6565 An Act relating to schools; amending 70 O.S. 2021,

7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 70 O.S. 2021, Section 1 -109, is
8181 amended to read as follows:
8282 Section 1-109. A. For all public schools in Oklahoma this
8383 state, school shall actually be in session and classroom instruction
8484 offered:
8585 1. For not less tha n one hundred eighty (180) days; or
8686 2. For not less than one thousand eighty (1,080) hours each
8787 school year, if a district board of education adopts a school -hours
8888 policy and notifies the St ate Board of Education prior to October 15
8989 of the applicable scho ol year; or

141141 3. Beginning with the 2021-2022 2024-2025 school year, for not
142142 less than one thousand eighty (1,080) hours with a minim um of one
143143 hundred sixty-five (165) one hundred fifty (150) days of instruction
144144 each school year, if a district board of education adopts a school -
145145 hours policy and notifies the State Board of Education prior to
146146 October 15 of the applicable school year; or
147147 4. Beginning with the 20 21-2022 school year, for not less t han
148148 one thousand eighty (1,080) hours each school year, if a district
149149 board of education adopts a s chool-hours policy, notifies the State
150150 Board of Education prior to October 15 of the applicable school year
151151 and meets the requirements established by the State Board of
152152 Education pursuant to subsection H of this section .
153153 B. A school district may not count more than thirty (30) hours
154154 each school year that are used for at tendance of professional
155155 meetings toward the one hundred eighty (180) days or one thousand
156156 eighty (1,080) hours of classroom instruction time required in
157157 subsection A of this section.
158158 C. Teachers off contract with an employing district shall not
159159 be required by the employing school district to att end professional
160160 meetings unless the teacher is paid additional compensation for the
161161 additional time. Teachers may be paid additional compensation for
162162 attending professional meetings in excess of their contract te rm.
163163 Subject to district board of educatio n policy or collective
164164 bargaining agreement, addi tional paid professional days may be

216216 granted for individual teachers to attend or participate in
217217 professional meetings, staff development training, or National Boa rd
218218 certification portfolio development as pr ovided for in Section 6 -
219219 204.2 of this title.
220220 D. A school district may authorize parent -teacher conferences
221221 to be held during a regular school day. If authorized by the school
222222 district, parent-teacher conferences shall be counted as classroom
223223 instruction time for no more than six (6) hours per semester, for a
224224 total of twelve (12) hours per school year.
225225 E. A school district may maintain school for le ss than a full
226226 school year only when conditions beyond the contr ol of school
227227 authorities make the maintenanc e of the term impossible and the
228228 State Board of Education has been apprised and has expressed
229229 concurrence in writing.
230230 F. The State Board of Educati on shall establish criteria for an
231231 extended-day schedule for schoo ls subject to paragraph 1 of
232232 subsection A of this section. The criteria shall:
233233 1. Prescribe a lengthened school day within limits determined
234234 not to be detrimental to quality instruction;
235235 2. Ensure that the s chedule is equivalent in annual hours of
236236 instruction to the one-hundred-eighty-day school year specified in
237237 paragraph 1 of subsection A of this section; and

289289 3. Be consistent with the provisions of this section and
290290 Sections 1-111 and 1-112 of this title, but may result in fewer
291291 annual days of instruct ion.
292292 G. Notwithstanding the provisions of subsection F of this
293293 section, a school district board of education subject to paragraph 1
294294 of subsection A of this section may adopt and implement a n extended-
295295 day schedule subject to the following requirements:
296296 1. The annual number of hours of instruction shall equal or
297297 exceed one thousand eighty (1,080) hours, which is the equivalent of
298298 one hundred eighty (180) days of instruction as specified in
299299 subsection A of this section for six (6) hours each day as specified
300300 in Section 1-111 of this title;
301301 2. The annual number of days of instruction shall equal o r
302302 exceed one hundred eighty (180) days as specified in subsection A of
303303 this section;
304304 3. The schedule adopted shall be consistent with the provisions
305305 of Sections 1-111 and 1-112 of this title, except that fo r not more
306306 than one (1) day per week, a school day shall consist of not less
307307 than five (5) hours devoted to academic instruction in a regular
308308 classroom setting;
309309 4. The district shall hold a public hearing prior to the
310310 adoption of an extended-day schedule authorized pursuant to this
311311 subsection; and

363363 5. The district shall document the impact on student
364364 achievement as determined by the academic performa nce data score and
365365 any other relevant factors that are a result of implementation of an
366366 extended-day schedule authorized pursuant to this subsection and
367367 provide an annual report to the State Board of Education of the
368368 results. If improvement in student ach ievement cannot be documented
369369 in the report, the district board of education shall revoke
370370 authorization as provided by this subsection. If the district does
371371 not revoke authorization after student achievement is not documented
372372 in the report, the State Boar d of Education may d eny accreditation
373373 of any school in violation of this subsection.
374374 H. Beginning with the 2021-2022 school year, a school district
375375 board of education may adopt a school -hours policy as provided for
376376 by paragraph 4 of subsection A of this s ection only if it meets or
377377 exceeds the minimum guidelines for stud ent performance and school
378378 district cost savings established by the State Board of Educatio n.
379379 The State Board of Education shall promulgate rules, subject to
380380 approval by the Legislature, es tablishing the minim um guidelines for
381381 student performance and sc hool district cost savings.
382382 I. If subject to paragraph 2 of subsection A of this section , a
383383 district board of education or designee may elect to close a school
384384 during the school day for incle ment weather purposes. In such an
385385 event, the number of hours incu rred in classroom instruction time

437437 prior to school closure shall be counted toward the one thousand
438438 eighty (1,080) hours per year requirement.
439439 J. I. Nothing in this section shall be construed as affecting
440440 the right of an employing school district to req uire teachers as
441441 defined in Section 6 -101.3 of this title to work in excess of the
442442 one thousand eighty (1,080) hours required for student instruction.
443443 In addition, nothing in this section shall be construed to affect
444444 the Fair Labor Standards Act status of a ny school district employee.
445445 K. J. The provisions of this section shall not prohibit the
446446 Oklahoma School for the Blind or the Oklahoma School for the Deaf
447447 from adopting an alternative school -hours policy if the Oklahoma
448448 School for the Blind or the Oklah oma School for the Deaf notifies
449449 and receives approval from t he State Board of Education prior to
450450 October 15 of the applicable school year.
451451 SECTION 2. This act shall become effective July 1, 2024.
452452 SECTION 3. It being immediately necessa ry for the preservation
453453 of the public peace, health , or safety, an emergency is hereby
454454 declared to exist, by reason whereof thi s act shall take effect and
455455 be in full force from and after its passage and approval.
