79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
80	80	SECTION 1. AMENDATORY 25 O.S. 2021, Section 311, is
81	81	amended to read as follows:
82	82	Section 311. A. Notwithstanding an y other provisions of law,
83	83	all regularly scheduled, continued or reconvened, special or
84	84	emergency meetings of public bodies shall be preceded by public
85	85	notice as follows:
86	86	1. All public bodies shall give notice in writing by December
87	87	15 of each calendar ye ar of the schedule showing the date, time and
88	88	place of the regularly scheduled meetings of such public bodies for
89	89	the following calendar year;

141	141	2. All state public bodies including, but not limited to,
142	142	public trusts and other bodies with the state as benef iciary, shall
143	143	give such notice to the Secretary of State;
144	144	3. All county public bodies including, but not limited to,
145	145	public trusts and any o ther bodies with the county as beneficiary,
146	146	shall give such notice to the county clerk of the county wherein
147	147	they are principally located;
148	148	4. All municipal public bodies including, but not limited to,
149	149	public trusts and any other bodies with the municipality as
150	150	beneficiary, shall give such notice to the municipal clerk of the
151	151	municipality wherein they are principally l ocated;
152	152	5. All multicounty, re gional, areawide or district public
153	153	bodies including, but not limited to, district boards of education,
154	154	shall give such notice to the county clerk of the coun ty wherein
155	155	they are principally located, or if no office exists, to the county
156	156	clerk of the county or counties served by such public body;
157	157	6. All governing boards of state institut ions of higher
158	158	education, and committees and subcommittees thereof, shall g ive such
159	159	notice to the Secretary of State. All other public bodies covered
160	160	by the provisions of t he Oklahoma Open Meeting Act which exist under
161	161	the auspices of a state institution of higher education, but a
162	162	majority of whose members are not members of the institution’s
163	163	governing board, shall give such notice to the count y clerk of the
164	164	county wherein the institution is principally located;

216	216	7. The Secretary of State and each county c lerk or municipal
217	217	clerk shall keep a record of all notices received in a re gister open
218	218	to the public for inspection during regular office hour s, and, in
219	219	addition, shall make known upon any request of any person the
220	220	contents of the register;
221	221	8. If any change is to be made of the dat e, time or place of
222	222	regularly scheduled meetings of public bodies, then notice in
223	223	writing shall be given to the Sec retary of State or county clerk or
224	224	municipal clerk, as required herein, not less than ten (10) days
225	225	prior to the implementation of any such change;
226	226	9. In addition to the advance public not ice in writing required
227	227	to be filed for regularly scheduled meeting s, described in paragraph
228	228	1 of this subsection, all public bodies shall, at least twenty -four
229	229	(24) hours prior to such regularly scheduled me etings, display
230	230	public notice of the meeting by at least one of the following
231	231	methods:
232	232	a. by posting information th at includes date, time, place
233	233	and agenda for the meeting in prominent public view at
234	234	the principal office of the p ublic body or at the
235	235	location of the meeting if no office exists, or
236	236	b. by posting on the public body’s Internet website the
237	237	date, time, place and agenda for the meeting in
238	238	accordance with Section 3106.2 of Title 74 of the
239	239	Oklahoma Statutes. Additionally, the public body

293	293	a public meeting requir ed by this subsection, and any
294	294	person may request to be included without charge, and
295	295	their request shall be accept ed. The emailed notice
296	296	of a public meeting required by this subsection sha ll
297	297	include in the body of the email or as an attachment
298	298	to the email the date, time, place and age nda for the
299	299	meeting and it shall be sent no less than twenty -four
300	300	(24) hours prior to the meeting. Additional ly, except
301	301	as provided in subparagraph c of this paragraph, the
302	302	public body shall make the notice of a public meeti ng
303	303	required by this subsection available to the public in
304	304	the principal office of the public body or at the
305	305	location of the meeting during normal bu siness hours
306	306	at least twenty–four (24) hours prior to the meeting,
307	307	or
308	308	c. upon the effective date of this act March 18, 2020,
309	309	and until February 15, 2022, o r until thirty (30) days
310	310	after the expiration or termination of the state of
311	311	emergency declared by the Governor to respond to the
312	312	threat of COVID-19 to the people of th is state and the
313	313	public’s peace, health and safety, whichever date
314	314	first occurs, the pub lic body shall not be required to

367	367	public in the principal office of the public body or
368	368	at the location of the meeti ng during normal business

371	371	10. The twenty-four (24) hours required in paragraph 9 of this
372	372	subsection shall exclude Saturda ys, Sundays and holidays legally
373	373	declared by the State of Oklahoma. The p osting or distribution of a
374	374	notice of a public meeting as described in paragraph 9 of th is
375	375	subsection shall not preclude a public body from considering at its
376	376	regularly scheduled meeting an y new business. “New business”, as
377	377	used herein, shall mean any mat ter not known about or which could
378	378	not have been reasonably foreseen prior to the time o f the posting;
379	379	11. In the event any meeting is to be continued or reconvened,
380	380	public notice of such action including date, time and place of the
381	381	continued meeting, sha ll be given by announcement at the origin al
382	382	meeting. Only matters appearing on the agen da of the meeting which
383	383	is continued may be discussed at the contin ued or reconvened
384	384	meeting;
385	385	12. Special meetings of public bodies shall not be held without
386	386	public notice being given at least forty-eight (48) hours prior to
387	387	the meetings. Such public not ice of date, time and place shall be
388	388	given in writing, in person or by telephonic means to the Secretary
389	389	of State or to the county clerk or to the municipal clerk by pu blic

441	441	bodies in the manner set forth in pa ragraphs 2, 3, 4, 5 and 6 of
442	442	this subsection. The public body also shall cause written notice of
443	443	the date, time and place of the meeting to be mail ed or delivered to
444	444	each person, newspaper, wire service, radio stat ion and television
445	445	station that has filed a written request for notice of meetings of
446	446	the public body with the clerk or secretary of the public body or
447	447	with some other person designa ted by the public body. Such written
448	448	notice shall be mailed or delivered at least forty-eight (48) hours
449	449	prior to the special meeting. The public body may charg e a fee of
450	450	up to Eighteen Dollars ($18.00) per year to persons or e ntities
451	451	filing a written request f or notice of meetings, and may require
452	452	such persons or entities to renew the request for notice annually.
453	453	In addition, all public bodies shall, at least t wenty-four (24)
454	454	hours prior to such special meetings, display public notice of the
455	455	meeting, setting forth thereon the date, time, place and ag enda for
456	456	the meeting. Only matters appearing on the posted agenda may be
457	457	considered at the special meeting. Such public notice shall be
458	458	posted in prominent public view at the prin cipal office of the
459	459	public body or at the location of the meeting if no office exists.
460	460	Twenty-four (24) hours prior public posting shall excl ude Saturdays,
461	461	Sundays and holidays legally dec lared by the State of Oklahoma. In
462	462	lieu of the public posting requirements of this paragraph, a public
463	463	body may elect to follow the requireme nts found in subparagraph b of
464	464	paragraph 9 of this subsection, prov ided that forty-eight-hour

519	519	13. In the event of an emergency, an emergency meeting of a
520	520	public body may be held without the public n otice heretofore
521	521	required. Should an emergency meeting of a public body be
522	522	necessary, the person calling such a meeting shall give as much
523	523	advance public notice as is reasonable and possible under the
524	524	circumstances existing, in person or by telephonic or electronic
525	525	means; and
526	526	14. A public body that gives public notice o f a meeting for
527	527	which there will be a videoconference option in a ccordance with
528	528	Section 307.1 of thi s title shall not modify the method of mee ting
529	529	described in the notice prior to the meeti ng and shall conduct the
530	530	meeting according to the methods described in the notice. If a code
531	531	or password is required to access the videoconfe rence meeting, the
532	532	code or password shall be included in the public notice.
533	533	B. 1. All agendas required pursuant to the provisions of this
534	534	section shall identify all items of busin ess to be transacted by a
535	535	public body at a meeting including, but not limited to, any proposed
536	536	executive session for the purpose of engaging i n deliberations or
537	537	rendering a final or interme diate decision in an individual
538	538	proceeding prescribed by the Administrative Procedures Act. No
539	539	action may be taken upon a matter raised during a period designated

593	593	2. If a public body proposes to conduct an execut ive session,
594	594	the agenda shall:
595	595	a. contain sufficient information for the public to
596	596	ascertain that an executive ses sion will be proposed,
597	597	b. identify the items of business and purposes of the
598	598	executive session, and
599	599	c. state specifically the provision of Sec tion 307 of
600	600	this title authorizing the executive session.
601	601	3. a. Any interested member of the public may address a
602	602	public body on any agenda item, item of new business ,
603	603	or any non-agenda item relevant to the function of the
604	604	public body in the time designated for public comment
605	605	at a meeting of the public bod y. Rules or policies of
606	606	a public body related to public comment shall be
607	607	limited to providing guidelines regarding the amount
608	608	of time a person may address the pu blic body and
609	609	designating a specific portion of the mee ting to
610	610	public comment. In no event may a public body
611	611	prohibit criticism of any act, omission, policy,
612	612	procedure, program, or service of the public body,
613	613	other than any criticism otherwise prohibited by law.
614	614	The requirements of this subparagraph shall not be

667	667	orderly conduct and proper decorum during a public

669	669	b. The requirements of subparagraph a of this para graph
670	670	shall not apply to:
671	671	(1) any official act that must be taken to address an
672	672	emergency situation affecting the public health,
673	673	welfare, or safety, if compliance with such
674	674	requirements would cause an unreasonable del ay in
675	675	the ability of the public body to act , or
676	676	(2) any meeting not subject to the provisions of the
677	677	Oklahoma Open Meeting Act.
678	678	SECTION 2. This act shall become effective November 1, 2024.
