43	65		An Act relating to municipal lands; amending 11 O.S.
44	66		2021, Section 33-204, which relates to municipal
45	67		powers regarding lakes; granting municipalities
46	68		certain authority over lakes and land owned by the
47	69		municipality; enabling construction of certain
48	70		structure; authorizing certain use of la kes or land;
49	71		authorizing lease of lakes or land for cer tain
50	72		purposes; allowing for contracting with certa in
51	73		entities for certain purpose; clarifying effect of
52	74		certain use or lease ; updating statutory language;

59	81		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
60	82		SECTION 1. AMENDATORY 11 O.S. 2021, Section 33 -204, is
61	83		amended to read as follows:
62	84		Section 33-204. A. The governing body of any municipality
63	85		owning a lake, inside or outside of the corporate limits, or owning
64	86		lands, inside or out side of the corporate limits, which adjoin and
65	87		abut upon a lake or large body of water capable of being used by a
66	88		motor-propelled boat may own, construct, maintain, operate, and
67	89		equip a marina, docks, and boathouses, and boats for amusement,
	90	+	parks, and recreational purposes. The governing body may also l ease

95		-	parks, and recreational purposes. The governing body may also lease
96	142		or rent to any person lots or spaces and provide permits for the
97	143		construction or use of privately owned marinas, boathouses, or docks
98	144		or other recreational purposes on such property for amusement ,
99	145		parks, and recreational purposes pursuant to such term s as the
100	146		governing body deems proper. Said The governing body may fix and
101	147		collect fares, rents, tolls, or other revenues for the use of said
102	148		such facilities, lots and spaces, and the issuance of permits. The
103	149		right of a municipality to own, construct, mai ntain, operate and
104	150		equip said docks, boathouses, and boats marinas, and to rent or
105	151		lease such facilities, spaces, and lots and the issuance of permits
106	152		for the construction or use of such privately owned marinas, docks,
107	153		or boathouses for amusement, parks, and recreational purposes is
108	154		hereby declared to be a public right and u se. Rent and lease of
109	155		such facilities, lots, and spaces shall be at fair market value.
110	156		Except in cases of rentals and leases authorized herein, said such
111	157		right and facilities shall con stitute a public benefit. The
112	158		municipal governing body may do all things necessary and proper in
113	159		its discretion pursuant to the authority granted to it by the
114	160		Constitution and laws of this state to furt her the ability of the
115	161		municipality to provide for the amusement, parks, and recreational
116	162		services authorized by the provis ions of this section.
117	163		B. Lakes and lands which adjoin and abut upon a lake owned or
118	164		leased by a municipality or by a public trust of which a
	165	+	municipality is a beneficiary, which are ded icated for a public

146		-	municipality is a beneficiary, which are dedicat ed for a public
147	217		purpose, may also be used or leased, for fair market value, for
148	218		amusement, parks, or recreation without abandoning or declaring such
149	219		public property as surplus or unsuitable, provided th e governing
150	220		body of the municipality determines use of such property for
151	221		amusement, parks, or recreation is a compatible contemporaneous use
152	222		that is subordinate to the primary public purpose for which the lake
153	223		or land was purchased or leased.
154	224		C. A municipality or public trust may contract with any person ,
155	225		entity, or any county, state, or federal agency to manage and
156	226		operate lakes and land s which adjoin and abut upon a lake dedicated
157	227		for a public purpose or for amusement, parks, or recreation
158	228		contemporaneous with a public purpose as described in this secti on.
159	229		D. Lakes or lands which adjoin and abut upon a lake that are
160	230		leased or used as provided for in this section shall not be deemed
161	231		to have been declared surplus, abandoned, or unsuitable by such
162	232		lease or use.
163	233		SECTION 2. This act shall be come effective November 1, 2024.
