79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
80	80	SECTION 1. AMENDATORY 11 O.S. 2021, Section 16 -112, is
81	81	amended to read as follows:
82	82	Section 16-112. A. When the municipal governing body shall
83	83	deem it advisable, it may, by resolution or ordinance, authorize the
84	84	mayor to call a special election on a date established in Section 3 -
85	85	101 of Title 26 of the Oklahoma Statutes for the purpose of
86	86	submitting to the registered voters of the municipali ty the question
87	87	of issuing municipal bonds, of granting any franchise, or for any
88	88	other purpose authorized by law.

140	140	B. Notwithstanding any other law, for purposes of submitting to
141	141	the registered voters of the municipality the question of issuing
142	142	municipal bonds or of any tax, the governing body may, by resolution
143	143	ordinance, authorize the mayor to call a special election on a state
144	144	or federal election day in November in an odd or even -numbered year.
145	145	SECTION 2. AMENDATORY 70 O.S. 202 1, Section 15-102, is
146	146	amended to read as follows:
147	147	Section 15-102. The Notwithstanding any other law, the board of
148	148	education shall call an election to be held on a state or fe deral
149	149	election day in November in an odd or even -numbered year, to which
150	150	shall be conducted by the county election board in all respects as
151	151	other elections, for the purpose of taking the sense of the district
152	152	upon the question of issuing such bonds, naming in the proclamation
153	153	of such election the amount of bonds to be voted on and the purpose
154	154	for which they are to be issued; and it sh all cause to be published
155	155	in a newspaper of general circulation in said the district the time
156	156	and place of such election, such notices to be given at least te n
157	157	(10) days before such election. In all ins tances where
158	158	proclamations for elections for boards of education are required by
159	159	statute of the mayor of a city, and in all instances where elections
160	160	for boards of education are provided for by statute wherein the
161	161	mayor and city clerk are denominated, the pre sident of the board of
162	162	education shall be substitu ted for the mayor and the cle rk of the
163	163	board of education shall be substitu ted for the city clerk. Boards

215	215	of education are hereby declared to be free and ind ependent of
216	216	cities in all matters relating to school elections legally called
217	217	upon all school matters, and presidents of boards of education shall
218	218	have full power to issue proclamations calling school elections;
219	219	provided, that no election shall be called on the same proposition
220	220	within four (4) months af ter such proposition has been defeated at
221	221	an election by the school district el ectors. The provisions of this
222	222	act section as to the waiting period shall not apply where the
223	223	school facilities have been destroyed by a n act of God. The cost of
224	224	such elections, together with the cost of such proclamations,
225	225	publication, notices or other expenses required, shall be legal
226	226	costs of boards of education.
227	227	SECTION 3. This act shall become effective Jul y 1, 2024.
228	228	SECTION 4. It being immediately necessary for the preservation
229	229	of the public peace, health or safety, an emergency is hereby
230	230	declared to exist, by reason whereof thi s act shall take effect and
231	231	be in full force from and after its passage and approval .
