8383 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8484 SECTION 1. AMENDATORY 51 O.S. 2021, Section 152, as
8585 amended by Section 18, Chapter 228, O.S.L. 2022 (51 O.S. Supp. 2023,
8686 Section 152), is amended to read as follows:
8787 Section 152. As used in The Governmenta l Tort Claims Act:
8888 1. “Action” means a proceeding in a court of competent
8989 jurisdiction by which one party brings a suit against another;

141141 2. “Agency” means any board, commission, comm ittee, department
142142 or other instrumentality or entity designated to act i n behalf of
143143 the state or a political subdivision;
144144 3. “Charitable health care provider ” means a person who is
145145 licensed, certified, or othe rwise authorized by the laws of this
146146 state to administer health care in the ordinary course of business
147147 or the practice of a profession and who provides care to a medically
148148 indigent person, as defi ned in paragraph 9 of this section, with no
149149 expectation of or acceptance of compensation of any kind;
150150 4. “Claim” means any written demand presented by a claimant or
151151 the claimant’s authorized representative in accordance with the
152152 Governmental Tort Claims Ac t to recover money from the state or
153153 political subdivisio n as compensation for an act or omissi on of a
154154 political subdivision or the state or an employee;
155155 5. “Claimant” means the person or the person’s authorized
156156 representative who files notice of a claim in accordance with The
157157 Governmental Tort Claims Act. On ly the following persons and no
158158 others may be claimants:
159159 a. any person holding an interest in real or personal
160160 property which suffers a loss, provided that the claim
161161 of the person shall be aggregated with claims of all
162162 other persons holding an interest in the property and
163163 the claims of all othe r persons which are derivative

216216 considered a single claimant,
217217 b. the individual actually involved in the accid ent or
218218 occurrence who suffers a loss, provided that the
219219 individual shall aggregate in the claim t he losses of
220220 all other persons which are derivative of the loss, or
221221 c. in the case of death, an administrator, special
222222 administrator or a personal representat ive who shall
223223 aggregate in the claim all losses of all p ersons which
224224 are derivative of the death;
225225 6. “Community health care provider” means:
226226 a. a health care provider who v olunteers services at a
227227 community health center that has been deemed by the
228228 U.S. Department of Health and Human Services as a
229229 federally qualified health center as defined by 42
230230 U.S.C., Section 1396d(l)(2)(B),
231231 b. a health provider who provides services to a n
232232 organization that has been deemed a federally
233233 qualified look-alike community health center, and
234234 c. a health care provider who provide s services to a
235235 community health center that h as made application to
236236 the U.S. Department of Health and Human Services for
237237 approval and deeming as a federally qualified look -
238238 alike community health cent er in compliance with

291291 comments from the U.S. Department of Health and Human
292292 Services as to the status of such application with the
293293 established intent of resubmitting a modified
294294 application, or, if denied, a ne w application, no
295295 later than six (6) months from the dat e of the
296296 official notification from the U.S. D epartment of
297297 Health and Human Services requiring resubmission of a
298298 new application;
299299 7. “Employee” means any person who is authorized to act in
300300 behalf of a political subdivision or the state whether that perso n
301301 is acting on a permanent or temporary basis, with or without being
302302 compensated or on a full-time or part-time basis.
303303 a. Employee also includes:
304304 (1) all elected or appointed officers, members of
305305 governing bodies and other persons designated to
306306 act for an agency or political subdivision, but
307307 the term does not mean a person or other legal
308308 entity while acting in the capacity of an
309309 independent contractor or an employee of an
310310 independent contractor,
311311 (2) from September 1, 1991, through June 30, 1996,
312312 licensed physicians, licensed osteopathic
313313 physicians and certified nurse-midwives providing

366366 State Department of Health clients pursuant to a
367367 contract entered into with the State Department
368368 of Health in accordance with paragraph 3 of
369369 subsection B of Section 1 -106 of Title 63 of the
370370 Oklahoma Statutes but only insofar as services
371371 authorized by and in conformity with the terms of
372372 the contract and the requirements of Se ction 1-
373373 233 of Title 63 of the Oklahoma Statutes, and
374374 (3) any volunteer, full-time or part-time firefighter
375375 when performing duties for a fire department
376376 provided for in subparagraph j of paragraph 11 of
377377 this section.
378378 b. For the purpose of The Governmenta l Tort Claims Act,
379379 the following are employees of this s tate, regardless
380380 of the place in this state where du ties as employees
381381 are performed:
382382 (1) physicians acting in an administrative capacity,
383383 (2) resident physicians and resident interns
384384 participating in a graduate medical education
385385 program of the University of Oklahoma Health
386386 Sciences Center, the College of Os teopathic
387387 Medicine of Oklahoma State University, or the

446446 administrative capacity as an employee of an
447447 agency of the State of Oklahoma,
448448 (5) physicians who provide medical care to inmates
449449 pursuant to a contract with the Department of
450450 Corrections,
451451 (6) any person who is licensed to practice medic ine
452452 pursuant to Title 59 of the Oklahoma Statutes,
453453 who is under an administrative professional
454454 services contract with the O klahoma Health Care
455455 Authority under the auspices of the Ok lahoma
456456 Health Care Authority Chief Medical Officer, and
457457 who is limited to performing administrative
458458 duties such as professional guidance for m edical
459459 reviews, reimbursement rates, service
460460 utilization, health care delivery and benefit
461461 design for the Oklahoma Health Care Authority,

515515 (7) licensed medical professionals under contract
516516 with city, county, or state entiti es who provide
517517 medical care to inmat es or detainees in the
518518 custody or control of law enforcemen t agencies,
519519 (8) licensed mental health professionals as defined
520520 in Sections 1-103 and 5-502 of Title 43A of the
521521 Oklahoma Statutes, who are c onducting initial
522522 examinations of individuals for the pu rpose of
523523 determining whether an individual meets the
524524 criteria for emergency detention as part of a
525525 contract with the Department of Ment al Health and
526526 Substance Abuse Services, and
527527 (9) licensed mental health professionals a s defined
528528 in Sections 1-103 and 5-502 of Title 43A of the
529529 Oklahoma Statutes, who are providing mental
530530 health or substance abuse treatment services
531531 under a professional se rvices contract with the
532532 Department of Mental Health and Substan ce Abuse
533533 Services and are providing such treatment
534534 services at a state-operated facility.

590590 teaching duties are not employees or agents of the
591591 state.
592592 c. Except as provided in subparagraph b of this
593593 paragraph, in no event shall the state be held liable
594594 for the tortious conduct of any physician, resi dent
595595 physician or intern while practicing medicine or
596596 providing medical treatment to patients.
597597 d. For purposes of The G overnmental Tort Claims Act,
598598 members of the state military forces on state active
599599 duty orders or on Title 32 active duty orders are
600600 employees of this state, rega rdless of the place,
601601 within or outside this state, where their duties as
602602 employees are performe d;
603603 8. “Loss” means death or injury to the body or rights of a
604604 person or damage to real or personal property or rights therein;
605605 9. “Medically indigent” means a person requiring medically
606606 necessary hospital or other health care services for the person or
607607 the dependents of the person who has no public or private third-
608608 party coverage, and whose personal resources are insufficient to
609609 provide for needed health care;
610610 10. “Municipality” means any incorporated city or town, and all
611611 institutions, agencies or instr umentalities of a municipality;

663663 11. “Political subdivision” means:
664664 a. a municipality,
665665 b. a school district, including, but not li mited to, a
666666 technology center school district establishe d pursuant
667667 to Section 4410, 4411, 4420 or 4420.1 of Title 70 of
668668 the Oklahoma Statutes,
669669 c. a county,
670670 d. a public trust where the sole beneficiary or
671671 beneficiaries are a city, town, school district or
672672 county. For purposes of The Gov ernmental Tort Claims
673673 Act, a public trust shall include:
674674 (1) a municipal hospital created pursu ant to Sections
675675 30-101 through 30-109 of Title 11 of the Oklahoma
676676 Statutes, a county hospital created pursuant to
677677 Sections 781 through 796 of Title 19 of the
678678 Oklahoma Statutes, or is created pursuant to a
679679 joint agreement between such governing
680680 authorities, that is operated for the public
681681 benefit by a public trust created pursuant to
682682 Sections 176 through 180.4 of Title 60 of the
683683 Oklahoma Statutes and managed by a g overning
684684 board appointed or elected by the municipality,
685685 county, or both, who exercises control of the
686686 hospital, subject to the approval of the

751751 all of the member interest is owned, by a public

753753 e. for the purposes of The G overnmental Tort Claims Act
754754 only, a housing authority created pursuant to the
755755 provisions of the Oklahoma Housing Authority Act,
756756 f. for the purposes of The Governmental Tor t Claims Act
757757 only, corporations organized not fo r profit pursuant
758758 to the provisions of the Oklahoma General Corporation
759759 Act for the primary purpose of developing and
760760 providing rural water supply and sewage disposal
761761 facilities to serve rural residents,

983983 Provided, the acquisition of commercial liability

10381038 liabilities, immunities or defenses provided pursuant
10391039 to the provisions of the Governmental Tort Claims Act,
10401040 and all their institutions, instrumentalities or agencies;
10411041 12. “Scope of employment” means performance by an employee
10421042 acting in good faith within the duties of the e mployee’s office or
10431043 employment or of tasks lawfully assigned by a competent autho rity
10441044 including the operation or use of an agency vehicle or equipment
10451045 with actual or implied consent of the supervisor of the employee,
10461046 but shall not include corruption , or fraud, gross negligence, or
10471047 willful misconduct;
10481048 13. “State” means the State of Oklahoma or any office,
10491049 department, agency, a uthority, commission, board, institution,
10501050 hospital, college, university, public trust created pursua nt to
10511051 Title 60 of the Oklahoma Statutes of which the State of Oklahoma is
10521052 the beneficiary, or other instrumentality thereof;
10531053 14. “State active duty” shall be defined in accordance with

12621262 b. The court may award reasonable attorney and expert
12631263 witness fees to a defendant who prevails in an action
12641264 under The Governmental Tort Claims Act if the court
12651265 determines that the plaint iff had no reasonable basis
12661266 for asserting a claim or appealing an adverse dec ision
12671267 of a trial court or administrativ e law judge. Fees

12701270 B. 1. Beginning on May 28, 2003, claims shall be allowed for
12711271 wrongful criminal felony conviction res ulting in imprisonment if the
12721272 claimant has received a full pardon on the basis of a written
12731273 finding by the Governor of actual innocence for th e crime for which
12741274 the claimant was sentenced or has been granted judicial reli ef
12751275 absolving the claimant of guilt on the basis of actual innocence of
12761276 the crime for which the claimant was sentenced. The Governor or the
12771277 court shall specifically state, in the pardon or order, the evidence
12781278 or basis on which the finding of actual innocen ce is based.
12791279 2. As used in paragrap h 1 of this subsection, for a claimant to
12801280 recover based on “actual innocence”, the individual must meet the
12811281 following criteria:

13421342 the conviction for the offense, and
13431343 e. (1) in the case of a pardon, a determination was made
13441344 by either the Pardon and Parole Board or the
13451345 Governor that the offense for which the
13461346 individual was convicted, sentenced and
13471347 imprisoned, including any lesser offenses, wa s
13481348 not committed by the individual, or
13491349 (2) in the case of judicial relief, a court of
13501350 competent jurisdiction found by clear and
13511351 convincing evidence that the offense for which
13521352 the individual was convicted, sentenced and
13531353 imprisoned, including any lesser included
13541354 offenses, was not committed by the individual and
13551355 issued an order vacating, dismissing or rever sing
13561356 the conviction and sentence and providing that no

14121412 3. A claimant shall not be entitled to compensation for any
14131413 part of a sentence in prison during which the claimant w as also
14141414 serving a concurrent sentenc e for a crime not covered by this

14161416 4. The total liability of the state and its political
14171417 subdivisions on any claim within the scop e of The Governmental Tort
14181418 Claims Act arising out of wrongful criminal felony conviction
14191419 resulting in imprisonment shall not exceed One Hundred Seventy -five
14201420 Thousand Dollars ($175,000.00).
14211421 5. The provisions of this subsection shall apply to convictions
14221422 occurring on or before May 28, 2003, as well as convictions
14231423 occurring after May 28, 2003. If a court of competent j urisdiction
14241424 finds that retroactive application of this subsection is
14251425 unconstitutional, the prospective application of this subsection
14261426 shall remain valid.
14271427 C. No award for damages in an action or any claim against the
14281428 state or a political subdivision shall include punitive or exemplary
14291429 damages.
14301430 D. When the amount awarded to or settled upon multiple
14311431 claimants exceeds the limitations of this secti on, any party may
14321432 apply to the district court which has jurisdiction of the ca use to

14861486 shall be in the proportion that the r atio of the award or settlement
14871487 made to him bears to the aggregate awards and settlements for all
14881488 claims against the state or its political subdivisions aris ing out
14891489 of the occurrence. When the amount of the aggregate losses
14901490 presented by a single claimant exceeds the limits of paragraph 1 or
14911491 2 of subsection A of this section, each p erson suffering a loss
14921492 shall be entitled to that person’s proportionate share.
14931493 E. The total liability of resident physicians and interns while
14941494 participating in a graduate medica l education program of the
14951495 University of Oklahoma College of Medicine, its aff iliated
14961496 institutions and the Oklahoma College of Osteopathic Medicine and
14971497 Surgery shall not exceed One Hundred Thousand Dollars ($100,000.00).
14981498 F. The state or a political subdiv ision may petition the court
14991499 that all parties and actions arising out of a sin gle accident or
15001500 occurrence shall be joined as provided b y law, and upon order of the
15011501 court the proceedings upon good cause shown shall be continued for a
15021502 reasonable time or until such joinder has been completed. The state
15031503 or political subdivision shall be allowed to interplead in any
15041504 action which may impose on it any duty or liabili ty pursuant to The
15051505 Governmental Tort Claims Act.
15061506 G. The liability of the state or political subdiv ision under
15071507 The Governmental Tort Claims Act shall be several from that of any
15081508 other person or entity, and the sta te or political subd ivision shall

17231723 Nothing herein shall give rise to liability arising f rom the failure

17251725 the above signs, signals or warning devices. The signs, signals and
17261726 warning devices referred to herein are those used in conn ection with
17271727 hazards normally connected with the use of roadways or public way s
17281728 and do not apply to the duty to warn of special defects such as

19491949 defenses provided for politic al subdivisions pursuant to the
19501950 provisions of The Governmental Tort Claims Act. A contract entered
