8181 BE IT ENACTED BY THE PEOPLE OF TH E STATE OF OKLAHOMA:
8282 SECTION 1. AMENDATORY 10A O.S. 2021, Section 2 -5-204, as
8383 amended by Section 4, Chapter 375, O.S.L. 2022 (10A O.S. Supp. 2023,
8484 Section 2-5-204), is amended to r ead as follows:
8585 Section 2-5-204. A. A child who is arrested for an o ffense
8686 pursuant to subsection A, B, C, D, or E of Section 2-5-205 of this
8787 title, may, depending on the child’s age and alleged crime, be
8888 charged as a juvenile delinquent, youthful offend er, or an adult.
8989 If charged as a juvenile delinquent, a petition shall be filed. If
9090 charged as a youthful offender or adult, an information shall be

142142 filed. At any time after the child is charged as a youthful
143143 offender or adult, the d istrict attorney may dismiss the information
144144 and file a juvenile delinquent petition.
145145 B. If the child is not otherwise rep resented by counsel and
146146 either the child, his or her parent, gua rdian, or next friend
147147 requests an attorney prior to or during interro gation, or upon being
148148 charged by information, as provided in subsection A of this section,
149149 the court shall appoint an attor ney, who shall not be a district
150150 attorney, for the child regardless of any attempted waiver by the
151151 parent, guardian, or next friend of the right to be represented by
152152 counsel. If the court appoints an attorney for a child for the
153153 interrogation or at the in itial appearance, the court shall review
154154 the appointment at a subsequent hearing to determine if the child,
155155 parent, guardian, or next friend qualifies for a court-appointed
156156 attorney.
157157 C. When a person proceeds to trial as either a youthful
158158 offender or as an adult as provided by the Youthful Off ender Act,
159159 the accused person sh all have all the statutory and constitutional
160160 rights and protections o f an adult accused of a crime. All
161161 proceedings shall be as for a criminal action and the provisions of
162162 Title 22 of the Oklahoma Statutes sha ll apply, except as provided
163163 for in the Youthful Offender Act.
164164 D. All youthful offender court records for a person who is
165165 certified to stand trial as an adult or youthful offender shall be

217217 considered adult records and shall not be subject to the provisions
218218 of Chapter 6 of the Oklahoma Juvenile Code; provided, however, all
219219 reports, evaluations, motions, records, exhibi ts or documents
220220 regarding the educational history, mental health or medical
221221 treatment or condition of the person that are submitted to the co urt
222222 or admitted into evidence during the hearing on the motion for
223223 certification as a juvenile or a youthful offender or on the motion
224224 for imposition of an a dult sentence shall be confidential and shall
225225 be filed or admitted under seal, except that such records sha ll be
226226 provided to the Office of Juv enile Affairs. Any testimony regarding
227227 the reports, evaluations, mo tions, records, exhibits or documents
228228 shall be given in camera and shall not be open to the g eneral
229229 public; provided, all persons having a direct interest in the case
230230 as provided in paragr aph 1 of subsection A of Section 2-2-402 of
231231 this title shall be allo wed to be present during the testimony but
232232 shall be admonished not to discuss the testimony f ollowing the
233233 hearing. All reports, evaluations, motions, re cords, exhibits or
234234 documents shall be released from under seal by order of the court if
235235 the youthful offender is sentenced to the custody or supervis ion of
236236 the Department of Corrections by the cou rt pursuant to paragraph 1
237237 of subsection B A of Section 2-5-209 2-5-208A or subsection B of
238238 Section 2-5-210 2-5-210A of this title or if the juvenile or
239239 youthful offender is later charged as an adult with a felony crime.

291291 E. Proceedings against a youthful offen der shall be heard by
292292 any judge of the district court.
293293 F. Upon arrest and detention of a person subject to the
294294 provisions of the Youthful Offender Act, the person has the sa me
295295 right to be released on bail as would an adult in the same
296296 circumstances.
297297 G. Upon a verdict of guilty or entry of a plea of guilty or
298298 nolo contendere by a youthful offender who has been certified for
299299 the imposition of an adult sentence as provided by S ection 2-5-207
300300 2-5-207A of this title, the person may be detained in an adult jail,
301301 adult lockup, adult detention facility or o ther adult facility if
302302 that facility is licensed by the State Department of Health t o
303303 detain children under eighteen (18) years o f age while the person is
304304 awaiting housing by the Department of Corrections. In no event
305305 shall a person who was under eighteen (18) years of age at the time
306306 the offense was comm itted be sentenced to life imprisonment without
307307 the possibility of parole or be giv en a mandatory minimum sentence
308308 that carries a term of imprisonment that exceeds t wenty (20) years.
309309 H. A child or youthful offender shall be tried a s an adult in
310310 all subsequent criminal prosecutions, and shall not be subject to
311311 the jurisdiction of the juvenile court as a juvenile delinque nt or
312312 youthful offender processes in any further proceedings if:
313313 1. The child or youthful offender has been certi fied to stand
314314 trial as an adult pursuant to any certification procedure provided

366366 by law and is subsequently convicted of the alleged offense or
367367 against whom the imposition of judgment and sentence has been
368368 deferred; or
369369 2. The youthful offender has been c ertified for the impositi on
370370 of an adult sentence as provided by Section 2-5-207 2-5-207A of this
371371 title and is subsequently convicted of the all eged offense or
372372 against whom the imposition of judgment and sentencing has been
373373 deferred.
374374 I. Except as otherwise provide d in the Youthful Offe nder Act, a
375375 person who has been certifi ed as a youthful offender shall be
376376 prosecuted as a youthful offender in all subsequen t criminal
377377 proceedings until the youthful offender has attained eighteen (18)
378378 years of age.
379379 All proceedings for the commission of a crime committed after a
380380 youthful offender has reached eighteen (18) years of age shall be
381381 adult proceedings.
382382 SECTION 2. AMENDATORY 22 O.S. 2021, Section 985.1, is
383383 amended to read as follows:
384384 Section 985.1. A. When sentencing a person convicted of a
385385 criminal offense for which there is a mandatory minimum se ntence of
386386 imprisonment, the court may depart from the applicable sen tence if
387387 the court finds substantial and compelling reasons on the record,
388388 after giving due regard to the nature of the crime, history, and

440440 character of the defendant and his or her chance s of successful
441441 rehabilitation, that:
442442 1. The mandatory minimum sent ence of imprisonment is not
443443 necessary for the protection of the public; or
444444 2. Imposition of the mandatory minimum sentence of imprisonment
445445 would result in substantial injustice to the def endant; or
446446 3. The mandatory minimum sentence of imprisonment is not
447447 necessary for the protection of the public and the defendant, based
448448 on a risk and needs assessment, is eligible for an alternative
449449 court, a diversion program or community sentencing, with out regard
450450 to exclusions because of previous convictions, and has be en accepted
451451 to the same, pending sentencing.
452452 B. The Except as provided in subsection D of this section, the
453453 court shall not have the discretion to depart from the applicable
454454 mandatory minimum sentence of imprisonment on convictions for
455455 criminal offenses under the following circumstances:
456456 1. The offense for wh ich the defendant was convicted is among
457457 those crimes listed in Section 571 of Title 57 of the Oklahoma
458458 Statutes as excepted from th e definition of “nonviolent offense”;
459459 2. The offense for which the defendant was convicted was a sex
460460 offense and will requi re the defendant to register a s a sex offender
461461 pursuant to the provisions of the Sex Offenders Registration Act;
462462 3. The offense for which the defendant was convicted involved
463463 the use of a firearm;

515515 4. The offense for which the defendant was convicted is a crime
516516 listed in Section 13.1 of Title 21 of the Oklahoma Statutes
517517 requiring the defendant to serve not less than eighty -five percent
518518 (85%) of any sentence of imprisonm ent imposed by the judicial syst em
519519 prior to becoming eligible for consideration for paro le;
520520 5. The offense for which the defendant was convicted is a
521521 violation of the Trafficking in Illegal Drugs Act as provided in
522522 Sections 2-414 through 2-420 of Title 63 of the O klahoma Statutes;
523523 6. The defendant was the leader, manager or supervisor of
524524 others in a continuing criminal enterprise; or
525525 7. The offense for which the defendant was convicted is a
526526 violation of the Oklahoma An titerrorism Act as provided in Secti ons
527527 1268 through 1268.8 of Title 21 of the Oklahoma Statutes.
528528 C. Any departure from the mandatory minimum sentence as
529529 authorized in this section shall not reduce the sentence to less
530530 than twenty-five percent (25%) of th e mandatory term.
531531 D. The court shall de part from the applicable man datory minimum
532532 sentence as required pursuant to subsection G of Section 2-5-204 of
533533 Title 10A of the Oklahoma Statutes.
534534 SECTION 3. This act shall become effective November 1, 2024.
