42	68		SECTION 1. AMENDATORY 70 O.S. 2021, Section 2603, is

45	70		Section 2603. A. Except as otherwise provided for in
46	71		subsection B of this section and elsewhere in this section, to be

49	99		eligible to participate in the Oklahom a Higher Learning Access
50	100		Program and to qualify for an award which includes payment of an
51	101		amount equivalent to resident tuition or other tuition pursua nt to
52	102		Section 2604 of this title for the first semester or other academic
53	103		unit of postsecondary enrollmen t, a student shall:
54		-
55	104		1. Be a resident of this state or be enrolled in a school
56	105		district located in this state that serves students who reside in
57	106		both this state and an adjacent state pursuant to a contract as
58	107		authorized in Section 5 -117.1 of this title;
59		-
60	108		2. Be a United States citizen or lawfully present in the United
61	109		States. A student who is not a United States citizen or lawfully
62	110		present in the United States shall not be eligible to part icipate in
63	111		the Oklahoma Higher Learning Access Program and to qualify for an
64	112		award notwithstanding the provisions of Section 3242 of this title.
65	113		The provisions of this paragraph shall not apply to any student who
66	114		was enrolled in the Oklahoma Higher Learning Access Program prior to
67	115		the end of the 2006-2007 school year;
68		-
69	116		3. Have a record of satisfactory compliance with agreements
70	117		executed pursuant to Section 2605 of this title;
71		-
72	118		4. a. have graduated within the previous thre e (3) years
73	119		from a high school accre dited by the State Board of
74	120		Education, or the Oklahoma School of Scie nce and
75	121		Mathematics with a minimum 2.5 cumulative grade point

94	162		5. Have completed the curricular requirements for admission to
95	163		an institution within The Oklahoma State System of Higher Education
96	164		and one additional unit or set of competencies in a course that
97	165		meets college admission requirements. Th e curriculum requirements
98	166		shall include two units or sets of competencies in foreign or non -
99	167		English language or technology courses that meet the college
100	168		admission requirements and one unit or set of competencies of a fine
101	169		arts course. Students shall also have attained a 2.5 grade point
102	170		average in the core curriculum courses. Students who attended a
103	171		high school which did not offer all the core curriculum courses or
104	172		students who were educated by other means and were not offered all

107	202		Oklahoma State Regents for Higher Education for remediation of high

110	204		6. Have satisfied admission standards as determine d by the
111	205		Oklahoma State Regents for Higher Education for first -time-entering
112	206		students for the appropriate type of institution, or, if attending a
113	207		private institution, have satisfied admission standards as
114	208		determined by the private institution. No student participating in
115	209		the Oklahoma Higher Learning Access Program shall be admitted into
116	210		an institution of hig her education by special admission standards;

118	211		7. Have secured admission to, and enrolled in, an institution
119	212		which is a member of The Oklahoma State Sy stem of Higher Education,

158	272		eighth, ninth, tenth, or eleventh grades and enrolls

166	306		B. 1. A student shall be eligible to participate in the
167	307		Oklahoma Higher Learning Access Program and to qua lify for an award
168	308		which includes payment of an amount equivalent to resident tuition
169	309		or other tuition pursuant to Section 2604 of this title for the
170	310		first semester or other academic unit of postsecondary enrollment if
171	311		the student meets all of the following criteria:
172		-
173	312		a. is a child of any person killed after January 1, 2000,
174	313		in the line of duty in any branch of the United States
175	314		Armed Forces or who died af ter January 1, 2000, as a
176	315		result of an injury sustained while in the line of
177	316		duty in any branch of the Un ited States Armed Forces
178	317		and the person who was killed or died filed an
179		-

181	318		individual or joint Oklahoma income tax return for the
182	319		tax year prior to the ye ar during which the person was
183	320		killed or died,

185	321		b. is a resident of this state or is enrolled in a school
186	322		district located in this state that serves students
187	323		who reside in both this state and an adjacent state
188	324		pursuant to a contract as authorized in Section 5-
189	325		117.1 of this title,

196	357		Oklahoma State Regents for Higher Education fo r first-
197	358		time-entering students for t he appropriate type of
198	359		institution, or, if attending a private instit ution,
199	360		has satisfied admission standards as determined by the
200	361		private institution. No student participating in the
201	362		Oklahoma Higher Learning Access Pro gram shall be
202	363		admitted into an institution of higher education by

218	403		2. A student who is e ligible to participate in the program
219	404		pursuant to this subsection shall not be required to meet the
220	405		eligibility requirements set forth in subsection A of this section.

224	406		C. To retain eligibility while pursuing the program of higher
225	407		learning in which enrolle d, the student shall:
226		-
227	408		1. Meet the requirements for retention and degree completion as
228	409		established by the institution in which the student is enrolled;
229		-
230	410		2. Maintain good academic standing and satisfactory academic
231	411		progress according to standards of the Okl ahoma State Regents for
232	412		Higher Education;
233		-
234	413		3. Maintain satisfactory academic progress as required for
235	414		eligibility for federal Title IV student financia l aid programs.
236	415		The provisions of this paragraph shall become effective for the
237	416		2012-2013 school year;
238		-
239	417		4. Comply with the standards related to maintenance of
240	418		eligibility as promulgated by the Oklahoma State Regents for Higher
241	419		Education; and
242		-
243	420		5. Refrain from conduct that leads to expulsion or suspension
244	421		of more than one semester from an institution of higher education.
245	422		A student who violates the provisions of this paragraph shall
246	423		permanently lose eligibility for program benefits. The provisions
247	424		of this paragraph shall become effective Janu ary 1, 2008.

249	425		D. The Oklahoma State Regents for Higher Education and the
250	426		State Board of Career and Technology Education shall promulgate

254	456		E. It is the intent of the Legislature that students in the
255	457		ninth grade for the 19 92-93 school year who are determined to be
256	458		eligible Oklahoma Higher Learning Access students pursuant to the
257	459		Oklahoma Higher Learning Access Act shall be the first students
258	460		eligible for benefits from the Oklahoma Higher Learning Access Trust
259	461		Fund.

261	462		F. The Oklahoma State Regents for Higher Education are
262	463		authorized to study, develop , and propose criteria for determining
263	464		award eligibility based upon the com pletion of seven semesters of
264	465		high school coursework by a student.

268	466		SECTION 2. AMENDATORY 70 O.S. 2021, Section 2605, as
269	467		amended by Section 1, Chapter 400, O.S.L. 2022 (70 O.S. Supp. 2023,
270	468		Section 2605), is amended to read as follo ws:

272	469		Section 2605. A. Each school y ear, every fifth- through
273	470		eleventh-grade student in the public and pr ivate schools of this
274	471		state and students who are educated by other means and are in the
275	472		equivalent of the fifth through eleventh grade shall be apprise d,
276	473		together with the parent, custodial parent, or guardian of the
277	474		student, of the opportunity for access to higher learning under the
278	475		Oklahoma Higher Learning Access Program. The Oklahoma State Regents
279	476		for Higher Education and the State Board of Education shall develop,
280	477		promote, and coordin ate a public awareness program to be utilized in

284	507		B. On a form provided by the Oklahoma State Regents for Higher
285	508		Education, every public s chool district shall designate at least one
286	509		Oklahoma Higher Learning Access Program contact person, who s hall be
287	510		a counselor or teacher, at each public school site in this state in
288	511		which eighth-, ninth-, tenth-, or eleventh-grade classes are taught.
289	512		When requested by the State Regents, the State Board of Education
290	513		shall assist the State Regents to ensure the designation of contact
291	514		persons. Private schools shall also designate at least one school
292	515		official as a contact person. For students who are educated by
293	516		other means, a parent or guardian or other person approved by the
294	517		State Regents shall be designated t he contact person.

296	518		C. 1. Students who qualify on the basis of financial need
297	519		according to subsection D or E of this section or who meet the
298	520		eligibility qualification set forth in subpar agraph a of paragraph 1
299	521		of subsection B of Section 2603 of this title prior to entering the
300	522		eleventh grade or prior to reaching the age of sixteen (16) and the
301	523		standards and provisions promulgated by the Oklahoma State R egents
302	524		for Higher Education shall be given the opportunity throughout the
303	525		eighth-, ninth-, tenth-, and eleventh-grade years, for students
304	526		enrolled in a public or private school, or between the ages of
305	527		thirteen (13) and sixteen (16), for students who are ed ucated by
306	528		other means, to enter into participation in the program by agreeing

317	561		c. refrain from commission of crimes or delinquent acts,

319	562		d. have school work and school records reviewed by
320	563		mentors designated pursuant to the program,

322	564		e. provide information requested by the Oklahoma State
323	565		Regents for Higher Education or the Sta te Board of
324	566		Education, and
325		-
326	567		f. participate in program activities.

328	568		2. Students who meet the eligibility qu alification set forth in
329	569		subparagraph a of paragraph 1 of subsection B of Section 2603 of
330	570		this title after completing the eleventh grade or after reach ing the
331	571		age of seventeen (17) shall be given the opportunity prior to
332	572		reaching the age of twenty -one (21) to enter into participation in
333	573		the program and shall execute an agreement with provisions as
334	574		determined by the Oklahoma State Regents for Higher Educa tion.

336	575		3. The contact person shall m aintain the agreements, which
337	576		shall be executed on forms provided by the Oklahoma State Regents
338	577		for Higher Education and managed according to regulations
339	578		promulgated by the Oklahoma State Regents for Higher Education, an d
340	579		the contact person shall monitor compliance of the student with the

348	613		section and except for students who qualify pursuant to subsection B
349	614		of Section 2603 of this title, a student shall not be found to be in
350	615		financial need for purposes of the Oklahoma Higher Learning Access
351	616		Program if:

355	617		1. At the time the student applies for participation in the
356	618		program during the eighth, ninth, or tenth grade for students
357	619		enrolled in a public or private sch ool, or between the ages of
358	620		thirteen (13) and fifteen (15), for stude nts who are educated by
359	621		other means, the income from taxable and nontaxable sources of the
360	622		student’s parent(s) exceeds Fifty Thousand Dollars ($50,000. 00) per
361	623		year;
362		-
363	624		2. Beginning with eighth -, ninth-, or tenth-grade students who
364	625		are enrolled in a public or private school or students between the
365	626		ages of thirteen (13) and fifteen (15) who are educated by other
366	627		means who apply for participation in the progr am in the 2017-2018
367	628		school year, the federal adjusted gross income of the student ’s
368	629		parent(s) exceeds Fif ty-five Thousand Dollars ($55,000.00) per year;

452	777		subsection, the student shall be determined to have met the

476	826		Welfare Act, shall not be found to be in financial need for purposes
477	827		of the Oklahoma Higher Learning Access Program if at the time the

496	869		4. Except for students who qu alify pursuant to subsection B of
497	870		Section 2603 of this title, the det ermination of financial
498	871		qualification as set forth in this subsection shall be based on the
499	872		income of the student, not the income of the parent(s), if the
500	873		student is determined to be independent of the student ’s parent(s)
501	874		for federal financial aid purposes . A determination of financial
502	875		qualification shall not be required for the student who meets the
503	876		criteria set forth in this subsection at the time the student
504	877		applies for participation i n the program. The provisions of this

537	928		this state that serves students who reside in both this state and an
538	929		adjacent state pursuant to a contract as authorized in Section 5 -
539	930		117.1 of this title, are in the eleventh and twelfth grades during
540	931		the 2006-2007 school year, and who were denied participation in the
541	932		program shall be allow ed to enter or reenter into participation in
542	933		the program by entering into agreements as set forth in subsections
543	934		C and D of this section by June 1, 200 8.

557	972		K. J. The school district where an Oklahoma Higher Learning
558	973		Access Program student is enrolled when the student begins
559	974		participation in the program and any subsequent sc hool district
560	975		where the student enro lls shall forward information regarding
561	976		participation by the student in the program to a school to which the
562	977		student transfers upon the request of the school for the records of
563	978		the student.

565	979		L. K. Students participating in the Oklahoma Higher Learning
566	980		Access Program shall provide their Social Security number or their
567	981		student identification number used by their school to the Oklahoma
568	982		State Regents for Higher Education. The Regents shall keep the
569	983		numbers confidential and u se them only for administrative purp oses.

571	984		SECTION 3. This act shall become effective Jul y 1, 2024.
