75	75	BE IT ENACTED BY THE PEO PLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. NEW LAW A new s ection of law to be codif ied
77	77	in the Oklahoma Statutes as Section 2607.2 of Title 63, unless there
78	78	is created a duplication in n umbering, reads as follows :
79	79	A. As used in this section:
80	80	1. “Covered facility” means:
81	81	a. a residential or inpatient mental health or substance
82	82	abuse treatment facility operated by or certified by
83	83	the Department of Mental Health and Substance Abuse
84	84	Services, or
85	85	b. a residential child care facility as defined in
86	86	Section 402 of Title 10 of the Oklahoma St atutes;

138	138	2. “Gender-affirming therapy” means nonmedical and nonsurgical
139	139	behavioral health care services or mental health counseling that
140	140	focuses on affirming a patient ’s perception of his or her gender
141	141	identity or biological sex, if that perception is inconsistent with
142	142	the patient’s biological sex, and does not try to modify it.
143	143	Gender-affirming therapy does not include gender transition
144	144	procedures as defined in Section 2607.1 of Title 63 of the Oklahoma
145	145	Statutes; and
146	146	3. “Social transition” means any intervention, not including
147	147	gender-affirming therapy as defined in this section or gender
148	148	transition procedures a s defined in Section 2607.1 of Title 63 of
149	149	the Oklahoma Statutes , to align a person’s appearance, physical
150	150	body, or behavior with the person’s perception of his or her gender
151	151	or biological sex, if that perception is inconsistent with the
152	152	person’s biological sex. Social transition includes, but is not
153	153	limited to, changing a person’s name or pronouns, changing the
154	154	gender of clothing worn, using speech therapy or other means to
155	155	change a person’s voice, or any similar intervention to align a
156	156	person’s appearance, physical body, or behavior with the person’s
157	157	perception of his or her gender or biological sex, if that
158	158	perception is inconsistent with the person’s biological sex.
159	159	B. A covered facility or agent thereof shall not:
160	160	1. Perform, assist, or cause a social transition of a child in
161	161	the custody of the facility; or

213	213	2. Provide gender-affirming therapy to a child in the custody
214	214	of the facility,
215	215	unless the covered facility or agent has obtained the prior written
216	216	informed consent of the child’s parent or legal guardian on a form
217	217	prescribed by subsection C of this section.
218	218	C. The Department of Mental Health and Substance Abuse Services
219	219	and the Department o f Human Services shall each prescribe a form for
220	220	obtainment and documentation of a parent or legal guardian ’s
221	221	informed consent to a social transition or gender -affirming therapy
222	222	of a child in the custody of a covered facility as required by
223	223	subsection B of this section.
224	224	D. A parent or legal guardian shall r eserve the right to refuse
225	225	consent to a social transition or gender -affirming therapy of the
226	226	parent or legal guardian ’s child as described in this section.
227	227	SECTION 2. This act shall beco me effective November 1, 2024.
