66	66	defining terms; providing for certain prescription
67	67	drugs to be covered outside of certai n deductible
68	68	requirements; directing rule promulgation; providing

75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. NEW LAW A new section of law to be co dified
77	77	in the Oklahoma Statutes as Section 6060.19 of Title 36, unless
78	78	there is created a duplication in numbering, reads as follows:
79	79	A. As used in this section:
80	80	1. “Chronic condition” means a serious health condition which:
81	81	a. requires periodic visits no less than twice per
82	82	calendar year for treatment by a health care provider ,
83	83	b. continues over an extended period of time, or
84	84	c. may cause episodic, rather than a continuing period

137	137	2. “High deductible health plan ” means a high deductible health
138	138	plan as defined pursuant to Section 7002 of Title 36 of the Okla homa
139	139	Statutes.
140	140	B. Any high deductible health plan that is offered, issued, or
141	141	renewed on or after the effective date of this act shall not subject
142	142	prescription drugs used to treat c hronic conditions to the annual
143	143	deductible established by the plan.
144	144	C. The Insurance Commissioner, in consultation with the
145	145	Oklahoma Health Care Authority, shall promulgate rules to es tablish
146	146	a list of qualifying prescription drugs unde r subsection B of this
147	147	section and any other rules necessary to e ffectuate the provisions
148	148	of this section.
149	149	SECTION 2. This act shall become effective January 1, 2025.
