7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 70 O.S. 2021, Section 3218.8, is
8181 amended to read as follows:
8282 Section 3218.8. A. Subject to the provisions of subsection D
8383 of this section, the Oklahoma State Regents for Higher Education are
8484 authorized to establish undergraduate resident tuition, nonresident
8585 tuition, and mandatory fees, wh ich students shall pay as a condition
8686 of enrollment, except as otherwise provid ed by law. The process for
8787 establishing tuition and mandatory fees shall incorporate the
8888 provisions of Section 3218.14 of this title.

140140 1. At the comprehensive universities the combined average of
141141 the resident tuition and mandatory fees established for any school
142142 year for the nonguaranteed rate, as determined by the State Regents,
143143 shall remain less than the combined average of the resident tuition
144144 and fees at the state -supported institutions of higher education
145145 that are members of the Big Twelve Conference on the effective date
146146 of this act. The combined average of the nonresident tuition and
147147 mandatory fees, as determined by the State Regents, shall remain
148148 less than one hundred fi ve percent (105%) of the combined average of
149149 the nonresident tuition and fees at the state -supported institutions
150150 of higher education that are members of the Big Twelve Conference on
151151 the effective date of this act.
152152 2. At the comprehensive universities, regional universities,
153153 and two-year colleges the combined average of the resident tuition
154154 and mandatory fees established for any school year for the
155155 nonguaranteed rate, as determined by the State Regents, shall remain
156156 less than the combined average of the resident tuition and mandatory
157157 fees at like-type state-supported comprehensive, regional, or two -
158158 year institutions of higher education in states as determined and
159159 approved by the State Regents that include, but are not limited to,
160160 those adjacent states contiguous to Oklahoma. The combined average
161161 of the nonresident tuition and mandato ry fees, as determined by the
162162 State Regents, shall remain less than one hundred five percent
163163 (105%) of the combined average of the nonresid ent tuition and fees

215215 at like-type state-supported comprehensive, regional, or two-year
216216 institutions of higher education in states as determined and
217217 approved by the State Regents that include, but are not limited to,
218218 those adjacent states contiguous to Oklahoma.
219219 B. In its deliberation on the e stablishment of resident tuition
220220 rates for undergraduate and graduate education , the Oklahoma State
221221 Regents for Higher Education shall balance the affordability of
222222 public higher education with the provision of availabl e, diverse,
223223 and high-quality learning opportunities. In this endeavor the State
224224 Regents shall give consideration to consider the level of state
225225 appropriations, the state economy, t he per capita income and cost of
226226 living, the college-going and college-retention rates, and the
227227 availability of financial aid in Oklahoma. For any increase in t he
228228 tuition rates, the State Reg ents shall demonstrate a reasonable
229229 effort to effect a proportionate increase in the availability of
230230 need-based student financial aid. Nee d-based financial aid shall
231231 include, but shall not be limited to, awards for the Oklahoma Higher
232232 Learning Access Program, Okla homa Tuition Aid Grants, federal need -
233233 based financial aid and tuition waivers, and private donations. In
234234 addition, when determining the guaranteed tuition rates as pro vided
235235 for in subsection D of this section, the State Regents shall
236236 consider the anticipated revenue needs during the four -year period
237237 of the guarantee.

289289 C. Students permitted to audit courses shall pay the same
290290 resident tuition and nonresident tuition as r equired of students who
291291 enroll for course credit.
292292 D. 1. Beginning with the 2008 -2009 academic year, each
293293 comprehensive and regional institution within The Oklahoma State
294294 System of Higher Education shall offer to resident students
295295 enrolling for the first time as a full-time undergraduate a tuition
296296 rate that will be guaranteed for a period of not less than four (4)
297297 consecutive academic years as provided for in this subsection.
298298 Students shall have the option to particip ate or not participate in
299299 the guaranteed tuition rate program and shall indicate their
300300 election at the time of enrollment. Each institution shall provide
301301 students with the following info rmation prior to enrollment:
302302 a. the annual tuition rate charged and the percentage
303303 increase for the previou s four (4) academic years, and
304304 b. the annual tuition and percentage increase th at the
305305 nonguaranteed tuition rate would have to increase to
306306 equal or exceed the guaranteed tuition rate for the
307307 succeeding four (4) academi c years.
308308 2. Except as otherwise provi ded for in this subsection, for a
309309 student who elects to participate in the guaranteed tuition rate
310310 program, who is a resident of the state, and who e nrolls for the
311311 first time as a full -time undergraduate student at an institution in
312312 the state after the 200 7-2008 academic year, the amount of

364364 undergraduate resident tuition charged to t he student for four (4)
365365 consecutive academic years at a comprehensive and regional
366366 institution shall not exceed the amount that the student was charged
367367 at the time of first enro llment, nor shall it exceed one hundred
368368 fifteen percent (115%) of the nonguaranteed undergraduate tuition
369369 rate charged to resident students enrolling for the first time as
370370 undergraduate students at the same institution for the same academic
371371 year.
372372 3. If the normal time of completion for an undergraduate
373373 program is more than four (4) years, as determined by the
374374 institution, the amount of resident tuition charged to students in
375375 that program who have elected to participate in the guaranteed
376376 tuition rate program shall not increase during the normal completion
377377 period of the program.
378378 4. If a student who has elected to participate in the
379379 guaranteed tuition ra te program is a member of the United States
380380 Armed Forces including the Army and Air National Guard, the Arm y,
381381 Navy, Air Force, Marine Corps, and Coast Guar d Reserves, or any
382382 other component of the Armed Forces, and when ordered by the proper
383383 authority to active or inactive duty or service is required to
384384 withdraw from an ins titution for military or other nationa l defense
385385 emergencies, the amount of resident tuition the student is required
386386 to pay upon reentering the institution shall not exceed the amount
387387 the student was charged at the time of withdrawal.

439439 5. If a student who has elected to participate in the
440440 guaranteed tuition rate program transfers to another institution or
441441 transfers from a constituent agency of an institution to another
442442 constituent agency or the institution after initial enrollment, the
443443 student shall be charg ed the amount of resident tuition char ged to
444444 other students enrolling for the first time at that institution or
445445 constituent agency.
446446 6. If a student who has elected to participate in the
447447 guaranteed tuition rate program changes majors or transfers to
448448 another campus of the same institution after initial enrollment, the
449449 tuition charged to the student shall equal the amount the student
450450 would have been charged had the student been admitted to the changed
451451 major or enrolled at the new campus when the student first enrolled.
452452 This paragraph shall not a pply if a student transfers from a
453453 constituent agency of an institution to another constituent agency
454454 of the institution.
455455 7. A student who elects to participate in the guaranteed
456456 tuition rate program shall maintain full -time enrollment during the
457457 guaranteed four-year period. For purposes of this subse ction, full-
458458 time enrollment shall be the number of credit hours as determined by
459459 the Oklahoma State Regents for Higher Education to be full -time
460460 enrollment for each institution.
461461 SECTION 2. This act shall become effective July 1, 2024.

513513 SECTION 3. It being immediately necessary for the preservation
514514 of the public peace, health , or safety, an emergency is hereby
515515 declared to exist, by reason whereof thi s act shall take effect and
516516 be in full force from and after its passage and approval.
