80 | 80 | | SECTION 1. AMENDATORY 70 O.S. 2021, Section 3218.8, is |

219 | 219 | | B. In its deliberation on the e stablishment of resident tuition |
---|
220 | 220 | | rates for undergraduate and graduate education , the Oklahoma State |
---|
221 | 221 | | Regents for Higher Education shall balance the affordability of |
---|
222 | 222 | | public higher education with the provision of availabl e, diverse, |
---|
223 | 223 | | and high-quality learning opportunities. In this endeavor the State |
---|
224 | 224 | | Regents shall give consideration to consider the level of state |
---|
225 | 225 | | appropriations, the state economy, t he per capita income and cost of |
---|
226 | 226 | | living, the college-going and college-retention rates, and the |
---|
227 | 227 | | availability of financial aid in Oklahoma. For any increase in t he |
---|
228 | 228 | | tuition rates, the State Reg ents shall demonstrate a reasonable |
---|
229 | 229 | | effort to effect a proportionate increase in the availability of |
---|
230 | 230 | | need-based student financial aid. Nee d-based financial aid shall |
---|
231 | 231 | | include, but shall not be limited to, awards for the Oklahoma Higher |
---|
232 | 232 | | Learning Access Program, Okla homa Tuition Aid Grants, federal need - |
---|
233 | 233 | | based financial aid and tuition waivers, and private donations. In |
---|
234 | 234 | | addition, when determining the guaranteed tuition rates as pro vided |
---|
235 | 235 | | for in subsection D of this section, the State Regents shall |
---|
236 | 236 | | consider the anticipated revenue needs during the four -year period |
---|
237 | 237 | | of the guarantee. |

292 | 292 | | D. 1. Beginning with the 2008 -2009 academic year, each |

293 | 293 | | comprehensive and regional institution within The Oklahoma State |
---|
294 | 294 | | System of Higher Education shall offer to resident students |
---|
295 | 295 | | enrolling for the first time as a full-time undergraduate a tuition |
---|
296 | 296 | | rate that will be guaranteed for a period of not less than four (4) |
---|
297 | 297 | | consecutive academic years as provided for in this subsection. |
---|
298 | 298 | | Students shall have the option to particip ate or not participate in |
---|
299 | 299 | | the guaranteed tuition rate program and shall indicate their |
---|
300 | 300 | | election at the time of enrollment. Each institution shall provide |
---|
301 | 301 | | students with the following info rmation prior to enrollment: |
---|
302 | 302 | | a. the annual tuition rate charged and the percentage |
---|
303 | 303 | | increase for the previou s four (4) academic years, and |
---|
304 | 304 | | b. the annual tuition and percentage increase th at the |
---|
305 | 305 | | nonguaranteed tuition rate would have to increase to |
---|
306 | 306 | | equal or exceed the guaranteed tuition rate for the |
---|
307 | 307 | | succeeding four (4) academi c years. |
---|
308 | 308 | | 2. Except as otherwise provi ded for in this subsection, for a |
---|
309 | 309 | | student who elects to participate in the guaranteed tuition rate |
---|
310 | 310 | | program, who is a resident of the state, and who e nrolls for the |
---|
311 | 311 | | first time as a full -time undergraduate student at an institution in |
---|
312 | 312 | | the state after the 200 7-2008 academic year, the amount of |
---|

375 | 375 | | that program who have elected to participate in the guaranteed |
---|
376 | 376 | | tuition rate program shall not increase during the normal completion |
---|
377 | 377 | | period of the program. |
---|
378 | 378 | | 4. If a student who has elected to participate in the |
---|
379 | 379 | | guaranteed tuition ra te program is a member of the United States |
---|
380 | 380 | | Armed Forces including the Army and Air National Guard, the Arm y, |
---|
381 | 381 | | Navy, Air Force, Marine Corps, and Coast Guar d Reserves, or any |
---|
382 | 382 | | other component of the Armed Forces, and when ordered by the proper |
---|
383 | 383 | | authority to active or inactive duty or service is required to |
---|
384 | 384 | | withdraw from an ins titution for military or other nationa l defense |
---|
385 | 385 | | emergencies, the amount of resident tuition the student is required |
---|
386 | 386 | | to pay upon reentering the institution shall not exceed the amount |
---|
387 | 387 | | the student was charged at the time of withdrawal. |

446 | 446 | | 6. If a student who has elected to participate in the |
---|
447 | 447 | | guaranteed tuition rate program changes majors or transfers to |
---|
448 | 448 | | another campus of the same institution after initial enrollment, the |
---|
449 | 449 | | tuition charged to the student shall equal the amount the student |
---|
450 | 450 | | would have been charged had the student been admitted to the changed |
---|
451 | 451 | | major or enrolled at the new campus when the student first enrolled. |
---|
452 | 452 | | This paragraph shall not a pply if a student transfers from a |
---|
453 | 453 | | constituent agency of an institution to another constituent agency |
---|
454 | 454 | | of the institution. |
---|
455 | 455 | | 7. A student who elects to participate in the guaranteed |
---|
456 | 456 | | tuition rate program shall maintain full -time enrollment during the |
---|
457 | 457 | | guaranteed four-year period. For purposes of this subse ction, full- |
---|
458 | 458 | | time enrollment shall be the number of credit hours as determined by |
---|
459 | 459 | | the Oklahoma State Regents for Higher Education to be full -time |
---|
460 | 460 | | enrollment for each institution. |
---|
