4142 An Act relating to controlled dangerous substances;
4243 amending 63 O.S. 2021, Section 2 -315, which relates
4344 to submission of out-of-date controlled dangerous
4445 substances for destruction ; modifying applicability
4546 of certain provisions; modifying terminology;
4647 removing certain limitations on disposal of
4748 controlled dangerous substances; requiring compliance
4849 with federal regulation; allowing ultimate user to
4950 submit own drugs for disposal under certain
5051 conditions; permittin g disposal of decedent’s
5152 prescribed drugs under certain conditions;
5253 authorizing qualified hospice program to dispose of
5354 decedent’s prescribed drugs under certain conditions;
5455 requiring completion, witness, and submission of
5556 certain form; defining terms; and providing an
5657 effective date.

6162 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6263 SECTION 1. AMENDATORY 63 O.S. 2021, Section 2-315, is
6364 amended to read as follows:
6465 Section 2-315. A. Except as otherwise provided by law, any
6566 person required to obtain an annual registration pursuant to Section
6667 2-302 of this title, or any group home, or residential care home as
6768 defined by Section 1-820 of this title shall submit for destruction

95+dispose of, in accordance with 21 C.F.R., Part 1317, all controlled
9696 dangerous substances which are out of date, which are unwanted,
9797 unused or which are abandoned by their owner at their facilit y due
9898 to death or other circumstan ces.
9999 B. All controlled dangerous substances described in subsection
100100 A of this section shall be submitted to the Oklahoma City laboratory
101101 of the Oklahoma State Bureau of Investigation, along with all
102102 required information o n forms provided by the Oklahoma State Bureau
103103 of Investigation, to the federal Drug Enforcement Administ ration, to
104104 a duly registered reverse distributor, to the original registered
105105 supplier or their registered agent, to a duly registered retail
106106 pharmacy, or to a hospital or clinic with an on-site pharmacy
107107 pursuant to the rules set forth in Part 1317 of Title 21 of the Code
108108 of Federal Regulations. When any such substance is transported by
109109 private contract or common carrier or United States Postal Service
110110 for the purpose of destruction or disposal, the sender shall require
111111 a receipt from such private contract or common carrier or Unite d
112112 States Postal Service, and such receipt shall be retained as a
113113 permanent record by the sender.
114114 C. 1. Controlled dangerous substances submitted to the
115115 Oklahoma State Bureau of Investigation pursuant to the provisions of
116116 this section shall be destroyed pursuant to the procedures provided
117117 in subsection A of Section 2 -508 of this title.

144+2. Controlled dangerous substances submitt ed to any
145+distributors, reverse distributors or their original registered
147146 suppliers pursuant to the provisions of this section shall be
148147 destroyed by incineration so as to make the substance absolutely
149148 unusable for human purposes in accordance with 21 C.F.R ., Part 1317.
150149 An official record listing the propert y destroyed, the location of
151150 destruction and disposal, and the name and title of the person
152151 supervising the destruction and disposal shall be submitted to the
153152 Oklahoma State Bureau of Narcotics and Dange rous Drugs Control and
154153 the federal Drug Enforcement Administration office located nearest
155154 the destruction site.
156155 D. The Office of the Chief Medical Examiner is hereby
157156 authorized to perform on -site incineration of all controlled
158157 dangerous substances which a re obtained in the discharge of the
159158 official duties of the Chief Medical Examiner. Any record relating
160159 to destruction of a controlled dangerous substance shall be
161160 maintained as required by the state or federal government and shall
162161 be available for inspect ion by appropriate state or federal
163162 government regulatory agencies.
164163 E. 1. An ultimate user who has lawfully obtained a contr olled
165164 dangerous substance in accordance with state and federal law may,
166165 without being registered under Section 2-302 of this title, deliver
167166 the controlled dangerous substance to an authorized person for the
168-purpose of disposal of the controlled dangerous substance under the
169-conditions provided by 21 U.S.C., Section 822(g)(1).

193+purpose of disposal of the c ontrolled dangerous substance under the
194+conditions provided by 21 U.S.C., Section 822(g)(1) .
197195 2. If a person dies while lawfully in possession of a
198196 controlled dangerous substance for personal use, any person lawfully
199197 entitled to dispose of the decedent ’s property may deliver t he
200198 controlled dangerous substance to another person for the purpose of
201199 disposal under the conditions provided by 21 U.S.C., Section
202200 822(g)(4).
203201 3. a. In the case of a decedent who was receiving hospice
204202 care at the time of death , an employee of a qualified
205203 hospice program, acting within the scope of his or her
206204 employment, may handle, without being registered under
207205 Section 2-302 of this title, any controlled dangerous
208206 substance that was lawfully dispensed to the decedent
209207 prior to death, under the conditions provided by 21
210208 U.S.C., Section 822(g)(5). Such employee shall, under
211209 penalty of perjury, complete, sign, and submit to the
212210 Oklahoma State Bureau of Narcotics and Dangerous Drugs
213211 Control a form to be prescribed by the Bureau. The
214212 form shall also be signed by a witness who is eithe r a
215213 second employee of the qualified hospice program or a
216214 family member of the decedent .
217215 b. As used in this paragraph:
218-(1) “employee of a qualified hospice program ” has the
219-same meaning as provided by 21 U.S.C., Section
220-822(g)(5)(B), and

242+(1) “employee of a qualified hospice program ” has the
243+same meaning as provided by 21 U.S.C., Section
244+822(g)(5)(B), and
248245 (2) “qualified hospice program ” means a qualified
249246 hospice program as defined in 21 U.S.C., Section
250247 822(g)(5)(B) that is licensed under the Oklahoma
251248 Hospice Licensing Act and registered under
252249 Section 2-302 of this title.
253250 F. This section shall constitute a part of the Uniform
254251 Controlled Dangerous Substances Act.
255252 SECTION 2. This act shall become effective Novembe r 1, 2024.
