7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 11 O.S. 2021, Section 16 -112, is
8181 amended to read as follows:
8282 Section 16-112. A. When the municipal governing body shall
8383 deem it advisable, it may, by resolution or ordinance, authorize the
8484 mayor to call a special election on a date established in Section 3 -
8585 101 of Title 26 of the Oklahoma Statutes for the purpose of
8686 submitting to the registered voters of the municipali ty the question
8787 of issuing municipal bonds, of granting any franchise, or for any
8888 other purpose authorized by law.

140140 B. Notwithstanding any other law, for purposes of submitting to
141141 the registered voters of the municipality the question of issuing
142142 municipal bonds or of any tax, the governing body may, by resolution
143143 ordinance, authorize the mayor to call a special election on a state
144144 or federal election day in November in an odd or even -numbered year.
145145 SECTION 2. AMENDATORY 70 O.S. 202 1, Section 15-102, is
146146 amended to read as follows:
147147 Section 15-102. The Notwithstanding any other law, the board of
148148 education shall call an election to be held on a state or fe deral
149149 election day in November in an odd or even -numbered year, to which
150150 shall be conducted by the county election board in all respects as
151151 other elections, for the purpose of taking the sense of the district
152152 upon the question of issuing such bonds, naming in the proclamation
153153 of such election the amount of bonds to be voted on and the purpose
154154 for which they are to be issued; and it sh all cause to be published
155155 in a newspaper of general circulation in said the district the time
156156 and place of such election, such notices to be given at least te n
157157 (10) days before such election. In all ins tances where
158158 proclamations for elections for boards of education are required by
159159 statute of the mayor of a city, and in all instances where elections
160160 for boards of education are provided for by statute wherein the
161161 mayor and city clerk are denominated, the pre sident of the board of
162162 education shall be substitu ted for the mayor and the cle rk of the
163163 board of education shall be substitu ted for the city clerk. Boards

215215 of education are hereby declared to be free and ind ependent of
216216 cities in all matters relating to school elections legally called
217217 upon all school matters, and presidents of boards of education shall
218218 have full power to issue proclamations calling school elections;
219219 provided, that no election shall be called on the same proposition
220220 within four (4) months af ter such proposition has been defeated at
221221 an election by the school district el ectors. The provisions of this
222222 act section as to the waiting period shall not apply where the
223223 school facilities have been destroyed by a n act of God. The cost of
224224 such elections, together with the cost of such proclamations,
225225 publication, notices or other expenses required, shall be legal
226226 costs of boards of education.
227227 SECTION 3. This act shall become effective Jul y 1, 2024.
228228 SECTION 4. It being immediately necessary for the preservation
229229 of the public peace, health or safety, an emergency is hereby
230230 declared to exist, by reason whereof thi s act shall take effect and
231231 be in full force from and after its passage and approval .
