5350 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5451 SECTION 1. AMENDATORY 74 O.S. 2021, Section 2212, is
5552 amended to read as follows:
5653 Section 2212. A. The Oklahoma Tourism and Recreation
5754 Commission shall have the authority to exercis e the following
5855 powers, rights, and privileges related to state parks:
5956 1. Have the exclusive possession and control of, and t o operate
6057 and maintain for the benefit of the people of the State of Oklahoma
6158 this state, all state parks and all lands and other properties no w
6259 or hereafter owned or leased by the state or Commission for park o r
6360 recreational purposes;

91-2. Acquire Except as provided in subsection B of this section,
92-acquire by purchase, exchange, lease, gif t, condemnation, or in any
9389 other manner and to maintain, u se, and operate any and all property,
9490 real, personal, or mixed, necessary or convenient to the exercise of
9591 the powers, rights, privileges, and functions conferred upon it by
9692 the Oklahoma Tourism, Parks and Recrea tion Enhancement Act . Title
9793 to all such property shall be vested in the State of Oklahoma this
9894 state, although such property is sometimes herein referred to as
9995 property “of the Commission”. The power of condemnation herein
10096 granted shall be exe rcised in the manner p rovided by the general
10197 laws of the state for th e condemnation of property by the state;
10298 3. Subject to the provisions of the Oklahoma Tourism, Parks and
10399 Recreation Enhancement Act, from time to time lease, without
104100 restriction as to term, any property which the Commission shall
105101 determine to be necessary or convenient to more full y carry into
106102 effect the duties and powers of said the Commission; and
107103 4. Acquire, conserve, prot ect, construct, extend, reduce,
108104 improve, maintain, and operate any and all facilities of a ll kinds
109105 which in the judgment of the Commissio n will provide recreational or
110106 other facilities for the benefit of the public, or which are
111107 necessary or convenient to the exercise of the powers of t he
112108 Commission.
113109 B. In the event the Commission elects to terminate or cancel or
114110 elects not to renew a lease for real property upon which a state
111+park is located or takes action resulting in the loss or chan ge of
112+ownership of a state park, which causes the removal of the

142-park is located or takes action resulting in the loss or chan ge of

144139 property’s status as a state park, the termination, nonrenewal , or
145140 action shall not occur without the approval of the Legislature.
146141 SECTION 2. This act shall become effective November 1, 202 4.
