77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. AMENDATORY 56 O.S. 2021, Section 1011.12, is
79	79	amended to read as follows:
80	80	Section 1011.12. A. The Oklahoma Health Care Authority, in
81	81	conjunction with the Department of Mental Health and Substance Abuse
82	82	Services, the State Department of Health and the State Department of
83	83	Education shall examine the feas ibility of a state plan amendment to
84	84	the Oklahoma Medicaid Program for applied behavior analysis
85	85	treatment of autism spectrum disorders .
86	86	B. On or before December 31, 2016, the Auth ority and partnering
87	87	agencies shall submit a report to the President Pro Tempore of the
88	88	Senate, the Speaker of the House of Representatives and the Governor

141	141	reviews of pilot projects and research from other states on the
142	142	effects of applied behavioral analysis treatme nt on autism spectrum
143	143	disorders.
144	144	C. 1. Beginning July 1, 2017, and subject Subject to the
145	145	availability of funding, the Authority and partnering agencies shall
146	146	draft a state plan a mendment for applied behavior analysis treatment
147	147	of individuals diagnosed with an intellectual or developmental
148	148	disability including, but not limited to, an autism spectrum
149	149	disorders. The provisions of this subsection shall only apply if
150	150	the report required by subsection B of this section demonstrates
151	151	applied behavioral analysis treatment to be evidence -based and
152	152	essential to qualifying participants in the Oklahoma Medicaid
153	153	Program disorder.
154	154	2. Treatment described in paragraph 1 of this subsection shall
155	155	consist of evidence-based care and related equipment prescribed or
156	156	ordered for an individual diagnose d with an intellectual or
157	157	developmental disability including, but not limited to, an autism
158	158	spectrum disorder by a licensed physician or a licensed doctoral -
159	159	level psychologist who determines the care to be medically necessary
160	160	including, but not limited to:
161	161	a. behavioral health treatment,
162	162	b. pharmacy care,
163	163	c. psychiatric care,

217	217	D. As used in this section:
218	218	1. “Applied behavior analysis ” means the design, implementation
219	219	and evaluation of environmental modifications, using behavioral
220	220	stimuli and consequences, to produce socially significa nt
221	221	improvement in human behavior, including the use of direct
222	222	observation, measurement and functional analysis of the relationship
223	223	between environment and behavior;
224	224	2. “Autism spectrum disorder ” means any of the pervasive
225	225	developmental disorders or autism spectrum disorders as defined by
226	226	the most recent edition of the Diagnostic and Statistical Manual of
227	227	Mental Disorders (DSM) or the edition that was in effect at the time
228	228	of diagnosis;
229	229	3. “Behavioral health treatment ” means counseling and treatment
230	230	programs, including applied behavior analysis, that are:
231	231	a. necessary to develop, maintain or restore, to the
232	232	maximum extent practicable, the functioning of an
233	233	individual, and
234	234	b. provided by a board-certified behavior analyst or by a
235	235	licensed doctoral-level psychologist so long as the
236	236	services performed are commensurate with the
237	237	psychologist’s university training and supervised
238	238	experience; and

290	290	4. “Treatment for autism spectrum disorder ” means evidence-
291	291	based care and related equipment prescribed or ordered for an
292	292	individual diagnosed with an autism spectrum disorder by a licensed
293	293	physician or a licensed doctoral -level psychologist who determines
294	294	the care to be medically necessary, including, but not limited to:
295	295	a. behavioral health treatment,
296	296	b. pharmacy care,
297	297	c. psychiatric care,
298	298	d. psychological care, and
299	299	e. therapeutic care
300	300	“Intellectual or developmental disability ” means a condition
301	301	characterized by significant limitations in both intellectual
302	302	functioning and adaptive behavior that originates before the age of
303	303	twenty-two.
304	304	SECTION 2. This act shall become effective July 1, 2024.
305	305	SECTION 3. It being immediately necessary for the preservation
306	306	of the public peace, health or safety, an emergency is hereby
307	307	declared to exist, by reason whereof this act shall take effect and
308	308	be in full force from and after its pas sage and approval.
