111-BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
11292 SECTION 1. NEW LAW A new section of law not to be
11393 codified in the Oklahoma Statutes reads as follows:
11494 It is the finding of the Legislature that abduction is a serious
11595 threat to the health and safety of minors in this state. The
11696 immediate notification and response to a child abduc tion greatly
11797 increases the chances of a positive outcome. Oklahoma child
11898 abduction response teams (OCARTs) are being created to facilitate
11999 efficient, effective, and coordinated law enforcement and social
120100 services responses to child abductions.
121101 SECTION 2. NEW LAW A new section of law to be codified
122102 in the Oklahoma Statutes as Section 2 -140a of Title 47, unless there
123103 is created a duplication i n numbering, reads as follows:
104+A. The Department of Public Safety is hereby authorized to
105+create and administer Oklahoma child abduction response teams
106+(OCARTs) for the purposes of mitigating child endangerment.
107+B. For purposes of this sec tion:
108+1. “Commissioner” means the Commissioner of the Department of
109+Public Safety;
110+2. “Custodial child abduction” means the abduction of a c hild
111+under the age of eighteen (18) by a custodial parent where a
112+reasonable and articulable suspicion exists that the child is i n
113+imminent danger;

150-A. The Department of Public Safety is hereby authorized to

166147 5. “Verified child abduction” means the confirmation o f a
167148 reasonable suspicion that a missing child or the victim of a
168149 custodial child abduction or non -custodial child abduction is in
169150 imminent danger.
170151 C. 1. a. The Commissioner shall create a network of Oklahoma
171152 child abduction response teams in cooperation wi th
172153 federal, state, tribal, county, and municipal law
173154 enforcement agencies, and the appropriate social
155+services agencies. The Commissioner is authorized to
156+enter into agreements with any governmental agency,
157+private person or entity, or not-for-profit
158+organization to effectuate the purposes of this act.
159+b. Each member agency of an OCART committee is
160+responsible for its own acts or o missions under The
161+Governmental Tort Claims Act, or otherwise under state
162+or federal law.

200-services agencies. The Commissioner is authorized to
201-enter into agreements with any governmental agency,
202-private person or entity, or not-for-profit
203-organization to effectuate the purposes of this act.
204-b. Each member agency of an OCART committee is
205-responsible for its own acts or o missions under The
206-Governmental Tort Claims Act, or otherwise under state
207-or federal law.
208190 c. When activated pursuant to this se ction, member
209191 agencies are exempt from the Oklahoma Central
210192 Purchasing Act.
211193 2. The Commissioner is authorized to accept contributions,
212194 donations, and gifts in support of OCART programs. All monies
213195 received by the Commiss ioner pursuant to this subsection shall be
214196 deposited to the credit of the Department of Public Safety
215197 Restricted Revolving Fund and shall be expended by the Depart ment
216198 solely for the purposes of the operation of OCART programs. All
217199 other property received by the Commissioner or designee p ursuant to
218200 this subsection shall be held by the Department in trust under the
219201 terms and conditions imposed by the donors and the title to any and
220202 all property acquired, granted, or donated to the Department shall
221203 be taken in the name of the state to be hel d for the use and benefit
222204 of education programs of the Department under the conditions of the
223205 grants or donations.

262245 2. The OCART committee shall consist of:
263246 a. the OCART coordinator who shall act as chairperson,
264247 b. one representative of the Oklahoma State Bureau of
265248 Investigation,
266249 c. one representative who is an active elec ted sheriff
267250 from the applicable region or a designee,
268251 d. one representative who is an active chief of police
269252 from the applicable region or a designee,
270253 e. one representative from the Department of Mental
271254 Health and Substance Abuse Services,
272255 f. one elected district attorney from the applicable
273256 region or a designee,
257+g. one representative from the Oklahoma Counter Terrori sm
258+Intelligence Center (OCTIC),
259+h. one representative from the Oklahoma State Bureau of
260+Narcotics and Danger ous Drugs Control,
261+i. one representative from the U.S. Marshals Service from
262+the applicable region , and
263+j. any other individuals deemed necessary by the
264+Commissioner or coordinator.

308292 3. In conjunction with the OCART coordinator, each OCART
309293 committee shall develop a plan for mounting a coor dinated response
310294 to a verified child abduction. The plan shall include, but not be
311295 limited to, an outline of the procedure for verification of a child
312296 abduction, a notification of a child abduction, outreach to local
313297 law enforcement agencies, and member a gency responsibilities in the
314298 event of a verified child abduction.
315299 E. Within four (4) hours of receiving a report of verified
316300 child abduction, the law enforcement agency receiving the report
317301 shall notify the Oklahoma Counter Terrorism Intelligence Center .
318302 F. Law enforcement agencies of this state are hereby authorized
319303 to utilize the automated license plate readers ( ALPRs) in carrying
320304 out a coordinated response to a verified child abduction.
321305 G. Each law enforcement member of an OCART committee shall
322306 receive initial training and annual refresher training as determined
323307 by the Commissioner.

662-F. Law enforcement agencies of this state are hereby authorized

671-General Revenue Fund of the State Treasury for the fiscal year
672-ending June 30, 2025, the sum of Three Hundred Thousand Dollars
673-($300,000.00) or so much thereof as may be necessary to implement
674-the provisions of this act.
675-SECTION 8. This act shall become effective July 1, 2024.
