3843 An Act relating to schools; amending 70 O.S. 2021,
3944 Section 24-158, as amended by Section 2, Chapter 281,
4045 O.S.L. 2022 (70 O.S. Supp. 2023, Section 24-158),
4146 which relates to the Oklahoma Prevention Needs

5459 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5560 SECTION 1. AMENDATORY 70 O.S. 2021, Section 24 -158, as
5661 amended by Section 2, Chapter 281, O.S.L. 2022 (70 O.S. Supp. 2023,
5762 Section 24-158), is amended to read as follows:
5863 Section 24-158. A. The “Oklahoma Prevention Needs Assessment
5964 Survey” means the biennial mental heal th prevention survey o f public
6065 school students in grades six, eight, ten , and twelve managed by the
6166 Department of Mental Health and Substance Abuse Servic es.
62-B. Beginning in the 2022 -2023 school year, and biennially
63-thereafter, public schools shall administer the Oklahoma Prevention
64-Needs Assessment Survey, or an alternative survey as provided in

94+B. Beginning in the 2022 -2023 school year, and biennially
95+thereafter, public schools shall admini ster the Oklahoma Prev ention
96+Needs Assessment Survey, or an alternative survey as provided in
9197 subsection D of this section, only to students with written consent
9298 as provided for in subsection E of this section for the purpose of
9399 providing direction to scho ols, school districts, and communities to
94100 effectively improve the lives of students regarding a variety of
95101 issues with a focus on alcohol, tobacco, other drug use, mental
96102 health, academic failure , and violence.
97103 C. The Department of Mental Health and Subst ance Abuse Services
98104 shall maintain the Oklahoma Preven tion Needs Assessment Survey and
99105 shall provide technic al assistance for schools in survey
100106 administration, reporting, planning , and development of school
101107 mental health prevention and intervention strateg ies informed by the
102108 survey results.
103109 D. If a school or school district chooses to administer an
104110 alternative survey or assessment tool to fulfill the purpo se
105111 described in subsection B of this se ction, it may apply for a waiver
106112 through the Department of Ment al Health and Substance Abuse
107113 Services.
108114 E. The school district superintendent or his or her designee
109115 shall provide prior written notification to the parents or legal
110116 guardians of students to be administered the Oklahoma Prevention
111117 Needs Assessment Survey or an alternative survey or assessment tool
112-adopted pursuant to subsection D of this section. The notification
113-shall include information to parents and l egal guardians that they
114-may opt their student out of in to the survey or assessment tool by

145+adopted pursuant to subsection D of this section . The notification
146+shall include information to parents and l egal guardians that they
147+may opt their student out of in to the survey or assessment tool by
141148 providing written notice consent to the school district. Only
142149 students whose parents or legal guardians have provided written
143150 consent to participate in the Oklahoma Prevention Needs Assessment
144151 Survey or an alternative survey or asses sment tool shall be
145152 administered the survey or tool.
146153 F. Prior to the biennial administration of the Oklahoma
147154 Prevention Needs Assessment Survey, the Department of Mental Health
148155 and Substance Abuse Services shall electronically submit the survey
149156 to the President Pro Tempore of the Oklahoma State Senate, the
150157 Speaker of the Oklahoma House of Representatives, the chairs of the
151158 committees with responsibility over common ed ucation in both houses
152159 of the Legislature, and the chairs of the committees with
153160 responsibility over public health in bot h houses of the Legisla ture.
154161 G. The provisions of this section shall be subjec t to the
155162 availability of federal funding . If federal funding is insufficient
156163 to provide the Oklahoma Prevention N eeds Assessment Survey to public
157164 schools on a biennial basis, administration of the survey shall not
158165 be required administered.
159166 H. The Board of Mental H ealth and Substance Abuse Services and
160167 the State Board of Education may promulgate rules as necessary to
161168 carry out the provisions of this section.
162-SECTION 2. This act shall become ef fective July 1, 2024.
163-SECTION 3. It being immediately necessary for the preservation
164-of the public peace, health, or safety, an emergency is hereby

196+SECTION 2. This act shall become effective July 1, 2024.
197+SECTION 3. It being immediately necessary for the preservation
198+of the public peace, health, or safety, an emergency is hereby
191199 declared to exist, by reason whereof thi s act shall take effect and
192200 be in full force from and after its passage and approval.
