61 | 62 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

62 | 63 | | SECTION 1. AMENDATORY 63 O.S. 2021, Section 2-315, is |
---|
63 | 64 | | amended to read as follows: |

64 | 65 | | Section 2-315. A. Except as otherwise provided by law, any |
---|
65 | 66 | | person required to obtain an annual registration pursuant to Section |
---|
66 | 67 | | 2-302 of this title, or any group home, or residential care home as |
---|
67 | 68 | | defined by Section 1-820 of this title shall submit for destruction |
---|
96 | 96 | | dangerous substances which are out of date, which are unwanted, |
---|
97 | 97 | | unused or which are abandoned by their owner at their facilit y due |
---|
98 | 98 | | to death or other circumstan ces. |

99 | 99 | | B. All controlled dangerous substances described in subsection |

100 | 100 | | A of this section shall be submitted to the Oklahoma City laboratory |
---|
101 | 101 | | of the Oklahoma State Bureau of Investigation, along with all |
---|
102 | 102 | | required information o n forms provided by the Oklahoma State Bureau |
---|
103 | 103 | | of Investigation, to the federal Drug Enforcement Administ ration, to |
---|
104 | 104 | | a duly registered reverse distributor, to the original registered |
---|
105 | 105 | | supplier or their registered agent, to a duly registered retail |
---|
106 | 106 | | pharmacy, or to a hospital or clinic with an on-site pharmacy |
---|
107 | 107 | | pursuant to the rules set forth in Part 1317 of Title 21 of the Code |
---|
108 | 108 | | of Federal Regulations. When any such substance is transported by |
---|
109 | 109 | | private contract or common carrier or United States Postal Service |
---|
110 | 110 | | for the purpose of destruction or disposal, the sender shall require |
---|
111 | 111 | | a receipt from such private contract or common carrier or Unite d |
---|
112 | 112 | | States Postal Service, and such receipt shall be retained as a |
---|
113 | 113 | | permanent record by the sender. |
---|
114 | 114 | | C. 1. Controlled dangerous substances submitted to the |
---|
115 | 115 | | Oklahoma State Bureau of Investigation pursuant to the provisions of |
---|
116 | 116 | | this section shall be destroyed pursuant to the procedures provided |
---|
117 | 117 | | in subsection A of Section 2 -508 of this title. |
---|
147 | 146 | | suppliers pursuant to the provisions of this section shall be |
---|
148 | 147 | | destroyed by incineration so as to make the substance absolutely |
---|
149 | 148 | | unusable for human purposes in accordance with 21 C.F.R ., Part 1317. |

150 | 149 | | An official record listing the propert y destroyed, the location of |
---|
151 | 150 | | destruction and disposal, and the name and title of the person |
---|
152 | 151 | | supervising the destruction and disposal shall be submitted to the |
---|
153 | 152 | | Oklahoma State Bureau of Narcotics and Dange rous Drugs Control and |
---|
154 | 153 | | the federal Drug Enforcement Administration office located nearest |
---|
155 | 154 | | the destruction site. |
---|
156 | 155 | | D. The Office of the Chief Medical Examiner is hereby |
---|
157 | 156 | | authorized to perform on -site incineration of all controlled |
---|
158 | 157 | | dangerous substances which a re obtained in the discharge of the |
---|
159 | 158 | | official duties of the Chief Medical Examiner. Any record relating |
---|
160 | 159 | | to destruction of a controlled dangerous substance shall be |
---|
161 | 160 | | maintained as required by the state or federal government and shall |
---|
162 | 161 | | be available for inspect ion by appropriate state or federal |
---|
163 | 162 | | government regulatory agencies. |
---|
164 | 163 | | E. 1. An ultimate user who has lawfully obtained a contr olled |
---|
165 | 164 | | dangerous substance in accordance with state and federal law may, |
---|
166 | 165 | | without being registered under Section 2-302 of this title, deliver |
---|
167 | 166 | | the controlled dangerous substance to an authorized person for the |
---|
197 | 195 | | 2. If a person dies while lawfully in possession of a |
---|
198 | 196 | | controlled dangerous substance for personal use, any person lawfully |
---|
199 | 197 | | entitled to dispose of the decedent ’s property may deliver t he |
---|
200 | 198 | | controlled dangerous substance to another person for the purpose of |
---|
201 | 199 | | disposal under the conditions provided by 21 U.S.C., Section |
---|
202 | 200 | | 822(g)(4). |

203 | 201 | | 3. a. In the case of a decedent who was receiving hospice |
---|
204 | 202 | | care at the time of death , an employee of a qualified |
---|
205 | 203 | | hospice program, acting within the scope of his or her |
---|
206 | 204 | | employment, may handle, without being registered under |
---|
207 | 205 | | Section 2-302 of this title, any controlled dangerous |
---|
208 | 206 | | substance that was lawfully dispensed to the decedent |
---|
209 | 207 | | prior to death, under the conditions provided by 21 |
---|
210 | 208 | | U.S.C., Section 822(g)(5). Such employee shall, under |
---|
211 | 209 | | penalty of perjury, complete, sign, and submit to the |
---|
212 | 210 | | Oklahoma State Bureau of Narcotics and Dangerous Drugs |
---|
213 | 211 | | Control a form to be prescribed by the Bureau. The |
---|
214 | 212 | | form shall also be signed by a witness who is eithe r a |
---|
215 | 213 | | second employee of the qualified hospice program or a |
---|
216 | 214 | | family member of the decedent . |
---|
217 | 215 | | b. As used in this paragraph: |
---|
248 | 245 | | (2) “qualified hospice program ” means a qualified |
---|
249 | 246 | | hospice program as defined in 21 U.S.C., Section |
---|
250 | 247 | | 822(g)(5)(B) that is licensed under the Oklahoma |
---|
251 | 248 | | Hospice Licensing Act and registered under |
---|
252 | 249 | | Section 2-302 of this title. |
---|
253 | 250 | | F. This section shall constitute a part of the Uniform |
---|
254 | 251 | | Controlled Dangerous Substances Act. |
---|
255 | 252 | | SECTION 2. This act shall become effective Novembe r 1, 2024. |
