39116 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

41117 SECTION 1. NEW LAW A new section of law to be codified
42118 in the Oklahoma Statutes as Section 1 -114.21 of Title 63, unless
43119 there is created a duplica tion in numbering, reads as follows:

45120 There is hereby created in the State Treasury a revolving fund
46121 for the State Department of Health to be designated the “Public
47-

49122 School Vision Screening Modernization Revolving Fund ”. The fund
50123 shall be a continuing fund, not subject to fiscal year limitations,
51124 and shall consist of all monies deposited to the credit of the fund
52125 by law or from private funds donated for one or both of t he purposes
53126 listed in this section. All monies accruing to the credit of the
54127 fund are hereby appropriated and may be budgeted and expended by the
55128 State Department of Health for the following purposes:

57129 1. Awarding grants to public schools as provided by S ection 2
58130 of this act; and

60157 2. Collection of necessary vision screening data including, but
61158 not limited to, through the cloud-based platform and data management
62159 system described in Section 1210.284 of Title 70 of the Oklahoma
63160 Statutes.

65161 Expenditures from the fund shall be made upon warrants issued by
66162 the State Treasurer against claims filed as pr escribed by law with
67163 the Director of the Office of Management and Enterprise Services for
68164 approval and payment.

70165 SECTION 2. NEW LAW A new secti on of law to be codified
71166 in the Oklahoma Statutes as Section 1 -114.22 of Title 63, unless
72167 there is created a duplicati on in numbering, reads as follows:

74168 A. The State Department of Health may award grants to public
75169 schools from the Public School Vision Scr eening Modernization
76170 Revolving Fund created in Section 1 of this act for the purpose of
77171 assisting public schools in obtaining vision screening equipment,
78172 collecting vision screening data, and obtaining related services to
79173 fulfill the requirements of Sectio n 1210.284 of Title 70 of the
80174 Oklahoma Statutes.

82175 B. The State Department of Health shall electronically submit
83176 an annual report on all grants awarded under this section to the
84177 President Pro Tempore of the Senate, the Speaker of the House of
85178 Representatives, and the Governor by January 15 of each year.

87205 SECTION 3. AMENDATORY 70 O.S. 2021, Section 1210.284, as
88206 amended by Section 1, Chapter 112, O.S.L. 2022 (70 O.S. Supp. 2023,
89207 Section 1210.284), is amended to read as follows:

93208 Section 1210.284. A. 1. The parent or guardian of each
94209 student enrolled in kindergarten at a p ublic school in this state
95210 shall provide certification to school personnel that the student
96211 passed a vision screening within the previous twelve (12) months or
97212 during the school year. Such screening shall be conducted by
98213 personnel listed on the statewide registry as maintained by the
99214 State Department of Health, which may include, but not be limited
100215 to, Oklahoma licensed optometrists and ophthalmologists.

102216 2. The parent or guardian of each student enrolled in first or
103217 third grade at a public school in this state shall provide within
104218 thirty (30) days of the beginning of the school year certification
105219 to school personnel that the student passed a vision screening
106220 within the previous twelve (12) months. Such screening shall be
107221 conducted by personnel listed on t he statewide registry as
108222 maintained by the State Department of Health; provided, Oklahoma
109223 licensed optometrists and ophthalmologists shall be exempt from such
110224 standards.

112225 3. The parent or guardian of each student who receives a vision
113226 screening as required by this section shall recei ve notification
114227 that a vision screening is not the equivalent of a comprehensive eye

130265 recognition of vision screener trainers,

132266 d. qualifications for initia l recognition and renewal of

140271 e. grounds for denial, refusal, suspension or revocation

147276 registry, available via the Internet, which shall

150304 b. maintain a list of approved vision screener trainers
151305 and trainers of visi on screener trainers, and

153306 c. maintain the standards for vision screening and
154307 referral. Such standards shall permit the use of an
155308 electronic eye chart as a substitute for a printed eye
156309 chart to assess relative visual acuity. As used in
157310 this subparagraph, “electronic eye chart ” means any
158311 computerized or other electronic system, device,
159312 automated computer program, or method of displaying on
160313 an electronic screen medicall y accepted and properly
161314 sized optotypes, which may be letters, numbers, or
162315 symbols, that is used to assess an individual ’s visual
163316 acuity. An electronic eye chart shall meet national
164317 standards of care and shall meet the guidelines
165318 established by the 2016 v ersion, or most recent
166319 version if updated, of the Procedures for the
167320 Evaluation of the Vis ual System by Pediatricians
168321 produced by the American Academy of Pediatrics , and

170322 d. subject to availability of funds, maintain a cloud -
171323 based platform and data manageme nt system that is
172324 compliant with the Health Insurance Portability and
173325 Accountability Act o f 1996 and the Family Educational
174326 Rights and Privacy Act of 1974 to collect individual
175327 student screening results from each school district,

176354 manage and report on compl iance, and act as an
177355 analytical platform for screening outcomes . The State
178356 Department of Education shall share vision screening

181357 results and any other relevant information with the
182358 State Department of Health for the purpose of
183359 implementing this subparagrap h. The agencies shall
184360 enter into an interagency agreement for the sharing of
185361 information as provided by this subparagraph .

187362 3. After notice and hearing, the Department State Department of
188363 Health may deny, refuse, suspend or revoke approval to an applicant
189364 who has a history of:
190-
191365 a. noncompliance or incomplete or partial compliance with
192366 the provisions of this section or the rules adopted by
193367 the Board Commissioner to implement the provisions of
194368 this section,
195-
196369 b. referring persons to a business in which the appl icant
197370 has a financial interest or a business which is owned
198371 or operated by someone within the third degree of
199372 consanguinity or affinity of the applicant, or

201373 c. conduct which demonstrates that the applicant is
202374 providing services in a manner which does not w arrant
203375 public trust.

205402 4. The Board Commissioner, giving consideration to the
206403 recommendations of the Council, shall pro mulgate rules to implement
207404 the provisions of this section.

209405 C. 1. The parent or guardian of each student who fails the
210406 vision screening required in subsection A of this section shall
211407 receive a recommendation to undergo a compre hensive eye examination
212408 performed by an ophthalmologist or optometrist.

214409 2. The ophthalmologist or optometrist shall forward a written
215410 report of the results of the co mprehensive eye examination to the
216411 student’s school, parent or guardian, and primary healt h care
217412 provider designated b y the parent or guardian. The report shall
218413 include, but not be limited to:

220414 a. date of report,

222415 b. name, address and date of birth of the s tudent,

230418 e. a summary of significa nt findings, including
231419 diagnoses, medication used, duration of action of
232420 medication, treatment, prognosis, whether or not a

235422 f. recommended educational adjustments for the child, if
236423 any, which may include: pref erential seating in the
237424 classroom, eyeglasses for full -time use in school,

238451 eyeglasses for part-time use in school, sight -saving
239452 eyeglasses, and any other recommendati ons, and

241453 g. name, address and signature of the examiner.

243454 D. No student shall be prohibite d from attending school for a
244455 parent’s or guardian’s failure to furnish a report of the student ’s
245456 vision screening or an examiner ’s failure to furnish the results of
246457 a student’s comprehensive eye examination required by this section.

248458 E. School districts s hall notify parents or guard ians of
249459 students who enroll in kindergarten, first, or third grade for the
250460 2007-08 school year and each year thereafter of the requirement s of
251461 this section.

253462 F. The State Board of Education shall adopt rules for the
254463 implementation of this section except as provided in subsection B of
255464 this section. The State Department of Education shall issue a
256465 report annually on the impact and effectivenes s of this section.

258466 SECTION 4. This act shall become effective July 1, 202 4.

260467 SECTION 5. It being immediately necessary for the preservation
261468 of the public peace, health or safety, an emergency is hereby
262469 declared to exist, by reason whereof this act shall take effect and
263470 be in full force from and after its passage and approval.
