75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY 10 O.S. 2021, Section 405.4, is
77	77	amended to read as follows:
78	78	Section 405.4. A. Any person with a bachelor ’s degree or
79	79	postgraduate degree shall be considered as having met the
80	80	educational requirements for a director of a full -time child care
81	81	center required by the Department of Human Services. Nothing in
82	82	this section shall be construed as to affect annual continuing
83	83	education requirements. The director of a child care center may
84	84	also qualify as a master t eacher for children of all ages.
85	85	B. Any person replacing a master teacher at a child care center
86	86	shall be granted a on e-year probationary period to fulfill the
87	87	educational qualifications required by the Department for a master

139	139	teacher. The Department may extend the probationary period an
140	140	additional year as long as the person is actively pursuing that
141	141	goal.
142	142	C. 1. Licensed child care facilities opened or expanded before
143	143	November 1, 2016, shall have thirty -five (35) square feet of floor
144	144	area per infant in room s occupied only by infants. New con struction
145	145	and existing space not previously licensed for child care after
146	146	November 1, 2016, shall have forty (40) squ are feet of floor area
147	147	per infant in rooms occupied only by infants .
148	148	2. Licensed child care facilities shall have not less than
149	149	thirty-two (32) square feet of floor area per child, not including
150	150	infants.
151	151	3. When determining average square footage per child of
152	152	licensed child care facilities for the purpose of determining
153	153	compliance with floor area requirements, the Department shall
154	154	utilize basic rounding principles in which a number shall round up
155	155	to the nearest whole number if the fractional part of the number is
156	156	five-tenths (0.5) or greater or shall round down to the nearest
157	157	whole number if the fractional part of the number is forty-nine
158	158	hundredths (0.49) or fewer.
159	159	SECTION 2. This act shall become effective November 1, 2024.
