75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:
76	76	SECTION 1. AMENDATORY 70 O.S. 2021, Section 17 -116.10,
77	77	is amended to read as follows:
78	78	Section 17-116.10. A. Subject to the requirements of Section
79	79	6-101.2 of this title and any other applicable requirements of law,
80	80	a member may enter into postretirement employment with a public
81	81	school of Oklahoma and still receive monthly retirement benefits
82	82	subject to the following limitations:
83	83	1. A retired member is not eligibl e to be employed by the
84	84	public schools of Oklahoma, in any capacity, for sixty (60) calendar
85	85	days between the retiree’s last day of preretirement public
86	86	education employment and any postretirement public education
87	87	employment. For purposes of this section, the term “last day of

139	139	preretirement employment” shall mean the last day the employee is
140	140	required to be physically present on the job to complete the terms
141	141	of the employment contract or agreement. An employee on paid leave
142	142	is still considered to be employ ed for purposes of this section.
143	143	Employment under any conditions during this time, volunteer services
144	144	for the purpose of obtaining a paid p osition at a later date, or
145	145	payment at a later time for services performed during this time
146	146	period shall cause the forfeiture of all retir ement benefits
147	147	received during the period;
148	148	2. Unless otherwise provided in paragraph 3 of this subsection,
149	149	earnings from the public schools may not exceed one-half (1/2) of
150	150	the member’s final average salary used in computing retireme nt
151	151	benefits, or the Earnings Limitation for employees allowed by the
152	152	Social Security Administration, whichev er is less. For retired
153	153	members under the age of sixty-two (62) years, the li mit on allowed
154	154	earnings from the public schools of Oklahoma for employment for the
155	155	performance of duties ordinarily performed by cl assified or
156	156	nonclassified personnel shall be th e lesser of Fifteen Thousand
157	157	Dollars ($15,000.00) or one-half (1/2) of the mem ber’s final average
158	158	salary used in computing retirement benefits unles s the earnings
159	159	limitation allowed by the Social Security Admi nistration would be
160	160	greater than Fifteen Thousa nd Dollars ($15,000.00). For re tired
161	161	members sixty-two (62) years of age or o lder, the limit on allowed
162	162	earnings from the public schools of Oklahoma for the performance o f

215	215	shall be the lesser of Thirty Thousand Dollars ($30, 000.00) or one-
216	216	half (1/2) of the member’s final average salary used in computing
217	217	retirement benefits. For pur poses of this paragraph, the following
218	218	shall apply:
219	219	a. earnings shall mean “regular annual compensation ” as
220	220	defined in paragraph (25) of Sec tion 17-101 of this
221	221	title, and shall include an y payment by a public
222	222	school for services rendered by a retired member who
223	223	is employed for any purpose whatsoever. Supplemental
224	224	retirement payments paid by a former public schoo l
225	225	employer pursuant to subsection 9 (9) of Section 17-
226	226	105 of this title or other s tate law shall not be
227	227	considered as earnings,
228	228	b. the Earnings Limitation for employees allowed by the
229	229	Social Security Administ ration to workers between the
230	230	age of sixty-two (62) years and sixty-five (65) years
231	231	shall apply to retired members below the age o f sixty-
232	232	two (62) years,
233	233	c. the limit on allowed earnings from the public schools
234	234	shall be automatically adjusted effective the first
235	235	day of January of each year to reflect the cu rrent
236	236	Earnings Limitation for employe es as determined from
237	237	time to time by the Social Security Administration,

289	289	d. the earnings limit for the ca lendar year in which a
290	290	member retires shall be one-twelfth (1/12) of the
291	291	annual limit multiplied by the number of months the
292	292	member is eligible to work and receive payments from
293	293	the public schools of Oklahoma,
294	294	e. earnings in excess of the maximum limit on allowed
295	295	earnings from public schools of Oklahoma shall result
296	296	in a loss of future retirement benefits for the yea r
297	297	the postretirement employment was p erformed of One
298	298	Dollar ($1.00) for each O ne Dollar ($1.00) earned over
299	299	the maximum allowed earnings amount ,
300	300	f. for those members age seventy (70) years and over, the
301	301	earnings in excess of the maximum limit allowed
302	302	earnings from public schools of Oklahoma shall be one-
303	303	half (1/2) the member’s final average salary used in
304	304	computing retirement benefits. Howev er, any retired
305	305	member receiving benefits from the Teachers’
306	306	Retirement System of Oklahoma who reached age seventy
307	307	(70) years prior to July 1, 1991, shall not be
308	308	restricted by the earnings limits pursuant to this
309	309	subparagraph until January 1, 1994. To qualify for
310	310	the provisions of this subparagraph, the mem ber must
311	311	be employed less than one -half (1/2) time compared to
312	312	other full-time employees in similar positions;

364	364	3. Notwithstanding paragraph 2 of this subsection, a retired
365	365	classified or nonclassified member who has been retired for thirty -
366	366	six (36) or more months and who is employed by a public school to
367	367	perform duties ordinarily performed by classified or nonclassified
368	368	personnel shall be able to receive annualized e arnings from the
369	369	public school with no reduction in retirement benefits regardless of
370	370	the amount of annualized earnings.
371	371	a. For a period of three (3) years beginning July 1,
372	372	2017, members who have retired as of July 1 , 2017, as
373	373	active classroom teachers, who have been retired and
374	374	receiving a benefit for at least one (1) year, and who
375	375	have not been employed by any public school during
376	376	that one-year period, shall be eligible to be
377	377	reemployed as an active classroom teache r in common or
378	378	career tech school distric ts, with no limitations on
379	379	earnings.
380	380	b. For a period of three (3) years beginning July 1,
381	381	2021, members who have retired as of July 1, 2020, who
382	382	have been retired and receiv ing a benefit for at least
383	383	one (1) year, and who have not been employed by any
384	384	public school during that one-year period, shall be
385	385	eligible to be reemployed as an active classroom
386	386	teacher in common or career tech s chool districts,
387	387	with no limitations on ea rnings. The one-year period

439	439	starts with the retiree’s last day of preretirement
440	440	public education employment.
441	441	c. A retired member who has been retired and has received
442	442	benefits for at least ninety (90) days shall be
443	443	eligible to be reemployed as a n active classroom
444	444	teacher in common or care er tech school districts with
445	445	no limitations on earnings for a period of three (3)
446	446	years beginning July 1, 2024 . Provided, a retiree who
447	447	is reemployed under this subparagraph may not be
448	448	employed as an active classroom teacher i n common or
449	449	career tech school districts during the ninety-day
450	450	period prior to reemployment. The ninety-day period
451	451	shall commence on the date of the retiree ’s last day
452	452	of preretirement public education employment.
453	453	Members returning under this section shal l not be subject to any
454	454	earning limitations earnings limitation following the end of the
455	455	three-year periods described in this paragraph. Mem bers returning
456	456	under this section shall only be employed purs uant to a temporary
457	457	contract; and
458	458	4. A member shall be considered to be e mployed by a school
459	459	district to perform the duties ordina rily performed by classified or
460	460	nonclassified personnel if the member is hired by th e school
461	461	district in the member’s individual capacity to perform the duties
462	462	or if the member perf orms the duties through employment with a

515	515	or partnership, or any other business structure t hat has agreed or
516	516	contracted to provide t he services to the school district.
517	517	B. A public school district that empl oys a retired member shall
518	518	be required to make contribut ions to the System for the retired
519	519	member in an amount as required in Section 17-108.1 and in paragraph
520	520	3 of subsection B of S ection 17-116.2 of this title.
521	521	C. For purposes of this section, postretirement employment of
522	522	less than one thousand (1,000) hour s per year with the Governor, the
523	523	State Senate, the House of Repre sentatives or the Le gislative
524	524	Service Bureau shall not be con sidered as postretirement employment
525	525	with a public school of Oklahoma.
526	526	D. The Board of Trustees of the Teachers’ Retirement System of
527	527	Oklahoma shall promulgate such rules as are necessary to implement
528	528	the provisions of this section.
529	529	E. A member who has e ntered into postretirement employment with
530	530	a participating employer of the Teachers’ Retirement System of
531	531	Oklahoma must fully c omply with all the provisions of the rules
532	532	promulgated by the Board of Trustees pursuant to this section in
533	533	order to continue rec eiving his or her monthly retirement benefit.
534	534	SECTION 2. This act shall become effective July 1, 2024.
535	535	SECTION 3. It being immediately necessary for the preservation
536	536	of the public peace, health or sa fety, an emergency is hereby
