4447 BE IT ENACTED BY THE PEOPLE OF THE STATE OF O KLAHOMA:
4548 SECTION 1. NEW LAW A new section of law to be codifi ed
4649 in the Oklahoma Statutes as Section 905 of Title 40, unless there is
4750 created a duplication in numb ering, reads as follows:
4851 A. There is hereby created in the State Treasury a revolving
4952 fund for the Oklahoma Workforce Commission to be designated the
5053 “Workforce Development Revolving Fund”. The fund shall be a
5154 continuing fund, not subject to fiscal year limita tions, and shall
5255 consist of all monies received by the Oklahoma Workforce Commission
5356 from state appropriations provided for the purpose of increasing the
5457 number of degrees, licenses, certificates, and other credentials
5558 granted to fulfill workforce needs identified pursuant to subsection
5659 B of this section. All monies accruing to the credit of the fund
5760 are hereby appropriated and may be budgeted and expended by the
5861 Oklahoma Workforce Co mmission for the purpose provided for in this
59-subsection. Expenditures from the fund s hall be made upon warrants

89+subsection. Expenditures from the fund shall be made upon warrants
8690 issued by the State Treasurer against claims filed as prescribed by
8791 law with the Director of the Office of Management and Enterprise
8892 Services for approval and payment.
8993 B. The Oklahoma Workforce Commission shall identify workforce
9094 needs in critical occupation areas that are in h igh demand and are
9195 projected to have positive future growth.
92-SECTION 2. There is hereby appropriated to the Workforce
93-Development Revolving Fund created pursuant to Section 1 of this act
94-from any monies not otherwise appropriated from the General Revenue
95-Fund of the State Treasury for the fiscal year ending June 30, 2023,
96-the sum of One Hundred Million Dollars ($ 100,000,000.00) or so much
97-thereof as may be necessary for the purpose provided for in Section
98-1 of this act.
99-SECTION 3. AMENDATORY Section 5, Chapte r 361, O.S.L.
100-2023 (40 O.S. Supp. 2023, Section 904), is amended to read as
101-follows:
102-Section 904. The Oklahoma Workforce Commission shall have the
103-following powers, duties, and responsibilities:
104-1. To administer the provisions of this act the Oklahoma
105-Workforce Transformation Act or any duty as directed by statute;
106-2. To establish an office for the Commission within this state;
107-3. To elect whatever other officers may be necessary to direct
108-operations of the Commission;

135-4. To employ or contract for pers onnel and administrative
136-support as the Commission deems appropriate to carry out the purpose
137-and provisions of this act the Oklahoma Workforce Transformation
138-Act, including but not limited to a nonprofit corporation to carry
139-out the Commission’s objective s, an Executive Director or other
140-chief executive officer and any other employees or contractors the
141-Commission deems appropriate, and to prescribe their duties and fix
142-their compensation;
143-5. To administer the Workforce Coordination Revolving Fund
144-created in Section 255.4 of Title 62 of the Oklahoma Statutes and
145-the Workforce Development Revolving Fund created in Section 1 of
146-this act;
147-6. To approve or disapprove the budget of the Commission;
148-7. To promulgate rules to carry out the provisions of this act
149-the Oklahoma Workforce Transformation Act ;
150-8. To enter into contracts or agreements for studies,
151-professional services, grant administration and procurement,
152-research projects, supplies, or any other services the Commission
153-deems necessary to carry out i ts purpose, and to incur those
154-expenses necessary to carry out those purposes;
155-9. To cooperate with any private, local, state, or national
156-commission, organizatio n, agency, or group and to make contracts and
157-agreements for joint programs beneficial to Okl ahoma’s workforce
158-development efforts;

185-10. To accept donations, grants, contributions, and gifts from
186-any public or private source and deposit such in the Workforce
187-Coordination Revolving Fund, created in Section 255.4 of Title 62 of
188-the Oklahoma Statutes ;
189-11. To oversee and direct to the extent permitted by law the
190-activities and administration of the Governor’s Council for
191-Workforce and Economic Development, inc luding but not limited to the
192-creation and submission of state plans to the federal governmen t
193-pursuant to the provisions of the federal Workforce Innovation and
194-Opportunity Act;
195-12. To collect data from federal, state, and local agencies,
196-departments, educational institutions, boards, commissions, or any
197-other entities including, but not limited to:
198-a. number of participants in workforce development
199-programming,
200-b. cost per participant,
201-c. wages before and after participation in programs,
202-d. degree or certificate conferred on each participant,
203-e. number of jobs open needing degrees or certificate s,
204-f. labor force and economic information, and
205-g. any other information the Commission deems appropriate
206-to guide funding decisions, facilitate its work or the
207-work of workforce development entities in the state,

234-or to understand the impact of the state’s workforce
235-efforts and programming;
236-13. To create and maintain a public dashboard and create
237-reports with data concerning workforce development efforts in the
238-state. All state and local agencies, departments, educational
239-institutions, boards, commissions , and other public entities shall
240-cooperate with information and data requests from the Commission or
241-its designees. It is the intent of the Legislature that the
242-Oklahoma Workforce Commission serve as the centralized data and
243-information repository for wo rkforce development activities for the
244-state; and
245-14. To make recommendations to the Legislature to improve
246-workforce development programs in the state.

96+SECTION 2. This act shall become effective July 1, 2024.
97+SECTION 3. It being immediately necessary for th e preservation
98+of the public peace, health , or safety, an emergency is hereby
99+declared to exist, by reason whereof thi s act shall take effect and
100+be in full force from and after its passage and approval.
