4999 eligible to participate in the Oklahom a Higher Learning Access
50100 Program and to qualify for an award which includes payment of an
51101 amount equivalent to resident tuition or other tuition pursua nt to
52102 Section 2604 of this title for the first semester or other academic
53103 unit of postsecondary enrollmen t, a student shall:

55104 1. Be a resident of this state or be enrolled in a school
56105 district located in this state that serves students who reside in
57106 both this state and an adjacent state pursuant to a contract as
58107 authorized in Section 5 -117.1 of this title;

60108 2. Be a United States citizen or lawfully present in the United
61109 States. A student who is not a United States citizen or lawfully
62110 present in the United States shall not be eligible to part icipate in
63111 the Oklahoma Higher Learning Access Program and to qualify for an
64112 award notwithstanding the provisions of Section 3242 of this title.
65113 The provisions of this paragraph shall not apply to any student who
66114 was enrolled in the Oklahoma Higher Learning Access Program prior to
67115 the end of the 2006-2007 school year;

69116 3. Have a record of satisfactory compliance with agreements
70117 executed pursuant to Section 2605 of this title;

98166 shall include two units or sets of competencies in foreign or non -
99167 English language or technology courses that meet the college
100168 admission requirements and one unit or set of competencies of a fine
101169 arts course. Students shall also have attained a 2.5 grade point
102170 average in the core curriculum courses. Students who attended a
103171 high school which did not offer all the core curriculum courses or
104172 students who were educated by other means and were not offered all

105200 the core curriculum cours es shall be allowed to satisfy this
106201 curriculum requirement by participating in a program approved by the
107202 Oklahoma State Regents for Higher Education for remediation of high
108203 school curricular deficiencies;

110204 6. Have satisfied admission standards as determine d by the
111205 Oklahoma State Regents for Higher Education for first -time-entering
112206 students for the appropriate type of institution, or, if attending a
113207 private institution, have satisfied admission standards as
114208 determined by the private institution. No student participating in
115209 the Oklahoma Higher Learning Access Program shall be admitted into
116210 an institution of hig her education by special admission standards;

166306 B. 1. A student shall be eligible to participate in the
167307 Oklahoma Higher Learning Access Program and to qua lify for an award
168308 which includes payment of an amount equivalent to resident tuition
169309 or other tuition pursuant to Section 2604 of this title for the
170310 first semester or other academic unit of postsecondary enrollment if
171311 the student meets all of the following criteria:

173312 a. is a child of any person killed after January 1, 2000,
174313 in the line of duty in any branch of the United States
175314 Armed Forces or who died af ter January 1, 2000, as a
176315 result of an injury sustained while in the line of
177316 duty in any branch of the Un ited States Armed Forces
178317 and the person who was killed or died filed an

181318 individual or joint Oklahoma income tax return for the
182319 tax year prior to the ye ar during which the person was

218403 2. A student who is e ligible to participate in the program
219404 pursuant to this subsection shall not be required to meet the
220405 eligibility requirements set forth in subsection A of this section.

224406 C. To retain eligibility while pursuing the program of higher
225407 learning in which enrolle d, the student shall:

227408 1. Meet the requirements for retention and degree completion as
228409 established by the institution in which the student is enrolled;

230410 2. Maintain good academic standing and satisfactory academic
231411 progress according to standards of the Okl ahoma State Regents for
232412 Higher Education;
233-
234413 3. Maintain satisfactory academic progress as required for
235414 eligibility for federal Title IV student financia l aid programs.
236415 The provisions of this paragraph shall become effective for the
237416 2012-2013 school year;
238-
239417 4. Comply with the standards related to maintenance of
240418 eligibility as promulgated by the Oklahoma State Regents for Higher
241419 Education; and
242-
243420 5. Refrain from conduct that leads to expulsion or suspension
244421 of more than one semester from an institution of higher education.
245422 A student who violates the provisions of this paragraph shall
246423 permanently lose eligibility for program benefits. The provisions
247424 of this paragraph shall become effective Janu ary 1, 2008.

249425 D. The Oklahoma State Regents for Higher Education and the
250426 State Board of Career and Technology Education shall promulgate

254456 E. It is the intent of the Legislature that students in the
255457 ninth grade for the 19 92-93 school year who are determined to be
256458 eligible Oklahoma Higher Learning Access students pursuant to the
257459 Oklahoma Higher Learning Access Act shall be the first students
258460 eligible for benefits from the Oklahoma Higher Learning Access Trust
259461 Fund.

261462 F. The Oklahoma State Regents for Higher Education are
262463 authorized to study, develop , and propose criteria for determining
263464 award eligibility based upon the com pletion of seven semesters of
264465 high school coursework by a student.

268466 SECTION 2. AMENDATORY 70 O.S. 2021, Section 2605, as
269467 amended by Section 1, Chapter 400, O.S.L. 2022 (70 O.S. Supp. 2023,
270468 Section 2605), is amended to read as follo ws:

272469 Section 2605. A. Each school y ear, every fifth- through
273470 eleventh-grade student in the public and pr ivate schools of this
274471 state and students who are educated by other means and are in the
275472 equivalent of the fifth through eleventh grade shall be apprise d,
276473 together with the parent, custodial parent, or guardian of the
277474 student, of the opportunity for access to higher learning under the
278475 Oklahoma Higher Learning Access Program. The Oklahoma State Regents
279476 for Higher Education and the State Board of Education shall develop,
280477 promote, and coordin ate a public awareness program to be utilized in

284507 B. On a form provided by the Oklahoma State Regents for Higher
285508 Education, every public s chool district shall designate at least one
286509 Oklahoma Higher Learning Access Program contact person, who s hall be
287510 a counselor or teacher, at each public school site in this state in
288511 which eighth-, ninth-, tenth-, or eleventh-grade classes are taught.
289512 When requested by the State Regents, the State Board of Education
290513 shall assist the State Regents to ensure the designation of contact
291514 persons. Private schools shall also designate at least one school
292515 official as a contact person. For students who are educated by
293516 other means, a parent or guardian or other person approved by the
294517 State Regents shall be designated t he contact person.

296518 C. 1. Students who qualify on the basis of financial need
297519 according to subsection D or E of this section or who meet the
298520 eligibility qualification set forth in subpar agraph a of paragraph 1
299521 of subsection B of Section 2603 of this title prior to entering the
300522 eleventh grade or prior to reaching the age of sixteen (16) and the
301523 standards and provisions promulgated by the Oklahoma State R egents
302524 for Higher Education shall be given the opportunity throughout the
303525 eighth-, ninth-, tenth-, and eleventh-grade years, for students
304526 enrolled in a public or private school, or between the ages of
305527 thirteen (13) and sixteen (16), for students who are ed ucated by
306528 other means, to enter into participation in the program by agreeing

328568 2. Students who meet the eligibility qu alification set forth in
329569 subparagraph a of paragraph 1 of subsection B of Section 2603 of
330570 this title after completing the eleventh grade or after reach ing the
331571 age of seventeen (17) shall be given the opportunity prior to
332572 reaching the age of twenty -one (21) to enter into participation in
333573 the program and shall execute an agreement with provisions as
334574 determined by the Oklahoma State Regents for Higher Educa tion.

336575 3. The contact person shall m aintain the agreements, which
337576 shall be executed on forms provided by the Oklahoma State Regents
338577 for Higher Education and managed according to regulations
339578 promulgated by the Oklahoma State Regents for Higher Education, an d

357619 enrolled in a public or private sch ool, or between the ages of

359621 other means, the income from taxable and nontaxable sources of the
360622 student’s parent(s) exceeds Fifty Thousand Dollars ($50,000. 00) per
361623 year;

363624 2. Beginning with eighth -, ninth-, or tenth-grade students who
364625 are enrolled in a public or private school or students between the
365626 ages of thirteen (13) and fifteen (15) who are educated by other
366627 means who apply for participation in the progr am in the 2017-2018
367628 school year, the federal adjusted gross income of the student ’s
368629 parent(s) exceeds Fif ty-five Thousand Dollars ($55,000.00) per year;

410716 center school that meets the requirements to be eligible for federal
411717 student financial aid , or a private institution of higher learning
412718 located within this state and accredited pursuant to Section 4103 of
413719 this title, the federal adjusted gross income of the student ’s
414720 parent(s) exceeds One Hundred Thousand Dollars ($100,000.00) per
415721 year.

417722 The determination of financial qu alification as set forth in
418723 paragraphs 5 and 6 of this subsection this paragraph shall be based
419724 on the income of the student, not the income of the parent(s), if a
420725 student:

422726 a. is determined to be independent of the student ’s
423727 parents for federal financial a id purposes,
424-
425728 b. was in the permanent custody of the Department of
426729 Human Services at the time the student enrolled in the

435763 has received an Oklahoma Higher Learning Access Program benefit
436764 award after the 2017 -2018 school year; and

438765 7. 5. The Oklahoma State Regen ts for Higher Education shall
439766 review the determination of financial qualification as set forth in
440767 paragraphs 1, 2, and 3, and 4 of this subsection if the income from

492866 financial need for purpo ses of the Oklahoma Higher Learning Access
493867 Program if the federal adjusted gross income of the student exceeds
494868 Sixty Thousand Dollars ($60,000.00) per year.

496869 4. Except for students who qu alify pursuant to subsection B of
497870 Section 2603 of this title, the det ermination of financial
498871 qualification as set forth in this subsection shall be based on the
499872 income of the student, not the income of the parent(s), if the
500873 student is determined to be independent of the student ’s parent(s)
501874 for federal financial aid purposes . A determination of financial
502875 qualification shall not be required for the student who meets the
503876 criteria set forth in this subsection at the time the student
504877 applies for participation i n the program. The provisions of this

538929 adjacent state pursuant to a contract as authorized in Section 5 -
539930 117.1 of this title, are in the eleventh and twelfth grades during
540931 the 2006-2007 school year, and who were denied participation in the
541932 program shall be allow ed to enter or reenter into participation in
542933 the program by entering into agreements as set forth in subsections
543934 C and D of this section by June 1, 200 8.

549965 J. I. The Oklahoma State Regents for Higher Education shall
550966 designate personnel to coo rdinate tracking of program records for
551967 the years when students participating in the program are still in
552968 the schools or are being educated by other means, provide staff
553969 development for contact persons in the schools, and provide liaison
554970 with the State Board of Education and local organizations and
555971 individuals participating in the program.

557972 K. J. The school district where an Oklahoma Higher Learning
558973 Access Program student is enrolled when the student begins
559974 participation in the program and any subsequent sc hool district
560975 where the student enro lls shall forward information regarding
561976 participation by the student in the program to a school to which the
562977 student transfers upon the request of the school for the records of
563978 the student.

565979 L. K. Students participating in the Oklahoma Higher Learning
566980 Access Program shall provide their Social Security number or their
567981 student identification number used by their school to the Oklahoma
568982 State Regents for Higher Education. The Regents shall keep the
569983 numbers confidential and u se them only for administrative purp oses.
