SENATE BILL NO. 1523 By: Daniels
An Act relating to noneconomic damages; amen ding 23
O.S. 2021, Section 61, which rel ates to obligation
not arising from contract; prohibiting party from
referencing noneconomic da mages to jury in certain
actions; and providing an effective date.
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. AMENDATORY 23 O.S. 2021, Section 61, is
amended to read as follows:
Section 61. A. For the breach of an obligation not arising
from contract, the measure of dama ges, except where otherwise
expressly provided by this chapter, is the amount which will
compensate for all detriment proximately caused thereby, whether it
could have been anticipated or not.
B. In a trial in an action for the brea ch of an obligation n ot
arising from contract, a p arty or counsel for a pa rty shall not seek
or refer to a specific dollar amount, state a range, or suggest a
mathematical formula for the jury to consider with respect to an
award for noneconomic dam ages.
SECTION 2. This act shall become effective November 1, 2024.
