8686 SECTION 1. AMENDATORY Section 1, Chapter 289, O.S.L.
8787 2023 (70 O.S. Supp. 2023, Section 1 8-114.15), is amended to read as

461461 B. 1. When determining the Minimum Sa lary Schedule, “fringe
462462 benefits” shall mean all or part of retirement benefits, excluding
463463 the contributions made pursuant to subsection A of Section 17 -108.1
464464 of Title 70 of the Oklahoma Statutes this title and the flexible
465465 benefit allowance pursuant to Section 26 -105 of Title 70 of the
466466 Oklahoma Statutes this title from the flexible benefit allowance
467467 funds disbursed by the State Board of Education and the State Board

520520 Title 70 of the Oklahoma Statutes this title.
521521 2. If a school district intends to provide retirement benefits
522522 to a teacher such that the teacher’s salary would be less than the
523523 amounts set forth in the minimum salary sc hedule specified in
524524 subsection A of this section, the district shall be required to
525525 provide written notification to the teacher prior to his or her
526526 employment or, if already employed by the district, no later than
527527 thirty (30) days prior to the date the district elects to provide
528528 retirement benefits such that the teacher’s salary would be less
529529 than the minimum salary schedule.
530530 C. Any of the degrees referr ed to in this section shall be from
531531 a college recognized by the State Board of Education. The Board
532532 shall accept teaching experience from out-of-state school districts
533533 that are accredited by the State Board of Education state board of
534534 education or appropriate state accrediting ag ency for the districts.
535535 The Board shall accept teaching experience from out-of-country
536536 schools that are accredited or otherwise endorsed by the appropriate
537537 national or regional accrediting or endorsement authority. Out-of-
538538 country certification documentat ion in a language other than English
539539 shall be analyzed by an educational credential evaluation service i n
540540 accordance with industry standards and guidelines and approved by
541541 the State Department of Education. The person seeking to have
542542 credit granted for ou t-of-country teaching experience shall be

594594 responsible for all costs of the analysis by a credent ial evaluation
595595 service. The Board shall accept teaching experience from primary
596596 and secondary schools that are operated by the United States
597597 Department of Defense or are affiliated with the United States
598598 Department of State.
599599 D. For the purpose of state salary in crements and retirement,
600600 no teacher shall be granted credit for more than five (5) yea rs of
601601 active duty in the military service or out-of-state or out-of-
602602 country teaching experience as a certified teacher or its
603603 equivalent. Nothing in this section shall prohibit boards of
604604 education from crediting more years of experience on district salary
605605 schedules than those allowed for state purposes.
606606 E. The State Board of Education shall recognize, for purposes
607607 of certification and salary increments, all the years of experience
608608 of a:
609609 1. Certified teacher who teaches in the educational program of
610610 the Department of Corrections, beginning with fiscal year 1981;
611611 2. Vocational rehabilitation counselor under the Department of
612612 Human Services if the counselor was emp loyed as a certified teacher
613613 by the State Department of Education when the Division of Vocatio nal
614614 Rehabilitation was transferred from the State Board of Career and
615615 Technology Education or the State Board of Education to the Oklahoma
616616 Public Welfare Commission on Ju ly 1, 1968;

668668 3. Vocational rehabilitation counselor which were completed
669669 while employed by the Department of Human Services if such counselor
670670 was certified as a teacher or was eligible for certification as a
671671 teacher in Oklahoma this state;
672672 4. Certified teacher which were completed while employed by the
673673 Child Study Center located at University Hospital, if the teacher
674674 was certified as a teacher in Oklahoma this state; and
675675 5. Certified school psychologist or psychometrist which were
676676 completed while employed as a doctoral intern, psychological
677677 assistant, or psychologist with any agency of the State of Oklahoma
678678 this state if the experience primarily involved work with persons of
679679 school- or preschool-age and if the person was, at the time the
680680 experience was acquired, certified as, or eligible for certification
681681 as, a school psychologist or psychometrist.
682682 F. The provisions of thi s section shall not apply to teachers
683683 who have entered into postr etirement employment with a public school
684684 in Oklahoma this state and are still receiving a monthly retirement
685685 benefit.
686686 G. If a person employed as certified personnel, as defined in
687687 Section 26-103 of Title 70 of the Oklahoma Statutes this title, by a
688688 school district during the 2022-2023 2023-2024 school year was
689689 receiving a salary above the step level indicated by the State
690690 Minimum Salary Schedule for the 2022-2023 2023-2024 school year, the
691691 person shall receive a salary increase amo unt equal to the amount

745745 district, unless the hours o r the duties of the certified personnel
746746 are reduced proportionately.
747747 H. If a school district does not receive Foundation or Salary
748748 Incentive Aid pursuant to Section 18-200.1 of Title 70 of the
749749 Oklahoma Statutes, funds shall be allocated by the State Bo ard of
750750 Education to implement the salary inc reases indicated in subsection
751751 A of this section.
752752 I. Persons employed as classroom instructional employees of
753753 technology center school districts supervised by the State Board of
754754 Career and Technology Education shall receive a salary increase
755755 amount equal to the amount indicated in s ubsection A of this section
756756 for the step level indicated for the person, provided they remain
757757 employed by the same technology center school district, unless the
758758 hours or the duties of the classroom instructional employees are
759759 reduced proportionately.
760760 J. Persons employed as correctional teachers or vocational
761761 instructors by the Department of Corrections pursuant to Section
762762 510.6a of Title 57 of the Oklahoma Statutes or persons employed as
763763 teachers by the Office of Juvenile Affairs shall receive a salary
764764 increase amount equal to the amount indicated in subsection A of
765765 this section for the step level indicated for the person, provided
766766 they remain employed by the same Department of Corrections or Office

821821 K. Persons employed as teachers by the State Department of
822822 Rehabilitation Services shall receive a salary increase amount equal
823823 to the amount indicated in subsection A of this section for the step
824824 level indicated for the person, provided they remain employed by the
825825 State Department of Rehabilitation Services, unless the hours or the
826826 duties of the teachers are reduced propor tionately.
827827 SECTION 2. This act shall become effective July 1, 2024.
828828 SECTION 3. It being immediately necessary for the preservation
829829 of the public peace, health , or safety, an emergency is her eby
830830 declared to exist, by reason whereof thi s act shall take effect and
831831 be in full force from and after its passage and approval.
