73	73	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
74	74	SECTION 1. AMENDATORY 21 O.S. 2021, S ection 852.1, is
75	75	amended to read as follows:
76	76	Section 852.1. A. A person who is the parent, guardian, or
77	77	person having custody or control over a child as defined in Section
78	78	1-1-105 of Title 10A of the Oklahoma Statutes, commits child
79	79	endangerment when the person:
80	80	1. Knowingly permits physical or sexual abuse of a child;
81	81	2. Knowingly permits a c hild to be present at a loca tion where
82	82	a controlled dangerous substance is being manufac tured or attempted
83	83	to be manufactured as defined in Section 2 -101 of Title 63 of the
84	84	Oklahoma Statutes;

136	136	3. Knowingly exposes a child to secondhand smoke of marijuana
137	137	or a drug or screening test of a child indicates the presence of
138	138	tetrahydrocannabinols ;
139	139	4. Knowingly permits a child to be present in a vehicle when
140	140	the person knows or should have known that the operator of the
141	141	vehicle is impaired by or is under the influ ence of alcohol or
142	142	another intoxicating substance; or
143	143	4. 5. Is the driver, operator, or person in physical control of
144	144	a vehicle in violation of Section 11 -902 of Title 47 of the Oklahoma
145	145	Statutes while transporting or hav ing in the vehicle s uch child or
146	146	children.
147	147	However, it is an affirmative defens e to this paragraph if the
148	148	person had a reasonable apprehension that any action to stop the
149	149	physical or sexual abuse or deny permission for the child to be in
150	150	the vehicle with an intoxicated person would result in substantial
151	151	bodily harm to the person or the child.
152	152	Nothing in this subsection shall prohibit the prosecution of a
153	153	person pursuant to the provisions of Section 11 -902 or 11-904 of
154	154	Title 47 of the Oklahoma Statutes.
155	155	B. The provisions of th is section shall not apply to any
156	156	parent, guardian or other person having custody or control of a
157	157	child for the sole reason that the parent, guardian or other person
158	158	in good faith selects and depends upon spiritual means or prayer for
159	159	the treatment or cure of disease or remedial care for such child.

211	211	This subsection shall in no way limit or modify the protections
212	212	afforded said such child in Section 852 of this title or Section 1 -
213	213	4-904 of Title 10A of the Oklahoma Statutes.
214	214	C. Any person convicted of violating a ny provision of this
215	215	section shall be guilty of a felo ny punishable by imprisonment in
216	216	the custody of the Department of Corrections for a term of not more
217	217	than four (4) years, or by a fine not exceeding Five Thousand
218	218	Dollars ($5,000.00), or by both such fine and imprisonment.
219	219	SECTION 2. This act shall become effective November 1, 2024.
