7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF O KLAHOMA:
7878 SECTION 1. AMENDATORY 30 O.S. 2021, Section 2-101, is
7979 amended to read as follows:
8080 Section 2-101. A. The When the court of each a county, when it
8181 appears determines it necessary or convenient, such court may
8282 appoint guardians a guardian or guardians for the persons and
8383 estates, or either, person or estate or both of them, of minors a
8484 minor.
8585 B. Such appointment may be made on the verified petition of a
8686 relative or other pe rson in on behalf of such minor.
8787 C. 1. Before making the appointment, the court may receive an

140140 prospective guardian. The investig ation and report of the
141141 prospective guardian and placement restrictions and requirements
142142 shall be made pursuant to the requirements of the Oklahoma Adoption
143143 Code. In determining whether to require a home study pursuant to
144144 the provisions of this paragraph, the court shall balance the need
145145 for a home study to prot ect the best interests of the minor with the
146146 ability of the prospective guardian to pay for the home study.
147147 2. a. Costs of the home study shall be assessed against any
148148 private child-placing agency having custody of the
149149 child, or the person having legal custody of the
150150 child, or the prospective guardian or guardians of the
151151 child.
152152 b. (1) For any child in the custody of the Department of
153153 Human Services or the Department Office of
154154 Juvenile Justice Affairs, the applicable
155155 Department or Office shall conduct or pro vide for
156156 the home study for such child as required by the
157157 Oklahoma Children’s Code or the Oklahoma Juvenile
158158 Code.
159159 (2) The Department of Human Services or the
160160 Department Office of Juvenile Justice Affairs
161161 shall not be required by any court to conduct o r
162162 provide for a home study and report to the court

217217 c. (1) No child temporarily residing in a licensed,
218218 certified domestic violence shelter in this state
219219 or another state shall be removed by an ex parte
220220 order or without proper notice for an evidentiary
221221 hearing for custody modification.
222222 (2) No child temporarily residing in a licensed,
223223 certified domestic violence shelter in this state
224224 or another state shall be removed by a
225225 guardianship custody order when a valid
226226 protective order has been issued for the
227227 custodial parent of the child.
228228 3. An order appointing a guardian of the minor who has a parent
229229 living or other person legally responsible for the child shall
230230 comply with the provisions of Section 2 -108 of this title.
231231 4. Except in the case of an emergency guardianship placement,
232232 the court shall receive a background check for a prospective
233233 guardian and all other household members eighteen (18) years of age
234234 and older, consisting of a review of a national fingerprint -based
235235 criminal background check or an Oklahoma State Bureau of
236236 Investigation name-based criminal history background check, a search
237237 of the Department of Corrections’ files maintained pursuant to the
238238 Sex Offenders Registration Act, and a search of the child abuse and

290290 neglect information system (CANIS) maintained for review by
291291 authorized entities by the Department of Human Services. The
292292 Department may charge a fee not to exceed Thirty -five Dollars
293293 ($35.00) for each search performed pursuant to this paragraph . In
294294 the case of an emergency placement, the court may waive the
295295 requirement for a CANIS search if it cannot be obtained in a
296296 reasonable time and the c ourt determines that it is in the minor ’s
297297 best interest that the CANIS search be waived.
298298 D. In addition, before Before making the appointment, the court
299299 must shall cause notice of the hearing on the petition for
300300 appointment of a guardian for a minor to be given in the form
301301 required by the court to the minor if the minor has attained the age
302302 of fourteen (14) as of the date the petition is filed. The court
303303 shall also cause notice to be sent to the following persons:
304304 1. The then-living parents of the minor and any other person
305305 having custody of the minor, if such parent or person is not one of
306306 the petitioners;
307307 2. If the minor has no then -living parent, then to one of the
308308 then-living grandparents who is not one of the petitioners and who
309309 is not married to one of the petitioners; and
310310 3. If there is no such then-living grandparent or if there is
311311 no such then-living grandparent whose address is known to the
312312 petitioner, then notice shall be given to an adult relative, if any,
313313 of the minor residing in the county in which the petition was filed.

365365 E. Such notice and a copy of the petition for guardianship
366366 shall be mailed to each person entitled to notice personally served
367367 at least ten (10) days prior to the date set by the court for a show
368368 cause hearing on the petition pursuant to this section, at that
369369 person’s address as last-known to the petitioner , at least ten (10)
370370 days prior to the date set by the court for hearing on the petition.
371371 Provided, the court may direct a s horter notice period if the court
372372 deems such shorter notice period to be appropriate under the
373373 circumstances. If there is no person other than the mi nor who is
374374 entitled to notice, or if the address of any person, other than the
375375 minor, who is entitled to notice is not known to the petitioner, the
376376 petition shall so allege. The court may dir ect that notice, other
377377 than notice to the minor if the minor has attained the age of
378378 fourteen (14), be waived or be given to any person or persons other
379379 than the minor in such manner as the court determines and directs.
380380 SECTION 2. This act shall become effective November 1, 2024.
