38	43		An Act relating to schools; amending 70 O.S. 2021,
39	44		Section 24-158, as amended by Section 2, Chapter 281,
40	45		O.S.L. 2022 (70 O.S. Supp. 2023, Section 24-158),
41	46		which relates to the Oklahoma Prevention Needs
42	47		Assessment Survey; providing for administrati on of
43	48		survey only to students with certain written consent;
44	49		requiring certain notification to in clude certain
45	50		information about opting in to a survey or tool;
46	51		requiring electronic submission of certain report;
47	52		updating statutory language; providing an effective

54	59		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55	60		SECTION 1. AMENDATORY 70 O.S. 2021, Section 24 -158, as
56	61		amended by Section 2, Chapter 281, O.S.L. 2022 (70 O.S. Supp. 2023,
57	62		Section 24-158), is amended to read as follows:
58	63		Section 24-158. A. The “Oklahoma Prevention Needs Assessment
59	64		Survey” means the biennial mental heal th prevention survey o f public
60	65		school students in grades six, eight, ten , and twelve managed by the
61	66		Department of Mental Health and Substance Abuse Servic es.
62		-	B. Beginning in the 2022 -2023 school year, and biennially
63		-	thereafter, public schools shall administer the Oklahoma Prevention
64		-	Needs Assessment Survey, or an alternative survey as provided in

	94	+	B. Beginning in the 2022 -2023 school year, and biennially
	95	+	thereafter, public schools shall admini ster the Oklahoma Prev ention
	96	+	Needs Assessment Survey, or an alternative survey as provided in
91	97		subsection D of this section, only to students with written consent
92	98		as provided for in subsection E of this section for the purpose of
93	99		providing direction to scho ols, school districts, and communities to
94	100		effectively improve the lives of students regarding a variety of
95	101		issues with a focus on alcohol, tobacco, other drug use, mental
96	102		health, academic failure , and violence.
97	103		C. The Department of Mental Health and Subst ance Abuse Services
98	104		shall maintain the Oklahoma Preven tion Needs Assessment Survey and
99	105		shall provide technic al assistance for schools in survey
100	106		administration, reporting, planning , and development of school
101	107		mental health prevention and intervention strateg ies informed by the
102	108		survey results.
103	109		D. If a school or school district chooses to administer an
104	110		alternative survey or assessment tool to fulfill the purpo se
105	111		described in subsection B of this se ction, it may apply for a waiver
106	112		through the Department of Ment al Health and Substance Abuse
107	113		Services.
108	114		E. The school district superintendent or his or her designee
109	115		shall provide prior written notification to the parents or legal
110	116		guardians of students to be administered the Oklahoma Prevention
111	117		Needs Assessment Survey or an alternative survey or assessment tool
112		-	adopted pursuant to subsection D of this section. The notification
113		-	shall include information to parents and l egal guardians that they
114		-	may opt their student out of in to the survey or assessment tool by

	145	+	adopted pursuant to subsection D of this section . The notification
	146	+	shall include information to parents and l egal guardians that they
	147	+	may opt their student out of in to the survey or assessment tool by
141	148		providing written notice consent to the school district. Only
142	149		students whose parents or legal guardians have provided written
143	150		consent to participate in the Oklahoma Prevention Needs Assessment
144	151		Survey or an alternative survey or asses sment tool shall be
145	152		administered the survey or tool.
146	153		F. Prior to the biennial administration of the Oklahoma
147	154		Prevention Needs Assessment Survey, the Department of Mental Health
148	155		and Substance Abuse Services shall electronically submit the survey
149	156		to the President Pro Tempore of the Oklahoma State Senate, the
150	157		Speaker of the Oklahoma House of Representatives, the chairs of the
151	158		committees with responsibility over common ed ucation in both houses
152	159		of the Legislature, and the chairs of the committees with
153	160		responsibility over public health in bot h houses of the Legisla ture.
154	161		G. The provisions of this section shall be subjec t to the
155	162		availability of federal funding . If federal funding is insufficient
156	163		to provide the Oklahoma Prevention N eeds Assessment Survey to public
157	164		schools on a biennial basis, administration of the survey shall not
158	165		be required administered.
159	166		H. The Board of Mental H ealth and Substance Abuse Services and
160	167		the State Board of Education may promulgate rules as necessary to
161	168		carry out the provisions of this section.
162		-	SECTION 2. This act shall become ef fective July 1, 2024.
163		-	SECTION 3. It being immediately necessary for the preservation
164		-	of the public peace, health, or safety, an emergency is hereby

	198	+	of the public peace, health, or safety, an emergency is hereby
191	199		declared to exist, by reason whereof thi s act shall take effect and
192	200		be in full force from and after its passage and approval.
