7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 10 O.S. 2021, Section 405.4, is
7777 amended to read as follows:
7878 Section 405.4. A. Any person with a bachelor ’s degree or
7979 postgraduate degree shall be considered as having met the
8080 educational requirements for a director of a full -time child care
8181 center required by the Department of Human Services. Nothing in
8282 this section shall be construed as to affect annual continuing
8383 education requirements. The director of a child care center may
8484 also qualify as a master t eacher for children of all ages.
8585 B. Any person replacing a master teacher at a child care center
8686 shall be granted a on e-year probationary period to fulfill the
8787 educational qualifications required by the Department for a master

139139 teacher. The Department may extend the probationary period an
140140 additional year as long as the person is actively pursuing that
141141 goal.
142142 C. 1. Licensed child care facilities opened or expanded before
143143 November 1, 2016, shall have thirty -five (35) square feet of floor
144144 area per infant in room s occupied only by infants. New con struction
145145 and existing space not previously licensed for child care after
146146 November 1, 2016, shall have forty (40) squ are feet of floor area
147147 per infant in rooms occupied only by infants .
148148 2. Licensed child care facilities shall have not less than
149149 thirty-two (32) square feet of floor area per child, not including
150150 infants.
151151 3. When determining average square footage per child of
152152 licensed child care facilities for the purpose of determining
153153 compliance with floor area requirements, the Department shall
154154 utilize basic rounding principles in which a number shall round up
155155 to the nearest whole number if the fractional part of the number is
156156 five-tenths (0.5) or greater or shall round down to the nearest
157157 whole number if the fractional part of the number is forty-nine
158158 hundredths (0.49) or fewer.
159159 SECTION 2. This act shall become effective November 1, 2024.
