7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 41 O.S. 2021, Se ction 118, is
7777 amended to read as follows:
7878 Section 118. A. A landlord shall at all times during the tenancy:
7979 1. Except in the case of a single -family residence, keep all
8080 common areas of his building, grounds, facilities and appurtenances
8181 in a clean, safe and sanitary condition;
8282 2. Make all repairs and do whatever is necessary to put and
8383 keep the tenant’s dwelling unit and premises in a fit and habitable

8686 electrical, plumbing, sanitar y, heating, ventilating, air-

139139 facilities and appliances, including elevators, supplied or required
140140 to be supplied by him the landlord;
141141 4. Except in the case of one - or two-family residences or whe re
142142 provided by a governmental entity, provide and maintain appropriate
143143 receptacles and conveniences for the removal of ashes, garbage,
144144 rubbish and other waste incidental to the occupancy of the dwelling
145145 unit and arrange for the frequent removal of such was tes; and
146146 5. Except in the case of a single -family residence or where the
147147 service is supplied by direct and independently metered utility
148148 connections to the dwelling unit, supply running water and
149149 reasonable amounts of hot water at all times and reasonable heat.
150150 B. The landlord and tenant of a dwelling unit may agree by a
151151 conspicuous writing independent of the rental agreement that the
152152 tenant is to perform specified repairs, maintenance tasks,
153153 alterations or remodeling.
154154 C. Prior to the commencement of a r ental agreement, if a
155155 landlord knows or has reason to know that the dwelling unit or any
156156 part of the premises was used in the manufacture of methamphetamine,
157157 the landlord shall disclose this i nformation to a prospective
158158 tenant. Provided however, if the la ndlord has had the level of
159159 contamination assessed within the dwelling unit or pertinent part of
160160 the premises, and it has been determined that the level of
161161 contamination does not exceed one -tenth of one microgram (0.1 mcg)
162162 per one hundred square centimeter s (100 cm2) of surface materials
