101 | 151 | | SECTION 2. AMENDATORY 66 O.S. 2021, Section 55, is |
---|
102 | 152 | | amended to read as follows: |

103 | 153 | | Section 55. (A) A. The report of the commissioners may be |
---|
104 | 154 | | reviewed by the district court, o n written exceptions filed by |
---|
105 | 155 | | either party, in the clerk’s office within thirty (30) days after |
---|
106 | 156 | | the filing of such report; and th e court shall make such order |
---|
107 | 157 | | therein as right and justice may require, either by confirmation, |
---|
108 | 158 | | rejection or by ordering a new appraisement on good cause shown; or |
---|

203 | 301 | | real property cannot be acquired by condemnation , or if the award of |

204 | 302 | | the jury exceeds the award of the court -appointed commissioners by |
---|
205 | 303 | | at least ten percent (10%) or exceeds the last written offer of just |
---|
206 | 304 | | compensation made by the condemning autho rity, whichever is greater, |
---|
207 | 305 | | then the owner of any right, title or interest in the property |
---|
208 | 306 | | involved may be paid such sum as in the opinion of the court will |
---|
209 | 307 | | reimburse such owner for his reasonable attorney, appraisal, |
---|
210 | 308 | | engineering, and expert witness fees actually incurred by written |
---|
211 | 309 | | contract because of the condemnation proceeding. The sum awarded |
---|
212 | 310 | | shall be paid by the party instituting the condemnation proceeding. |
---|
213 | 311 | | SECTION 3. This act shall become effective July 1, 2024. |
---|
214 | 312 | | SECTION 4. It being immediately necessary for the preservation |
---|
215 | 313 | | of the public peace, health or safety, an emergency is hereby |
