7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 25 O.S. 2021, Section 311, is
8181 amended to read as follows:
8282 Section 311. A. Notwithstanding an y other provisions of law,
8383 all regularly scheduled, continued or reconvened, special or
8484 emergency meetings of public bodies shall be preceded by public
8585 notice as follows:
8686 1. All public bodies shall give notice in writing by December
8787 15 of each calendar ye ar of the schedule showing the date, time and
8888 place of the regularly scheduled meetings of such public bodies for
8989 the following calendar year;

141141 2. All state public bodies including, but not limited to,
142142 public trusts and other bodies with the state as benef iciary, shall
143143 give such notice to the Secretary of State;
144144 3. All county public bodies including, but not limited to,
145145 public trusts and any o ther bodies with the county as beneficiary,
146146 shall give such notice to the county clerk of the county wherein
147147 they are principally located;
148148 4. All municipal public bodies including, but not limited to,
149149 public trusts and any other bodies with the municipality as
150150 beneficiary, shall give such notice to the municipal clerk of the
151151 municipality wherein they are principally l ocated;
152152 5. All multicounty, re gional, areawide or district public
153153 bodies including, but not limited to, district boards of education,
154154 shall give such notice to the county clerk of the coun ty wherein
155155 they are principally located, or if no office exists, to the county
156156 clerk of the county or counties served by such public body;
157157 6. All governing boards of state institut ions of higher
158158 education, and committees and subcommittees thereof, shall g ive such
159159 notice to the Secretary of State. All other public bodies covered
160160 by the provisions of t he Oklahoma Open Meeting Act which exist under
161161 the auspices of a state institution of higher education, but a
162162 majority of whose members are not members of the institution’s
163163 governing board, shall give such notice to the count y clerk of the
164164 county wherein the institution is principally located;

216216 7. The Secretary of State and each county c lerk or municipal
217217 clerk shall keep a record of all notices received in a re gister open
218218 to the public for inspection during regular office hour s, and, in
219219 addition, shall make known upon any request of any person the
220220 contents of the register;
221221 8. If any change is to be made of the dat e, time or place of
222222 regularly scheduled meetings of public bodies, then notice in
223223 writing shall be given to the Sec retary of State or county clerk or
224224 municipal clerk, as required herein, not less than ten (10) days
225225 prior to the implementation of any such change;
226226 9. In addition to the advance public not ice in writing required
227227 to be filed for regularly scheduled meeting s, described in paragraph
228228 1 of this subsection, all public bodies shall, at least twenty -four
229229 (24) hours prior to such regularly scheduled me etings, display
230230 public notice of the meeting by at least one of the following
231231 methods:
232232 a. by posting information th at includes date, time, place
233233 and agenda for the meeting in prominent public view at
234234 the principal office of the p ublic body or at the
235235 location of the meeting if no office exists, or
236236 b. by posting on the public body’s Internet website the
237237 date, time, place and agenda for the meeting in
238238 accordance with Section 3106.2 of Title 74 of the
239239 Oklahoma Statutes. Additionally, the public body

291291 shall offer and consistently maintain an email
292292 distribution system for distribution of such notice of
293293 a public meeting requir ed by this subsection, and any
294294 person may request to be included without charge, and
295295 their request shall be accept ed. The emailed notice
296296 of a public meeting required by this subsection sha ll
297297 include in the body of the email or as an attachment
298298 to the email the date, time, place and age nda for the
299299 meeting and it shall be sent no less than twenty -four
300300 (24) hours prior to the meeting. Additional ly, except
301301 as provided in subparagraph c of this paragraph, the
302302 public body shall make the notice of a public meeti ng
303303 required by this subsection available to the public in
304304 the principal office of the public body or at the
305305 location of the meeting during normal bu siness hours
306306 at least twenty–four (24) hours prior to the meeting,
307307 or
308308 c. upon the effective date of this act March 18, 2020,
309309 and until February 15, 2022, o r until thirty (30) days
310310 after the expiration or termination of the state of
311311 emergency declared by the Governor to respond to the
312312 threat of COVID-19 to the people of th is state and the
313313 public’s peace, health and safety, whichever date
314314 first occurs, the pub lic body shall not be required to

366366 make the notice of a public meeti ng available to the
367367 public in the principal office of the public body or
368368 at the location of the meeti ng during normal business
369369 hours at least twenty-four (24) hours prior to the
370370 meeting;
371371 10. The twenty-four (24) hours required in paragraph 9 of this
372372 subsection shall exclude Saturda ys, Sundays and holidays legally
373373 declared by the State of Oklahoma. The p osting or distribution of a
374374 notice of a public meeting as described in paragraph 9 of th is
375375 subsection shall not preclude a public body from considering at its
376376 regularly scheduled meeting an y new business. “New business”, as
377377 used herein, shall mean any mat ter not known about or which could
378378 not have been reasonably foreseen prior to the time o f the posting;
379379 11. In the event any meeting is to be continued or reconvened,
380380 public notice of such action including date, time and place of the
381381 continued meeting, sha ll be given by announcement at the origin al
382382 meeting. Only matters appearing on the agen da of the meeting which
383383 is continued may be discussed at the contin ued or reconvened
384384 meeting;
385385 12. Special meetings of public bodies shall not be held without
386386 public notice being given at least forty-eight (48) hours prior to
387387 the meetings. Such public not ice of date, time and place shall be
388388 given in writing, in person or by telephonic means to the Secretary
389389 of State or to the county clerk or to the municipal clerk by pu blic

441441 bodies in the manner set forth in pa ragraphs 2, 3, 4, 5 and 6 of
442442 this subsection. The public body also shall cause written notice of
443443 the date, time and place of the meeting to be mail ed or delivered to
444444 each person, newspaper, wire service, radio stat ion and television
445445 station that has filed a written request for notice of meetings of
446446 the public body with the clerk or secretary of the public body or
447447 with some other person designa ted by the public body. Such written
448448 notice shall be mailed or delivered at least forty-eight (48) hours
449449 prior to the special meeting. The public body may charg e a fee of
450450 up to Eighteen Dollars ($18.00) per year to persons or e ntities
451451 filing a written request f or notice of meetings, and may require
452452 such persons or entities to renew the request for notice annually.
453453 In addition, all public bodies shall, at least t wenty-four (24)
454454 hours prior to such special meetings, display public notice of the
455455 meeting, setting forth thereon the date, time, place and ag enda for
456456 the meeting. Only matters appearing on the posted agenda may be
457457 considered at the special meeting. Such public notice shall be
458458 posted in prominent public view at the prin cipal office of the
459459 public body or at the location of the meeting if no office exists.
460460 Twenty-four (24) hours prior public posting shall excl ude Saturdays,
461461 Sundays and holidays legally dec lared by the State of Oklahoma. In
462462 lieu of the public posting requirements of this paragraph, a public
463463 body may elect to follow the requireme nts found in subparagraph b of
464464 paragraph 9 of this subsection, prov ided that forty-eight-hour

517517 hour requirement shall exclude Saturdays, Sundays and ho lidays
518518 legally declared by the State of Oklahoma;
519519 13. In the event of an emergency, an emergency meeting of a
520520 public body may be held without the public n otice heretofore
521521 required. Should an emergency meeting of a public body be
522522 necessary, the person calling such a meeting shall give as much
523523 advance public notice as is reasonable and possible under the
524524 circumstances existing, in person or by telephonic or electronic
525525 means; and
526526 14. A public body that gives public notice o f a meeting for
527527 which there will be a videoconference option in a ccordance with
528528 Section 307.1 of thi s title shall not modify the method of mee ting
529529 described in the notice prior to the meeti ng and shall conduct the
530530 meeting according to the methods described in the notice. If a code
531531 or password is required to access the videoconfe rence meeting, the
532532 code or password shall be included in the public notice.
533533 B. 1. All agendas required pursuant to the provisions of this
534534 section shall identify all items of busin ess to be transacted by a
535535 public body at a meeting including, but not limited to, any proposed
536536 executive session for the purpose of engaging i n deliberations or
537537 rendering a final or interme diate decision in an individual
538538 proceeding prescribed by the Administrative Procedures Act. No
539539 action may be taken upon a matter raised during a period designated

592592 on an agenda as an item upon which action may be taken.
593593 2. If a public body proposes to conduct an execut ive session,
594594 the agenda shall:
595595 a. contain sufficient information for the public to
596596 ascertain that an executive ses sion will be proposed,
597597 b. identify the items of business and purposes of the
598598 executive session, and
599599 c. state specifically the provision of Sec tion 307 of
600600 this title authorizing the executive session.
601601 3. a. Any interested member of the public may address a
602602 public body on any agenda item, item of new business ,
603603 or any non-agenda item relevant to the function of the
604604 public body in the time designated for public comment
605605 at a meeting of the public bod y. Rules or policies of
606606 a public body related to public comment shall be
607607 limited to providing guidelines regarding the amount
608608 of time a person may address the pu blic body and
609609 designating a specific portion of the mee ting to
610610 public comment. In no event may a public body
611611 prohibit criticism of any act, omission, policy,
612612 procedure, program, or service of the public body,
613613 other than any criticism otherwise prohibited by law.
614614 The requirements of this subparagraph shall not be

667667 orderly conduct and proper decorum during a public
668668 meeting.
669669 b. The requirements of subparagraph a of this para graph
670670 shall not apply to:
671671 (1) any official act that must be taken to address an
672672 emergency situation affecting the public health,
673673 welfare, or safety, if compliance with such
674674 requirements would cause an unreasonable del ay in
675675 the ability of the public body to act , or
676676 (2) any meeting not subject to the provisions of the
677677 Oklahoma Open Meeting Act.
678678 SECTION 2. This act shall become effective November 1, 2024.
