4365 An Act relating to cosmetology and barbering;

5577 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5678 SECTION 1. AMENDATORY 59 O.S. 2021, Section 199.2, is
5779 amended to read as follows:
5880 Section 199.2. A. 1. There is hereby re-created, to continue
5981 until July 1, 2024 2025, in accordance with the provisions of the
6082 Oklahoma Sunset Law, a State Board of Cosmetology and Barbering
6183 which shall be composed of e leven (11) members to be appointed by
6284 the Governor and to serve at the pleasure of the Governor. On July
6385 1, 2025, the State Board of Cosmetology and Barbering and all duties
6486 and responsibilities associated with the Oklahoma Cosmetology and
87+Barbering Act shall be transferred to the State Department of
88+Health.

92-Barbering Act shall be transferred to the State Department of
93-Health.
94140 2. One member shall be appointed from each congressional
95141 district and the additiona l members shall be appointed at -large.
96142 However, when congressional distric ts are redrawn, each member
97143 appointed prior to July 1 of the year in which such modification
98144 becomes effective shall complete the current term of office and
99145 appointments made after J uly 1 of the year in which such
100146 modification becomes effective shall be ba sed on the redrawn
101147 districts. Appointments made after July 1 of the year in which such
102148 modification becomes effective shall be from any redrawn districts
103149 which are not represented by a board member until such time as each
104150 of the modified congressional dis tricts are represented by a board
105151 member. One member shall be a barber appointed at -large.
106152 3. At the time of appointment, the members shall be citizens of
107153 this state, at least twen ty-five (25) years of age, and shall be
108154 high school graduates. Six members shall, at the time of
109155 appointment, have had at least five (5) years’ continuous practical
110156 experience in the practice of cosmetology in this state; one member
111157 shall be appointed at large and, at the time of the appointment,
112158 have had at least five (5) year s’ continuous practical experience in
113159 the practice of barbering in this state; one member shall be a lay
114160 person; one member shall be an administrator of a licensed private
115161 cosmetology school; one member shall be an administrator of a
162+licensed barber school ; and one member shall be an administrator of
163+a public school licensed to teach cosmetology or ba rbering.

143-licensed barber school ; and one member shall be an administrator of
144-a public school licensed to teach cosmetology or ba rbering.
145215 4. No two members shall be graduates of the same cosmetology
146216 school, nor shall they be organizers of or promote the organizat ion
147217 of any cosmetic, bea uty, or hairdressers’ association. Each of the
148218 eight cosmetology appointees shall continue to be ac tively engaged
149219 in the profession of cosmetology while serving . No two members
150220 engaged in the profession of barbering shall be organ izers of or
151221 promote the organization of any barbering association . Each of the
152222 two barbering appointees shall continue t o be actively engaged in
153223 the profession of barbering while serving.
154224 5. If any member retires or ceases to practice his or her
155225 profession during the term of me mbership on the Board , such terms
156226 shall automatically cease and the Governor shall appoint a like -
157227 qualified person to fulfill the remainder of the term.
158228 B. The terms of office for B oard members shall be four (4)
159229 years ending June 30.
160230 C. Each member shall serve until a successor is appointed and
161231 qualified.
162232 D. Six members of the Board shall constitu te a quorum for the
163233 transaction of business.
164234 E. The Governor may remove any member of the Board at any time
165235 at the Governor’s discretion. Vacancies shall be f illed by
166236 appointment by the Governor for the unexpired portion of the term.
237+F. The Board shall organize by electing from its membership a
238+chair and vice-chair, each to serve for a p eriod of one (1) year .

194-F. The Board shall organize by electing from its membership a
195-chair and vice-chair, each to serve for a period of one (1) year .
196290 The presiding officer shal l not be entitled to vot e upon any
197291 question except in the case of a tie vote.
198292 Members shall be reimbursed for their a ctual and necessary
199293 traveling expenses as provided by the State Travel Reimbursement
200294 Act.
201295 G. Within thirty (30) days after the end of each fiscal year,
202296 the Board shall make a full report to the Governor of all its
203297 receipts and expenditures, and also a fu ll statement of its work
204298 during the year, together with such recommendations as the Board
205299 deems expedient.
206300 H. The Board may expend funds fo r suitable office space for the
207301 transaction of its business . The Board shall adopt a common seal
208302 for the use of the executive director in authenticating Board
209303 documents.
210304 I. The Board shall meet at its office for the transaction of
211305 such business as may come before it on the seco nd Monday in January,
212306 March, May, July, September, and November and at such other times as
213307 it may deem advisable.
214308 SECTION 2. This act shall become effective November 1, 2024.
