8585 BE IT ENACTED BY THE PEOPLE OF THE STAT E OF OKLAHOMA:
8686 SECTION 1. AMENDATORY 70 O.S. 2021, Section 8 -101.2, as
8787 amended by Section 1, Chapter 193, O.S .L. 2022 (70 O.S. Supp. 2023,
8888 Section 8-101.2), is amended to read as follows:
8989 Section 8-101.2. A. Except as provided in subsection B of this
9090 section, on and after January 1, 2022, the transfer of a student
9191 from the district in which the student resides to another school

144144 to pursue shall be granted at any time in the year unless the number
145145 of transfers exceeds the capacity of a grade level for each school
146146 site within a school district . If the capacity of a grade level for
147147 each school site within a school district i s insufficient to enroll
148148 all eligible students, the school district sha ll select transfer
149149 students in the order in which the district received the student
150150 transfer applications . The capacity of a schoo l district shall be
151151 determined by the school district bo ard of education based on its
152152 policy adopted pursuant to subsection B of this section. A student
153153 may be granted a one-year transfer and may automatically continue to
154154 attend the school each school yea r to which the student transferred
155155 with the approval of the receiving district. At the end of each
156156 school year, a school dis trict may deny continued transfer of the
157157 student for the reasons outlined in paragraphs 1 and 2 of subsec tion
158158 B of this section. Any brother or sister of a student who transfers
159159 may attend the school district to whic h the student transferred, if
160160 the school district policy gives preference to sibling transfers
161161 regardless of capacity, and the brother or sister of the transferred
162162 student does not meet a basis for denial as outl ined in paragraphs 1
163163 and 2 of subsection B of this section. Any child in the custody of
164164 the Department of Human Services in fos ter care who is living in the
165165 home of a student who transfers may attend the school distr ict to
166166 which the student transferred . Except for a child in the custody of
167167 the Department of Human Services in foster care, a transfer s tudent

219219 shall not transfer more than two (2) times per school year to one or
220220 more school districts in which the student does not reside, provided
221221 that the student may always reenroll at any time in his or her
222222 school district of residence. At the discretion of the receiving
223223 district, a student who has attend ed a school district as a resident
224224 student for at least three (3) y ears prior to becoming eligible to
225225 apply as a transfer student may be allowed to transfer to the school
226226 district regardless of capac ity.
227227 If the grade a student is entitled to pursue is not offered in
228228 the district where the student resides, the transfer sha ll be
229229 automatically approved.
230230 B. Each school district board of education shal l adopt a policy
231231 to determine the number of transfer students the school dist rict has
232232 the capacity to accept in each grade level for each school site
233233 within a school district no later than January 1, 2022 . The policy
234234 may include:
235235 1. The acts and reasons outlined in Section 24-101.3 of this
236236 title as a basis for denial of a transfer; and
237237 2. A history of absences as a basis fo r denial of a transfer.
238238 For the purposes of this secti on, “history of absences” means ten or
239239 more absences in one semester that are not excused for the re asons
240240 provided for in subsection B of Section 10 -105 of this title or due
241241 to illness.

293293 The policy shall be publicly posted on the school district
294294 website.
295295 C. 1. Each school district board of education shall include in
296296 its transfer policy adopted pu rsuant to subsection B of this section
297297 an exception for the emergency transfer of a student who has been
298298 the victim of bullying or threatening behavior as defined in Section
299299 24-100.3 of this title. The parent of the student shall file a
300300 written application for an emergency transfer with the
301301 superintendent of the receiving school district. Upon verification
302302 by the receiving school distri ct that the student was the victim of
303303 bullying or threatening behavior and that the sending school
304304 district was notified of the incident or incidents prior to the
305305 filing of the request to transfer, the receiving school district
306306 shall approve the transfer.
307307 2. The transfer policy may include a provision prohi biting the
308308 transfer of a student who committed bullying or threatening behavior
309309 against a student granted an emergency transfer pursuant to
310310 paragraph 1 of this subsection if the receiving school district
311311 receives verification from the sending school district that it was
312312 notified of the incident or incidents prior to the filing of the
313313 request to transfer.
314314 D. By the first day of January, Ap ril, July, and October, the
315315 school district board of education shall establish the number of

367367 transfer students the school d istrict has the capacity to accept in
368368 each grade level for each school site within a school district.
369369 D. E. After establishing the number of transfer students the
370370 school district has the capacity to accept in each grade level for
371371 each school site within a sc hool district, the board of education
372372 shall:
373373 1. Publish in a prominent place on the school dis trict website
374374 the number of transfer students for each grade level for each school
375375 site within a school district which the school district has the
376376 capacity to accept; and
377377 2. Report to the State Department o f Education the number of
378378 transfer students for each gr ade level for each schoo l site within a
379379 school district which the school distr ict has the capacity to
380380 accept.
381381 E. F. If a transfer request is denied by the sc hool district,
382382 the parent of the student may a ppeal the denial within ten (10) days
383383 of notification of the denial to the receiving school district board
384384 of education. The receiving school district board of education
385385 shall consider the appeal at its next r egularly scheduled board
386386 meeting. If the receiving school district board of education denies
387387 the appeal, the parent of the studen t may appeal the denial within
388388 ten (10) days of notification of the appeal denial to the State
389389 Board of Education. The parent shall submit to the State Board of
390390 Education and the superintendent of the receiving school a notice of

442442 appeal on a form prescrib ed by the State Board of Education. The
443443 appeal shall be considered by the State Board of Education at its
444444 next regularly scheduled meeting, where the parent and a
445445 representative from the receiving school district may address t he
446446 Board. The State Board of Education shall promulgate rules to
447447 establish the appeals process authorized by this subsection.
448448 F. G. Each school district boa rd of education shall
449449 electronically submit to the State Department of Education the
450450 number of student transfers app roved and denied and whether each
451451 denial was based on capacity, acts and re asons outlined in Section
452452 24-101.3 of this title, or a history of absences as p rovided for in
453453 paragraph 2 of subsection B of th is section. The State Department
454454 of Education shall pu blish the data on its websit e and make the data
455455 available to the Office of Educational Quality and A ccountability.
456456 G. H. Each year, the Office of Educational Quality and
457457 Accountability shall ran domly select ten percent (10%) of the school
458458 districts in the state and conduct an audit of each district’s
459459 approved and denied transfe rs based on the provisions of the
460460 policies adopted by the respective school dis trict board of
461461 education. If the Office finds inac curate reporting of capacity
462462 levels by a school distric t, the Office shall set the capacity for
463463 the school district.
464464 SECTION 2. This act shall become effective July 1, 2024.

516516 SECTION 3. It being immediately necessa ry for the preservation
517517 of the public peace, health , or safety, an emergency is hereby
518518 declared to exist, by reason whereof thi s act shall take effect and
