8181 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8282 SECTION 1. AMENDATORY 10 O.S. 2021, Section 405.4, is
8383 amended to read as follows:
8484 Section 405.4. A. Any person with a bachelor ’s degree or
8585 postgraduate degree shall be considered as having met the
8686 educational requirements for a director of a full -time child care
8787 center required by the Department of Human Services. Nothing in
8888 this section shall be construed as to affect annual continuing
8989 education requirements. The director of a child care center may
9090 also qualify as a master t eacher for children of all ages.

142142 B. Any The continuing education requirements established by the
143143 Department shall be on a two-year cycle.
144144 C. Subject to the exemptions provided by subsection D of this
145145 section, a person replacing a master teacher at a child care center
146146 shall be granted a one -year probationary period to fulfill the
147147 educational qualifications required by the Department for a master
148148 teacher. The Department may extend the probationary period an
149149 additional year as long as the person is actively pursuing that
150150 goal.
151151 D. A person shall be exempt fro m the educational qualifications
152152 required by the Department for a master teache r if the person has:
153153 1. Not less than two (2) years o f full-time experience or the
154154 equivalent in the profession of child care or education as
155155 determined by the Department ; or
156156 2. Obtained not less than six (6) credit hours at an
157157 institution within The Oklahoma State System of Higher Education or
158158 at a technology center school in subjects rel evant to child care as
159159 determined by the Department.
160160 C. E. Licensed child care facilities opened or expanded before
161161 November 1, 2016, shall have thirty -five (35) square feet of floor
162162 area per infant in room s occupied only by infa nts. New construction
163163 and existing space not previously licensed for child care after
164164 November 1, 2016, shall have forty (40) square feet of floor area
165165 per infant in rooms occupied only by infants.
