3965 An Act relating to school employees; amending 70 O.S.

4975 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5076 SECTION 1. AMENDATORY 70 O.S. 2021, Section 5 -139, is
5177 amended to read as follows:
5278 Section 5-139. School Upon the effective date of this act,
5379 school districts shall make be prohibited from making payroll
5480 deductions for either or both professional organization du es and
5581 political contributions at the written request of any school
5682 employee and shall transmit deducted funds to the organization
5783 designated by the school district employee. Such deductions shall
5884 be on a ten-month basis unless otherwise designated by the employee
5985 organization. However, a school employee may request at any time in
6086 writing, including by email or fax, for the school district to
6187 immediately terminate or initiate payroll deductions to a

139+professional organization. Upon receipt of any written request, the
90140 school district shall within five (5) business days or by the next
91141 pay period, whichever is earlier, terminate or initiate any future
92142 payroll deductions of the requesting school employee to a
93143 professional organization. Upon receipt of a writt en request, the
94144 school district shall notify the profess ional organization o f the
95145 initiation or termination of payroll deductions within fifteen (15)
96146 business days. If the request is to terminate a deduction, the
97147 school district shall not make any advance payments to any
98148 professional organization of any future dues on behalf of the school
99149 employee. No school district policy or negotiated agreement shall
100150 place any other conditions or requirements, including but not
101151 limited to personal hand delivery, upon a ny employee to initiate or
102152 terminate any payroll deducti on to a professional organization
103153 except for a written request as outlined in this section. Any
104154 school district policy or provision in a negotiated agreement that
105155 places additional conditions or requ irements on initiation or
106156 termination beyond those outlined in this section shall be null and
107157 void. A school district which fails to terminate payroll deductions
108158 for an employee in accordance with this section shall immediately
109159 reimburse the employee the amount of all payroll deductions made by
110160 the school district after the emplo yee’s request, and the amount due
111161 the employee shall double every thirty (30) days until paid in full .
112162 SECTION 2. This act shall become effective July 1, 2024.

140214 SECTION 3. It being immediately necessary for the preservation
141215 of the public peace, health , or safety, an emergency is hereby
142216 declared to exist, by reason whereof thi s act shall take effect and
143217 be in full force from and after its passage and approval.
