49	75		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
50	76		SECTION 1. AMENDATORY 70 O.S. 2021, Section 5 -139, is
51	77		amended to read as follows:
52	78		Section 5-139. School Upon the effective date of this act,
53	79		school districts shall make be prohibited from making payroll
54	80		deductions for either or both professional organization du es and
55	81		political contributions at the written request of any school
56	82		employee and shall transmit deducted funds to the organization
57	83		designated by the school district employee. Such deductions shall
58	84		be on a ten-month basis unless otherwise designated by the employee
59	85		organization. However, a school employee may request at any time in
60	86		writing, including by email or fax, for the school district to
61	87		immediately terminate or initiate payroll deductions to a
62		-	professional organization. Upon receipt of any written request, the

	139	+	professional organization. Upon receipt of any written request, the
90	140		school district shall within five (5) business days or by the next
91	141		pay period, whichever is earlier, terminate or initiate any future
92	142		payroll deductions of the requesting school employee to a
93	143		professional organization. Upon receipt of a writt en request, the
94	144		school district shall notify the profess ional organization o f the
95	145		initiation or termination of payroll deductions within fifteen (15)
96	146		business days. If the request is to terminate a deduction, the
97	147		school district shall not make any advance payments to any
98	148		professional organization of any future dues on behalf of the school
99	149		employee. No school district policy or negotiated agreement shall
100	150		place any other conditions or requirements, including but not
101	151		limited to personal hand delivery, upon a ny employee to initiate or
102	152		terminate any payroll deducti on to a professional organization
103	153		except for a written request as outlined in this section. Any
104	154		school district policy or provision in a negotiated agreement that
105	155		places additional conditions or requ irements on initiation or
106	156		termination beyond those outlined in this section shall be null and
107	157		void. A school district which fails to terminate payroll deductions
108	158		for an employee in accordance with this section shall immediately
109	159		reimburse the employee the amount of all payroll deductions made by
110	160		the school district after the emplo yee’s request, and the amount due
111	161		the employee shall double every thirty (30) days until paid in full .
112	162		SECTION 2. This act shall become effective July 1, 2024.

140	214		SECTION 3. It being immediately necessary for the preservation
141	215		of the public peace, health , or safety, an emergency is hereby
142	216		declared to exist, by reason whereof thi s act shall take effect and
143	217		be in full force from and after its passage and approval.
