153	153	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
154	154	SECTION 1. NEW LAW A new section of law not to be
155	155	codified in the Oklahoma Statutes reads as follows:
156	156	This act shall be known and may be cited as the “Oklahoma State
157	157	Guard and Militia Revitalization Act of 202 4”.
158	158	SECTION 2. AMENDATORY 44 O.S. 2021, Section 41, is
159	159	amended to read as follows:
160	160	Section 41. A. The Militia of the State of Oklahoma shall
161	161	consist of all able-bodied citizens of the United States and all
162	162	other able-bodied persons who are sound of mind, who shall be or
163	163	shall have declared their intentions to become citizens of the
164	164	United States, who shall be more than seventeen (17) are at least
165	165	sixteen (16) years of age and not more than seventy (70) years of
166	166	age, and said the militia shall be divided into three (3) classes:
167	167	The National Guard, the Oklahoma State Guard, and the Unorganiz ed
168	168	Militia; provided, that persons in the Unorganized Militia ov er the
169	169	age of seventy (70) years and under the age of seventeen (17) years
170	170	shall be exempt from mandatory service .
171	171	SECTION 3. AMENDATORY 44 O.S. 2021, Section 242, is
172	172	amended to read as follows:
173	173	Section 242. Such military forces shall be designated as the
174	174	“Oklahoma State Guard” and shall be composed of officer s
175	175	commissioned or assigned, and such a ble-bodied male citizens of the

228	228	additional to and distinct from the National Guard of the State of
229	229	Oklahoma, as defined i n Title 32 of the United States Code. They
230	230	shall not be required to se rve outside the boundaries of the State
231	231	of Oklahoma this state.
232	232	SECTION 4. AMENDATORY 44 O.S. 2021, Section 243, is
233	233	amended to read as fo llows:
234	234	Section 243. A. The Governor is hereby authorized to shall
235	235	prescribe rules and regulation s governing the enlistment,
236	236	organization, administration, equipment, discipline and discharge of
237	237	the personnel of such military forces; to requisition from the
238	238	Secretary of Defense such arms and equipment as may be in the
239	239	possession of and can be spared by the Department of Defense and to
240	240	extend thereto the facilities of state armories, A rmed Forces
241	241	Reserve Centers, readiness centers, logistics, aviation, and
242	242	training facilities, warehouses and their equipment and such oth er
243	243	state premises and property as m ay be available for the purpose of
244	244	drill and instruction. Insofar as applicable the procedure for the
245	245	enlistment, organization, pay, maintenance, equipment and
246	246	disciplining of such forces shall be in conformity with the law and
247	247	the rules and regulation s governing and pertaining to the National
248	248	Guard; provided, that t he officers and enlist ed personnel in the
249	249	Oklahoma State Guard shall not receive any compensation or m onetary
250	250	allowances from the state except when:

302	302	1. When activated for state active duty, as defined in Section
303	303	801 of this title, by order of the Governor;
304	304	2. When attending state-mandated training; or
305	305	3. For Oklahoma State Guard county coordinators or state-level
306	306	full-time personnel.
307	307	B. The Governor shall a ppoint a Commandant of the O klahoma
308	308	State Guard and Unorganized Militia (OSGUM Commandant or
309	309	“Commandant”) to serve within the Military Department of the State
310	310	of Oklahoma and to report to the Adjutant General (TAG).
311	311	C. Members of the Oklahoma State Guard shall be considered part
312	312	of state military forces as defined in Section 801 of this title and
313	313	shall be subject to the Oklahoma Uniform Code of Mili tary Justice.
314	314	C. D. When prescribing the rules and regulations governing
315	315	enlistment, organization, administ ration, equipment, discipline and
316	316	discharge of the personnel of the Oklahoma State Gu ard, the Governor
317	317	shall issue such rules and regulations in the form of an executive
318	318	order or in a series of such orders. An executive order or a series
319	319	of such orders prescribing the rules and regulations governing
320	320	enlistment, organization, adminis tration, equipment, discipline and
321	321	discharge of the personnel of the Oklahom a State Guard shall also be
322	322	published by the Adjutant General as a military publication .
323	323	E. TAG shall authorize at least four voluntary Multiple Unit
324	324	Training Assemblies (MUTA) of Inactive Duty for Trainin g (IDT) per

377	377	compensated by the state for attending such trainings.
378	378	SECTION 5. NEW LAW A new se ction of law to be codified
379	379	in the Oklahoma Statutes as Section 251.1 of Title 44, unless there
380	380	is created a duplication in numbering, read s as follows:
381	381	A. A unit of the Oklahoma State Guard (OSG) shall be
382	382	established in each county of this state that shall operate under
383	383	and report to a county coordinator. Members of each county unit of
384	384	the Oklahoma State Guard and of the Unorganized Milit ia shall be
385	385	able to immediately respond, if called into service, fully equipp ed
386	386	for infantry or other service within this state.
387	387	B. Privately owned semia utomatic firearms may be required for
388	388	service for the Oklahoma State Guard or the Unorganized Militia if
389	389	such firearms are ordered or mustered for service. Any such firearm
390	390	shall be similar to firearms issued by the mil itary forces of the
391	391	United States, the National Guard, or the military or police forces
392	392	of this state, pursuant to regulation developed by the Military
393	393	Department of the State of Oklahoma. Such firearms shall:
394	394	1. Be capable of accepting a standard capaci ty magazine of
395	395	greater than ten round s; and
396	396	2. Contain ergonomic features including, but not limited to,
397	397	any or all of the following:
398	398	a. a pistol grip below the action,
399	399	b. an adjustable buttstock ,

452	452	designed to reduce or eliminate harmf ul noise or flash
453	453	signature,
454	454	d. a lug capable of accepting a bayonet or other
455	455	accessories, or
456	456	e. a protective shroud or handguard partially or fully
457	457	encircling the barrel to pre vent barrel heat injury to
458	458	the user.
459	459	C. Notwithstanding the requirements set forth in subsection B
460	460	of this section, the Adjutant General (TAG) shall promulgate an
461	461	additional standard for emergency situations that sha ll authorize
462	462	the use of any safe and op erable semiautomatic or other rifle,
463	463	pistol, or shotgun that is in common use by military or police
464	464	forces.
465	465	D. Under orders promulgated by the Gover nor and the Adjutant
466	466	General (TAG), each county coordinator of the Oklahoma State Guard
467	467	shall ensure the equipping, training, and readiness to the ex tent
468	468	permitted by local county volu nteer staffing and interest, and for
469	469	the training and readiness of volunteers drawn from the Unorganized
470	470	Militia of this state.
471	471	E. 1. The State of Oklahoma shall fund:
472	472	a. the position of the county coordinator , and
473	473	b. the county OSG unit when activated for state active
474	474	duty, as defined in Section 801 of this title, by

528	528	2. Counties and citizen groups may voluntarily fund person nel,
529	529	training, equipment, vehicles , and logistics for their respective
530	530	county OSG units in coordination with the Military Departme nt of the
531	531	State of Oklahoma, but such OSG units shall remain under the command
532	532	of the Department when ordered to service, and any such use of
533	533	voluntary funding shall be consis tent with orders and regulations of
534	534	the Governor pursuant to Section 243 of this title.
535	535	F. The Military Department of the State of Oklahoma shall
536	536	develop a plan of coordination with county sheriffs and the county’s
537	537	respective OSG unit for em ergency management.
538	538	G. County OSG units shall adhere to the uniform and grooming
539	539	standards set forth in Army Regulations AR 670-1.
540	540	H. Beginning December 1, 2024, the county election board
541	541	secretary of each county shall provide every registered voter with
542	542	notice of the opportunity for service in and contact information for
543	543	the county OSG unit, and there after, upon first-time voter
544	544	registration.
545	545	I. Nothing in this section shall be construed to require or
546	546	permit any scheme of licensing, registration , or list of specific
547	547	firearms.

601	601	is created a duplication in numbering, reads as fo llows:
602	602	A. The sheriff of each county in this st ate shall solicit
603	603	nominees with prior honorable service in the Armed Forces of the
604	604	United States or National Guard and who reside within the county, to
605	605	serve as the interim Oklahoma State Guard county coordinator for
606	606	that county. Any person desiring to serve shall provide to the
607	607	sheriff for the county of desired service his or her Certificate of
608	608	Release or Discharge from Active Duty (Form DD 214) or National
609	609	Guard Report of Separation and R ecord of Service (NGB Form 22) and
610	610	most recent evaluation report prior to the expiration of his or her
611	611	term of service.
612	612	B. No later than November 30, 2024, the sheriff of each county
613	613	in this state shall appoint an interim county coordinator. The
614	614	appointment must be approved by a majority vote of the board o f
615	615	county commissioners.
616	616	C. The county coordinator shall have the power and duty to
617	617	initiate the administration of the county unit of the Oklahoma State
618	618	Guard and Unorganized Militia . The county coordinator shall report
619	619	to the OSGUM Commandant and to TAG, and such intermediary officers
620	620	as TAG shall appoint, for ensurin g the readiness of the OSG county
621	621	unit and training opportunities for the Unorganized Militia within
622	622	the county.

678	678	the last forty-eight (48) months, who reside within the county.
679	679	SECTION 7. NEW LAW A new section of law to be c odified
680	680	in the Oklahoma Statutes as Section 251.3 of Title 44, unless there
681	681	is created a duplication in numbering, reads as follows:
682	682	There is hereby created in the State Treasury a revolving fund
683	683	for the Military Department of the Stat e of Oklahoma to be
684	684	designated the “Oklahoma State Guard Revolving Fund”. The fund
685	685	shall be a continuing fund, not subject to fiscal year limitations,
686	686	and shall consist of all monies received by the Department from
687	687	appropriations, grants, or private donations provided for the
688	688	purposes stated in this section. All monies accruing to the credit
689	689	of the fund are hereby appropriated and may be budgeted and expended
690	690	by the Department for the following purposes:
691	691	1. Funding the positions of Oklahoma State Guard county
692	692	coordinators; and
693	693	2. Making grants to county coordinators to be used for training
694	694	of personnel and purchasing of ammunition, weaponry, and other
695	695	necessary equipment.
696	696	Expenditures from the fund shall be made upon warrants issued by
697	697	the State Treasurer against claims filed as prescribed by law with
