7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:
7676 SECTION 1. AMENDATORY 70 O.S. 2021, Section 17 -116.10,
7777 is amended to read as follows:
7878 Section 17-116.10. A. Subject to the requirements of Section
7979 6-101.2 of this title and any other applicable requirements of law,
8080 a member may enter into postretirement employment with a public
8181 school of Oklahoma and still receive monthly retirement benefits
8282 subject to the following limitations:
8383 1. A retired member is not eligibl e to be employed by the
8484 public schools of Oklahoma, in any capacity, for sixty (60) calendar
8585 days between the retiree’s last day of preretirement public
8686 education employment and any postretirement public education
8787 employment. For purposes of this section, the term “last day of

139139 preretirement employment” shall mean the last day the employee is
140140 required to be physically present on the job to complete the terms
141141 of the employment contract or agreement. An employee on paid leave
142142 is still considered to be employ ed for purposes of this section.
143143 Employment under any conditions during this time, volunteer services
144144 for the purpose of obtaining a paid p osition at a later date, or
145145 payment at a later time for services performed during this time
146146 period shall cause the forfeiture of all retir ement benefits
147147 received during the period;
148148 2. Unless otherwise provided in paragraph 3 of this subsection,
149149 earnings from the public schools may not exceed one-half (1/2) of
150150 the member’s final average salary used in computing retireme nt
151151 benefits, or the Earnings Limitation for employees allowed by the
152152 Social Security Administration, whichev er is less. For retired
153153 members under the age of sixty-two (62) years, the li mit on allowed
154154 earnings from the public schools of Oklahoma for employment for the
155155 performance of duties ordinarily performed by cl assified or
156156 nonclassified personnel shall be th e lesser of Fifteen Thousand
157157 Dollars ($15,000.00) or one-half (1/2) of the mem ber’s final average
158158 salary used in computing retirement benefits unles s the earnings
159159 limitation allowed by the Social Security Admi nistration would be
160160 greater than Fifteen Thousa nd Dollars ($15,000.00). For re tired
161161 members sixty-two (62) years of age or o lder, the limit on allowed
162162 earnings from the public schools of Oklahoma for the performance o f

214214 duties ordinarily performed by class ified or nonclassified personnel
215215 shall be the lesser of Thirty Thousand Dollars ($30, 000.00) or one-
216216 half (1/2) of the member’s final average salary used in computing
217217 retirement benefits. For pur poses of this paragraph, the following
218218 shall apply:
219219 a. earnings shall mean “regular annual compensation ” as
220220 defined in paragraph (25) of Sec tion 17-101 of this
221221 title, and shall include an y payment by a public
222222 school for services rendered by a retired member who
223223 is employed for any purpose whatsoever. Supplemental
224224 retirement payments paid by a former public schoo l
225225 employer pursuant to subsection 9 (9) of Section 17-
226226 105 of this title or other s tate law shall not be
227227 considered as earnings,
228228 b. the Earnings Limitation for employees allowed by the
229229 Social Security Administ ration to workers between the
230230 age of sixty-two (62) years and sixty-five (65) years
231231 shall apply to retired members below the age o f sixty-
232232 two (62) years,
233233 c. the limit on allowed earnings from the public schools
234234 shall be automatically adjusted effective the first
235235 day of January of each year to reflect the cu rrent
236236 Earnings Limitation for employe es as determined from
237237 time to time by the Social Security Administration,

289289 d. the earnings limit for the ca lendar year in which a
290290 member retires shall be one-twelfth (1/12) of the
291291 annual limit multiplied by the number of months the
292292 member is eligible to work and receive payments from
293293 the public schools of Oklahoma,
294294 e. earnings in excess of the maximum limit on allowed
295295 earnings from public schools of Oklahoma shall result
296296 in a loss of future retirement benefits for the yea r
297297 the postretirement employment was p erformed of One
298298 Dollar ($1.00) for each O ne Dollar ($1.00) earned over
299299 the maximum allowed earnings amount ,
300300 f. for those members age seventy (70) years and over, the
301301 earnings in excess of the maximum limit allowed
302302 earnings from public schools of Oklahoma shall be one-
303303 half (1/2) the member’s final average salary used in
304304 computing retirement benefits. Howev er, any retired
305305 member receiving benefits from the Teachers’
306306 Retirement System of Oklahoma who reached age seventy
307307 (70) years prior to July 1, 1991, shall not be
308308 restricted by the earnings limits pursuant to this
309309 subparagraph until January 1, 1994. To qualify for
310310 the provisions of this subparagraph, the mem ber must
311311 be employed less than one -half (1/2) time compared to
312312 other full-time employees in similar positions;

364364 3. Notwithstanding paragraph 2 of this subsection, a retired
365365 classified or nonclassified member who has been retired for thirty -
366366 six (36) or more months and who is employed by a public school to
367367 perform duties ordinarily performed by classified or nonclassified
368368 personnel shall be able to receive annualized e arnings from the
369369 public school with no reduction in retirement benefits regardless of
370370 the amount of annualized earnings.
371371 a. For a period of three (3) years beginning July 1,
372372 2017, members who have retired as of July 1 , 2017, as
373373 active classroom teachers, who have been retired and
374374 receiving a benefit for at least one (1) year, and who
375375 have not been employed by any public school during
376376 that one-year period, shall be eligible to be
377377 reemployed as an active classroom teache r in common or
378378 career tech school distric ts, with no limitations on
379379 earnings.
380380 b. For a period of three (3) years beginning July 1,
381381 2021, members who have retired as of July 1, 2020, who
382382 have been retired and receiv ing a benefit for at least
383383 one (1) year, and who have not been employed by any
384384 public school during that one-year period, shall be
385385 eligible to be reemployed as an active classroom
386386 teacher in common or career tech s chool districts,
387387 with no limitations on ea rnings. The one-year period

439439 starts with the retiree’s last day of preretirement
440440 public education employment.
441441 c. A retired member who has been retired and has received
442442 benefits for at least ninety (90) days shall be
443443 eligible to be reemployed as a n active classroom
444444 teacher in common or care er tech school districts with
445445 no limitations on earnings for a period of three (3)
446446 years beginning July 1, 2024 . Provided, a retiree who
447447 is reemployed under this subparagraph may not be
448448 employed as an active classroom teacher i n common or
449449 career tech school districts during the ninety-day
450450 period prior to reemployment. The ninety-day period
451451 shall commence on the date of the retiree ’s last day
452452 of preretirement public education employment.
453453 Members returning under this section shal l not be subject to any
454454 earning limitations earnings limitation following the end of the
455455 three-year periods described in this paragraph. Mem bers returning
456456 under this section shall only be employed purs uant to a temporary
457457 contract; and
458458 4. A member shall be considered to be e mployed by a school
459459 district to perform the duties ordina rily performed by classified or
460460 nonclassified personnel if the member is hired by th e school
461461 district in the member’s individual capacity to perform the duties
462462 or if the member perf orms the duties through employment with a

514514 proprietorship, partnership, corp oration, limited liability company
515515 or partnership, or any other business structure t hat has agreed or
516516 contracted to provide t he services to the school district.
517517 B. A public school district that empl oys a retired member shall
518518 be required to make contribut ions to the System for the retired
519519 member in an amount as required in Section 17-108.1 and in paragraph
520520 3 of subsection B of S ection 17-116.2 of this title.
521521 C. For purposes of this section, postretirement employment of
522522 less than one thousand (1,000) hour s per year with the Governor, the
523523 State Senate, the House of Repre sentatives or the Le gislative
524524 Service Bureau shall not be con sidered as postretirement employment
525525 with a public school of Oklahoma.
526526 D. The Board of Trustees of the Teachers’ Retirement System of
527527 Oklahoma shall promulgate such rules as are necessary to implement
528528 the provisions of this section.
529529 E. A member who has e ntered into postretirement employment with
530530 a participating employer of the Teachers’ Retirement System of
531531 Oklahoma must fully c omply with all the provisions of the rules
532532 promulgated by the Board of Trustees pursuant to this section in
533533 order to continue rec eiving his or her monthly retirement benefit.
534534 SECTION 2. This act shall become effective July 1, 2024.
535535 SECTION 3. It being immediately necessary for the preservation
536536 of the public peace, health or sa fety, an emergency is hereby
