7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 56 O.S. 2021, Section 1011.12, is
7979 amended to read as follows:
8080 Section 1011.12. A. The Oklahoma Health Care Authority, in
8181 conjunction with the Department of Mental Health and Substance Abuse
8282 Services, the State Department of Health and the State Department of
8383 Education shall examine the feas ibility of a state plan amendment to
8484 the Oklahoma Medicaid Program for applied behavior analysis
8585 treatment of autism spectrum disorders .
8686 B. On or before December 31, 2016, the Auth ority and partnering
8787 agencies shall submit a report to the President Pro Tempore of the

142142 effects of applied behavioral analysis treatme nt on autism spectrum

144144 C. 1. Beginning July 1, 2017, and subject Subject to the
145145 availability of funding, the Authority and partnering agencies shall
146146 draft a state plan a mendment for applied behavior analysis treatment
147147 of individuals diagnosed with an intellectual or developmental
148148 disability including, but not limited to, an autism spectrum
149149 disorders. The provisions of this subsection shall only apply if
150150 the report required by subsection B of this section demonstrates
151151 applied behavioral analysis treatment to be evidence -based and
152152 essential to qualifying participants in the Oklahoma Medicaid
153153 Program disorder.
154154 2. Treatment described in paragraph 1 of this subsection shall
155155 consist of evidence-based care and related equipment prescribed or
156156 ordered for an individual diagnose d with an intellectual or
157157 developmental disability including, but not limited to, an autism
158158 spectrum disorder by a licensed physician or a licensed doctoral -
159159 level psychologist who determines the care to be medically necessary
160160 including, but not limited to:
161161 a. behavioral health treatment,
162162 b. pharmacy care,

217217 D. As used in this section:
218218 1. “Applied behavior analysis ” means the design, implementation
219219 and evaluation of environmental modifications, using behavioral
220220 stimuli and consequences, to produce socially significa nt
221221 improvement in human behavior, including the use of direct
222222 observation, measurement and functional analysis of the relationship
223223 between environment and behavior;
224224 2. “Autism spectrum disorder ” means any of the pervasive
225225 developmental disorders or autism spectrum disorders as defined by
226226 the most recent edition of the Diagnostic and Statistical Manual of
227227 Mental Disorders (DSM) or the edition that was in effect at the time
228228 of diagnosis;
229229 3. “Behavioral health treatment ” means counseling and treatment
230230 programs, including applied behavior analysis, that are:
231231 a. necessary to develop, maintain or restore, to the
232232 maximum extent practicable, the functioning of an
233233 individual, and
234234 b. provided by a board-certified behavior analyst or by a
235235 licensed doctoral-level psychologist so long as the
236236 services performed are commensurate with the
237237 psychologist’s university training and supervised

290290 4. “Treatment for autism spectrum disorder ” means evidence-
291291 based care and related equipment prescribed or ordered for an
292292 individual diagnosed with an autism spectrum disorder by a licensed
293293 physician or a licensed doctoral -level psychologist who determines
294294 the care to be medically necessary, including, but not limited to:
295295 a. behavioral health treatment,
296296 b. pharmacy care,
297297 c. psychiatric care,
298298 d. psychological care, and
299299 e. therapeutic care
300300 “Intellectual or developmental disability ” means a condition
301301 characterized by significant limitations in both intellectual
302302 functioning and adaptive behavior that originates before the age of
303303 twenty-two.
304304 SECTION 2. This act shall become effective July 1, 2024.
305305 SECTION 3. It being immediately necessary for the preservation
306306 of the public peace, health or safety, an emergency is hereby
307307 declared to exist, by reason whereof this act shall take effect and
308308 be in full force from and after its pas sage and approval.
