8181 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8282 SECTION 1. AMENDATORY 21 O.S. 2021, Section 1835, as
8383 amended by Section 2, Chapter 159, O.S.L. 2023 (21 O.S. Supp. 2023,
8484 Section 1835), is amended to read as follows:
8585 Section 1835. A. Whoever shall willfully or maliciously enter
8686 the garden, yard, pasture or field of another af ter being expressly
8787 forbidden to do so or without permission by the owner or lawful
8888 occupant thereof when such property is posted pursuant to this act ,
8989 or a person failing to leave lodging establishment premises pursuant
9090 to Section 508 of Title 15 of the Oklahoma Statutes, shall be deemed

142142 guilty of trespass and upon conviction shall be punished by a fine
143143 of not more than Two Hundred Fifty Dollars ($250.00); provided, that
144144 this provision shall not apply to registered land su rveyors and
145145 registered professiona l engineers for the purpose of land surveying
146146 in the performance of their professional services; and, provided
147147 further, that anyone who willfully o r maliciously enters any such
148148 garden, yard, pasture or field, and therein c ommits or attempts to
149149 commit waste, theft or damage sh all be deemed guilty of a
150150 misdemeanor and upon conviction shall be fined not less than Fifty
151151 Dollars ($50.00) nor more than Five Hundred Dollars ($500.00), or by
152152 confinement in the county jail for not l ess than thirty (30) days
153153 nor more than six (6) months, or by both such fine and imprisonm ent.
154154 1. This provision shall not apply to:
155155 a. peace officers as defined in Section 99 of this title,
156156 b. federal, state or local government employees engaged
157157 in the performance of their duties,
158158 c. firefighters, emergency medical personnel or public
159159 utility employees engaged in addressing an emergency
160160 that presents an imminent danger to health, safety or
161161 the environment in the performance of their duties, or
162162 d. parties engaged in oil and gas operations, wh ich shall
163163 include, without limitation, exploration, d rilling,
164164 production and sales activities, under authority of
165165 mineral ownership, an oil and gas lease, seismic

217217 agreement or permit, gas gathering, purchase,
218218 transportation or treating contracts, Corporation
219219 Commission or other lawful authority from persons
220220 entitled to give the same;.
221221 2. The provisions of this section shall not prohibit:
222222 a. railroad employees and emergency equipment from
223223 entering such land to restore rail s ervice following
224224 an accident, derailment or natural disaster,
225225 b. the entrance of utilit y employees or contractors while
226226 acting in the scope of their employment, or
227227 c. employees or contractors of valid easement or license
228228 holders while acting in the scope o f their
229229 employment;.
230230 3. The following persons may enter such land of another unless
231231 forbidden to do so, either orally or in writing, by the owner or
232232 lawful occupier thereof:
233233 a. registered land surveyors and registered professional
234234 engineers for the purpos e of land surveying in the
235235 performance of their professional services,
236236 b. persons making a delivery, selling a product or
237237 service, conducting a survey or poll, working on
238238 behalf of a candidate for political office, or

290290 c. persons who have a legitimate reason for entering and
291291 who, immediately upon entering, seek to conduct
292292 business.
293293 For purposes of this act, “posted” means exhibiting signs to
294294 read as follows: “PROPERTY RESTRICTED”; “POSTED - KEEP OUT”; “KEEP
295295 OUT”; “NO TRESPASSING”; or similar signs which are displayed or
296296 marked by identifiable paint marks as provided for in this act.
297297 Property that is fenced or not fenced shall have such signs or
298298 identifying paint marks placed conspicuously and at all places where
299299 entry to the property is reasonably expected.
300300 B. Anyone who willfully or maliciously enters any such land of
301301 another when such property is posted pursuant to this act and
302302 commits or attempts to commit waste, theft or damage shall be deemed
303303 guilty of a misdemeanor and upon co nviction shall be punishe d by
304304 imprisonment in the county jail for a term of not less than thirty
305305 (30) days nor more than six (6) mon ths, by a fine of not less than
306306 Fifty Dollars ($50.00) nor more than Five Hundred Dollars ($500.00),
307307 or by both such fine an d imprisonment.
308308 C. No provisions of this section shall be construed to conflict
309309 with Section 5-202 or 6-304 of Title 29 of the Okla homa Statutes.
310310 D. Whoever shall willfully enter the pecan grove of another
311311 without the prior consent of the owner or occupa nt thereof to so do
312312 shall be deemed guilty of trespass and upo n conviction shall be
313313 punished by a fine of not more than Twenty-five Dollars ($25.00);

372372 owned or managed by the Grand River Dam Authority with out permission
373373 shall be deemed guilty of misdemea nor trespass and upon conviction
374374 shall be punished by a fine of not more than Two Hundred Fifty
375375 Dollars ($250.00); provided, that this pr ovision shall not apply to
376376 registered land surveyors and registered pr ofessional engineers for
377377 the purpose of land surv eying in the performance of their
378378 professional services; and, provided furt her, that anyone who
379379 willfully or maliciously enters upon prop erty owned or managed by
380380 the Grand River Dam Authority without permiss ion and therein commits
381381 or attempts to commit was te, theft or damage shall be deemed guilty
382382 of misdemeanor tresp ass and upon conviction shall be punished by a
383383 fine of not less than Fifty Dollars ($50.00) nor more than Five
384384 Hundred Dollars ($500.00), or b y imprisonment in the county jail for
385385 not less than thirty (30) days nor more than six (6) months, or by
386386 both such fine and im prisonment.
387387 F. Any person who shall willfully or maliciousl y enter the
388388 grounds of the Governor’s Mansion within the State Capitol Park, as

447447 SECTION 2. NEW LAW A new section of law to be codified
448448 in the Oklahoma Statutes as Section 1840.1 of Title 21, unless there
449449 is created a duplication in numbering, reads as follows:
450450 Sections 2 through 5 of this act shall be kno wn and may be cited
451451 as the “Oklahoma Posted Land Act”.
452452 SECTION 3. NEW LAW A new section of law to be codified
453453 in the Oklahoma Statut es as Section 1840.2 of Title 21, unless there
454454 is created a duplication in numbering, reads as follows:
455455 A. The owner or lessee of any forest land may post the land by
456456 either of the following methods:
457457 1. By placing signs around the boundaries of the property at
458458 conspicuous points and at each point of entry. The signs shall read
459459 “PROPERTY RESTRICTED”, “POSTED - KEEP OUT”, “KEEP OUT”, “NO
460460 TRESPASSING”, or similar signs which are displayed. The signs shall
461461 be placed so as to be readily visible to any perso n approaching the
462462 property; or

514514 2. By placing identifying paint marks on trees or posts aroun d
515515 the area to be posted. Each paint mark shall be a vertical line of
516516 at least eight (8) inches in length, and the bottom of the mark
517517 shall be no less than three (3) feet nor more t han five (5) feet
518518 high. The paint marks shall be placed not more than one hundred
519519 (100) feet apart and shall be readily visi ble to any person
520520 approaching the property.
521521 B. The type and color of the paint to be used for posting shall
522522 be prescribed by the Oklahoma Department of Agriculture, Food, and
523523 Forestry. The Department shal l not select a color that is presently
524524 being used by the timber industry in Oklahoma t o mark land lines or
525525 property lines.
526526 SECTION 4. NEW LAW A new section of law to be codified
527527 in the Oklahoma Statutes as Section 1840.3 of Title 21, unless there
528528 is created a duplication in numberi ng, reads as follows:
529529 A. The owner or lessee of any real p roperty other than forest
530530 land, including cultivated land, orchards, pastureland,
531531 impoundments, or other real property, may p ost the real property by
532532 either of the following methods:
533533 1. By placing signs around the boundaries of the property at
534534 conspicuous points and at each point of entry. The signs shall read
535535 “PROPERTY RESTRICTED”, “POSTED - KEEP OUT”, “KEEP OUT”, “NO

605605 A. The color of paint prescribed by the Department of Wildlife
606606 Conservation for posting purposes shall not be used on trees or
607607 posts for any other purpose. Any person who knowingly paints any
608608 tree or post the color u sed for posting purposes for any other
609609 purpose other than posting real property pursuant to this act shall
610610 be guilty of a misdemeanor and upon convict ion thereof shall be
611611 fined a sum not to exceed Two Hundred Fifty Dollars ($250.00).

663663 B. It shall be unlawful for any person to post any land which
664664 the person does not own or lease except with the permission of the
665665 owner or lessee. Any person violating this subsection shall be
666666 guilty of a misdemeanor and upon conviction thereof shall be fined a
667667 sum not to exceed Two Hundred Fifty Dollars ($250.00).
668668 SECTION 6. This act shall become effec tive November 1, 2024.
