53	75		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
54	76		SECTION 1. AMENDATORY 76 O.S. 2021, Section 5.6, is
55	77		amended to read as follows:
56	78		Section 5.6. A. Any donor who makes a good -faith donation of
57	79		food which is at the time of donation fit for human consumption to a
58	80		charitable organization , or nonprofit corporation , or correctional
59	81		center shall not be liable for damages in an y civil suit or subject
60	82		to criminal prosecution for any injury resulting from the nature,
61	83		age, condition, or packaging of the donated food, unless the injury
62	84		or death is a direct result of the gross neglige nce, recklessness,
63	85		or intentional misconduct of th e donor.

94	140		Food Donation” with hyperlinks to Section 5.6 of Title 76 of the
95	141		Oklahoma Statutes, Oklahoma Administration Administrative Code Title
96	142		310: Chapter 257, 42 U.S.C., Section 1791, and to the website of
97	143		Oklahoma State University ’s Robert S. M. Kerr Food and Agriculture
98	144		Agricultural Products Center.
99	145		C. This section shall apply to all good-faith donations of
100	146		perishable or nonperishable food which is not readily marketable due
101	147		to appearance, freshness, grade , or other conditions.
102	148		D. This section shall not restrict the authori ty of any
103	149		appropriate agency to regulate or ban the use of such food for human
104	150		consumption.
105	151		E. For purposes of this section:
106	152		1. “Donor” means any person, profit or nonprofit food
107	153		distributor, or person who harvests perishable foods who makes a
108	154		good-faith donation of food;
109	155		2. “Good-faith donation” means a gift conferred without
110	156		condition or consideration;
111	157		3. “Charitable organization” means any benevolent,
112	158		philanthropic, patriotic, eleem osynary, educational, social, civic,
113	159		recreational, or religious group or association or any other person
114	160		performing or purporting to perform acts beneficial to the public;
	161	+	2. “Correctional center” means any facility housing offenders
	162	+	in the custody of the Department of Corrections ;

152	222		5. “Food” includes any packaged, prepared, perishable , or
153	223		nonperishable food item , and wild game;
154	224		5. “Good-faith donation” means a gift conferred without
155	225		condition or consideration; and
156	226		6. “Nonprofit corporation ” means a corporation fo rmed for a
157	227		purpose not involving pecuniary gain to its shareholders or members,
158	228		paying no dividends or other pecuniary remuneration, directly or
159	229		indirectly, to its shareholders or members as such, and having no
160	230		capital stock.
161	231		SECTION 2. This act shall become effective November 1, 2024.
