153153 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
154154 SECTION 1. NEW LAW A new section of law not to be
155155 codified in the Oklahoma Statutes reads as follows:
156156 This act shall be known and may be cited as the “Oklahoma State
157157 Guard and Militia Revitalization Act of 202 4”.
158158 SECTION 2. AMENDATORY 44 O.S. 2021, Section 41, is
159159 amended to read as follows:
160160 Section 41. A. The Militia of the State of Oklahoma shall
161161 consist of all able-bodied citizens of the United States and all
162162 other able-bodied persons who are sound of mind, who shall be or
163163 shall have declared their intentions to become citizens of the
164164 United States, who shall be more than seventeen (17) are at least
165165 sixteen (16) years of age and not more than seventy (70) years of
166166 age, and said the militia shall be divided into three (3) classes:
167167 The National Guard, the Oklahoma State Guard, and the Unorganiz ed
168168 Militia; provided, that persons in the Unorganized Militia ov er the
169169 age of seventy (70) years and under the age of seventeen (17) years
170170 shall be exempt from mandatory service .
171171 SECTION 3. AMENDATORY 44 O.S. 2021, Section 242, is
172172 amended to read as follows:
173173 Section 242. Such military forces shall be designated as the
174174 “Oklahoma State Guard” and shall be composed of officer s
175175 commissioned or assigned, and such a ble-bodied male citizens of the

227227 state as shall volunteer for service therein. They shall be
228228 additional to and distinct from the National Guard of the State of
229229 Oklahoma, as defined i n Title 32 of the United States Code. They
230230 shall not be required to se rve outside the boundaries of the State
231231 of Oklahoma this state.
232232 SECTION 4. AMENDATORY 44 O.S. 2021, Section 243, is
233233 amended to read as fo llows:
234234 Section 243. A. The Governor is hereby authorized to shall
235235 prescribe rules and regulation s governing the enlistment,
236236 organization, administration, equipment, discipline and discharge of
237237 the personnel of such military forces; to requisition from the
238238 Secretary of Defense such arms and equipment as may be in the
239239 possession of and can be spared by the Department of Defense and to
240240 extend thereto the facilities of state armories, A rmed Forces
241241 Reserve Centers, readiness centers, logistics, aviation, and
242242 training facilities, warehouses and their equipment and such oth er
243243 state premises and property as m ay be available for the purpose of
244244 drill and instruction. Insofar as applicable the procedure for the
245245 enlistment, organization, pay, maintenance, equipment and
246246 disciplining of such forces shall be in conformity with the law and
247247 the rules and regulation s governing and pertaining to the National
248248 Guard; provided, that t he officers and enlist ed personnel in the
249249 Oklahoma State Guard shall not receive any compensation or m onetary
250250 allowances from the state except when:

302302 1. When activated for state active duty, as defined in Section
303303 801 of this title, by order of the Governor;
304304 2. When attending state-mandated training; or
305305 3. For Oklahoma State Guard county coordinators or state-level
306306 full-time personnel.
307307 B. The Governor shall a ppoint a Commandant of the O klahoma
308308 State Guard and Unorganized Militia (OSGUM Commandant or
309309 “Commandant”) to serve within the Military Department of the State
310310 of Oklahoma and to report to the Adjutant General (TAG).
311311 C. Members of the Oklahoma State Guard shall be considered part
312312 of state military forces as defined in Section 801 of this title and
313313 shall be subject to the Oklahoma Uniform Code of Mili tary Justice.
314314 C. D. When prescribing the rules and regulations governing
315315 enlistment, organization, administ ration, equipment, discipline and
316316 discharge of the personnel of the Oklahoma State Gu ard, the Governor
317317 shall issue such rules and regulations in the form of an executive
318318 order or in a series of such orders. An executive order or a series
319319 of such orders prescribing the rules and regulations governing
320320 enlistment, organization, adminis tration, equipment, discipline and
321321 discharge of the personnel of the Oklahom a State Guard shall also be
322322 published by the Adjutant General as a military publication .
323323 E. TAG shall authorize at least four voluntary Multiple Unit
324324 Training Assemblies (MUTA) of Inactive Duty for Trainin g (IDT) per

376376 month and fifteen (15) days of annual training. Personnel shall be
377377 compensated by the state for attending such trainings.
378378 SECTION 5. NEW LAW A new se ction of law to be codified
379379 in the Oklahoma Statutes as Section 251.1 of Title 44, unless there
380380 is created a duplication in numbering, read s as follows:
381381 A. A unit of the Oklahoma State Guard (OSG) shall be
382382 established in each county of this state that shall operate under
383383 and report to a county coordinator. Members of each county unit of
384384 the Oklahoma State Guard and of the Unorganized Milit ia shall be
385385 able to immediately respond, if called into service, fully equipp ed
386386 for infantry or other service within this state.
387387 B. Privately owned semia utomatic firearms may be required for
388388 service for the Oklahoma State Guard or the Unorganized Militia if
389389 such firearms are ordered or mustered for service. Any such firearm
390390 shall be similar to firearms issued by the mil itary forces of the
391391 United States, the National Guard, or the military or police forces
392392 of this state, pursuant to regulation developed by the Military
393393 Department of the State of Oklahoma. Such firearms shall:
394394 1. Be capable of accepting a standard capaci ty magazine of
395395 greater than ten round s; and
396396 2. Contain ergonomic features including, but not limited to,
397397 any or all of the following:
398398 a. a pistol grip below the action,
399399 b. an adjustable buttstock ,

451451 c. a threaded barrel capable of accepting a muzzle device
452452 designed to reduce or eliminate harmf ul noise or flash
453453 signature,
454454 d. a lug capable of accepting a bayonet or other
455455 accessories, or
456456 e. a protective shroud or handguard partially or fully
457457 encircling the barrel to pre vent barrel heat injury to
458458 the user.
459459 C. Notwithstanding the requirements set forth in subsection B
460460 of this section, the Adjutant General (TAG) shall promulgate an
461461 additional standard for emergency situations that sha ll authorize
462462 the use of any safe and op erable semiautomatic or other rifle,
463463 pistol, or shotgun that is in common use by military or police
464464 forces.
465465 D. Under orders promulgated by the Gover nor and the Adjutant
466466 General (TAG), each county coordinator of the Oklahoma State Guard
467467 shall ensure the equipping, training, and readiness to the ex tent
468468 permitted by local county volu nteer staffing and interest, and for
469469 the training and readiness of volunteers drawn from the Unorganized
470470 Militia of this state.
471471 E. 1. The State of Oklahoma shall fund:
472472 a. the position of the county coordinator , and
473473 b. the county OSG unit when activated for state active
474474 duty, as defined in Section 801 of this title, by

528528 2. Counties and citizen groups may voluntarily fund person nel,
529529 training, equipment, vehicles , and logistics for their respective
530530 county OSG units in coordination with the Military Departme nt of the
531531 State of Oklahoma, but such OSG units shall remain under the command
532532 of the Department when ordered to service, and any such use of
533533 voluntary funding shall be consis tent with orders and regulations of
534534 the Governor pursuant to Section 243 of this title.
535535 F. The Military Department of the State of Oklahoma shall
536536 develop a plan of coordination with county sheriffs and the county’s
537537 respective OSG unit for em ergency management.
538538 G. County OSG units shall adhere to the uniform and grooming
539539 standards set forth in Army Regulations AR 670-1.
540540 H. Beginning December 1, 2024, the county election board
541541 secretary of each county shall provide every registered voter with
542542 notice of the opportunity for service in and contact information for
543543 the county OSG unit, and there after, upon first-time voter
544544 registration.
545545 I. Nothing in this section shall be construed to require or
546546 permit any scheme of licensing, registration , or list of specific
547547 firearms.

599599 SECTION 6. NEW LAW A new section of law to be codified
600600 in the Oklahoma Statutes as Section 251.2 of Title 44, unless there
601601 is created a duplication in numbering, reads as fo llows:
602602 A. The sheriff of each county in this st ate shall solicit
603603 nominees with prior honorable service in the Armed Forces of the
604604 United States or National Guard and who reside within the county, to
605605 serve as the interim Oklahoma State Guard county coordinator for
606606 that county. Any person desiring to serve shall provide to the
607607 sheriff for the county of desired service his or her Certificate of
608608 Release or Discharge from Active Duty (Form DD 214) or National
609609 Guard Report of Separation and R ecord of Service (NGB Form 22) and
610610 most recent evaluation report prior to the expiration of his or her
611611 term of service.
612612 B. No later than November 30, 2024, the sheriff of each county
613613 in this state shall appoint an interim county coordinator. The
614614 appointment must be approved by a majority vote of the board o f
615615 county commissioners.
616616 C. The county coordinator shall have the power and duty to
617617 initiate the administration of the county unit of the Oklahoma State
618618 Guard and Unorganized Militia . The county coordinator shall report
619619 to the OSGUM Commandant and to TAG, and such intermediary officers
620620 as TAG shall appoint, for ensurin g the readiness of the OSG county
621621 unit and training opportunities for the Unorganized Militia within
622622 the county.

674674 D. No later than January 30, 2025, and by March 1 of every year
675675 thereafter, the Oklahoma National Guard shall provide to county
676676 coordinators a list of persons retired or honorably discharged from
677677 the service of the United States or from the National Guard within
678678 the last forty-eight (48) months, who reside within the county.
679679 SECTION 7. NEW LAW A new section of law to be c odified
680680 in the Oklahoma Statutes as Section 251.3 of Title 44, unless there
681681 is created a duplication in numbering, reads as follows:
682682 There is hereby created in the State Treasury a revolving fund
683683 for the Military Department of the Stat e of Oklahoma to be
684684 designated the “Oklahoma State Guard Revolving Fund”. The fund
685685 shall be a continuing fund, not subject to fiscal year limitations,
686686 and shall consist of all monies received by the Department from
687687 appropriations, grants, or private donations provided for the
688688 purposes stated in this section. All monies accruing to the credit
689689 of the fund are hereby appropriated and may be budgeted and expended
690690 by the Department for the following purposes:
691691 1. Funding the positions of Oklahoma State Guard county
692692 coordinators; and
693693 2. Making grants to county coordinators to be used for training
694694 of personnel and purchasing of ammunition, weaponry, and other
695695 necessary equipment.
696696 Expenditures from the fund shall be made upon warrants issued by
697697 the State Treasurer against claims filed as prescribed by law with
