, and operate any and all property,
94	90		real, personal, or mixed, necessary or convenient to the exercise of
95	91		the powers, rights, privileges, and functions conferred upon it by
96	92		the Oklahoma Tourism, Parks and Recrea tion Enhancement Act . Title
97	93		to all such property shall be vested in the State of Oklahoma this
98	94		state, although such property is sometimes herein referred to as
99	95		property “of the Commission”. The power of condemnation herein
100	96		granted shall be exe rcised in the manner p rovided by the general
101	97		laws of the state for th e condemnation of property by the state;
102	98		3. Subject to the provisions of the Oklahoma Tourism, Parks and
103	99		Recreation Enhancement Act, from time to time lease, without
104	100		restriction as to term, any property which the Commission shall
105	101		determine to be necessary or convenient to more full y carry into
106	102		effect the duties and powers of said the Commission; and
107	103		4. Acquire, conserve, prot ect, construct, extend, reduce,
108	104		improve, maintain, and operate any and all facilities of a ll kinds
109	105		which in the judgment of the Commissio n will provide recreational or
110	106		other facilities for the benefit of the public, or which are
111	107		necessary or convenient to the exercise of the powers of t he
112	108		Commission.
113	109		B. In the event the Commission elects to terminate or cancel or
114	110		elects not to renew a lease for real property upon which a state
	111	+	park is located or takes action resulting in the loss or chan ge of
	112	+	ownership of a state park, which causes the removal of the

146	141		SECTION 2. This act shall become effective November 1, 202 4.
