7373 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7474 SECTION 1. AMENDATORY 59 O.S. 2021 , Section 161.12, is
7575 amended to read as follows:
7676 Section 161.12. A. The Board of Chiropractic Examin ers is
7777 authorized, after notice and an opportunity for a hearing pursuant
7878 to Article II of the Administrative Procedures Act, to issue an
7979 order imposing one or more of the follo wing penalties whenever the
8080 Board finds, by clear and convincing evidence, that a chiropractic
8181 physician has committed any of the acts or occurrences set forth in
8282 subsection B of this section:
8383 1. Disapproval of an application for a renewal license;
8484 2. Revocation or suspension of an original license or renewal

137137 3. Restriction of the practice of a chiropractic physician
138138 under such terms and conditions as deemed appropriate by the Board;
139139 4. An administrative fine not to exceed One Thousand Dollars
140140 ($1,000.00) for each count or separate violation;
141141 5. A censure or reprimand;
142142 6. Placement of a chiropractic physician on probation for a
143143 period of time and under such terms and cond itions as the Board may
144144 specify, including requiring the chiropractic physician to submit to
145145 treatment, to attend continuing education courses, to submit to
146146 reexamination, or to work under the supervision of another
147147 chiropractic physician; and
148148 7. The assessment of costs expended by the Board in
149149 investigating and prose cuting a violation. The costs may include,
150150 but are not limited to, staff time, salary and travel expenses,
151151 witness fees and attorney fees, and shall be considered part of the
152152 order of the Board.
153153 B. The following acts or occurrences by a chiropractic
154154 physician shall constitute gro unds for which the penalties specified
155155 in subsection A of this section may be imposed by order of the
156156 Board:
157157 1. Pleading guilty or nolo contendere to, or being convicted
158158 of, a felony, a misdemeanor involving moral turpitude, or a
159159 violation of federal or state controlled dangerous substances laws.
160160 A copy of the judgment and sentence of the convi ction, duly

212212 certified by the clerk of the court in which the conviction wa s
213213 obtained, and a certificate of the cler k that the conviction has
214214 become final, shall be sufficient evidence for the imposition of a
215215 penalty;
216216 2. Being habitually drunk or habitually using habit -forming
217217 drugs;
218218 3. Using advertising in which statements are made that are
219219 fraudulent, deceitful or misleading to the public ;
220220 4. Aiding or abetting any person not licensed to practice
221221 chiropractic in this state to practice chiropractic, exce pt students
222222 who are regularly enrolled in an accredited chiropractic colle ge;
223223 5. Performing or attempting to perfo rm major or minor surgery
224224 in this state, or using electricity in any form for surgical
225225 purposes, including cauterization;
226226 6. Using or having in a chiropractic physician ’s possession any
227227 instrument for treatment purposes, the use or possession of which
228228 has been prohibited or dec lared unlawful by any agency of the United
229229 States or the State of Oklahoma;
230230 7. Unlawfully possessing, prescribing or administering any
231231 drug, medicine, serum or vaccine. This section shall not prevent a
232232 chiropractic physician from p ossessing, prescribing or
233233 administering, by a needle or otherwise, vitamins, minerals or
234234 nutritional supplements, or from practicing within the scope of the
235235 science and art of chiropractic as defined in Section 161.2 of this

287287 title; provided, however, that a chiropractic physicia n who is
288288 authorized by the Board to administer and use injectables shall not
289289 possess, prescribe, or administer injecti ons of any product
290290 classified as a biological product pursuant to regulations of the
291291 United States Food and Drug Administration, including but not
292292 limited to:
293293 a. stem cells,
294294 b. platelet-rich plasma therapy, including but not
295295 limited to activated platelet-rich plasma therapy, and
296296 c. intravenous ozone therapy;
297297 8. Advertising or displaying, directly or indirectly, any
298298 certificate, diploma or o ther document which conveys or implies
299299 information that the person is skilled in any healing art other than
300300 chiropractic unless the chiropractic physician also possesses a
301301 valid current license in said such healing art;
302302 9. Obtaining an original license or renewal license in a
303303 fraudulent manner;
304304 10. Violating any provision of the Un fair Claims Settlement
305305 Practices Act or any rule promulgated pursuan t thereto;
306306 11. Willfully aiding or assisting an insurer, as defined in
307307 Section 1250.2 of Title 36 of the Okl ahoma Statutes, or an
308308 administrator, as defined in Section 1442 of Title 36 of the
309309 Oklahoma Statutes, to deny claims w hich under the terms of the
310310 insurance contract are covered services and are medically ne cessary;

362362 12. Violating any provision of the Oklah oma Chiropractic
363363 Practice Act; or
364364 13. Violating any of the rules of the Board.
365365 C. Any chiropractic physician against whom a penalty is imposed
366366 by an order of the Board under t he provisions of this section shall
367367 have the right to seek a judicial review of the order pursuant to
368368 Article II of the Administrative Procedures Act.
369369 D. The Board is authorized to issue a confide ntial letter of
370370 concern to a chiropractic physician when, though evidence does not
371371 warrant initiation of an individual proceeding, the Boa rd has noted
372372 indications of possible errant conduct by the chiropractic physici an
373373 that could lead to serious consequences and formal action by the
374374 Board.
375375 E. If no order imposin g a penalty against a chiropractic
376376 physician is issued by the Board within thre e (3) years after a
377377 complaint against the chiropractic physician is received by the
378378 Board, the complaint and all relat ed documents shall be expunged
379379 from the records of the Board.
380380 SECTION 2. This act shall become effective November 1, 2024 .
