4752 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4853 SECTION 1. NEW LAW A n ew section of law to be codified
4954 in the Oklahoma Statutes as Section 2607. 2 of Title 63, unless there
5055 is created a duplication in numbering, reads as follows:
5156 A. As used in this section:
5257 1. a. “Gender transition procedure s” means any medical or
5358 surgical treatment including but not limited to
5459 physician’s services, inpatient and outpatient
5560 hospital services, or pr escribed drugs related to
5661 gender transition that seeks to:
57-(1) alter or remove physical or anatomical
58-characteristics or features that are typical for
59-the individual’s biological sex, or
60-(2) instill or create physiological or anatomical
61-characteristics that resemble a sex different

88+(1) alter or remove physical or anatomical
89+characteristics or features that are typical for
90+the individual’s biological sex, or
91+(2) instill or create physiological or anatomical
92+characteristics that resemble a sex different
8993 from the individual’s biological sex, including
9094 but not limited to medical services th at provide
9195 puberty-blocking drugs, cross-sex hormones, or
9296 other mechanisms to promote the development of
9397 feminizing or masculinizing features i n the
9498 opposite biological sex, or genital or nongenital
9599 gender reassignment surg ery performed for the
96100 purpose of assisting an individual with a gender
97101 transition.
98102 b. Gender transition procedures do not include :
99103 (1) behavioral health care services or mental health
100104 counseling,
101105 (2) medications to treat depression and anxiety,
102106 (3) medications prescribed, dispensed, o r
103107 administered specifically for the purpose of
104108 treating precocious puberty or delayed puberty in
105109 that patient,
106110 (4) services provided to individua ls born with
107111 ambiguous genitalia, incomplete genitalia, or
108-both male and female anatomy, or biochemically
109-verifiable disorder of sex development (DSD),
110-including but not limited to:
111-(a) 46,XX DSD,
112-(b) 46,XY DSD,

138+both male and female anatomy, or biochemically
139+verifiable disorder of sex development (DSD),
140+including but not limited to:
141+(a) 46,XX DSD,
142+(b) 46,XY DSD,
140143 (c) sex chromosomes DSDs,
141144 (d) XX or XY sex reversal, and
142145 (e) ovotesticular disorder, or
143146 (5) the treatment of any infection, in jury, disease,
144147 or disorder that has been caused by or
145148 exacerbated by the performance of gender
146149 transition procedures, whether or not the gender
147150 transition procedure was performed in acc ordance
148151 with state and federal law ;
149152 2. “Health care provider” means a physician, physician
150153 assistant, Advanced Practice Registered Nurse, or any other person
151154 who is licensed, certified, or otherwise authorized by the laws of
152155 this state to administer health care in the ordin ary course of the
153156 practice of his or her profession; and
154157 3. “Public funds” means state funds from any source including
155158 but not limited to appropriations, apportionments, or revenue
156159 generated by state agencies through fines , fees, or any other means.
157160 B. Public funds shall not be directly or indirectly used,
158161 granted, paid, or distributed to any entity, organization, health
159-care provider, or individual that prov ides or refers for gender
160-transition procedures.
161-C. Gender transition procedure s shall not be provided or
162-referred for in the following situations :

190+C. Gender transition procedures shall not be provided or
191+referred for in the following situations :
190192 1. By or in a health care facility owned b y the state or a
191193 county or local government; or
192194 2. By a health care provider employed by the state or a county
193195 or local government.
194196 SECTION 2. This act shall become effective July 1, 2023.
195197 SECTION 3. It being immediately necessary for the preserv ation
196198 of the public peace, health or safety, an emergency is hereby
197199 declared to exist, by reason whereof this act shall take effect and
198200 be in full force from and after its passage and approval.
