75	75	BE IT ENACTED BY THE PEOPLE O F THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY 21 O.S. 2021, Section 1902, is
77	77	amended to read as follow s:
78	78	Section 1902. As used in the Bus Passenger Safety Act:
79	79	1. “Bus” means a vehicle designed to carry passengers that is
80	80	part of a network of passenger vehicles for use by the public,
81	81	running on a regular schedule of routes, times , and fares;
82	82	2. “Bus transportation company ” or “company” means any person
83	83	or governmental entity providing for -hire transport to passengers or
84	84	cargo by bus rolling stock transit vehicle s upon the roads, streets,
85	85	highways, public or dedicated rights-of-way, and turnpikes of this
86	86	state;

138	138	3. “Deadly or dangerous weapon ” includes all weapons listed in
139	139	Section 1287 of this title, and any other weapon capable of
140	140	inflicting serious bodily injury, except for a weapon carried for
141	141	lawful self-defense in compliance under the Oklahoma Self Defense
142	142	Self-Defense Act;
143	143	4. “Passenger” means any person served by the bus
144	144	transportation company; and
145	145	5. “Rolling stock transit vehicles” include buses, vans, cars,
146	146	railcars, locomotives, trolley cars, ferry boats, and vehicles u sed
147	147	for support services ;
148	148	6. “Terminal” means a bus station, stop, platform, or depot or
149	149	any facility operated or leased by or operated on behalf of a bus
150	150	transportation company. This term shall incl ude a reasonable area
151	151	immediately adjacent to any designated stop al ong the route traveled
152	152	by any bus rolling stock transit vehicle operated by a bus
153	153	transportation company and parking lots or parking areas adjacent to
154	154	a terminal; and
155	155	7. “Transit worker” means any employee, contractor, or
156	156	volunteer working on behalf of a transit age ncy.
157	157	SECTION 2. AMENDATORY 21 O.S. 2021, Section 1903, is
158	158	amended to read as follows:
159	159	Section 1903. A. No person shall by force or violence, or
160	160	threat of force or violence, seize or exercise control of any bus
161	161	rolling stock transit vehicle . Any person violating this subsection

213	213	shall be guilty of a felony and shall, upon conviction, be punished
214	214	by imprisonment in the custody of the Department of Correc tions for
215	215	not more than twenty (20) years, or by a fine of not more than
216	216	Twenty Thousand Dollars ($20,000.00), or by both such fine and
217	217	imprisonment.
218	218	B. In addition, no person shall intimidate, threaten, assault
219	219	or batter any driver, attendant, guard , transit worker, or passenger
220	220	of any bus with intent to violate subsection A of this section
221	221	rolling stock transit vehicle . Any person violating this subsection
222	222	shall be guilty of a felony and shall, upon conviction, be punished
223	223	by imprisonment in the custody of the Department of Corrections for
224	224	not more than ten (10) years, or by a fin e of not more than Five
225	225	Thousand Dollars ($5,000.00), or by both such f ine and imprisonment.
226	226	C. In addition, any p erson violating subsection A or B of this
227	227	section using a dang erous or deadly weapon shall be guilty of a
228	228	felony, and shall, upon conviction, be punished by imprisonment in
229	229	the custody of the Department of Corrections for not more than
230	230	twenty (20) years, or by a fine of not more than Twenty Thousand
231	231	Dollars ($20,000.00), or by both such fine and imprisonment.
232	232	D. It shall be unlawful for any pe rson to discharge any firearm
233	233	into or within any bus rolling stock transit vehicle, terminal, or
234	234	other transportation facility, unless such action is determined to
235	235	have been in defensive force resulting from reasonable fear of
236	236	imminent peril of death or great bodily harm to himself or herself

293	293	SECTION 3. It being immediately necessary for the preservation
294	294	of the public peace, health or safety, an emergency is hereby
295	295	declared to exist, by reason whereof this act shall take effect and
296	296	be in full force from and after its passage and approval.
