55 | 77 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

56 | 78 | | SECTION 1. AMENDATORY 59 O.S. 2021, Section 199.2, is |
---|
57 | 79 | | amended to read as follows: |

58 | 80 | | Section 199.2. A. 1. There is hereby re-created, to continue |
---|
59 | 81 | | until July 1, 2024 2025, in accordance with the provisions of the |
---|
60 | 82 | | Oklahoma Sunset Law, a State Board of Cosmetology and Barbering |
---|
61 | 83 | | which shall be composed of e leven (11) members to be appointed by |
---|
62 | 84 | | the Governor and to serve at the pleasure of the Governor. On July |
---|
63 | 85 | | 1, 2025, the State Board of Cosmetology and Barbering and all duties |
---|
64 | 86 | | and responsibilities associated with the Oklahoma Cosmetology and |
---|
94 | 140 | | 2. One member shall be appointed from each congressional |
---|
95 | 141 | | district and the additiona l members shall be appointed at -large. |
---|
96 | 142 | | However, when congressional distric ts are redrawn, each member |
---|
97 | 143 | | appointed prior to July 1 of the year in which such modification |

98 | 144 | | becomes effective shall complete the current term of office and |

99 | 145 | | appointments made after J uly 1 of the year in which such |

100 | 146 | | modification becomes effective shall be ba sed on the redrawn |

101 | 147 | | districts. Appointments made after July 1 of the year in which such |

102 | 148 | | modification becomes effective shall be from any redrawn districts |
---|
103 | 149 | | which are not represented by a board member until such time as each |
---|
104 | 150 | | of the modified congressional dis tricts are represented by a board |
---|
105 | 151 | | member. One member shall be a barber appointed at -large. |
---|
106 | 152 | | 3. At the time of appointment, the members shall be citizens of |
---|
107 | 153 | | this state, at least twen ty-five (25) years of age, and shall be |
---|
108 | 154 | | high school graduates. Six members shall, at the time of |
---|
109 | 155 | | appointment, have had at least five (5) years’ continuous practical |
---|
110 | 156 | | experience in the practice of cosmetology in this state; one member |
---|
111 | 157 | | shall be appointed at large and, at the time of the appointment, |
---|
112 | 158 | | have had at least five (5) year s’ continuous practical experience in |
---|
113 | 159 | | the practice of barbering in this state; one member shall be a lay |
---|
114 | 160 | | person; one member shall be an administrator of a licensed private |
---|
115 | 161 | | cosmetology school; one member shall be an administrator of a |
---|
145 | 215 | | 4. No two members shall be graduates of the same cosmetology |
---|
146 | 216 | | school, nor shall they be organizers of or promote the organizat ion |
---|
147 | 217 | | of any cosmetic, bea uty, or hairdressers’ association. Each of the |
---|
148 | 218 | | eight cosmetology appointees shall continue to be ac tively engaged |
---|
149 | 219 | | in the profession of cosmetology while serving . No two members |
---|
150 | 220 | | engaged in the profession of barbering shall be organ izers of or |
---|
151 | 221 | | promote the organization of any barbering association . Each of the |
---|
152 | 222 | | two barbering appointees shall continue t o be actively engaged in |
---|
153 | 223 | | the profession of barbering while serving. |
---|
154 | 224 | | 5. If any member retires or ceases to practice his or her |
---|
155 | 225 | | profession during the term of me mbership on the Board , such terms |
---|
156 | 226 | | shall automatically cease and the Governor shall appoint a like - |
---|
157 | 227 | | qualified person to fulfill the remainder of the term. |
---|
158 | 228 | | B. The terms of office for B oard members shall be four (4) |
---|
159 | 229 | | years ending June 30. |
---|
160 | 230 | | C. Each member shall serve until a successor is appointed and |
---|
161 | 231 | | qualified. |
---|
162 | 232 | | D. Six members of the Board shall constitu te a quorum for the |
---|
163 | 233 | | transaction of business. |
---|
164 | 234 | | E. The Governor may remove any member of the Board at any time |
---|
165 | 235 | | at the Governor’s discretion. Vacancies shall be f illed by |
---|
166 | 236 | | appointment by the Governor for the unexpired portion of the term. |
---|
196 | 290 | | The presiding officer shal l not be entitled to vot e upon any |
---|
197 | 291 | | question except in the case of a tie vote. |

198 | 292 | | Members shall be reimbursed for their a ctual and necessary |
---|
199 | 293 | | traveling expenses as provided by the State Travel Reimbursement |

200 | 294 | | Act. |

201 | 295 | | G. Within thirty (30) days after the end of each fiscal year, |
---|
202 | 296 | | the Board shall make a full report to the Governor of all its |
---|
203 | 297 | | receipts and expenditures, and also a fu ll statement of its work |
---|
204 | 298 | | during the year, together with such recommendations as the Board |
---|
205 | 299 | | deems expedient. |
---|
206 | 300 | | H. The Board may expend funds fo r suitable office space for the |
---|
207 | 301 | | transaction of its business . The Board shall adopt a common seal |
---|
208 | 302 | | for the use of the executive director in authenticating Board |
---|
209 | 303 | | documents. |
---|
210 | 304 | | I. The Board shall meet at its office for the transaction of |
---|
211 | 305 | | such business as may come before it on the seco nd Monday in January, |
---|
212 | 306 | | March, May, July, September, and November and at such other times as |
---|
213 | 307 | | it may deem advisable. |
---|
214 | 308 | | SECTION 2. This act shall become effective November 1, 2024. |
