7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 70 O.S. 2021, Section 1 -116, is
7777 amended to read as follows:
7878 Section 1-116. As used in this title:
7979 1. “Teacher” means any person who is e mployed to serve as
8080 district superintendent, principal, s upervisor, a counselor,
8181 librarian, school nurse or a classroom teacher or in any other
8282 instructional, supervisory or administrative capacity. T he person
8383 shall not be deemed qualified unless the person who holds a valid
8484 certificate issued by and in accordance wi th the rules of the State
8585 Board of Education or the rules of the State Board of Ca reer and
8686 Technology Education , to perform the particular services for which
8787 the person is employed;

139139 2. “Superintendent” or “superintendent of schools ” means the
140140 executive officer of the board of education and the administrative
141141 head of the school system o f a district maintaining an accredited
142142 school, provided the person holds an administrat or’s certificate
143143 recognized by the State Board of Education;
144144 3. “Principal” means any person other than a district
145145 superintendent of schools having supervisory or admin istrative
146146 authority over any school or school building having two or more
147147 teachers. A teaching principal shall be a principal who devotes at
148148 least one-half (1/2) the time school is in session to classroom
149149 teaching. Teaching principals shall be required t o hold
150150 administrative certificates;
151151 4. “Teachers” means, for purposes of complying wit h the State
152152 Aid Law and other statutes, but not any other provision of law,
153153 which apportion money on the basis of teaching units or the number
154154 of teachers employed or qu alified, all persons holding employed to
155155 serve as classroom teachers who hold proper valid certificates and
156156 connected in any capacity with the instruction of pupils issued by
157157 and in accordance with the r ules of the of the State Board of
158158 Education or the State Board of Career and Technology Education;
159159 5. “Inductee” means any certified teacher who is employed in a
160160 local school to serve as a classroom teacher under the guidance and
161161 assistance of a mentor teacher or teachers;

213213 6. “Student teacher” means any student who is enrolled in an
214214 institution of higher le arning approved by the State Board o f
215215 Education for teacher training and who is jointly assigned by the
216216 institution of higher learning and a board of education of a school
217217 district to perform practice teaching und er the direction of a
218218 regularly employed an d certified teacher. A student teacher, while
219219 serving an internship under the supervision of a certified teacher,
220220 shall be accorded the sa me protection of the laws as that accorded
221221 the certified teacher and shall be eligible to receive compensation
222222 beginning on the first day of the intern ship for up to one full
223223 school year; provided, however, that such compensation shall not be
224224 considered compensation for purposes of teacher retirement or the
225225 minimum salary schedu le;
226226 7. “School nurse” means a person emplo yed full time by a board
227227 of education who is a regi stered nurse licensed by the Oklahoma
228228 State Board of Nurse Registration and Nursing Educ ation Board of
229229 Nursing and is certified the same as a teacher by the State Board of
230230 Education. Provided , that any person who is emplo yed as a full-time
231231 school nurse in any school distr ict in Oklahoma who is not
232232 registered on July 2, 1971, may continue to serve in the same
233233 capacity; however, such person shall, under rules adopt ed by the
234234 State Board of Educa tion, attend classes in nursing and prepare to
235235 become registered.

287287 A school nurse employed by a board of education shall be
288288 accorded the same protection of laws and a ll other benefits accorded
289289 a certified teacher; and
290290 8. “Support employee” means an employee who provides those
291291 services which are not perfo rmed by certified teac hers, principals,
292292 superintendents, or administrators and which are necessary for the
293293 efficient and satisfactory functioning of a school district.
294294 SECTION 2. This act shall become effective July 1, 2024.
295295 SECTION 3. It being immediately necessary for the preservation
296296 of the public peace, health , or safety, an emergency is here by
297297 declared to exist, by reason whereof thi s act shall take effect and
298298 be in full force from and after its passage and approval.
