65	65	An Act relating to students; amending 70 O.S. 2021,
66	66	Section 27-103, which relates to the Oklahoma
67	67	Extracurricular Activities Accountab ility Act;
68	68	requiring certain association’s written policy to
69	69	include certain provision regarding participation of
70	70	certain students; repealing 70 O.S. 2021, Section 8-
71	71	103.2, which relates to a prohibition on
72	72	participating in certain competitions for certain
73	73	time period following transfer; providing an
74	74	effective date; and declaring an emergency.

79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
80	80	SECTION 1. AMENDATORY 70 O .S. 2021, Section 27-103, is
81	81	amended to read as follows:
82	82	Section 27-103. A public school or school district shall not be
83	83	a member of any school athletic association unless that association
84	84	has adopted a written policy t hat requires the following:
85	85	1. All records of the association to be made accessible
86	86	consistent with the provisions of the Oklahoma Open Records Act;
87	87	2. All meetings of the association to be open and conducted in
88	88	a manner consistent with t he provisions of the Oklahoma Open Meeting

140	140	Act, including specifically the notice and agenda, voting and
141	141	executive session requirements; and
142	142	3. An annual financial audit and a compliance audit of all
143	143	funds of the association in accordance with the auditing standards
144	144	set forth in the Oklahoma Public School Audit Law. In addition, the
145	145	association shall have performance audits conducted of the
146	146	operations of the association. A perfo rmance audit shall be
147	147	conducted no later than December 31, 2014, and by Decem ber 31 every
148	148	five (5) years thereafter ; and
149	149	4. A student who enrolls in a school district in which the
150	150	student is not a resident pursuant to the Education Open Transfer
151	151	Act prior to the start of the student’s junior year is allowed to
152	152	participate in interscholastic activities or contests offere d by the
153	153	receiving school district upon enrollment .
154	154	SECTION 2. REPEALER 70 O.S. 2021, Section 8-103.2, is
155	155	hereby repealed.
156	156	SECTION 3. This act shall become effective July 1, 2024.
157	157	SECTION 4. It being immediately necessary for the preservation
158	158	of the public peace, health, or safety, an emergency is hereby
159	159	declared to exist, by reason whereof thi s act shall take effect and
160	160	be in full force from and after its passage and approval.
