153153 BE IT ENACTED BY THE PEO PLE OF THE STATE OF OKLAHOMA:
154154 SECTION 1. NEW LAW A new section of law to be codified
155155 in the Oklahoma Statutes as Section 561-1 of Title 43, unless there
156156 is created a duplication in numbering, reads as follows:
157157 This act shall be known and may be cited as the “Uniform Child
158158 Abduction Prevention Act ”.
159159 SECTION 2. NEW LAW A new section of law to be codified
160160 in the Oklahoma Statutes as Se ction 561-2 of Title 43, unless there
161161 is created a duplication in numbering, re ads as follows:
162162 As used in this act:
163163 1. “Abduction” means the wrongful removal or wrongful retention
164164 of a child;
165165 2. ”Child” means an unemancipated individual who is less than
166166 eighteen (18) years of age;
167167 3. “Child custody determination ” means a judgment, decree, or
168168 other court order providing for the legal custody, physical custody,
169169 or visitation with respect to a child. The te rm includes a
170170 permanent, temporary, initial, and m odification order;
171171 4. “Child custody proceeding” means a proceeding in which l egal
172172 custody, physical custody, or visitation with respect to a child is
173173 at issue. The term includes a proceeding for divorce, dissolution
174174 of marriage, separation, neglect, abu se, dependency, guardianship,

228228 5. “Court” means an entity authorized under the law of a state
229229 to establish, enforce, or modif y a child custody determination ;
230230 6. “Petition” includes a motion or its equivalent ;
231231 7. “Record” means information that is inscr ibed on a tangible
232232 medium or that is stored in an electronic or other medium and is
233233 retrievable in perceivable form ;
234234 8. “State” means a state of the United States, the District of
235235 Columbia, Puerto Rico, the United States Virgin Islands, or any
236236 territory or insular possession subject to the jurisdiction of the
237237 United States. The term includes a federally recognized Indian
238238 tribe or nation;
239239 9. “Travel document” means records relating to a travel
240240 itinerary, including travel tickets, passes, reservations for
241241 transportation, or accommodations. The term does not include a
242242 passport or visa;
243243 10. “Wrongful removal” means the taking of a child that
244244 breaches rights of custody or visitati on given or recognized under
245245 the laws of this state; and
246246 11. “Wrongful retention” means the keeping or concealing of a
247247 child that breaches rights of custody or visitation given or
248248 recognized under the law s of this state.

303303 The provisions of the Uni form Child Custody Jurisdiction and
304304 Enforcement Act as provided in Sections 551-110, 551-111, and 551-
305305 112 of Title 43 of the Oklahoma Statutes shall apply to cooperation
306306 and communications among courts in proceeding s under this act.
307307 SECTION 4. NEW LAW A new section of law to be codified
308308 in the Oklahoma Statutes as Section 561-4 of Title 43, unless there
309309 is created a duplication in numbering, reads as follows:
310310 A. A court on its own motion may order abduction prevention
311311 measures in a child custody proceeding if the court finds that the
312312 evidence establishes a credible risk of abduction of the child.
313313 B. A party to a child custody determination or another
314314 individual or entity having a right under the law s of this state or
315315 any other state to seek a child custody determination for the child
316316 may file a petition seeking abduction prevention meas ures to protect
317317 the child under this act.
318318 C. As authorized by Section 551 -315 of Title 43 of the Okla homa
319319 Statutes, a district attorney may seek a warrant to take physical
320320 custody of a child pursuant to Section 9 of this act, or to take
321321 other appropriate prevention measures.

376376 A. A petition under this act may be filed only in a cour t that
377377 has jurisdiction to make a child custody determination with respect
378378 to the child at issue under Article 2 of the Uniform Child Custody
379379 Jurisdiction and Enforcement Act, Section 5 51-201 et seq. of Title
380380 43 of the Oklahoma Statutes.
381381 B. A court of this state has temporary emergency jurisdiction
382382 under Section 551-204 of Title 43 of the Ok lahoma Statutes if the
383383 court finds a credible r isk of abduction.
384384 SECTION 6. NEW LAW A new section of law to be codified
385385 in the Oklahoma Statutes as Sect ion 561-6 of Title 43, unless there
386386 is created a duplication in numbering, reads as follows:
387387 A petition under this act shall be verified and include a copy
388388 of any existing child custody determination, if available. The
389389 petition shall specify the risk factors for abduction, including the
390390 relevant factors described in Section 7 of this act. Subject to the
391391 subsection E of Section 5 51-209 of Title 43 of the Oklahoma
392392 Statutes, if reasonably ascertainable, the petitio n shall contain:
393393 1. The name, date of birth , and gender of the child;
394394 2. The customary address and current physical location of the
395395 child;

447447 3. The identity, customary address, and current physical
448448 location of the respon dent;
449449 4. A statement of whether a prior action to prevent abduction
450450 or domestic violence has been filed by a party or other individual
451451 or entity having custody of the child, and the date, location, and
452452 disposition of the action;
453453 5. A statement of whether a party to the proceeding has been
454454 arrested for a crime related to domestic vi olence, stalking, or
455455 child abuse or neglect, and the date, location, and disposition of
456456 the case; and
457457 6. Any other information required to be submitted to the court
458458 for a child custody determination pursuant to Section 551-209 of
459459 Title 43 of the Oklahoma Sta tutes.
460460 SECTION 7. NEW LAW A new section of law to be codified
461461 in the Oklahoma Statutes as Section 561-7 of Title 43, unless there
462462 is created a duplica tion in numbering, reads as follows:
463463 A. In determining whether there is a cred ible risk of abduction
464464 of a child, the court shall consider any evidence that the
465465 petitioner or respondent:
466466 1. Has previously abducted or attempted to abduct the child;
467467 2. Has threatened to abduct the child;
468468 3. Has recently engaged in activities that may indicate a
469469 planned abduction including but not limited to:
470470 a. abandoning employment,

523523 c. terminating a lease,
524524 d. closing bank or other financial management accounts,
525525 liquidating assets, hiding or destroying financial
526526 documents, or conducting any unusual financial
527527 activities,
528528 e. applying for a passport or visa or obtaining travel
529529 documents for the respondent, a family member, or the
530530 child, or
531531 f. seeking to obtain the child ’s birth certificate or
532532 school or medical records;
533533 4. Has engaged in domestic violence, stalk ing, or child abuse
534534 or neglect;
535535 5. Has refused to follow a child custody determination;
536536 6. Lacks strong familial, financial, emotional, or cultural
537537 ties to the state or the United States;
538538 7. Has strong familial, f inancial, emotional, or cultural ties
539539 to another state or country;
540540 8. Is likely to take the child to a country that:
541541 a. is not a party to the Hague Convention on the Civil
542542 Aspects of International Child Abduction and does not
543543 provide for the extradition of an abducting parent or
544544 for the return of an abducted child ,

596596 b. is a party to the Hague Convention on the Civil
597597 Aspects of International Child Abduction but:
598598 (1) the Hague Convention on the Civil Aspects of
599599 International Child Abduction is not in force
600600 between the United States and that country ,
601601 (2) is noncompliant according to the most recent
602602 compliance report issued by the United States
603603 Department of State, or
604604 (3) lacks legal mechanisms for immediately and
605605 effectively enforcing a return order under the
606606 Hague Convention on the Civil Aspects of
607607 International Child Abduction ,
608608 c. poses a risk that the child ’s physical or emotional
609609 health or safety would be endangered in the country
610610 because of specific circumstances relating to the
611611 child or because of human ri ghts violations committed
612612 against children,
613613 d. has laws or practices that would:
614614 (1) enable the respondent, without due cause, to
615615 prevent the petitioner from contacting the chil d,
616616 (2) restrict the petitioner from freely traveling to
617617 or exiting from the country because of the
618618 petitioner’s gender, nationality, marital status,
619619 or religion, or

671671 (3) restrict the child’s ability to legally leave the
672672 country after the child reaches the a ge of
673673 majority because of a child ’s gender,
674674 nationality, or religion ,
675675 e. is included by the United States Department of State
676676 on a current list of state sponsors of terrorism ,
677677 f. does not have an official United States diplomatic
678678 presence in the country , or
679679 g. is engaged in active military action or war, including
680680 a civil war, to whic h the child may be exposed;
681681 9. Is undergoing a change in immigration or citizenship status
682682 that would adversely affect the re spondent’s ability to remain in
683683 the United States legally;
684684 10. Has had an application for United States citizenship
685685 denied;
686686 11. Has forged or presented misleading or false evidence on
687687 government forms or supporting documents to obtain or attempt to
688688 obtain a passport, a visa, travel documents, a Social S ecurity card,
689689 a driver license, or other government -issued identification card or
690690 has made a misrepresentation to the United States government;
691691 12. Has used multiple names to attempt to mislead or defraud;
692692 or
693693 13. Has engaged in any other conduct the cour t considers
694694 relevant to the risk of abduction.

746746 B. In the hearing on a petition under this act, the court shall
747747 consider any evidence that the respondent believed in good faith
748748 that the respondent’s conduct was necessary to avoid imminent harm
749749 to the child or respondent and any other evidence that may be
750750 relevant to whether the respondent may be permitted to remove or
751751 retain the child.
752752 SECTION 8. NEW LAW A new section of law to be cod ified
753753 in the Oklahoma Statutes as Section 561-8 of Title 43, unless there
754754 is created a duplication in numbering, reads as follows :
755755 A. If a petition is filed under this act, the court may enter
756756 an order that shall include:
757757 1. The basis for the cou rt’s exercise of jurisdiction;
758758 2. The manner in which not ice and opportunity to be heard were
759759 given to the persons entitled to notice of the proceeding;
760760 3. A detailed description of each party ’s custody and
761761 visitation rights and residential arrangements for the child;
762762 4. A provision stating that a violation of the order may
763763 subject the party in violation to civil and criminal penalties; and
764764 5. Identification of the child ’s country of habitual residence
765765 at the time of the issuance of the order.
766766 B. If, at a hearing on a petition under this act or on the
767767 court’s own motion, the court after reviewing the evidence finds a
768768 credible risk of abduction of the child, the court shall enter an
769769 abduction prevention order. The order shall include the provisions

821821 required by subsection A of this section and measures and
822822 conditions, including provisions in subsections C, D, and E of this
823823 section, that are reasonably calculated to prevent abduction of the
824824 child, giving due consideration to the custody and visitation righ ts
825825 of the parties. The court shall consider the age of the child, the
826826 potential harm to the child from an abduction, the legal and
827827 practical difficulties of returning the child to the jurisdiction if
828828 abducted, and the reasons for the potential abduction, includin g
829829 evidence of domestic violence, stalking, or chil d abuse or neglect.
830830 C. An abduction prevention order may include one or more o f the
831831 following:
832832 1. An imposition of travel restrictions that require that a
833833 party traveling with the child outside a designated geographical
834834 area provide the other par ty with the following:
835835 a. the travel itinerary of the child ,
836836 b. a list of physical addresses and telephone numbers at
837837 which the child can be reached at specified times , and
838838 c. copies of all travel documents;
839839 2. A prohibition of the respondent directly or indirect ly:
840840 a. removing the child from this state, the United States,
841841 or another geographic area without permission of the
842842 court or the petitioner ’s written consent,
843843 b. removing or retaining the child in vi olation of a
844844 child custody determination,

896896 c. removing the child from school or a child -care or
897897 similar facility, or
898898 d. approaching the child at any location other than a
899899 site designated for supervised visitation;
900900 3. A requirement that a party register the order in another
901901 state as a prerequisite to allowing the child to travel to that
902902 state;
903903 4. With regard to the child ’s passport:
904904 a. a direction that the petitioner place the child’s name
905905 in the United States Department of State ’s Child
906906 Passport Issuance Alert Program,
907907 b. a requirement that the respondent surrend er to the
908908 court or the petitioner ’s attorney any United States
909909 or foreign passport issued in the child ’s name,
910910 including a passport issued in the name of both the
911911 parent and the child , and
912912 c. a prohibition upon the respondent from applying on
913913 behalf of the child for a new or replacement passport
914914 or visa;
915915 5. As a prerequisite to exer cising custody or visitation, a
916916 requirement that the respondent provide:
917917 a. to the United States Department of S tate Office of
918918 Children’s Issues and the relevant foreign consula te
919919 or embassy, an authenticated copy of the order

972972 child,
973973 b. to the court:
974974 (1) proof that the respondent has provided the
975975 information in subparagraph a, and
976976 (2) an acknowledgment in a record from the releva nt
977977 foreign consulate or embassy that no passport
978978 application has been made, or passport issued, on
979979 behalf of the child,
980980 c. to the petitioner, proof of registration with the
981981 United States Embassy or other United States
982982 diplomatic presence in the destination country and
983983 with the Central Authority for the Hague Convention on
984984 the Civil Aspects of International Child Abduction, if
985985 that Convention is in effect between the United States
986986 and the destination country, unless one of the parties
987987 objects, and
988988 d. a written waiver under the Privacy Act, 5 U.S.C.
989989 Section 552a, as amended, with respect to any
990990 document, application, or other information pertaining
991991 to the child authorizing its disclosure to the court
992992 and the petitioner; and
993993 6. Upon the petitioner’s request, a requirement that the
994994 respondent obtain an order from the relevant foreign country

10481048 D. In an abduction prevention order, the court may impose
10491049 conditions on the exerc ise of custody or visitation that:
10501050 1. Limit visitation or require that visitat ion with the child
10511051 by the respondent be supervised until the court finds that
10521052 supervision is no longer necessary and or der the respondent to pay
10531053 the costs of supervision;
10541054 2. Require the respondent to post a bond or provide other
10551055 security in an amount sufficient to serve as a financial deterrent
10561056 to abduction, the proceeds of which may be used to pay for the
10571057 reasonable expenses of recovery of the child, including reasonable
10581058 attorney fees and costs if there is an abduction; and
10591059 3. Require the respondent to o btain education on the
10601060 potentially harmful effects to the child from abduct ion.
10611061 E. To prevent imminent abduction of a child, a court may:
10621062 1. Issue a warrant to take physical c ustody of the child under
10631063 Section 9 or the law s of this state other than this act;
10641064 2. Direct the use of law enforcement to take any action
10651065 reasonably necessary to locate the child, obtain return of the
10661066 child, or enforce a custody determination under this act or the laws
10671067 of this state other than this act; or
10681068 3. Grant any other relie f allowed under the law s of this state

11211121 F. The remedies provided in this act are cumulative and do not
11221122 affect the availability of other remedies to prevent abduction.
11231123 SECTION 9. NEW LAW A new section of law to be codified
11241124 in the Oklahoma Statutes as Section 561-9 of Title 43, unless there
11251125 is created a duplication in numbering, reads as follows:
11261126 A. If a petition under this act contains allegations, and the
11271127 court finds that there is a credibl e risk that the child is
11281128 imminently likely to be wrongfully removed, the court may issue an
11291129 ex parte warrant to take physical custody of the child.
11301130 B. The respondent on a petition under subsection A of this
11311131 section shall be afforded an opportunity to be heard at the earliest
11321132 possible time after the ex parte warrant is executed, but not later
11331133 than the next judicial day unless a hearing on that date is
11341134 impossible. In such event, the court shall hold t he hearing on the
11351135 first judicial day possible.
11361136 C. An ex parte warrant under subsection A of this section to
11371137 take physical custody of a child shall:
11381138 1. Recite the facts upon which a determination o f a credible
11391139 risk of imminent wrongful removal of the chil d is based;
11401140 2. Direct law enforcement officers to take physical custody of
11411141 the child immediately;
11421142 3. State the date and time for the hearing on the petition; and
11431143 4. Provide for the safe interim placement of the child pending
11441144 further order of the court.

11961196 D. If feasible, before issuing a warrant and before determining
11971197 the placement of the child after the warrant is executed, the court
11981198 may order a search of the relevant databases of the National Crim e
11991199 Information Center system a nd similar state databases to determine
12001200 if either the petitioner or respondent has a history of domestic
12011201 violence, stalking, or child abuse or neglect.
12021202 E. The petition and warrant shall be served on the respondent
12031203 when or immediately after the child is taken into physical custody.
12041204 F. A warrant to take physical custody of a child, issued by
12051205 this state or another state, is enforceable throughout this state.
12061206 If the court finds that a less intrusive remedy will not be
12071207 effective, it may authorize law enforcem ent officers to enter
12081208 private property to take physical custody of the child. If required
12091209 by exigent circumstances, the court may authorize law enforce ment
12101210 officers to make a forcible entry at any hour.
12111211 G. If the court finds, after a hearing, that a petitioner
12121212 sought an ex parte war rant under subsection A of this section for
12131213 the purpose of harassment or in bad faith, the court may award the
12141214 respondent reasonable attorney fees, costs, and expenses.
12151215 H. This act does not affect the availability of relief al lowed
12161216 under the laws of this state other than this act.

12781278 of Title 43 of the Oklahoma Statutes or other applicable laws of

12931293 authorize electronic delivery of any of the notices described in
