6565 An Act relating to indigenous and traditional healing

7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. NEW LAW A new section of law to b e codified
7979 in the Oklahoma Statutes as Section 732 of Title 59, unless there is
8080 created a duplication in numbering, reads as follows:
8181 A. As used in this section:
8282 1. “Culture” means a way of life of a group of people
8383 including, but not limited to, the behaviors, beliefs, values,
8484 customs, traditional practices, art, rituals, and ceremonies
8585 specific to a people ;
8686 2. “Indigenous” or “native” means any individual with a
8787 distinct language, culture, and belief ; and

139139 3. “Indigenous and traditional healing therapies” means any
140140 healing art, practice, ritual, ceremony, or modality that has been
141141 historically performed and utilized by indigenous or native peoples .
142142 B. The Legislature intends , by its enactment of this section,
143143 to protect and preserve by this state, unfettered public access to
144144 all indigenous and traditional healing therapies and to protect and
145145 preserve the right to practice and pro vide services according to
146146 this section.
147147 C. Notwithstanding any other state law or rule, an individual
148148 who does not hold a li cense, permit, certification, or registration
149149 as a health care professional issued by this state shall not be in
150150 violation of any health care professional practice act or other law
151151 or rule if that individual or agent provides care or treatment in
152152 compliance with subsection D of this section and does not falsely
153153 represent himself or herself as a licensed practitioner of medicine
154154 or other healthcare professional as described in Tit le 59 of the
155155 Oklahoma Statutes, or fraudulently use any title or degree
156156 appertaining to the licensed practice thereof, or falsely claim any
157157 training, certification, or approval of any organization that he or
158158 she does not have.
159159 D. A practitioner of indigenous and traditional healing
160160 therapies shall not:
161161 1. Perform surgery, or any other procedure that harmfully
162162 penetrates the body;

214214 2. Set fractures;
215215 3. Prescribe or administer X or Gamma ray radiation, or any
216216 other radiation field not inherent to the human body;
217217 4. Prescribe or administer a prescription drug or device, or
218218 any controlled substance;
219219 5. Recommend interruption or elimination of prescribed
220220 medications and/or treatments ;
221221 6. Conventionally diagnose a medical disease ;
222222 7. Forcefully move joints, or move joints beyond their normal
223223 range of motion;
224224 8. State, advertise, or otherwise falsely represent to any
225225 individual that the person is licensed by, certified by, or
226226 registered with this state to practice as a healthcare professional ;
227227 or
228228 9. Have a felony conviction of any crime involving the
229229 intentional harm of another pers on or moral turpitude.
230230 E. Any person who fails to comply with this section may , as
231231 provided by law, be subject to administrative action by the
232232 appropriate licensing board , criminal prosecution, civil liability,
233233 or any other remedies provided by law.
234234 SECTION 2. This act shall become effective November 1, 2024.
