81	81	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
82	82	SECTION 1. AMENDATORY 21 O.S. 2021, Section 1835, as
83	83	amended by Section 2, Chapter 159, O.S.L. 2023 (21 O.S. Supp. 2023,
84	84	Section 1835), is amended to read as follows:
85	85	Section 1835. A. Whoever shall willfully or maliciously enter
86	86	the garden, yard, pasture or field of another af ter being expressly
87	87	forbidden to do so or without permission by the owner or lawful
88	88	occupant thereof when such property is posted pursuant to this act ,
89	89	or a person failing to leave lodging establishment premises pursuant
90	90	to Section 508 of Title 15 of the Oklahoma Statutes, shall be deemed

143	143	of not more than Two Hundred Fifty Dollars ($250.00); provided, that
144	144	this provision shall not apply to registered land su rveyors and
145	145	registered professiona l engineers for the purpose of land surveying
146	146	in the performance of their professional services; and, provided
147	147	further, that anyone who willfully o r maliciously enters any such
148	148	garden, yard, pasture or field, and therein c ommits or attempts to
149	149	commit waste, theft or damage sh all be deemed guilty of a
150	150	misdemeanor and upon conviction shall be fined not less than Fifty
151	151	Dollars ($50.00) nor more than Five Hundred Dollars ($500.00), or by
152	152	confinement in the county jail for not l ess than thirty (30) days
153	153	nor more than six (6) months, or by both such fine and imprisonm ent.
154	154	1. This provision shall not apply to:
155	155	a. peace officers as defined in Section 99 of this title,
156	156	b. federal, state or local government employees engaged
157	157	in the performance of their duties,
158	158	c. firefighters, emergency medical personnel or public
159	159	utility employees engaged in addressing an emergency
160	160	that presents an imminent danger to health, safety or
161	161	the environment in the performance of their duties, or
162	162	d. parties engaged in oil and gas operations, wh ich shall
163	163	include, without limitation, exploration, d rilling,
164	164	production and sales activities, under authority of
165	165	mineral ownership, an oil and gas lease, seismic

218	218	transportation or treating contracts, Corporation
219	219	Commission or other lawful authority from persons
220	220	entitled to give the same;.
221	221	2. The provisions of this section shall not prohibit:
222	222	a. railroad employees and emergency equipment from
223	223	entering such land to restore rail s ervice following
224	224	an accident, derailment or natural disaster,
225	225	b. the entrance of utilit y employees or contractors while
226	226	acting in the scope of their employment, or
227	227	c. employees or contractors of valid easement or license
228	228	holders while acting in the scope o f their
229	229	employment;.
230	230	3. The following persons may enter such land of another unless
231	231	forbidden to do so, either orally or in writing, by the owner or
232	232	lawful occupier thereof:
233	233	a. registered land surveyors and registered professional
234	234	engineers for the purpos e of land surveying in the
235	235	performance of their professional services,
236	236	b. persons making a delivery, selling a product or
237	237	service, conducting a survey or poll, working on
238	238	behalf of a candidate for political office, or

291	291	who, immediately upon entering, seek to conduct
292	292	business.
293	293	For purposes of this act, “posted” means exhibiting signs to
294	294	read as follows: “PROPERTY RESTRICTED”; “POSTED - KEEP OUT”; “KEEP
295	295	OUT”; “NO TRESPASSING”; or similar signs which are displayed or
296	296	marked by identifiable paint marks as provided for in this act.
297	297	Property that is fenced or not fenced shall have such signs or
298	298	identifying paint marks placed conspicuously and at all places where
299	299	entry to the property is reasonably expected.
300	300	B. Anyone who willfully or maliciously enters any such land of
301	301	another when such property is posted pursuant to this act and
302	302	commits or attempts to commit waste, theft or damage shall be deemed
303	303	guilty of a misdemeanor and upon co nviction shall be punishe d by
304	304	imprisonment in the county jail for a term of not less than thirty
305	305	(30) days nor more than six (6) mon ths, by a fine of not less than
306	306	Fifty Dollars ($50.00) nor more than Five Hundred Dollars ($500.00),
307	307	or by both such fine an d imprisonment.
308	308	C. No provisions of this section shall be construed to conflict
309	309	with Section 5-202 or 6-304 of Title 29 of the Okla homa Statutes.
310	310	D. Whoever shall willfully enter the pecan grove of another
311	311	without the prior consent of the owner or occupa nt thereof to so do
312	312	shall be deemed guilty of trespass and upo n conviction shall be
313	313	punished by a fine of not more than Twenty-five Dollars ($25.00);

373	373	shall be deemed guilty of misdemea nor trespass and upon conviction
374	374	shall be punished by a fine of not more than Two Hundred Fifty
375	375	Dollars ($250.00); provided, that this pr ovision shall not apply to
376	376	registered land surveyors and registered pr ofessional engineers for
377	377	the purpose of land surv eying in the performance of their
378	378	professional services; and, provided furt her, that anyone who
379	379	willfully or maliciously enters upon prop erty owned or managed by
380	380	the Grand River Dam Authority without permiss ion and therein commits
381	381	or attempts to commit was te, theft or damage shall be deemed guilty
382	382	of misdemeanor tresp ass and upon conviction shall be punished by a
383	383	fine of not less than Fifty Dollars ($50.00) nor more than Five
384	384	Hundred Dollars ($500.00), or b y imprisonment in the county jail for
385	385	not less than thirty (30) days nor more than six (6) months, or by
386	386	both such fine and im prisonment.
387	387	F. Any person who shall willfully or maliciousl y enter the
388	388	grounds of the Governor’s Mansion within the State Capitol Park, as

447	447	SECTION 2. NEW LAW A new section of law to be codified
448	448	in the Oklahoma Statutes as Section 1840.1 of Title 21, unless there
449	449	is created a duplication in numbering, reads as follows:
450	450	Sections 2 through 5 of this act shall be kno wn and may be cited
451	451	as the “Oklahoma Posted Land Act”.
452	452	SECTION 3. NEW LAW A new section of law to be codified
453	453	in the Oklahoma Statut es as Section 1840.2 of Title 21, unless there
454	454	is created a duplication in numbering, reads as follows:
455	455	A. The owner or lessee of any forest land may post the land by
456	456	either of the following methods:
457	457	1. By placing signs around the boundaries of the property at
458	458	conspicuous points and at each point of entry. The signs shall read
459	459	“PROPERTY RESTRICTED”, “POSTED - KEEP OUT”, “KEEP OUT”, “NO
460	460	TRESPASSING”, or similar signs which are displayed. The signs shall
461	461	be placed so as to be readily visible to any perso n approaching the
462	462	property; or

521	521	B. The type and color of the paint to be used for posting shall
522	522	be prescribed by the Oklahoma Department of Agriculture, Food, and
523	523	Forestry. The Department shal l not select a color that is presently
524	524	being used by the timber industry in Oklahoma t o mark land lines or
525	525	property lines.
526	526	SECTION 4. NEW LAW A new section of law to be codified
527	527	in the Oklahoma Statutes as Section 1840.3 of Title 21, unless there
528	528	is created a duplication in numberi ng, reads as follows:
529	529	A. The owner or lessee of any real p roperty other than forest
530	530	land, including cultivated land, orchards, pastureland,
531	531	impoundments, or other real property, may p ost the real property by
532	532	either of the following methods:
533	533	1. By placing signs around the boundaries of the property at

608	608	tree or post the color u sed for posting purposes for any other
609	609	purpose other than posting real property pursuant to this act shall
610	610	be guilty of a misdemeanor and upon convict ion thereof shall be
611	611	fined a sum not to exceed Two Hundred Fifty Dollars ($250.00).

665	665	owner or lessee. Any person violating this subsection shall be
666	666	guilty of a misdemeanor and upon conviction thereof shall be fined a
667	667	sum not to exceed Two Hundred Fifty Dollars ($250.00).
