7575 BE IT ENACTED BY THE PEOPLE O F THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 21 O.S. 2021, Section 1902, is
7777 amended to read as follow s:
7878 Section 1902. As used in the Bus Passenger Safety Act:
7979 1. “Bus” means a vehicle designed to carry passengers that is
8080 part of a network of passenger vehicles for use by the public,
8181 running on a regular schedule of routes, times , and fares;
8282 2. “Bus transportation company ” or “company” means any person
8383 or governmental entity providing for -hire transport to passengers or
8484 cargo by bus rolling stock transit vehicle s upon the roads, streets,
8585 highways, public or dedicated rights-of-way, and turnpikes of this

138138 3. “Deadly or dangerous weapon ” includes all weapons listed in
139139 Section 1287 of this title, and any other weapon capable of
140140 inflicting serious bodily injury, except for a weapon carried for
141141 lawful self-defense in compliance under the Oklahoma Self Defense
142142 Self-Defense Act;
143143 4. “Passenger” means any person served by the bus
144144 transportation company; and
145145 5. “Rolling stock transit vehicles” include buses, vans, cars,
146146 railcars, locomotives, trolley cars, ferry boats, and vehicles u sed
147147 for support services ;
148148 6. “Terminal” means a bus station, stop, platform, or depot or
149149 any facility operated or leased by or operated on behalf of a bus
150150 transportation company. This term shall incl ude a reasonable area
151151 immediately adjacent to any designated stop al ong the route traveled
152152 by any bus rolling stock transit vehicle operated by a bus
153153 transportation company and parking lots or parking areas adjacent to
154154 a terminal; and
155155 7. “Transit worker” means any employee, contractor, or
156156 volunteer working on behalf of a transit age ncy.
157157 SECTION 2. AMENDATORY 21 O.S. 2021, Section 1903, is
158158 amended to read as follows:
159159 Section 1903. A. No person shall by force or violence, or
160160 threat of force or violence, seize or exercise control of any bus
161161 rolling stock transit vehicle . Any person violating this subsection

213213 shall be guilty of a felony and shall, upon conviction, be punished
214214 by imprisonment in the custody of the Department of Correc tions for
215215 not more than twenty (20) years, or by a fine of not more than
216216 Twenty Thousand Dollars ($20,000.00), or by both such fine and
217217 imprisonment.
218218 B. In addition, no person shall intimidate, threaten, assault
219219 or batter any driver, attendant, guard , transit worker, or passenger
220220 of any bus with intent to violate subsection A of this section
221221 rolling stock transit vehicle . Any person violating this subsection
222222 shall be guilty of a felony and shall, upon conviction, be punished
223223 by imprisonment in the custody of the Department of Corrections for
224224 not more than ten (10) years, or by a fin e of not more than Five
225225 Thousand Dollars ($5,000.00), or by both such f ine and imprisonment.
226226 C. In addition, any p erson violating subsection A or B of this
227227 section using a dang erous or deadly weapon shall be guilty of a
228228 felony, and shall, upon conviction, be punished by imprisonment in
229229 the custody of the Department of Corrections for not more than
230230 twenty (20) years, or by a fine of not more than Twenty Thousand
231231 Dollars ($20,000.00), or by both such fine and imprisonment.
232232 D. It shall be unlawful for any pe rson to discharge any firearm
233233 into or within any bus rolling stock transit vehicle, terminal, or
234234 other transportation facility, unless such action is determined to
235235 have been in defensive force resulting from reasonable fear of
236236 imminent peril of death or great bodily harm to himself or herself

288288 or another. Such person shall, upon conviction, be guilty of a
289289 felony punishable by a fine of not more than Five Thousand Dollars
290290 ($5,000.00) or by imprisonment in the custody of the Department of
291291 Corrections for not more than five (5) years, or by both such fine
292292 and imprisonment.
293293 SECTION 3. It being immediately necessary for the preservation
294294 of the public peace, health or safety, an emergency is hereby
295295 declared to exist, by reason whereof this act shall take effect and
296296 be in full force from and after its passage and approval.
