7575 BE IT ENACTED BY THE PEO PLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. NEW LAW A new s ection of law to be codif ied
7777 in the Oklahoma Statutes as Section 2607.2 of Title 63, unless there
7878 is created a duplication in n umbering, reads as follows :
7979 A. As used in this section:
8080 1. “Covered facility” means:
8181 a. a residential or inpatient mental health or substance
8282 abuse treatment facility operated by or certified by
8383 the Department of Mental Health and Substance Abuse
8484 Services, or
8585 b. a residential child care facility as defined in
8686 Section 402 of Title 10 of the Oklahoma St atutes;

138138 2. “Gender-affirming therapy” means nonmedical and nonsurgical
139139 behavioral health care services or mental health counseling that
140140 focuses on affirming a patient ’s perception of his or her gender
141141 identity or biological sex, if that perception is inconsistent with
142142 the patient’s biological sex, and does not try to modify it.
143143 Gender-affirming therapy does not include gender transition
144144 procedures as defined in Section 2607.1 of Title 63 of the Oklahoma
145145 Statutes; and
146146 3. “Social transition” means any intervention, not including
147147 gender-affirming therapy as defined in this section or gender
148148 transition procedures a s defined in Section 2607.1 of Title 63 of
149149 the Oklahoma Statutes , to align a person’s appearance, physical
150150 body, or behavior with the person’s perception of his or her gender
151151 or biological sex, if that perception is inconsistent with the
152152 person’s biological sex. Social transition includes, but is not
153153 limited to, changing a person’s name or pronouns, changing the
154154 gender of clothing worn, using speech therapy or other means to
155155 change a person’s voice, or any similar intervention to align a
156156 person’s appearance, physical body, or behavior with the person’s
157157 perception of his or her gender or biological sex, if that
158158 perception is inconsistent with the person’s biological sex.
159159 B. A covered facility or agent thereof shall not:
160160 1. Perform, assist, or cause a social transition of a child in
161161 the custody of the facility; or

213213 2. Provide gender-affirming therapy to a child in the custody
214214 of the facility,
215215 unless the covered facility or agent has obtained the prior written
216216 informed consent of the child’s parent or legal guardian on a form
217217 prescribed by subsection C of this section.
218218 C. The Department of Mental Health and Substance Abuse Services
219219 and the Department o f Human Services shall each prescribe a form for
220220 obtainment and documentation of a parent or legal guardian ’s
221221 informed consent to a social transition or gender -affirming therapy
222222 of a child in the custody of a covered facility as required by
223223 subsection B of this section.
224224 D. A parent or legal guardian shall r eserve the right to refuse
225225 consent to a social transition or gender -affirming therapy of the
226226 parent or legal guardian ’s child as described in this section.
227227 SECTION 2. This act shall beco me effective November 1, 2024.
