65	65	An Act relating to wildlife; authorizing the
66	66	Department of Wildlife Conservation to implement
67	67	certain program; requiring collaboration from other
68	68	Oklahoma entities; providing for indemnity of the
69	69	Department from damages resulting from implementation
70	70	of this program; exempting indemnity from certain
71	71	issues; providing for the promulgation of rules;
72	72	allowing the Department to provide ex emptions from
73	73	certain permitting; providing for codification; and

79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
80	80	SECTION 1. NEW LAW A n ew section of law to be codified
81	81	in the Oklahoma Statu tes as Section 7-707 of Title 29, unless there
82	82	is created a duplication in numbering, reads as follows:
83	83	A. The Department of Wildlife Conservation shall administer
84	84	directly and through collaboration with the Oklahoma Department of
85	85	Agriculture, Food, and Forestry, the Oklahoma Conservation
86	86	Commission, and the Oklahoma Cooperative Extension Service at
87	87	Oklahoma State University to implement a program or programs for the
88	88	distribution of traps for the capture or deterrence of invasive and
89	89	nuisance species affecting Oklahoma landowners or land lessors.

141	141	B. The Department or any employee or agent of the Department
142	142	shall not be liable for damages in any civil suit or subject to
143	143	criminal prosecution for any injury re sulting from the program,
144	144	unless the injury or dea th is a direct result of the gross
145	145	negligence, recklessness, or intentional mis conduct of the
146	146	Department or employee or agent of the Department.
147	147	C. The Department of Wildlife Conservation shall promulgate the
148	148	rules necessary for the implementation of this program along with
149	149	any educational material necessary for the proper o peration of the
150	150	traps leased to landowners and land le ssors through this program as
151	151	not to violate the provisions of subsec tion B of this section. The
152	152	Department may allow exemptions for landowners and land lessors
153	153	participating in this program from the permits required to control
154	154	nuisance and invasive species set for in Title 29 of the Oklahoma
155	155	Statutes.
156	156	SECTION 2. This act shall beco me effective November 1, 2024.
