5375 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5476 SECTION 1. AMENDATORY 76 O.S. 2021, Section 5.6, is
5577 amended to read as follows:
5678 Section 5.6. A. Any donor who makes a good -faith donation of
5779 food which is at the time of donation fit for human consumption to a
5880 charitable organization , or nonprofit corporation , or correctional
5981 center shall not be liable for damages in an y civil suit or subject
6082 to criminal prosecution for any injury resulting from the nature,
6183 age, condition, or packaging of the donated food, unless the injury
6284 or death is a direct result of the gross neglige nce, recklessness,
6385 or intentional misconduct of th e donor.

94140 Food Donation” with hyperlinks to Section 5.6 of Title 76 of the
95141 Oklahoma Statutes, Oklahoma Administration Administrative Code Title
96142 310: Chapter 257, 42 U.S.C., Section 1791, and to the website of
97143 Oklahoma State University ’s Robert S. M. Kerr Food and Agriculture
98144 Agricultural Products Center.
99145 C. This section shall apply to all good-faith donations of
100146 perishable or nonperishable food which is not readily marketable due
101147 to appearance, freshness, grade , or other conditions.
102148 D. This section shall not restrict the authori ty of any
103149 appropriate agency to regulate or ban the use of such food for human
104150 consumption.
105151 E. For purposes of this section:
106152 1. “Donor” means any person, profit or nonprofit food
107153 distributor, or person who harvests perishable foods who makes a
108154 good-faith donation of food;
109155 2. “Good-faith donation” means a gift conferred without
110156 condition or consideration;
111157 3. “Charitable organization” means any benevolent,
112158 philanthropic, patriotic, eleem osynary, educational, social, civic,
113159 recreational, or religious group or association or any other person
114160 performing or purporting to perform acts beneficial to the public;
161+2. “Correctional center” means any facility housing offenders
162+in the custody of the Department of Corrections ;

142-2. “Correctional center” means any facility housing offenders

153223 nonperishable food item , and wild game;
154224 5. “Good-faith donation” means a gift conferred without
155225 condition or consideration; and
156226 6. “Nonprofit corporation ” means a corporation fo rmed for a
157227 purpose not involving pecuniary gain to its shareholders or members,
158228 paying no dividends or other pecuniary remuneration, directly or
159229 indirectly, to its shareholders or members as such, and having no
160230 capital stock.
161231 SECTION 2. This act shall become effective November 1, 2024.
